Motion: To dispense with the reading of the minutes of the March 21, 2014 meeting and to approve the same as recorded in the minute book: AGENDA PROCLAMATIONS NATIONAL ALCOHOL AWARENESS MONTH: April 2014 PROCLAMATION WHEREAS, alcohol is the number one drug of choice for America s young people and a primary factor in the four leading causes of death for young person s ages 10-21; and WHEREAS, The month of April will be filled with local, state, and national events aimed at educating people about the treatment and prevention of alcoholism in schools, colleges, churches and countless other community organizations; and WHEREAS, alcohol use by young people is extremely dangerous - both to the young individual and to society, and is directly associated with traffic fatalities, violence, suicide, educational failure, alcohol overdose, unsafe sex and other destructive behaviors. Annually, over 6,500 people under the age of 21 die from alcohol-related accidents and thousands more are injured; and WHEREAS, additionally, 7,000 kids in the United States under the age of 16 take their first drink and those who begin drinking before age 15 are four times more likely to develop alcoholism than those who begin after the age of 21; and WHEREAS, more than 1,700 college students in the United States are killed each year- about 4.65 a day as a result of alcohol-related injuries ; and WHEREAS, 25% of United States children are exposed to alcohol-use disorders in their family; and WHEREAS, underage alcohol use costs the nation an estimated $62 billion annually. NOW, THEREFORE, BE IT PROCLAIMED, that the Board of Commissioners for the Township of Long Beach proclaim April as NATIONAL ALCOHOL AWARENESS MONTH 2014 to increase awareness of the dangers and issues associated with alcohol abuse. BE IT FURTHER PROCLAIMED that certified copies of this proclamation shall be sent to the Ocean County Board of Chosen Freeholders, LBI Board of Health and LBI municipalities. NATIONAL YOUTH SPORTS SAFETY MONTH: April 2014 PROCLAMATION WHEREAS, youth sports injuries account for 41% of musculoskeletal injuries in kids age 5-21 years. Most injuries occur in 13 year olds, who are immature physically, emotionally and intellectually; and WHEREAS, sprains, strains, overuse injuries and fractures are the most common youth sports injuries and children going through growth spurts or exercising without adequate rest periods are most vulnerable ; and WHEREAS, basketball, track, baseball, gymnastics and swimming are the most common sports in which overuse injuries are seen, including traumatic brain injuries. Also, 8% of all spinal cord injuries are sports related injuries. WHEREAS, children are especially vulnerable to extremes of temperature and there have been deaths of high school football players due to heat stoke; and WHEREAS, high school athletes suffer 2 million injuries, 500,000 doctor visits and 30,000 hospitalizations each year; and WHEREAS, concussion legislation has now passed in 43 states and urges schools to adopt safety measures to protect students from injury or illness that occur in certain areas; and Page 1
2 WHEREAS, the plan requires that all schools have a comprehensive athletic care program and a health care team and assure safe practice and play facilities that are regularly inspected and cleaned. NOW, THEREFORE, BE IT PROCLAIMED, that the Board of Commissioners for the Township of Long Beach proclaim April as NATIONAL YOUTH SPORTS SAFETY MONTH and encourages and supports the efforts of our schools in providing safety equipment to our youth and sports safety knowledge to all children involved in sports in addition to their parents. BE IT FURTHER PROCLAIMED that certified copies of this proclamation shall be sent to the Ocean County Board of Chosen Freeholders, LBI Board of Health and LBI municipalities. NATIONAL INFANT IMMUNIZATION MONTH: April 2014 PROCLAMATION WHEREAS, giving babies the recommended immunizations by age two is the best way to protect them from 14 serious childhood diseases; and WHEREAS, the United States has the safest, most effective vaccine supply in its history; and WHEREAS, vaccine-preventable diseases still circulate in the United States and the world, so continued vaccination is necessary to protect everyone from potential outbreaks. Even when diseases are rare in the US, they can be brought into the country, putting unvaccinated children at risk; and WHEREAS, it is important to vaccinate children on time, according to the childhood immunization schedule, to provide the best protection early in life, when babies are vulnerable and before they are likely to be exposed to diseases; and WHEREAS, for 20 years, National Infant Immunization Week has encouraged parents, caregivers, and health care