2 Constance Popineau 4, rue Meissonier Paris FEI Nomination committee Paris, April the 29th Application for FEI Tribunal member Dear Nomination committee members, I worked for the Equestrian French Federation for more than 6 years, before resigning from this job few months ago. I was the Head of legal department, and I could have the chance to participate to FEI activities like FEI General Assemblies and to be in contact with the FEI legal department, for rules applications, or explanations, or for FEI Tribunal cases about French riders, and French teams. During this experience, I learned a lot about FEI rules, for doping, with banned substances and medication controlled specificities, or general rules, about animal welfare and finally, I discovered the FEI tribunal s role and rules. I am a rider (at amator level) for a very long time, and I am still interesting in horse sector and sport. I work now for horse racing sector, for a thoroughbred association. Doping rules are also parts of my new job. Staying in sport field, I am a new member of the French tennis federation, for doping committee at appeal level, this could help me to have an objective point of view of sport rules at national level for a different sport than equestrian one. I would enjoy joining the FEI family becoming a FEI tribunal member even if I could only present you one heart beating for horses and defending ethic, fairplay, honesty and sports rules. Background I am a Canadian lawyer holding both civil and common law degrees. I have practised law for over 20 years and I am currently a sole practitioner with subject matter expertise in corporate/securities law, professional conduct, and equine law. More particularly, o I advise on investigations and enforcement actions involving possible breaches of securities laws, and I represent and defend clients before regulatory bodies such as the British Columbia Securities Commission (the Commission); o I provide legal advice and prepare documents on all matters related to corporate finance transactions and securities law compliance; o I assist lawyers who are under investigation by the Law Society of British Columbia with the complaint process; and o I am one of very few Canadian lawyers with an equine law practice focussing on issues of negligence and misrepresentation, among other things. 8 o I plan and write comprehensive legal arguments on allegations of fraud, misconduct, and misrepresentation and I defend my legal arguments at the Commission or in the Courts of British Columbia. I prepare alleged wrongdoers and potential witnesses to give testimony at investigative or court proceedings; o I conducted detailed investigations into breaches of laws, regulations, and codes of professional conduct by collecting evidence involving complex legal issues, and applying legal analysis and assessment to that evidence. I exercised my discretion to close investigations by drafting clear and comprehensive written legal decisions communicating the essence and correctness of my assessment to the alleged wrongdoer. Alternatively, I prepared comprehensive legal opinions of fact and law to support my assessment, and I presented and defended my legal opinions before the applicable sanction approval body. I prepared the evidence for presentation at hearings; o I assisted with representing a defendant developer against approximately 85 plaintiffs in a complex commercial litigation matter, including preparing for and attending 51 examinations-for-discovery, organizingexhibits and following-up with opposing counsel on outstanding requests. I summarized discovery transcripts and identified relevant read-ins. I reviewed and identified reliance documents. I researched case law on pertinent issues and I prepared, reviewed and commented on various written submissions; and o I was selected to develop legislation, including harmonizing two laws related to securities regulation across Canada. The results included committee members adopting the majority of the amendments, which improved investor protection and the clarity of the laws themselves. My relevant volunteer experience includes: o I participated as a member of the Bylaws & Rules Revision Subcommittee for a British Columbian sports and recreational facility where I was one of three lawyers rewriting the bylaws and rules for this 8,000 member club. I drafted detailed disciplinary procedures, which would now survive a courl challenge. o I was appointed to serve on the Advisory Committee to the Judicial Council of British Columbia where I was responsible for assessing the suitability of applicants for the Provincial Court Bench and influencing the Judicial Council's decision to grant interviews to potential candidates. Ahout Me I am a hard-working woman who believes that integrity cormts and transparency and accountability are instrumental in integrity's survival. When confronted with legal issues, I believe in thinking outside the box to arrive at an equitable resolution of these issues. Given my values and work experience, I would not have any diffrculty understanding the goals and mandate of the FEI and the FEI tribunal. As evidenced by my equine website, I am knowledgeable of the equestrian sport and passionate about horse welfare. I have attended FEI events at Spruce Meadows and in Las Vegas. I also have a paid lease on a Dutch warmblood horse whose show name is Nouveau de Pomme. I have a flexible schedule and I am prepared to travel. I am computer literate and I also have a working knowledge of French.

Since I graduated as a lawyer in Colombia, a country of a civil law system, but I also have a Master s Degree from a University in the U.S.A., a country of the commonlaw system, together with an experience of over 35 years on international law and arbitration in different fields of the law, I believe that my knowledge and background can be useful for the FEI Tribunal. The foregoing is also enhanced by my knowledge and experience of the equestrian sport, due to my experience of 45 years as a dressage rider, international competitor, former Vice-president of the Colombian Equestrian Federation and FEI 4* judge. My experience as a lawyer for both private and public entities and as a negotiator and arbitrator for complex contracts and cases have also developed my problemsolving skills and my ability to work with colleagues from around the world by using the available technologies. It is also important to point out that since I am the managing partner of my Law Firm I can also commit myself to work flexible hours in the assigned tasks and cases and I can also travel as necessary for hearings and meetings. For the above-mentioned reasons, I believe that my education, background and experience can benefit the sport and the effective and correct decisions and tasks that are assigned to the Tribunal. In this way, I believe I can to contribute to our wonderful sport that has given us all so much joy and happiness while preserving the welfare of our horses and the fair play in our competitions.
