OCTOBER 23, 2018 STATEMENT OF COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT On January 2, 2018, adequate notice of this meeting pursuant to the Open Public Meetings Act has been furnished by inclusion thereof in the Annual Schedule of Meetings for 2018 which has been posted on the bulletin board at Borough Hall, filed with the Borough Clerk, faxed to the Our Town, The Record, and The Community News newspapers and distributed to all persons, if any, requesting copies of same pursuant to said Act. In case of an emergency or fire alarm you must evacuate the building by using any of the exit doors in the room. They are immediately to my right and the double doors at the rear of the room. Occupants must exit the building by using the staircase and not the elevator. This meeting is being recorded by both video and audio and may be rebroadcast. Pastor Oscar Cosachowa of Zion Lutheran Church was present to give the invocation. SALUTE TO THE FLAG ROLL CALL Members of the Governing Body present: Mayor Febre, Council members Garofalow, Ullman, Gervino, Lindenau, Morrone, and Padovano. Also present were Borough Attorney Ronald A. Dario, Borough Administrator Roberta Stern, and Deputy Clerk Sally J. Miller ABSENT: Borough Clerk Jean M. Pelligra Council member Gervino made a motion to go out of the regular order of business; seconded by Council member Morrone for the purpose of the adoption of resolutions All in Favor. Mayor Febre administered the Oath of Office to Chief Joseph Natale. Chief Natale said a few words and thanked his family, Mayor and Council and co-workers. Chief Natale spoke briefly about each officer prior to Mayor Febre administering the Oath of Office. Mayor Febre administered the Oath of Office to Captain Kenny, Lieutenant Moran and Sergeant Parodi. Council member Morrone made a motion to go back into the regular order of business; seconded by Council member Gervino All in Favor. WORK SESSION ITEMS items on or off agenda PROCLAMATIONS, PRESENTATIONS, ETC. CFO Charles Cuccia was present to review and discuss the Best Practices Inventories Check List with the Governing Body as required by the Division of Local Government Services and stated the Borough of Maywood has met all the requirements; therefore, there will be no reduction in our state aid. Mayor Febre asked why the number of questions increased. CFO Cuccia responded each administration picks a particular area to enhance the program. There being no further questions for CFO Cuccia, Mayor Febre closed this portion of the meeting.

2 MEETING OPEN TO THE PUBLIC (FIVE MINUTE TIME FRAME) Mayor Febre opened the meeting to the public for any comments on or off the agenda. Derek Eisenberg 121 Belle Avenue spoke about the comments made by Council members Garofalow and Lindenau and Mayor Febre at the last meeting regarding the hiring of a new police officer. Mr. Eisenberg asked if anyone knew what the qualifications were for hiring a police officer. Mayor Febre responded we let our professionals make the recommendations. Mr. Eisenberg asked what is your duty in selecting a police officer candidate. Mayor Febre responded the criteria is set by the Chief of Police and we base our decision on the recommendation of our professionals. Mr. Eisenberg stated we should have at least one female officer since fifty percent of our population is female. Attorney Dario responded the vast majority who apply are male applicants. Mike Gillen 221 Prospect Avenue asked if the flooding issue by the stream on Prospect Avenue is being repaired because it gets worse each year. Administrator Stern responded the Borough Engineer has looked into it; however, she will meet with him and go back to review the area. Mr. Gillen asked if everything is up to code on the construction project that is set back behind another house on Prospect Avenue. Administrator Stern responded yes. Mr. Gillen asked if they have to run a special pipe directly to the sewer; adding will this affect the stream. Administrator Stern asked that he come in to speak with our Construction Official, Mr. Mazzer. Mr. Gillen asked if a tree located three feet in from the curb is a town tree. Administrator Stern responded yes; adding the town received a letter from PSE&G regarding the tree you are referencing and we gave them permission to remove the tree at the property owner s expense. There being no further comments from the public, Mayor Febre closed this portion of the meeting. PUBLIC HEARING ON PENDING ORDINANCES - ADOPTION OF ORDINANCES NONE APPROVAL OF MINUTES Council member Gervino moved for approval of the October 9, 2018 Work Session and Closed Session minutes; seconded by Council member Morrone; and so carried by unanimous roll call vote. PRESENTATION OF BILLS AND CLAIMS AND REQUEST FOR PUBLIC COMMENT The Clerk presented the bill resolution. Council member Morrone moved for approval, seconded by Council member Gervino; and so carried with the exception of Council member Padovano abstaining to bills payable to Figlia Electric.