professionals to participate in educational, recognition, and media events to increase the awareness of the importance of immunizing children before their second birthday; and WHEREAS, this year, National Infant Immunization Week will be celebrated as part of World Immunization Week, an initiative of the World Health Organization where all six WHO regions, including more than 180 Member States, territories and areas will simultaneously promote immunization, advance equity in the use of vaccines and universal access to vaccination services, and enable cooperation on cross-border immunization activities in April NOW, THEREFORE, BE IT PROCLAIMED, that the Board of Commissioners for the Township of Long Beach proclaim the week of April 26 th - May 3 rd 2014 as NATIONAL INFANT IMMUNIZATION WEEK and encourage all parents to vaccinate their infants and children in a timely manner and referring those without medical insurance to Federally Qualified Health Centers to assure proper vaccination and medical care of infants, children and adults. BE IT FURTHER PROCLAIMED that certified copies of this proclamation shall be sent to the Ocean County Board of Chosen Freeholders, LBI Board of Health and LBI municipalities. NATIONAL VOLUNTEER WEEK: April 6 12, 2014 PROCLAMATION WHEREAS, the week of April 6 April 12, 2014 has been so proclaimed National Volunteer Week in recognition of the Retired and Senior Volunteer Program (RSVP) sponsored by the Ocean County Board of Social Services; and WHEREAS, the recognition this year focuses on an Olympic theme, Our Volunteers are Golden. National Volunteer Week is about inspiring, recognizing and encouraging people to seek out imaginative ways to engage in their communities. The impact and power of volunteerism and service is an integral aspect of our civic leadership. This is a time to recognize individuals, families, nonprofit organizations and government entities and the tremendous impact they are making on our country s most critical challenges year-round; and WHEREAS, the Board of Commissioners for the Township of Long Beach recognize the support given by volunteers to the needs of the communities of Ocean County, such as increasing the capacity of agencies and organizations to provide services, increasing the ability of recipients of service to lead more productive and independent lives and fostering the concept of service to the community. NOW, THEREFORE, BE IT PROCLAIMED by the Board of Commissioners for the Township of Long Beach that it hereby proclaims the week of April 6 April 12, 2014 as Page 2
3 National Volunteer Week and honors all of the volunteers of Ocean County for their outstanding service to the communities of Ocean County; and BE IT FURTHER PROCLAIMED that a certified copy of this proclamation be forwarded to the Ocean County Board of Chosen Freeholders, LBI municipalities, Ocean County Board of Social Services, Senator Connors, Assemblywoman Gove and Assemblyman Rumpf. NATIONAL LIBRARY WEEK: April 13 19, 2014 PROCLAMATION NATIONAL LIBRARY WEEK PROCLAMATION WHEREAS, libraries help lives change in their communities, campuses and schools; and WHEREAS, librarians work to meet the changing needs of their communities, including providing resources for everyone and bringing services outside of library walls; and WHEREAS, libraries and librarians bring together community members to enrich and shape the community and address local issues; and WHEREAS, librarians are trained, tech-savvy professionals, providing technology training and access to downloadable content such as e-books; and WHEREAS, libraries offer programs to meet community needs, providing residents with resume writing classes, 24/7 homework help and financial planning services from teens applying for student loans to older adults planning their retirement; and WHEREAS, libraries continuously grow and evolve in how they provide for the needs of every member of their communities; and WHEREAS, libraries, librarians, library workers and supporters across America are celebrating National Library Week. NOW, THEREFORE, BE IT RESOLVED THAT THE Board of Commissioners for the Township of Long Beach hereby proclaim National Library Week, April 13-19, 2014 and encourage all residents to visit the library this week to take advantage of the wonderful library resources your library. Lives your library. Linda Feaster, Ocean County Library, thanked the Mayor and Commissioners for their support and noted it was the 25 th Anniversary of the LBI Library building. Mayor Mancini thanked Linda for the use of the Library during the rebuild efforts after Superstorm Sandy. BRANT BEACH TAXPAYERS ASSOCIATION PILOT PROGRAM: MAY SEPT Bill Kunz, Brant Beach Taxpayers explained the sign posts would show street locations from