2 The Foundation for Criminal Justice preserves and promotes the core values of the National Association of Criminal Defense Lawyers and the American criminal justice system. Through the projects it supports, the Foundation for Criminal Justice is at the vanguard of pursuing reforms necessary to make America s criminal justice system fairer and more humane by supporting public defense and sentencing reform, addressing racial and ethnic disparities in the criminal justice system, opposing overcriminalization, guarding against the evisceration of fundamental constitutional rights, and supporting abolition of the death penalty. For 60 years, NACDL has been the foundation of the criminal defense bar. With support from the FCJ, NACDL continues to press for real criminal justice reform in policy and in the courts, every day, by helping lawyers challenge government abuses of power. Criminal defense lawyers stand with their clients, protecting them and our most cherished freedoms. The FCJ ensures through training, collegial support, litigation, and institutional change a better, fairer criminal justice system and society. The FCJ is the most important charity I can think of to support in order to fix America s criminal justice system and ensure a robust defense bar.

3 The Foundation of Criminal Justice Reform For sixty years, NACDL has been fighting to prevent and reverse injustice in the criminal system. The specter of new and unprecedented threats to criminal justice reform looms large. Public defense systems badly need reform and resources. Technological innovation and policy trends present unprecedented risks to privacy rights. The collateral consequences of arrest and conviction threaten people with permanent civil incapacitation. Overcriminalization, Brady violations, and the trial penalty continue to stifle due process of law. Now is the time to press for reform and to support the nation s criminal defense bar. The Foundation for Criminal Justice is fighting to address these issues. Here are a few of the current and upcoming initiatives supported by the Foundation: v v Unprecedented projects and reports that support and expand Fourth Amendment protections; Public defense reform on the state and federal level; Strategic opportunities to combat excessive sentencing; v v Comprehensive evaluations and policy responses to new and disruptive technologies and techniques, such as body cameras, predictive policing, risk assessment tools, biometrics, and more; v v Brady reform designed to ensure prompt disclosure of all favorable evidence; vprojects v that tear down the collateral consequences of arrest and conviction and promote legal mechanisms to restore rights and status after conviction or arrest, such as pardons, expungements, and certificates of good conduct; and v v Support for novel projects such as state-level clemency initiatives and the First Amendment Strike Force and Mass Defense Unit 1

4 Michelle Alexander Champion of Justice Civil & Humanitarian Award Author of The New Jim Crow Michelle Alexander is a highly acclaimed civil rights lawyer, advocate, legal scholar, and best-selling author. Her award-winning book, The New Jim Crow: Mass Incarceration in the Age of Colorblindness, helped to spark a national debate about the crisis of mass incarceration in the United States, and inspired racial justice organizing and advocacy efforts nationwide. Numerous commentators have dubbed The New Jim Crow the bible of a social movement, and the book has become a staple of university curriculums, advocacy trainings, reading groups, and faith-based study circles. For more than a decade, Quintin Chatman has served as Editor of The Champion magazine, NACDL s flagship monthly magazine. Under Quintin s stewardship, The Champion has been widely acclaimed throughout the profession and beyond. Periodic themed issues highlight major milestones and have garnered high praise from within the publications industry. Quintin Chatman Executive Director s Award Editor, The Champion, NACDL 2

5 Malika Saada Saar is Google s Senior Counsel on Civil and Human Rights. Before joining Google, Malika was founder and Executive Director of the Human Rights Project for Girls (Rights4Girls), a human rights organization focused on gender-based violence against young women and girls in the U.S. She also served as Special Counsel on Human Rights at The Raben Malika Saada Saar Champion of Justice Legal Award Senior Counsel on Civil and Human Rights, Google Group. As a human rights lawyer and advocate, Malika led the effort to shut down Craigslist sex ads that served as the leading site for the trafficking of children for sex, ended the federal practice of shackling pregnant mothers behind bars in U.S. prisons, and successfully advocated for millions in federal funding for treatment services for at-risk families. Theodore V. Wells Jr Lifetime Achievement Award Partner, Paul Weiss Ted Wells co-chairs the Litigation Department at Paul, Weiss and is widely recognized as one of the best trial lawyers in America. Active in social, political and community affairs, Ted is Chairman Emeritus of the NAACP Legal Defense and Educational Fund Board of Directors and he is a Fellow of the Harvard Corporation, the governing body of Harvard University. His clientele has included some of the most prominent criminal cases of the current era. 3

9 Dan Bannister 123rf The Work of the FCJ The Foundation for Criminal Justice supports efforts to ensure access to competent counsel, overcome overcriminalization, promote discovery reform, fight prosecutorial misconduct, preserve the Fourth Amendment, restore rights after arrest or conviction, end racial and ethnic bias and disparities, and promote diversity within the defense bar, among other efforts. 10 Clemency Project 2014 The Foundation for Criminal Justice was among the first supporters of Clemency Project 2014, an unprecedented, independent effort by the nation s bar. A working group including the American Bar Association, the American Civil Liberties Union, Families Against Mandatory Minimums, many federal public and community defenders, and the National Association of Criminal Defense Lawyers, the project continued its FCJ-supported efforts in 2016 to identify potential clemency petitioners and to recruit and train volunteer lawyers to assist them in securing clemency, and completed its work in the final days of the Obama administration. The scope of Clemency Project 2014 was unprecedented. The project received over 36,000 requests from federal prisoners for volunteer assistance. The project set out to ensure that every applicant who potentially met the administration s criteria had a volunteer lawyer to prepare and submit a timely clemency petition. The Project reviewed more than 36,000 applicants, supported 2,571 clemency petitions, and President Obama granted clemency to 894 of those project-supported petitions. Of those, 314 individuals were serving life sentences; another 132 were serving sentences over 30 years. These grantees received over 13,500 years of sentence reductions, saving the United CLEMENCY PROJECT States over $436,000,000 in the TM cost of incarceration. Grantee Spotlight: Stephen Hardridge I am grateful to have a second chance. To be considered for the opportunity was a blessing, but to receive clemency really put things in perspective. I work very hard to ensure that I do not waste this opportunity. I work long hours at an energy business and I have successfully financed a car. That may seem simple to those who have not been incarcerated for many years, but I am very proud of my accomplishments thus far. I am happy and peaceful two feelings I have not experienced in a very long time. I hope others have the opportunity to have a second chance at life. My faith has been restored. 8
