PARTICIPATION IN THIS SWEEPSTAKES IS VOID WHERE PROHIBITED. 1. SPONSORSHIP: This Sweepstakes contest is sponsored by San Manuel Casino("Sponsor"), an economic development project of the San Manuel Band of Mission Indians, a federally recognized Indian tribe ("Tribe"). You understand and agree as a condition of your eligibility to participate that all activities in connection with this Sweepstakes contest are and will be taking place on the Tribe's Indian lands in Highland, California. 2. ELIGIBILITY: This Sweepstakes contest is only open to individuals who, at the time of entry, are residents of the State of California and are 21 years of age or older, who qualify and enroll in the Sweepstakes under these Rules. By such enrollment, you acknowledge and agree to its terms. Officers or employees of Sponsor or of the Tribe or of their affiliates, members, subsidiaries, franchisees, vendors, and advertising or promotion agencies are not eligible, nor are members of those individuals families (defined as parents, children, siblings, spouse, and life partners). If you are on any ban or self-exclusion list of any casino or other gaming project operated by or affiliated with Sponsor or the Tribe you are also ineligible. Proof of your residency and age will be required with a valid photo ID. Regardless of your eligibility, this Sweepstakes contest is void where prohibited by law. Only one entry per Club Serrano Member is permitted. Should multiple entries from the same Club Serrano Member be submitted, only the first entry received will be eligible and all others will be disqualified. Sponsor shall have no responsibility to determine or ensure that only one entry has been submitted. 3. ENROLLMENT PERIOD: Enrollment in the Sweepstakes begins at 12:00pm PST on September 5, 2018 and ends at 11:59pm PST on September 16, 2018 (the "Enrollment Period"). No extensions, either express or implied, will be granted. All entries must be received during the Enrollment Period at the location and by the time indicated in these Rules. Proof of mailing or other form of delivery will not be deemed to be proof of receipt. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. Any entry forms submitted through the use of robotic, automatic, programmed or similar repetitive methods will be disqualified. 1

AGREEMENT TO OFFICIAL RULES: By enrolling in this Sweepstakes contest, you agree to be bound by these Rules, including but not limited to the Contest Rules set forth below, and to the decisions of Sponsor, which shall be final. All federal, state, and local laws apply. Neither Sponsor, the Tribe, nor their affiliates, subsidiaries, governmental agencies, advertising, promotion, or legal advisors, or their employees, officers, directors, shareholders, agents, members, and representatives, are responsible, or shall be liable, for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties; (iii) errors in any transmission related to the Sweepstakes; (iv) any condition caused by events beyond the control of Sponsor or Tribe that may cause the contest to be disrupted or corrupted; (v) any injuries, losses, damages of any kind caused by a prize resulting from the acceptance, possession, or use of a prize, or from participation in the contest; or (vi) any printing or typographical errors in any materials associated with the contest. 5. CONTEST RULES: The Sweepstakes contest will be operated in accordance with the following Contest Rules and will take place following the close of the Enrollment Period: a. Participants must follow the link provided and enter their info (name, & phone number) to win two (2) tickets to the show and meet and greet for Warrant, hosted by Woobox. Contest begins on September 5, 2018 at 12pm PST and ends September 16, 2018 at 11:59pm PST. Only one Winner for the sweepstakes. Winner receives two (2) tickets to Warrant show and Meet and Greet with Warrant on September 21, 2018, (Inside Rock & Brews San Manuel at the 8p or 10p show), a $25 slot play voucher and a $25 food voucher for Rock & Brews San Manuel. Approximate value $100. Participants must be on Facebook and be at least 21 years of age and possess a valid ID and Club Serrano card. Patrons can qualify by answering the trivia question correctly, hosted by Woobox. Facebook profile MUST BE public. Patrons can only participate once per contest per Club Serrano member. Winner announced September 17, Winner will be randomly chosen through Woobox from all eligible entries received that have fulfilled any further actions required to qualify as a Winner. Winners will be contacted through . There they will provide their Club Serrano card # and contact info. Patrons will have 24 hours to respond to the initial . After the winner is confirmed, they will have until 12p on September 21, 2018 to claim their prize. Winner must pickup their tickets at the San Manuel Box Office located inside the casino. b. Winners will be determined in accordance with the Contest Rules. Sponsor s decisions as to all matters related to administration of the Sweepstakes Contest, including but not limited to the determination of any winners, shall be final and not subject to an appeal. 2