the beach and would be located from 31 st to 56 th Streets. ORDINANCES &PUBLIC HEARINGS 1. Second Reading Ordinance 14-09: AN ORDINANCE AUTHORIZING A LEASE BETWEEN TOWNSHIP OF LONG BEACH AND THE LONG BEACH ISLAND CHAMBER OF COMMERCE REGARDING THE EXTERIOR AND INTERIOR SPACE OF THE MOTOR VEHICLES USED BY TOWNSHIP FOR THE MUNICIPAL TRANSPORTATION SYSTEM AN ORDINANCE AUTHORIZING A LEASE BETWEEN TOWNSHIP OF LONG BEACH AND THE LONG BEACH ISLAND CHAMBER OF COMMERCE REGARDING THE EXTERIOR AND INTERIOR SPACE OF THE MOTOR VEHICLES USED BY TOWNSHIP FOR THE MUNICIPAL TRANSPORTATION SYSTEM WHEREAS, Township of Long Beach (hereinafter Township ) has created the Municipal Transportation System, comprised of shuttle buses or other vehicles deemed to be appropriate by Township, to operate in Township and Long Beach Island as a whole in order to address the real and present needs for additional public transportation, support the important goal of the alleviation of traffic and parking problems, fill a need for an immediately available emergency transportation system required during declared emergencies, enhance and support the economic activities in Township and region as a whole, and benefit the experience and way of life of Township s residents, businesses, and visitors, as well as generally protect the public health, welfare, and safety; and WHEREAS, Township has determined that the exterior and interior advertising space on the motor vehicles used for the Municipal Transportation System is not presently needed for public use; and WHEREAS, the Long Beach Island Chamber of Commerce (hereinafter Chamber ) is a non-profit corporation of the State of New Jersey, is an organization comprised of businesses of all types based both on Long Beach Island and the surrounding mainland communities; and Page 3
4 WHEREAS, the Chamber s stated mission is to stimulate and promote tourism and commerce on Long Beach Island and its goals are: (i) to generate the funds necessary to market and promote Long Beach Island to the New Jersey, New York, and Pennsylvania metropolitan regions and beyond as a vacation destination and as a place to live; and (ii) to support, sustain, and create a thriving Long Beach Island that will benefit both the public and businesses located in Township and Long Beach Island as a whole; and WHEREAS, by design, the mission and goals of the Chamber are focused solely on the promotion of Long Beach Island; and WHEREAS, the Chamber s mission and goals enhance and benefit the general public health and welfare, and economic vitality of the residents and business of Township and Long Beach Island as a whole; and WHEREAS, it is estimated Chamber s activities will directly and/or indirectly benefit the approximate year-round population of Township of 3,000 persons, the approximate year-round population of Long Beach Island of 20,000 persons, the seasonal population of Long Beach Island, which is estimated to annually exceed 100,000 persons at any given time, and the all residents and businesses located in the Long Beach Island region; and WHEREAS, N.J.S.A. 40A:12-14(c) provides that a municipality may lease to a nonprofit corporation for nominal or other consideration the property of a municipality that is not needed by a municipality for its use for use by a nonprofit corporation for such activities that benefit the public; and WHEREAS, Township is hereby authorizing the Commissioner of Revenue and Finance of Township to negotiate and execute a lease between Township and Chamber pursuant to the requirements set forth herein. NOW THEREFORE, BE IT ORDAINED by the Mayor and Board of Commissioners of the Township of Long Beach, Ocean County, State of New Jersey, in accordance with the aforesaid recitals, which are incorporated herein by reference, that: STATEMENT OF PURPOSE The purpose of this Ordinance is to authorize the Commissioner of Revenue of Finance of Township of Long Beach to negotiate and enter into a lease agreement with the Long Beach Island Chamber of Commerce pursuant to the terms set forth herein and in accordance with N.J.S.A. 40A:12-14(c), which shall lease from Township to Chamber the exterior space of the motor vehicles that comprise Township s Municipal Transportation System, which exterior space shall be used by Chamber to sell advertising space to third-parties and Chamber shall use the proceeds of the sale of the advertising space for such activities that benefit the public. 