6 ASN : A long road towards independence In the beginning : within the CEA 1973: Establishment of a department in the ministry for industry with responsibility for regulation of the safety of nuclear installations 1991: The department becomes a Directorate reporting to two Ministers (industry and the environment) 1997: Extension of the area of competence to transport 2002: The Directorate becomes a General Directorate reporting to three Ministers (industry, environment and health), with extension of the area of competence to radiation protection 2006: The TSN Act creates ASN as an Independent Administrative Authority November 9th 2010 Organizational Structure of French ASN 6
7 Independent Administrative Authority TSN Act : Legitimacy, increased powers ASN is managed by a board of 5 commissioners appointed by the French President the leader of the Senate the leader of the National Assembly irrevocable, for a non-renewable 6-year term, full time. 10 ASN s Missions The tasks of ASN cover the nuclear safety and radiation protection of civilian installations and small-scale nuclear installations cover an integrated approach for environment protection and workers protection, do not cover security and physical protection, do not cover energy policy. 11 Regulation ASN helps drafting regulations submits opinions to the Government on draft decrees and ministerial orders. ASN can issue regulatory decisions of a technical nature to complete regulation issued by the Government. ASN ensures that the regulations are clear, accessible and proportionate to the safety issues. ASN regulates all civilian nuclear activities: nuclear power plants, radioactive waste management, nuclear fuel, transport, consignments of radioactive materials, medical installations, research laboratories, industrial activities Law Decrees Orders ASN Decisions ASN Guidance Parliament ASN November 9th 2010 Organizational Structure of French ASN 11
12 Issue of individual authorisations For nuclear installations, ASN: Assesses BNI authorisation or decommissioning decrees and makes proposals to the Government Authorises commissioning of these installations and pronounces delicensing following decommissioning Defines the requirements applicable to these installations with regard to the prevention of risks, pollution and detrimental effects Check any modification of the installation which has an impact on safety ASN also issues the licences for the nuclear pressure vessels, for the design of packages (transport of radioactive materials) and for small-scale nuclear facilities provided for by the Public Health Code. 13 Role of ASN, Role of the Government ASN Consulted on any draft regulation related to nuclear and radiation safety and security Issues technical regulatory decisions to complete government regulation all other decisions for nuclear activities Government Issues all regulatory texts, except ASN regulatory decisions Endorses ASN regulatory decisions ASN reviews operator license file for new installations Decision to license a nuclear site November 9th 2010 Organizational Structure of French ASN 13
14 Inspections and Enforcement ASN checks facilities and activities compliance with rules and specifications 2,000 inspections / year. ASN has appropriate enforcement powers and may impose penalties to remedy the most important risks Penalties are impartial, justified and appropriate to the level of risk presented by the situation concerned. Examples of administrative actions : formal notice deposit of the financial amount corresponding to the cost of the work to be performed; mandatory performance of the work at the expense of the licensee; temporary suspension of operation of the installation revocation of an authorisation November 9th 2010 Organizational Structure of French ASN 14
15 Responsibilities for Nuclear Safety and Radiation Protection Defines general objectives of safety and radiation protection The Nuclear Safety Authority Proposes means procedures of achieving these objectives Ensures that the objectives are achieved by the means proposed Implement the approved provisions The BNI operators: EDF, CEA, AREVA, ANDRA The users of ionising radiation Supervises the implementation of the provisions and informs the public on the results November 9th 2010 Organizational Structure of French ASN 15
16 Role of ASN, Role of the Government ASN ASN oversights compliance with the regulation and the licence conditions ASN controls the nuclear facilities through: inspections enforcement actions emergency decisions ASN controls any radioactive sources. 17 Emergencies Management In case of emergency, ASN : Ensures that the licensee keeps the accident under control, minimises the consequences and rapidly and regularly inform the authorities Advises the Government, especially the préfet concerning the population protection measures to be taken Contributes to public information Exercise its function of competent authority (as defined by international conventions) Information of IAEA and foreign countries Provide assistance Responsible for preparedness (emergency plans, exercises) November 9th 2010 Organizational Structure of French ASN 17
18 Public Information Information is the other fundamental mission of ASN : nuclear safety and radioprotection are a matter for everybody, therefore ASN wants to give each citizen the means to make their own opinion on these issues. ASN develops specific tools (Internet website, technical publications, annual report on nuclear safety in France ) November 9th 2010 Organizational Structure of French ASN 18
19 Role of ASN, Role of the Government ASN ASN assists the government to face emergency situations. ASN contributes to informing the public independently. Government Overall responsibility to manage an emergency situations Informs the public ASN makes proposals to the Government to define French position for international negotiations and participates in the French representation in international bodies in its areas of competence. 20 Conclusion On behalf of the State, the French Nuclear Safety Authority ASN regulates nuclear safety and radiation protection in order to protect workers, patients, the public and the environment from the risks related to nuclear activities. It also contributes to informing the citizens. The aim of ASN is to ensure : an efficient, impartial, legitimate and credible regulation of nuclear activities, recognised by the public and regarded internationally as a benchmark for good practice.
