2 established on 7 May 2000 as a local non-governmental organization committed to combating corruption in Georgia by promoting transparency, accountability, and public engagement. Our mission is to serve as the primary source of information on corruption reform in Georgia, assist the Georgian Government and the broader public in facilitating reform in sectors where corruption exists, and build and strengthen institutions. To fulfill this mission, TI Georgia: establishes programmatic activities that target structural corruption in specific sectors; promotes access of local populations to information on existing problems and changes initiated to address these problems; encourages input on reform from local and international experts; assists the Government in drafting policy; and produces analysis and public policy recommendations on current activities and on future reform. Transparency International Secretariat Transparency International (TI) is the global civil society organization leading the fight against corruption. It brings together civil society, business, and governments in a powerful global coalition. TI, through its International Secretariat and more than 90 independent national chapters around the world, works to stem both the supply and demand of corruption at the local, national, and international levels. In the international arena, TI raises awareness about the damaging effects of corruption, advocates policy reform, works towards the implementation of multilateral conventions, and monitors compliance by governments, corporations, and banks. At the national level, chapters work to increase levels of accountability and transparency, monitoring the performance of key institutions and pressing for necessary reforms in a non-partisan manner. Monitoring Georgia's International Commitments 1 June May 2009 Funded by Irish Department of Foreign Affairs TI Georgia s on-going project Monitoring Georgia s International Commitments is funded by the Irish Department of Foreign Affairs. As the name would suggest, it aims to monitor, assess and evaluate international commitments Georgia has made, particularly those under the European Neighborhood Policy. Four specific sectors have been identified: (1) rule of law judiciary, law enforcement institutions, and criminal justice; (2) human rights and fundamental freedoms; (3) business climate and economic development; and (4) security and conflict resolution.

4 The project is less about international commitments per se and more about the government s commitment to and implementation of reforms. Reform, when initiated, is done so in an entirely adhoc manner and at the level of individual sectors, ignoring the importance of comprehensive and inclusive reform strategies. There is little input or oversight from the public or from experts who can accurately assess the work being done. In general, there has been a lack of information generated or circulated on the work of individual sectors, conflicting and inconsistent accounts of what changes are being made, and a general lack of understanding within the ministries themselves of what should be their medium- and long-term reform strategies. TI Georgia's project, by independently assessing the Government s activities in comparison with its international commitments, by increasing public access to information on reforms, and providing the international community with an independent assessment of the reform process, fills an important gap. It acts as an early warning mechanism, giving warning of corruption, and as a catalyst for continuous re-planning and revision of decisions and procedures. In a broader sense, it seeks to ensure the development of a consistent and long-term reform strategy. It aims to: - inform citizens about the available methods to combat the problem of corruption; - ensure the effective communication between citizens and state institutions responsible for dealing with those problems; - ascertain the sectors in which instances of corruption are most common; and - highlight and resolve the legislative and systemic weaknesses that foster corruption. A free hotline allows people to inform the ALAC about cases of corruption. Based on information generated and analyzed through TI ALAC database, it reveals: - The sectors, state institutions and regions in which corruption related complaints are the most common; and - The state institutions which respond to citizens complaints most rapidly and those that did so most belatedly (or not at all). ALAC will publicize this data periodically as part of its advocacy. Advocacy will be carried out to raise awareness about the sectors and institutions which are the subject of most complaints and in

6 highlighting attention to specific institutional and legal vulnerabilities. Good practice on the part of institutions will also be publicly recognized. As part of its work, ALAC will prepare legislative recommendations for the government and civil society. The basic strategy will be to use information from individual cases to identify problems at the system level. In cases where the government, or at least some parts of the government, is open to reform and genuinely interested in improving the situation, advocacy will take place directly through meetings and conversations. Where there is less openness the advocacy will be more public. If the cases will not be adequately resolved and/or the investigation will not be undertaken properly, ALAC may link clients with investigative journalists who are able to raise cases in the public eye in a way that would not be appropriate for TI. One strength of the ALAC s advocacy approach is that the issues will not be based only on the opinion of experts (let alone foreign experts) or of studies, the methodology of which can be challenged in order to divert attention from the findings. Rather, it will be a simple way of saying that these are the areas and issues about which citizens themselves are concerned. Within a month from ALAC's inauguration, it received almost 100 calls and visitors and opened 22 cases. 31% of hotline users were invited for preliminary consultation with ALAC legal staff. The project produced and disseminated three studies on international aid. The first study critically engaged with the issue of access to information on aid, drawing public attention to the difficulty of