1. Authorization and Terms A. The lease (hereinafter Lease ) between Township of Long Beach (hereinafter Township ) and the Long Beach Island Chamber of Commerce (hereinafter Chamber ) shall be negotiated and executed by the Commissioner of Revenue and Finance pursuant to the terms authorized herein, and any and all additional terms as deemed appropriate by the Commissioner of Revenue and Finance. B. The Lease shall provide that for consideration of one dollar ($1.00) and other nominal consideration, as deemed appropriate, Chamber shall lease from Township and Township shall lease to Chamber the exterior and interior space of the motor vehicles that comprise the Municipal Transportation System (hereinafter Advertising Space ) from Township. C. The Lease shall provide that Chamber is precluded from any assignment of its rights and interest in the Lease to any third-parties. D. The Lease shall be limited to a one-year term and Township and Chamber may either agree to successive one-year option periods set forth in the Lease and/or enter into additional lease agreements relating to the Advertising Space pursuant to and in accordance with the authority granted herein in subsequent years, each of which shall be in Township s discretion. E. The Lease shall provide that Chamber shall use all proceeds from the Advertising Space for the following public purposes: (i) to stimulate and promote tourism and commerce on Long Beach Island: (ii) to market Long Beach Island to the New Jersey, New York, and Pennsylvania metropolitan regions and beyond as a vacation destination and as a place to live; (iii) to support, sustain, and create a thriving Long Beach Island that will benefit both the public and businesses located in Township and Long Beach Island as a whole; and (iv) to benefit the general public Page 4
5 health and welfare, and economic vitality of the residents and business of Township and Long Beach Island as a whole. F. The Lease shall comply in all respects with the requirements set forth in N.J.S.A. 40A:12-14(c). 2. Compliance and Reporting A. The Lease shall provide that Chamber shall be required to annually submit a report to the Clerk of Township setting forth the following: 1. The use to which the Lease was put by Chamber during each calendar year; 2. The activities of Chamber undertaken in furtherance of the public purpose for which the Lease was granted; 3. The approximate value or cost, including the proceeds of the sale of the Advertisement Space received by Chamber, if any, of such activities in furtherance of such purpose; and 4. Affirmation of the continued tax exempt status of Chamber pursuant to both State and Federal law. 3. Enforcement The Township Clerk shall be responsible for the enforcement of the conditions of the Lease. 4. Repealer All ordinances, or parts of ordinances, inconsistent with this ordinance are hereby repealed to the extent of such inconsistency. 5. Severability. If any word, phrase, clause, section, or provision of this ordinance shall be found by any Court of competent jurisdiction to be unenforceable, illegal or unconstitutional, such word, phrase, clause, section, or provision shall be severable from the balance of the ordinance and the remainder of the ordinance shall remain in full force and effect. Effective date. This ordinance shall take effect after final adoption and publication as required by law. Lynda Wells, Municipal Clerk explained the purpose of this Ordinance was to authorize the Commissioner of Revenue of Finance to negotiate and enter into a lease agreement with the Long Beach Island Chamber of Commerce to lease advertising space on the trolley buses for such activities that benefit the public. Passed on first reading at a regular meeting held on March 21, 2014 and advertised in the BEACH HAVEN TIMES issue of March 27, OPEN PUBLIC HEARING No comments CLOSE PUBLIC HEARING Motion to adopt Ordinance on Second Reading: 2. Second Reading Ordinance 14-10C: AN ORDINANCE AMENDING AN ORDINANCE ENTITLED, CODE OF THE TOWNSHIP OF LONG BEACH, COUNTY OF OCEAN, STATE OF NEW JERSEY, (1997) AS THE SAME IN SECTION 64-2 PERTAINS TO BUILDING AND ZONING PERMIT REQUIREMENTS Lynda Wells explained this ordinance made minor adjustments and amendments to Ordinance #14-04C adopted on Friday, March 7, The amendment defined the WAIVER FORM to require a builder, developer or contractor seeking to disrupt disconnect or discontinue any utility service to advise property owners whose utilities may be interrupted that the applicant was prepared to provide substitute utilities during such period of interruption. Passed on first reading at a regular meeting held on March 21, 2014 and advertised in the BEACH HAVEN TIMES issue of March 27, AN ORDINANCE AMENDING AN ORDINANCE entitled, Code of the Township of Long Beach, County of Ocean, State of New Jersey, (1997) as the same in Section 64-2 pertains to building and zoning permit requirements. THE BOARD OF COMMISSIONERS OF THE TOWNSHIP OF LONG BEACH DO ORDAIN: STATEMENT OF PURPOSE This Ordinance is adopted to make minor adjustments and amendments to Ordinance No C adopted on second and final reading on Friday March 7, The purpose of the amendment is to define the form which Paragraph H. of 64-2 requires a builder, developer or contractor to provide to the Building Department and also to acknowledge that the title of that form will be known as the WAIVER FORM and further to require the builder, developer or Page 5