9 CORRESPONDENCE AND REPORT OF THE BOROUGH CLERK Deputy Borough Clerk Miller reported on the following: 1. She reminded everyone Election Day is Tuesday, November 6, 2018 and the polls will be open from 6:00 am to 8:00 pm. 2. She stated the Maywood Avenue School students will be attending our next council meeting on November 20, She stated correspondence from the American Legion was distributed to Mayor and Council mailboxes regarding their annual journal ad; adding we generally take the Gold Page at a cost of $ and asked if the council was in agreement Council in agreement. 4. She sent best wishes to Borough Clerk Jean Pelligra; adding we missed having her here tonight.

10 REPORT OF ADMINISTRATOR Administrator Stern reported on the following: 1. She reported we met with the last property owner on Maywood Avenue between W. Hunter Avenue and the railroad tracks so we could finalize the application and final design for the second phase of the Streetscapes project; adding everything went well and he agreed to the project. 2. She stated a grant has been filed with the State of New Jersey, Bureau of Mobile Resources for a vehicle charging station. 3. She stated we are filing a second Assistance to Firefighter Grant with FEMA this week for an exhaust evacuation and sprinkler system at Peerless Firehouse. 4. She stated we will be receiving the bronze award again this year for Sustainable Jersey; adding, it will be presented at the NJLM Conference. REPORT OF THE ATTORNEY Attorney Dario stated he has no report this evening. COMMITTEE REPORTS Council member Garofalow reported on the following: 1. He reported the following from the Board of Health: The Board of Health meeting was held on October 18, 2018 The Flu Clinic took place on October 10, 2018; adding sixty-one vaccines were administered. The Ruth s Chris Steak House will be opening soon. A total of $4, in fees has been collected as of September 30, He stated the TANAAC meeting will be held tomorrow night at 7:00 pm at Teterboro Airport. 3. He stated on Monday, October 29, 2018, four Navy F18 jets will be flying over at 10:30 am. Mayor Febre stated he has requested Tara Grunstra to contact the County to ask if a second flu clinic could be held during evening hours. Council member Ullman reported on the following: 1. He stated a town-wide paper shredding event will be held on Saturday, November 3, 2018 in the Maywood Avenue School. 2. He stated the Sustainable Jersey application was approved. 3. He reported the town-wide garage sale was a big success. Council member Gervino reported on the following: 1. He stated the Hackbarth meeting at the Library is scheduled for Wednesday, November 7, 2018, at 12:30 pm. 2. He advised the Library website had been off-line; however, a new person has been hired and the website is now up and running. He encouraged everyone to visit the new website. Council member Lindenau reported on the following: 1. He reported the following from the DPW: Trees have been removed and sidewalks have been repaired or replaced. The old playground in Memorial Park has been dismantled and removed; adding the new playground equipment will be installed by the end of this week or early next week. The streetsweeper will be out early morning on Mondays and Fridays. A salt delivery was received today.

