KAHN, ESQUIRE PRO HAC VICE Pursuant to the United States District Court for the District of New Hampshire Rule 83.2, Benjamin Marcus, Esquire, hereby moves this Court for an order approving the admission pro hac vice of Brad M. Kahn, Esq. to appear before this Court in the above-captioned proceeding on behalf of Appellee Certain Unaffiliated Holders of Convertible Senior Notes. In support of this Motion, movant states as follows: 1. I am a member of the law firm of Drummond Woodsum, with offices located at 84 Marginal Way, Suite 600, Portland, ME and 1001 Elm Street, Suite 303, Manchester, NH Attorney Kahn is a member of the law firm of Akin Gump Struass Hauer & Feld, LLP, having an office at Bank of America Tower, One Bryant Park, New York, NY Attorney Kahn is admitted to practice law in the state courts of New York and the US District Court for Southern District of New York. Attorney Kahn is in good standing and eligible to practice in theses courts. See Exhibit A. 5. Attorney Kahn is not currently suspended or disbarred in any jurisdiction. See Exhibit A. 6. Attorney Kahn has not been subject to any prior denials or revocations of pro hac vice status in any court. See Exhibit A. 7. During Attorney Kahn s representation of Certain Unaffiliated Holders of Convertible Senior Notes in this proceeding, Attorney Kahn at all times shall associate with the undersigned or another member of the bar of this Court, upon whom all process, notices and other papers may be served, who shall sign all papers with this Court, and whose attendance at any proceeding may be required by the Court. 8. By this Motion, the undersigned moves for the admission pro hac vice of Brad M. Kahn, Esquire, so that he may appear before this Court in all matters related to this proceeding. WHEREFORE, Benjamin Marcus, Esq. respectfully requests that this Court enter an Order, in the form attached hereto: (1 Approving the admission pro hac vice of Brad M.