6 contractor seeking to disrupt, disconnect or discontinue any utility service to advise property owners whose utilities may be interrupted that the applicant is prepared to provide substitute utilities during such period of interruption. SECTION I 64-2 of an Ordinance entitled Code of the Township of Long Beach, County of Ocean, State of New Jersey, (1997) is hereby amended in paragraph H in the first paragraph by the addition of the following language as the last sentence of the paragraph: The form shall be known as the WAIVER FORM. SECTION II The second paragraph of paragraph H is hereby repealed and in lieu and instead thereof the following is adopted: The Waiver Form provided by the Building Department shall be executed by the applicant, builder, developer or contractor setting forth the required information under the penalties of perjury for any false information therein contained. A copy of the Waiver Form executed by the owner or owners of every property whose utilities are to be disrupted or disconnected from utility service acknowledging that they have been contacted concerning the disruption or disconnection of the utility service and do not object thereto. The acknowledgement contained in the Waiver Form shall also state that all property owners whose utilities may be interrupted or disconnected have been advised that the applicant is prepared to provide substitute utilities during such period of interruption. SECTION III All Ordinances or parts of Ordinances inconsistent herewith are repealed to the extent of such inconsistency. First Reading Ordinance 14-11C: AN ORDINANCE AMENDING AN ORDINANCE ENTITLED, CODE OF THE TOWNSHIP OF LONG BEACH, COUNTY OF OCEAN, STATE OF NEW JERSEY, (1997) AS THE SAME IN CHAPTER 64 PERTAINS TO RELOCATION PERMITS. Lynda Wells, Municipal Clerk explained this Ordinance provided clarification in A.5. regarding clearance of at least 15 ft of unobstructed roadway required when placing a structure in the right-of-way. Motion to approve Ordinance 14-11C on First Reading: 4. First Reading Ordinance 14-12C: AN ORDINANCE AMENDING AN ORDINANCE ENTITLED, CODE OF THE TOWNSHIP OF LONG BEACH, COUNTY OF OCEAN, STATE OF NEW JERSEY, (1997) CREATES IN CHAPTER NEW SUB- SECTION D, PERTAINING TO LOT COVERAGE. Lynda Wells, Municipal Clerk explained this Ordinance added new sub-section D to Chapter , noting electric meter platforms meeting certain criteria shall not be considered as lot coverage Motion to approve Ordinance 14-12C on First Reading: Page 6
7 ADOPTIONS & APPROVALS 5. Resolution : Affirm Long Beach Township s Civil Rights Policy Township of Long Beach Declaration of Civil Rights A RESOLUTION AFFIRMING THE TOWNSHIP S CIVIL RIGHTS POLICY WITH RESPECT TO ALL OFFICIALS, APPOINTEES, EMPLOYEES, PROSPECTIVE EMPLOYEES, VOLUNTEERS, INDEPENDENT CONTRACTORS, AND MEMBERS OF THE PUBLIC THAT COME INTO CONTACT WITH MUNICIPAL EMPLOYEES, OFFICIALS AND VOLUNTEERS WHEREAS, it is the policy of Township to treat the public, employees, prospective employees, appointees, volunteers and contractors in a manner consistent with all applicable civil rights laws and regulations including, but not limited to the Federal Civil Rights Act of 1964 as subsequently amended, the New Jersey Law Against Discrimination, the Americans with Disabilities Act and the Conscientious Employee Protection Act, and WHEREAS, the governing body of Township determined that certain procedures needed to be established to accomplish the aforementioned policy objectives and adopted Resolution No (c), and, now, readopts same. NOW, THEREFORE BE IT AFFIRMED by the Commissioners of the Township of Long Beach that: Section 1: No official, employee, appointee or volunteer of the Township by whatever title known, or any entity that is in any way a part of the (local unit type) shall engage, either directly or indirectly in any act including the failure to act that constitutes unlawful discrimination, harassment, retaliation or a violation of any person s constitutional rights while such official, employee, appointee volunteer, or entity is engaged in or acting on behalf of the Township s business or using the facilities or property of the Township. Section 2: The prohibitions and requirements of this resolution shall extend to any person or entity, including but not limited to any volunteer organization or interlocal organization, whether structured