11 Council member Morrone reported on the following: 1. He stated Chief Natale wants to remind everyone there is a curfew from 10:00 pm on October 30, 2018 until 6:00 am October 31, 2018; adding no juvenile age 17 and under should be out after 10:00 pm. 2. He congratulated Chief Natale, Captain Kenny, Lieutenant Moran and Sergeant Parodi on their promotions. Council President Padovano reported on the following: 1. She reported the building department collected $4, in permit fees from October 9, 2018 through today. 2. She thanked Administrator Stern for her hard work on the Streetscapes project on the south end of Maywood Avenue. REPORT OF THE MAYOR Mayor Febre reported on the following: 1. He stated the grant writer is waiting for additional information from the Fire Chief for the Assistance to Firefighter s Grant. 2. He stated he asked our Traffic Officer and Borough Engineer to do a traffic study for four-way stop signs on Poplar Avenue and Parkway. Administrator Stern responded the Borough Engineer just submitted his report. 3. He said a few words about the hiring of a new police officer and stated there are people who can get things done on their own merit regardless of their gender or ethnicity. RESIGNATIONS - ACCEPTANCE OF THE FOLLOWING 1. Robert Miloche as a member of the Maywood Fire Police effective October 1, George Trapp from the Shade Tree Commission effective October 23, Council member Lindenau moved the resignations be accepted; seconded by Council member Ullman; and so carried by unanimous roll call vote. APPOINTMENTS - APPROVAL OF THE FOLLOWING 1. Mark Michalski as a Part-Time Police Department Telecommunicator effective October 24, 2018 at a salary of $15.00 per hour. 2. Anthony DeFina as a regular full member of the Maywood Fire Department assigned to Undine Hose Company No. 1, effective October 23, Council member Morrone moved the appointments, seconded by Council member Gervino; and so carried by unanimous roll call vote. COUNCIL APPROVAL OF THE FOLLOWING 1. From Rosary Society Our Lady Queen of Peace Church requesting permission to hold an On- Premise 50/50 raffle at Our Lady Queen of Peace Church, 400 Maywood Avenue, Maywood, on Saturday, November 10, 2018 from 8:00 pm to 10:00 pm. Council member Morrone moved for the approval, seconded by Council member Garofalow; and so carried by unanimous roll call vote.

12 RESOLUTIONS BY TITLE - CONSIDERATION OF THE FOLLOWING RESOLUTION # RESOLUTION REQUESTING APPROVAL OF ITEMS OF REVENUE AND APPROPRIATION N.J.S.A. 40A:4-87 WHEREAS N.J.S.A. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget and, WHEREAS, the Director may also approve the insertion of any item of appropriation for an equal amount, WHEREAS, the Borough of Maywood wishes to amend its 2018 Budget to include an amount as revenue, NOW THEREFORE, BE IT RESOLVED that the Governing Body of the Borough of Maywood hereby requests the Director of the Division of Local Government Services to approve the insertion of an item in the budget of the year 2018 in the sum of $6,099, which is now available as a revenue from: Special Items of General Revenue Anticipated with Prior Written Consent of the Director of Local Government Services: Public and Private Revenues Off-Set with Appropriations: CDBG Handicapped Accessible Improvements Borough Hall BE IT FURTHER RESOLVED that a like sum of $6,099 be and the same is hereby appropriated under the caption of: General Appropriations (A) Operations - Excluded from CAPS Public and Private Programs Offset by Revenue CDBG Handicapped Accessible Improvements Borough Hall RESOLUTION # A RESOLUTION RATIFYING AND CONFIRMING THE PURCHASE OF TASER REPLACEMENTS WITH CARTRIDGES AND WARRANTY FOR THE MAYWOOD POLICE DEPARTMENT WITH FUNDS FROM THE D.E.A. ACCOUNT WHEREAS, a need exists within the Borough to enter into a contract to purchase six replacement tasers with cartridges and warranty for the Maywood Police Department; and WHEREAS, the purchase will be made fully with funds from the D.E.A. account for a full contract amount of $36, paid over a five (5) year period; and WHEREAS, the Borough has appointed a Qualified Purchasing Agent in accordance with N.J.A.C. 5:34-5 et seq. and