Call to order: President-elect, Susan Mills, called the meeting to order. Introductions were made around the room. II. Approval of April 25 minutes: A motion was made to approve the April 25 minutes. The motion was seconded and carried. III. Treasurer s report: Barb Illsley reported that the account is in good financial shape and there is a total of $35,000 earmarked for the fall conference. A motion was made to approve the treasurer s report. The motion was seconded and carried. IV. President Reports: CSTS: Currently not much activity. Election of MACCAC Representative to CSTS: Barb Illsley made a motion to reappoint the three current members to maintain continuity during the transition period. These members would be Tim Cleveland, Jerry Haley and Andy Erickson. The motion was seconded and carried. Short-term felony offenders: Ron reported that a couple of meetings have been held recently with DOC on this issue. The results of these meetings are as follows: The local programs will have great flexibility with what they do with the offenders. The offenders do not have to be incarcerated. They can use electronic monitoring, or other alternative sanctions. 1

2 Regarding medical care of the offenders, it was decided that DOC would keep 20% of the $ 2.4 million in funding in reserve for medical expenses of the offender that exceed six days. If the medical care extends beyond six days, the DOC will take the offender back into an institution. Any funds left over at the end of the year will be transferred into the general fund. Jail credit: Statute requires that the probation officer must state time served at the time of sentencing to determine when the six months period begins. A discussion ensued regarding how different situations will be handled regarding these issues. It is anticipated that many issues will come up once this process begins. The DOC will hold workgroups to discuss various issues and MACCAC will be invited to participate. FTS Demonstration: Tom Adkins reported that this is a financial tracking system, which can be seen in Anoka and it is highly recommended that members go to Anoka to see a demo on this program. The product is available through MCCC on laptop currently. Susan Mills suggested that the board meeting be held in Anoka in June so the board can watch this demonstration. The members agreed to this suggestion. Summer Board Meeting Schedule: Susan Mills asked the board if they would like to travel in July and August as well. The committee agreed to meet in Duluth in August and Willmar in July. V. Committee Reports: Policy Committee Mark Sizer Mark distributed a recently edited copy of the bylaws for review. These bylaws will be available for approval at the annual meeting. Mark stated that the Out of Home Placement subcommittee met April 11 and 16 in St. Cloud. Mark noted that they did identify three major goals: 1) Develop strategies to facilitate the effective and efficient use of Out-of- Home Placement. 2) Manage the cost of Out-of-Home Placements without compromising public safety. 3) Research the length and type of Out-of-Home Placement and its effectiveness. Mark also reviewed the strategies that the subcommittee has come up with. This will also be presented at the annual conference. Awards: Mark Sizer reviewed award revisions including the clarification of the criteria for Jack Young Award nominations. The directors make nominations for this award and the awards committee then makes the selection. The Board of Directors Award is an award that recognizes exemplary individuals, programs or projects 2

3 that serve to advance the knowledge, effectiveness, and the integrity of the criminal justice system. Mark stated that MACCAC seeks to recognize visionary individuals and/or organizations that have exemplified the management and innovative skills necessary to lead community corrections forward in one or more of the following areas:! The recipient either changes or contributes to the broad field of community corrections and helps to move the field forward.! The recipient s contribution to the field makes a difference that is supported by a significant outcome.! Others can replicate the elements of the recipient s work.! The recipient has contributed significantly to policy and practice, legislation, programming, administration or systemic change. Mark noted that nominations for the MACCAC Board of Directors Award may be made by administrators, management, line staff and any other individual associated with MACCAC member agencies and organizations. The MACCAC Executive Committee shall select the recipient(s) for this award from the pool of nominees. Nomination forms will be mailed out. A motion was made by Barb Illsley to approve the new Board of Director s award. Tom Adkins seconded the motion. The motion carried. Annual Conference Planning Committee: Raeone gave a report on the May 22 committee meeting and went over the draft agenda will the committee. She noted that Gretchen Stein, Ph.D., CEAp President and CEO of The Sand Creek Group, LTD. will be speaking on Wednesday evening. Her presentation is titled, Facing the Challenges in Changing Times. Juveniles and out-of-home placements will be the focus of the Thursday morning session. Commissioner Joan Fabian has confirmed for noon. Speakers are listed as invited at this time as none are confirmed. Gov. Pawlenty has been invited for Friday morning and we hope that he will send staff. This will be followed by a panel that we are calling Moving Ahead to promote an open dialog of what the correctional system could look like in the future. Susan encouraged the group to get registrations in for the conference as soon as possible. Brochures and nomination forms will be ed to the board. Legislative Committee: Ron Wiborg and Raeone Loscalzo reviewed the following legislative issues with the members: Funding 1. Reduces CCA, CPO, felony caseload reduction, sex offender treatment funding by 5%. Eliminates the following grant programs: Juvenile Restitution, EJJ, Continuum of Care, Intensive Repeat DWRoI, Sex Offender Assessment Reimbursement, Juvenile Female Grants, and Juvenile Residential Treatment. 3

4 2. Restores restorative justice grants, allocates $300,000 for Provides $1.2 million in 04/05 for grants to counties to assist in housing short-term offenders (reduced from $5 million for 04/05. Policy Items: 1. Allows DOC to double-bunk state prisoners in level 5 institutions. 2. Requires felony offenders that have 180 days or less to serve, to serve time at the local level. Probation officer must provide to the court, the amount of time the person has in credit for prior imprisonment prior to the sentencing hearing. Does not sunset short-term offender language. 3. DNA testing extended until June of Probation Violations Sanction Conference. Allow CPO counties to utilize new administrative sanctions conference for technical probation violations. 5. Internet access fee to the Criminal Justice Network of $15/month for Internet access for criminal justice agencies and a $35/month for accessing the network via dial-up. 6. Mental Health Case Management requires counties to contract with eligible providers willing to provide mental health case management services to persons with serious and persistent mental illness. 7. Offenders with SPMI Alternative Placement: Court can place a SPMI offender on probation and require as a condition that the offender complete an appropriate supervised alternative living program (Rule 36). $449,000 is allocated to DOC. 8. DWI Staggered Sentencing: The court may sentence a person convicted of a gross misdemeanor or felony DWI violation to an executed sentence of incarceration in a local correctional facility to be served in equal segments in three or more consecutive years. 9. EJJ language was not repealed, and there is no funding allotted. 10. Felony pre-sentence investigations did not get changed. Court shall continue to order felony PSI s. 11. Privatization Proposal Language that would have allowed the DOC to issue an RFP to build and operate a private correctional facility did not prevail. 4

5 Items NOT included in the Judiciary Budget Bill: 1. S.F. 58 Lower Alcohol level to.08%. Not heard on the floor to date. Also not heard in the House. DOC Report: Mark Siemers reported on recent legislation regarding funding by reviewing a spreadsheet with the board. He noted that Restorative justice grants have been restored in the amount of $300,000. Beltrami ($61,000) and Mille Lacs probation have been restored. REAM Grant Mark Siemers stated that Commissioner Fabian will be signing the letters soon and they will be mailed. $1 m in request and a pot of $608 leaving all applicants short of requested funding. The members further discussed legislative issues and a suggestion was made to bring a special speaker in to the July meeting for the purpose of educating the legislators on these issues. VI.