as a governmental entity or a private entity, that receives authorization or support in any way from the Township to provide services that otherwise could be performed by the Township. Section 3: Unlawful discrimination, harassment and civil rights shall be defined for purposes of this resolution using the latest definitions contained in the applicable Federal and State laws concerning discrimination, harassment and civil rights. Section 4: The Township has established written procedures for any person to report alleged unlawful discrimination, harassment, retaliation and violations of civil rights prohibited by this resolution. Such procedures include alternate ways to report a complaint so that the person making the complaint need not communicate with the alleged violator in the event the alleged violator would be the normal contact for such complaints. A copy of the General Complaint Procedure is attached and made part of this Resolution. Section 5: No person shall retaliate against any person who reports any alleged unlawful discrimination, harassment or violation of civil rights, provided however, that any person who reports alleged violations in bad faith shall be subject to appropriate discipline. Section 6: The Township has established written procedures to require all officials, employees, appointees and volunteers of the Township as well as all other entities subject to this resolution to periodically complete training concerning their duties, responsibilities and rights pursuant to this resolution. Section 7: The Township Clerk shall establish a system to monitor compliance and shall report at least annually to the governing body the results of the monitoring. Section 8: At least annually, the Township Clerk shall cause a summary of this resolution and the procedures established pursuant to this resolution to be communicated within the Township. This communication shall include a statement from the governing body expressing its unequivocal commitment to enforce this resolution. This summary shall also be posted on the Township s web site. Section 9: This resolution shall take effect immediately. Section 10: A copy of this resolution shall be published in the official newspaper of the Township in order for the public to be made aware of this policy and the Township s commitment to the implementation and enforcement of this policy. Resolution : Authorize the use of a Tort Claim Form as required by the Ocean County Municipal Joint Insurance Fund A RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE TOWNSHIP OF LONG BEACH ADOPTING A FORM REQUIRED TO BE USED FOR THE FILING OF THE NOTICES OF TORT CLAIMS AGAINST THE TOWNSHIP IN ACCORDANCE WITH THE PROVISIONS OF THE NEW JERSEY TORT CLAIMS ACT, N.J.S.A. 59:8-6 WHEREAS, the New Jersey Tort Claims Act, N.J.S.AS. 59:8-6, provides that a public entity may adopt a form to be completed by claimants seeking to file a Notice of Tort Claim against the public entity; and WHEREAS, the Township of Long Beach is a public entity covered by the provisions of the New Jersey Tort Claims Act; and WHEREAS, the Township of Long Beach deems it advisable, necessary, and in the public interest to adopt a Notice of Tort Claim Form in the form attached hereto and made a part hereof. NOW, THEREFORE BE IT RESOLVED, by the Board of Commissioners of the Township of Long Beach assembled in public session this 4 th day of April, 2014, that the attached Notice of Tort Claim form be and hereby is adopted as the official Notice of Tort Claim form for the Township of Long Beach; and BE IT FURTHER RESOLVED that all persons making claims against the Township of Long Beach, pursuant to the New Jersey Tort Claims Act, N.J.S.A. 59:8-1, et. seq,. be required to complete the form herein adopted as a condition of compliance with the notice requirement of the New Jersey Tort Claims Act. 7. Phase I thru III; $59, RESOLUTION RESOLUTION AUTHORIZING THE AWARD OF A PROFESSIONAL SERVICE CONTRACT WHEREAS, the Township of Long Beach has a need to acquire various professional services as listed below as an alternative method contract pursuant to the provisions of N.J.S.A.19:44A-20.4 or 20.5; and WHEREAS, P.L. 195, Chapter 353 of the laws of the State of New Jersey provide that certain professional services are exempt from public bidding; and WHEREAS, the Township of Long Beach wishes to award contracts without competitive bidding for various professional services pursuant to NJSA 40A:11-5(a)(a)(i). Such contracts and resolutions are available for pubic inspection at the office of the Township Clerk; and WHEREAS, the statute defines professional services as services rendered by a person authorized by law to practice a recognized profession, which practice is regulated by law; and WHEREAS, the listed services are recognized professions, which professions are regulated by law; and WHEREAS, the vendor listed below completed and submitted a Business Entity Disclosure and Political Contribution Disclosure Certification which certify that they Page 10