8 obtaining even the most basic information on aid payments from many international donors. The study recommended that the Georgian Ministry of Finance publish all donor contributions to Georgia online, a suggestion that was subsequently adopted by the ministry. Targeted distribution of the study to aid campaigners in the US and Europe ensured that TI Georgia s findings on the ground directly fed back into debates about aid effectiveness on the global level. Promoting Understanding of the Energy Sector in Georgia 1 October October 2008 Funded by BP Georgia 8

9 TI Georgia s project Promoting Understanding of the Energy Sector in Georgia strove to increase public awareness of the energy sector in Georgia and to disseminate information throughout the country about the reforms carried out in this sector. In order to accomplish these goals, TI Georgia: 1. Conducted intensive trainings for journalists on the energy sector in Georgia to develop understanding of this complicated sector. In total 10 trainings were conducted; 2. Produced tri-annual newspaper inserts that included comprehensive articles on energy sector related issues for distribution throughout the country; and 3. Produced and disseminated monthly reports documenting (a) issues of concern in the energy sector, (b) the government s activities and achievement of intended results, (c) transparency of the sector, and (d) the effect of international energy developments on Georgia and Georgia s relations with energy supplier countries. Currently the energy sector is not well understood. There are two main reasons for this: (a) the Government is not proactive in providing information to the public about the energy sector and there are often conflicting messages about issues related to gas and electricity, and (b) the energy sector is a rather technical field, which is not easy to follow or understand for either ordinary citizens or journalists who are not specialists in this field. TI Georgia invited various experts in the energy sector to a series of trainings. TI Georgia s subsequent reports were prepared by an experienced researcher with strong analytical and writing skills and were distributed electronically in both Georgian and English to over 2,000 recipients in and outside Georgia and additionally through regular mail in Georgia. The reports and newspaper inserts were also disseminated to the Georgian public at large throughout all of Georgia's regions. Within the framework of the project and with the assistance of the analytical consulting agency PRIMETIME, which conducts targeted research on media and TV coverage, TI Georgia tracked the coverage of the energy sector, focusing on what information was being given to the public, what issues were most frequently reported on, and which regions were most frequently covered and given the most information. In addition, this information allowed TI Georgia to monitor the quantity of newspaper articles produced on the energy sector and determined whether or not this number increased throughout the project. The results of media and TV tracking were included in the newspaper inserts prepared in the framework of this project. In order to provide additional support and incentives to journalists to enable them to report on energy sector issues, TI Georgia awarded one journalist with a journalism award on a quarterly basis. Monitoring of Georgia s Implementation of OECD s Anti Corruption Network for Transitions Economies Recommendations April 2008 September 2008 Source of Funding: The Organization for Security and Co-operation in Europe (OSCE Mission to Georgia) The project aimed at ensuring implementation of the recommendations developed under the Anti- Corruption Action Plan by the Anti-Corruption Network for Transition Economies (ACN) a regional anti-corruption program of the Organization for Economic Co-operation and Development (OECD). To accomplish this, TI Georgia continued to monitor action taken by the government of Georgia to implement the ACN recommendations and present the respective findings to the OECD ACN and the Georgian public. This project included the following activities: 10