the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.) permits the awarding of contracts that fall below the bidding threshold without competitive bids or for Equipment repair service if in the nature of an extraordinary unspecifiable service and/or pursuant to State Contract; and WHEREAS, pursuant to Resolution # 27-18, purchases in excess of $1,000 require Mayor and Council approval; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Maywood, Bergen County, New Jersey, that the Borough Administrator is hereby authorized to sign and issue a purchase order for the Police Captain to purchase the six replacement tasers with cartridges and warranty for use of the Maywood Police Department in the sum of $36, paid over a five (5) year period with the first payment being $7, followed by four (4) equal payments of $7,364.90, payable to Axon Enterprise, Inc., N. 85 th Street, Scottsdale, Arizona pursuant to the price

13 quotations received from Axon Enterprise, Inc. whose response was most advantageous to the Borough, price and other factors considered. CERTIFICATION OF FUNDS I, Charles Cuccia, Chief Financial Officer of the Borough of Maywood, hereby duly certify that fund(s) are available for the above stated contract. Said funds are available from DEA-Justice Account. RESOLUTION # A RESOLUTION RATIFYING AND CONFIRMING THE PURCHASE OF PROMETHEAN V6 ACTIVPANEL SMART BOARD FOR THE MAYWOOD POLICE DEPARTMENT WITH FUNDS FROM THE D.E.A. ACCOUNT WHEREAS, a need exists within the Borough to purchase a Promethean V6 ActivPanel Smart Board for the Maywood Police Department; and WHEREAS, the Police Captain has indicated the purchase will be made fully with funds from the D.E.A. account; and WHEREAS, the Borough has appointed a Qualified Purchasing Agent in accordance with N.J.A.C. 5:34-5 et seq. and the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.) permits the awarding of contracts that fall below the bidding threshold without competitive bids; and WHEREAS, pursuant to Resolution # 27-18, purchases in excess of $1,000 require Mayor and Council approval; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Maywood, Bergen County, New Jersey, that the Borough Administrator is hereby authorized to sign and issue a purchase order for the Police Captain to purchase a Promethean V6 ActivPanel Smart Board for use of the Maywood Police Department in the sum of $5,825.78, payable to Keyboard Consultants, Inc., 6 Kingsbridge Road, Fairfield, NJ pursuant to the price quotations received from Keyboard Consultants, Inc. whose response was most advantageous to the Borough, price and other factors considered. CERTIFICATION OF FUNDS I, Charles Cuccia, Chief Financial Officer of the Borough of Maywood, hereby duly certify that fund(s) are available for the above stated contract. Said funds are available from the DEA-Justice Account. RESOLUTION # RESOLUTION PROMOTING POLICE OFFICER MATTHEW PARODI TO THE RANK OF SERGEANT WITHIN THE BOROUGH OF MAYWOOD POLICE DEPARTMENT IN THE BOROUGH OF MAYWOOD, BERGEN COUNTY, NEW JERSEY WHEREAS, there exists a need to approve the promotion of Police Officers within the Police Department in the Borough of Maywood, County of Bergen, State of New Jersey; and WHEREAS the Mayor and Council of the Borough of Maywood recognize the service and dedication of Police Officer Matthew Parodi who has proudly served the Borough for more than 12 years as a Police Officer and as a detective, and wish to promote Police Officer Matthew Parodi to the rank of Sergeant. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Maywood, County of Bergen, State of New Jersey that Police Officer Matthew Parodi is promoted to the rank of Sergeant within the Borough of Maywood Police Department, and the Mayor be and is hereby authorized and directed to execute, and the Borough Clerk to attest, to any and all documents