11 have not made any reportable contributions to a political or candidate committee in the Township of Long Beach in the previous one year, and that the contract will prohibit the vendor from making any reportable contributions through the term of the contract; and WHEREAS, the Board of Commissioners of Township of Long Beach has determined and certified in writing that the value of the services may exceed $17,500.00; and WHEREAS, the Chief Financial Officer has provided certification of the availability of funds as per N.J.A.C. 5: NOW, THEREFORE BE IT RESOLVED that the Board of Commissioners of the Township of Long Beach authorizes the Mayor to enter into a contract from January 1 st 2014 through December 31 st 2014 as per specific contract terms with the Professional listed below as described herein; and NAME DESCRIPTION OF SERVICES AMOUNT RCC Consultants, Inc. Consulting Services for the $59, relocation of the Municipal Cell Tower Site currently located on 69 th St. BE IT FURTHER RESOLVED that the Business Disclosure Entity Certification and the Political Contribution Disclosure Form as required, be placed on file with the Municipal Clerk; and BE IT FINALLY RESOLVED that the Municipal Clerk shall send a notice of the alternative method professional appointment and have same published at least once in the official newspaper of the Township of Long Beach and shall keep the resolution and contract on file for public inspection. Resolution : Approve Bills & Payroll Bills in the amount of: $10,733, Payroll in the amount of: $ 387, RESOLUTION RESOLUTION OF THE TOWNSHIP OF LONG BEACH, COUNTY OF OCEAN, STATE OF NEW JERSEY AUTHORIZING THE PAYMENT OF TOWNSHIP BILLS WHEREAS, the Chief Financial Officer and various Department Heads of the Township of Long Beach have carefully examined all vouchers presented for the payment of claims; and WHEREAS, after due consideration of the said vouchers, the Board of Commissioners of the Township of Long Beach has approved payment of same; and WHEREAS, Payroll Department has certified and submitted a request for approval of Township payroll in the amount of $387, NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Township of Long Beach as follows: 1. The said approved vouchers amounting to the sum of $10,733, be and the some are hereby authorized to be paid on. 2. The said approved payroll amounting to the sum of $387, be and the same are hereby authorized to be paid on. The Municipal Clerk be and she is hereby directed to list on the page in the Minute Book following the Minutes of this meeting all of the said vouchers hereby authorized to be paid. Motion to approve Items 13: COMMISSIONERS' REPORTS Commissioner Lattanzi had no comments. Commissioner Bayard reported the Twp. received $13, from Ocean County for the recycling reimbursement for the last half of Commissioner Bayard also reported the State Forestry Dept. donated 1,000 dune grass seedlings that would be available on April 30 th. He instructed residents to check the website for pick up locations. Page 11
12 Mayor Mancini announced the next meeting of the Board of Commissioners would take place on Friday, April 25, 2014 at 4:00 p.m. at which time public hearings will be held for Ordinances 14-11C & 14-12C. Mayor Mancini also announced the next regular meeting of the Land Use Board will be held on Wednesday, April 9, 2014 at 7:00 p.m. in the Multi Purpose Room. Mayor Mancini read the Police Report: Community Policing officer Megan Keller could assist in presenting Informational seminars on several topics: Identity Theft Prevention, ICE (In Case Of Emergency) Child Safety Seat Installation, Storm Preparedness, Computer safety tips. Residents should call the station to request this service at The Long Beach Township Police were taking part in the distracted driving campaign which enforced TEXTING and use of CELL PHONES while driving. In addition enforcement would address FAILURE TO KEEP RIGHT. Operation Take Back NJ was set for April 26 th 2014, people can drop off expired, unwanted medications at the Long Beach Township Police Department. The drop box would be in the lobby, hours for drop off were from 10am to 2pm. The Police Department advised the public to be wary of solicitations from sources that were not legitimate (computer, phone, mail). Residents should report suspicious solicitations to the Department at OPEN PUBLIC SESSION Greg Kopenhaver, Brant Beach asked if the Twp. paints the inside of the water towers as well as the outside.