11 (1) Monitoring government institutions at the central and local level to track developments on important legislation and regulatory decisions that relate to the ACN recommendations; (2) Analyzing corruption cases at the local level in order to identify the most frequently occurring types of corruption in the regions, the sectors most vulnerable to corruption, the levels where corruption occurs, the regional distribution of corruption cases, and the root causes of corruption, and; (3) Preparing an independent, alternative report that will outline the main developments and opinions around the ACN targeted policy issues, including divergent views and recommendations. In addition, TI Georgia prepared an analysis of corruption at the local level. Voter Education and Election Observation Mission in Kvemo Kartli for the Parliamentary Elections in spring April May 2008 Funded by Swiss Agency for Development and Cooperation On May 2008 TI Georgia conducted a monitoring of the polling and counting procedures in the region of Kvemo Kartli. The organization deployed its monitors to 110 polling stations in the following five election districts: Marneuli, Gardabani, Bolnisi, Dmanisi, and Tsalka, thus covering 40% of the polling stations in the region with 51% of voters in those five districts. The monitoring targeted precincts with the highest numbers of registered voters in the respective districts and ones where the majority of registered voters were ethnic minorities. In 56 out of the 110 polling stations monitored by TI Georgia the monitors noted significant breaches of election legislation. The problems ranged from poor the qualifications of the Precinct Election Commission (PEC) members carouseling the voting, ballot stuffing, other duties. A total of 137 appeals have been compiled involving election violations in all 110 precincts. Among the most frequently observed violations were: Precinct Election Commission members agitating voters in the polling station in favor of the ruling party, voters marking ballot papers outside polling booths, voters being allowed to vote without presenting ID cards or upon presenting other persons ID cards, proxy voting, inconsistent application of inking, Precinct Election Commission members following voters into polling booths, voters entering polling booths in groups of two and more, the presence of unauthorized persons during polling and counting procedures, and the correcting of summary protocols. In addition to these problems, the electoral process was marred by the refusal of Precinct Election Commissions to register TI Georgia s and other election day monitors appeals. The monitoring included: (a) interviews with the leaders of various political parties participating in the elections, representatives of Georgian and international NGOs involved in election monitoring, and state institutions involved in election administration; (b) analyzing the allocation of state funds during the pre-election period based on official documentation; (c) analyzing political advertising and coverage of political candidates through selected media outlets; (d) analyzing election legislation and the decisions of the Central Election Commission; and (e) observing the preelection activities of the ruling party. The misuse of administrative resources has been cited as a problem in Georgia in every election since After the presidential election in January 2008, TI Georgia has made specific recommendations about how to reduce the use of administrative resources during election campaigns. Unfortunately, despite the need and the advocacy work done by both domestic and international organizations on this issue, the Election Code was not modified to limit the use of administrative resources in advance of the parliamentary elections. Rather, legislation has been made more liberal instead of more restrictive. Public officials were still allowed to engage in pre-election campaigning activities, with few exceptions indicated in the law, and election candidates were granted the right to use material-technical resources funded from the state and local budgets as long as these resources are equally accessible for all of them. During both of the elections TI Georgia produced interim and final reports, including separate media

Promoting Civil Society Monitoring of Secondary Healthcare Reform October May 2008 Source of Funding: Eurasia Partnership Foundation During October May 2008, Transparency International Georgia implemented the project Promoting Civil Society Monitoring of Secondary Healthcare Reform with funding from the Eurasia Partnership Foundation. The proposal was designed to follow on the heels of the government s initiation of hospital sector privatization and had two main objectives: promote the effectiveness of the healthcare system in Georgia and improve the capacity of civil society to monitor the reform of secondary healthcare in Georgia. Through the project, TI Georgia reviewed and monitored the implementation of select privatization agreements, trained journalists about the intricacies of secondary healthcare reform throughout the 15

17 TI Georgia s project "Informed Citizens and Accountable Government" strove to foster communication between majoritarian parliamentarians and their constituencies and promote public awareness of and input into the legislative process. To achieve these goals, TI Georgia, in cooperation with majoritarian MPs and their district office (bureau) representatives, conducted public meetings in three-month cycles in 57 districts in Georgia. At these meetings citizens received information about parliamentary developments over the last three months and its future plans. They also had the opportunity to inform their majoritarian MPs about their main concerns at the local level and share with him/her their opinions about Parliament s work. As part of the project, TI Georgia also assessed majoritarian bureaus and administrative barriers to their work and conducted trainings for bureau staff to increase their competence. In total, 188 public meetings were held, including 176 district and 12 regional meetings, with more than 5,000 participants in 57 districts within 9 regions in Georgia. These meetings were focused on the following laws: Tax Code, Privatization of State Owned Lands, Law on General Education, Law on Higher Education, Law on State Compensations and Academic Stipends, Law on Self Governance, Law on Local Budgets, Law on Local Elections, Law on Local Property, Election Code, Labor Code, Amendments to the Constitution, and the Venice Commission s Opinion on the Amendments. In addition, the following were discussed during the meetings: manipulation of voting on legislation, MPs responsibilities, voters rights, election procedures, parliament s oversight function, details of ongoing reforms among other issues. In addition to organizing public meetings throughout the districts, TI Georgia prepared and disseminated public awareness-raising materials throughout Georgia in the Georgian and Russian languages. The materials included: Citizen s Guidebook outlining the duties of MPs and the ways in which to communicate with them, a Voters Guide explaining voting procedures for the elections, a brochure on self-governance outlining the functions of local government bodies and citizens rights visà-vis the decision-making process at the local level, a brochure on pensions and compensation explaining the new regulations in these fields, a FAQs brochure on local election procedures, the selfgovernance system, the local budget, and local property which provided answers to the most frequently asked questions about these issues, leaflets on new traffic rules, a poster of nine important laws and MPs voting records on those laws, and a newspaper insert which included information on majoritarian MPs, such as their district and parliamentary activities, attendance during sessions, voting results, their financial and property disclosures during the last four years, transparency issues, a description of weaknesses in the legislation related to the work of majoritarian MPs, et al. During project implementation TI Georgia conducted four trainings on five different topics for 59 bureau staff members. Participants spent a total of 7 days at the trainings. The TI Georgia Office conducted the following activities to achieve these goals by: - Disseminating draft laws in advance and organizing public discussions about them. The Office was in constant communication with lawmakers, civil society organizations, interest groups and ordinary citizens both inside and outside Tbilisi. This ensured that interested parties could provide input on draft legislation through focus groups and roundtable discussions within the narrow timeframe for