14 necessary to effectuate the aforementioned promotion according to Borough Code Chapter 56-6, Borough policy and the applicable collective bargaining agreement, and BE IT FURTHER RESOLVED, that such promotion shall be made retroactive to October 1, 2018; and BE IT FURTHER RESOLVED, that a copy of the within resolution and the governing collective bargaining agreement be available for public inspection during regular business hours and pursuant to the laws of the State of New Jersey, County of Bergen and Borough of Maywood; and RESOLUTION # RESOLUTION PROMOTING POLICE SERGEANT TIMOTHY MORAN TO THE RANK OF LIEUTENANT WITHIN THE BOROUGH OF MAYWOOD POLICE DEPARTMENT IN THE BOROUGH OF MAYWOOD, BERGEN COUNTY, NEW JERSEY WHEREAS, there exists a need to approve the promotion of Police Officers within the Police Department in the Borough of Maywood, County of Bergen, State of New Jersey; and WHEREAS the Mayor and Council of the Borough of Maywood recognize the service and dedication of Police Sergeant Timothy Moran who has proudly served the Borough for more than 20 years as a Police Officer, Detective and Sergeant, and wish to promote Police Sergeant Timothy Moran to the rank of Lieutenant. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Maywood, County of Bergen, State of New Jersey that Police Sergeant Timothy Moran is promoted to the rank of Lieutenant within the Borough of Maywood Police Department, and the Mayor be and he is hereby authorized and directed to execute, and the Borough Clerk to attest, to any and all documents necessary to effectuate the aforementioned promotion according to Borough Code Chapter 56-6, Borough policy and the applicable collective bargaining agreement, and BE IT FURTHER RESOLVED, that such promotion shall be made retroactive to October 1, 2018; and BE IT FURTHER RESOLVED, that a copy of the within resolution and the governing collective bargaining agreement be available for public inspection during regular business hours and pursuant to the laws of the State of New Jersey, County of Bergen and Borough of Maywood; and RESOLUTION # RESOLUTION PROMOTING POLICE LIEUTENANT TERENCE KENNY TO THE RANK OF CAPTAIN WITHIN THE BOROUGH OF MAYWOOD POLICE DEPARTMENT IN THE BOROUGH OF MAYWOOD, BERGEN COUNTY, NEW JERSEY WHEREAS, there exists a need to approve the promotion of Police Officers within the Police Department in the Borough of Maywood, County of Bergen, State of New Jersey; and WHEREAS the Mayor and Council of the Borough of Maywood recognize the service and dedication of Police Lieutenant Terence Kenny who has proudly served the Borough for more than 25 years as a Police Officer, Detective, Detective Sergeant and Lieutenant, and wish to promote Police Lieutenant Terence Kenny to the rank of Captain. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Maywood, County of Bergen, State of New Jersey that Police Lieutenant Terence Kenny is promoted to the rank of Captain within the Borough of Maywood Police Department, and the Mayor be and he is hereby authorized and directed to execute, and the Borough Clerk to attest, to any and all documents necessary to effectuate the aforementioned promotion according to Borough Code 56-6, Borough policy and the applicable collective bargaining agreement, and

15 BE IT FURTHER RESOLVED, that such promotion shall be made retroactive to October 1, 2018; and BE IT FURTHER RESOLVED, that a copy of the within resolution and the governing collective bargaining agreement be available for public inspection during regular business hours and pursuant to the laws of the State of New Jersey, County of Bergen and Borough of Maywood; and RESOLUTION # RESOLUTION APPOINTING JOSEPH NATALE AS CHIEF OF POLICE OF THE BOROUGH OF MAYWOOD POLICE DEPARTMENT IN THE BOROUGH OF MAYWOOD, BERGEN COUNTY, NEW JERSEY WHEREAS, the responsibilities and duties of the Chief of Police are delineated in N.J.S.A. 40A: as well as Borough Code Chapter 56 Subsection 5; and WHEREAS, Chief of Police David Pegg has retired as Chief of Police of the Borough of Maywood Police Department, effective September 30, 2018 and WHEREAS, there now exists a need to appoint a Chief of Police for the Borough of Maywood Police Department; and WHEREAS the Mayor and Council of the Borough of Maywood recognize the service and dedication of Police Captain Joseph Natale who has proudly served the Borough for more than 25 years as a Police Officer, Detective, Sergeant, Lieutenant and Captain; and WHEREAS, the Mayor and Council of the Borough of Maywood finds and determines that Police Captain Joseph Natale meets and exceeds all the qualifications and requirements for appointment as Chief of Police. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Maywood, County of Bergen, State of New Jersey that Police Captain Joseph Natale is hereby appointed to serve as Chief of Police of the Borough of Maywood Police Department, wherein he shall be responsible for performing all of the duties set forth in N.J.S.A. 40A: as well as any rules and regulations contained within the Borough Code, Borough policy and any and all other pertaining laws to the said position retroactive to October 1, BE IT FURTHER RESOLVED, that the Mayor be and he is hereby authorized and directed to execute, and the Borough Clerk to attest to an employment agreement between the Borough of Maywood and Joseph Natale to govern the terms of compensation for his service as Chief of Police of the Borough of Maywood Police; and BE IT FURTHER RESOLVED, that a copy of the within resolution and aforementioned agreement be available for public inspection during regular business hours and pursuant to the laws of the State of New Jersey, County of Bergen and Borough of Maywood; and RESOLUTION # A RESOLUTION RATIFYING AND CONFIRMING THE INSTALLATION AND COST THEREOF FOR PLAYGROUND EQUIPMENT IN MEMORIAL PARK WHEREAS, a need exists within the Borough to install playground equipment in Memorial Park; and WHEREAS, the Borough Administrator had solicited and received price quotations; and WHEREAS, the Borough administrator has identified Park Builder, LLC of Jackson, New Jersey as having the proper experience and qualifications necessary to perform such service to the Borough; and WHEREAS, pursuant to Resolution # adopted by the Mayor and Council of the Borough of Maywood, purchases in excess of $12,500 require Mayor and Council approval;

16 WHEREAS, the Borough has appointed a Qualified Purchasing Agent in accordance with N.J.A.C. 5:34-5 et seq. and pursuant to N.J.S.A. 40A: 11-1 et. seq. the Borough may by resolution and without advertising for bids, purchase any goods or services if said contract amount is below the bidding threshold; and WHEREAS, N.J.S.A Title 59 provides, in pertinent part, that neither the public entity nor a public employee is liable for an injury caused by the plan or design of public property or any improvement thereto where the plan or design was approved in advance of construction by the Borough or a public employee exercising discretionary authority on its behalf or where such plan or design was prepared in conformity with standards previously approved by the Borough. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Maywood, Bergen County, New Jersey, that the Borough Administrator is hereby authorized to sign and issue purchase orders for the installation of playground equipment in Memorial Park for the sum of $ 23,000.00, payable to Park Builder, LLC of Jackson, New Jersey, pursuant to the price quotations received from Park Builder, LLC whose response was most advantageous to the Borough, price and other factors considered. BE IT FURTHER RESOLVED that the Mayor and Borough Council approved of the design of these improvements and invoke their immunities and protection pursuant to N.J.S.A. Title 59; and CERTIFICATION OF FUNDS I, Charles Cuccia, Chief Financial Officer of the Borough of Maywood, hereby duly certify that fund(s) are available for the above stated contract. Said funds are available from line item Recreation Trust Council member Morrone moved for the adoptions, seconded by Council member Lindenau; and so carried by unanimous roll call vote. INTRODUCTION OF ORDINANCES NONE NEW BUSINESS Council member Garofalow spoke regarding a resolution the Board of Health received from the Borough of Moonachie opposing the new natural gas-fired power plant in North Bergen due to the pollution it will produce. Administrator Stern responded she also received copies of the resolution and explained it is a complicated issue; adding she will distribute reports from the Sierra Club and other environmental groups for council to review. Mayor Febre was in agreement to put a resolution on an upcoming agenda after research has been done.