20 deliberation set by the legislative system in Georgia. TIG then consolidated this feedback and provided the recommendations in a single, accessible dossier while parliament was still considering the draft. This rapid response enabled the media, parliamentarians and the public to lobby for changes that strengthen transparency and reduce opportunities for corruption. Within a two-year period seven biannual reports were distributed and, correspondingly, a total of 19 focus groups were conducted in different districts in which a total of 261 people participated. - Increasing parliament s communication skills and distributing publications describing parliament s work. TI Georgia built an active and intensive relationship with media and public relations services in parliament to ensure a maximum coverage of the comments and recommendations it had elicited. In order to improve parliament s PR skills, TI Georgia conducted trainings for the speaker s office, committees, factions, and majoritarian MPs offices. In a two-year period 14 trainings on five different topics were conducted for 95 parliamentary staff members. Participants spent a total of 12 days at the trainings. TI Georgia also assisted five parliamentary committees to prepare and publish bi-annual committee reports. The reports include information about committee members (e.g., party affiliation, attendance records, membership in different structures), the committee s functions and goals, and its activities and accomplishments (legal drafting, reforms in respective spheres, research, oversight activities, public relations, etc.). - Conducting a survey describing public opinion and expectations towards the parliament to further assist the Georgian parliament. - Informing the public about newly adopted laws through the dissemination of comprehensive brochures explaining new regulations. Other Activities and Events Corruption Perception Index 2008 On September 23, 2008, Berlin-based Transparency International, the global civil society organization leading the fight against corruption, published the results of the Corruption Perception Index (CPI) 2008 in which Georgia received 3.9 points (out of a total ten), ranking 67th among 180 countries. The CPI ranks countries in terms of the degree to which business people and country analysts--both residents and non-residents--perceive corruption to exist in the public and political sectors. Georgia s score this year is only a slight improvement over the score in 2007 (3.4). Since the Rose Revolution, Georgia s score has steadily risen, starting at 1.8 in While a score of 3.9 is an improvement, it still indicates that corruption is a significant problem in the public sector. The Corruption Perception Index (CPI) is based on results collated over the two preceding years in this case 2007 and This is to ensure that the index captures the longer term picture. As the 21

22 accompanying analysis states, Georgia s score is more a reflection of the results of reforms implemented in 2007 than of those in 2008 itself. If Georgia is to continue this positive trend and improve its ranking for the upcoming 2009 survey, it must take measures to solve the problems highlighted by Transparency International-Georgia when the CPI was published last year. These measures include: 1. Planning and implementing civil service reform more effectively in cooperation with stakeholders 2. Improving scrutiny of the financial and assets declarations of public officials 3. Implementing active preventive measures against corruption 4. Creating an improved and more transparent plea bargaining system 5. Raising the level of adherence to freedom of information regulation 6. Improving the system of public procurement 7. Ensuring more effective scrutiny of government spending 8. Reforming the judiciary to increase public confidence in the courts. Methodology The CPI is compiled by Transparency International Secretariat, combining results from several surveys by a variety of well-known international organizations to create a consolidated score for each country. This year, a total of seven surveys were used to calculate Georgia s score including: 1. The Bertelsmann Foundation s Bertelsmann Transformation Index (2008), which assesses the government s capacity to punish and contain corruption; 2. The World Bank s Country Policy and Institutional Assessment (2007), which covers corruption, conflicts of interest, the diversion of funds, and anti-corruption efforts and achievements; 3. Freedom House s Nations in Transit (2007), which measures the extent of corruption as practiced in governments, as perceived by the public and as reported in the media. It also covers the implementation of anticorruption initiatives; 4. Global Insight s Country Risk Ratings (2007), which measures the likelihood of encountering corrupt officials, both in the form of petty bureaucratic corruption and high-level political corruption; 5. Merchant International Group s Grey Area Dynamics (2007), which covers corruption, ranging from the bribery of government ministers to inducements paid to the humblest clerk. 6. The World Economic Forum s Global Competitiveness Report (2007), which measures the extent to which unofficial payments and bribes are prevalent in the way governments function. 7.