Delivery of any prize to a Winner is contingent upon, among other things, the Winner s compliance with and agreement to the Official Rules, including the fulfillment of any further actions that may be required under the Official Rules. d. If a Winner has been identified but cannot be contacted on the first attempt using the contact information provided in the Enrollment Application, or if after being contacted the Winner does not respond within 24 hours of initial contact, an alternate entrant will be selected in his or her place at random from all eligible entries received that have fulfilled any further actions required to qualify as a Winner. The process of delivering prize(s) to Winners will be continued until all prizes have been distributed. e. Except where otherwise noted in the Official Rules, the selection of all contests, vendors, prizes, products, and services associated with the Sweepstakes is subject to the Sponsor s sole and absolute discretion. Prizes (and/or any portion thereof) are nontransferable and non-exchangeable. No substitutions or cash redemption of prizes are permitted, except that Sponsor retains the right to substitute a prize of equal or greater value including at Sponsor s election, the cash value of the applicable prize. Additional restrictions may apply. 6. WAIVER OF LIABILITY; TAXES AND OTHER COSTS; NO WARRANTIES: All Federal, State and local taxes related to the prize are the sole responsibility of the Winner. All other expenses and costs not expressly listed above are Winner s sole responsibility. No refunds or credit for changes are allowed. No transfer of the prize is permitted. Noncompliance may result in disqualification, and an alternate Winner may be selected. Sponsor, the Tribe and other released parties associated therein in these Rules (the Released Parties ) make no warranties and hereby disclaim any and all warranties, expressed or implied, concerning any prize awarded, or any advertisement, statement, promotion, conduct or any other aspect whatsoever in connection with the Sweepstakes or any contest associated with it. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE PRIZE IS PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, AND THE RELEASED PARTIES HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON- INFRINGEMENT. 7. PERMISSIONS: Except where prohibited by law, in the event you become a Winner you grant to Sponsor and its advertising agencies the irrevocable permission and right to use, reproduce and publish your photo, name, likeness, voice, and statements related to the Sweepstakes 3

4 or Sponsor (whether written or recorded in any medium), biographical information, worldwide and in any media or form, whether now known or hereafter created, for any purpose related to advertising or promoting Sponsor, the Tribe or the Sweepstake, without further compensation. You may also be required by Sponsor, and agree hereby to comply with such request, to execute and deliver to Sponsor a written publicity release and consent agreement regarding the subject of such release and consent, a declaration of eligibility, and other consents, as permitted by law, as a condition of receiving a prize. The failure to comply with such requirement or request may result in a forfeiture or invalidation of the prize. 8. USE OF DATA: Sponsor will be collecting personal data about you and other participants (including, without limitation, name, phone number, mailing address, gender, age, addresses) when you or they enter the Sweepstakes contest. Sponsor is entitled to use personal data contained in all entries, on-line or otherwise, in accordance with the Sponsor s privacy policy. By participating in the Sweepstakes contest, entrants hereby agree to all personal information uses and disclaimers as explained in Sponsor s Privacy Policy at 9. MODIFICATION OR CANCELLATION OF SWEEPSTAKES EVENTS: Sponsor reserves the right to cancel or modify any Sweepstakes contest for any reason in its sole discretion and without notice to you or any other participant and your or their approval. 10. TAMPERING, FRAUD OR TECHNICAL DIFFICULTIES: If, in Sponsor s opinion, there is any suspected or actual evidence of electronic or nonelectronic tampering or fraud in connection with any portion of the Sweepstakes contest, or if technical difficulties compromise the integrity of the Sweepstakes contest, Sponsor reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers or otherwise interferes with the entry process), and to cancel, terminate, modify or suspend the Sweepstakes contest, in whole or in part, at any time without notice. In the event of such cancellation, Sponsor reserves the right to award prizes in a random drawing from all eligible entries received before the time of cancellation. 4

5 11. LEGAL ACTS AND APPLICANTS ONLY: Sponsor in no way promotes illegal acts, and any and all entries which include or promote illegal acts will be disqualified. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alteration of entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any or entry received by Sponsor on account of technical problems or traffic congestion on the Internet or at any website, any combination thereof, or otherwise, including any injury or damage to entrant s or any other person s computer related to or resulting from participation or downloading any materials in the Sweepstakes contest. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES CONTEST MAY BE IN VIOLATION OF APPLICABLE LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY THE LAW. 12. ADDITIONAL INFORMATION AND QUESTIONS; CLAIMS: All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of any participant, Sponsor or the Released Parties in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the Tribe or, if none exist that would apply, to the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions which would cause the application or the laws of any jurisdiction other than the Tribe or the State of California. As a mandatory prerequisite to the assertion of any claim of any kind concerning the Sweepstakes, its contests, these Rules, the agreements contained herein, or any other matters arising therefrom, any such claim shall be made in writing to the Sponsor within 60 (sixty) days from the date the claim or matter first arose, or such claim shall be deemed void and invalid as a matter of law. If the claim cannot be resolved within 60 days of receipt by the Sponsor, the claimant shall have 60 days from the date of receipt to pursue the claim in the San Manuel Tribal Court unless extended in writing by mutual agreement. All claims shall be limited to a maximum of $600 the maximum amount that could have been won in any Sweepstakes contest that may be the subject of the dispute, or claimant's actual out of pocket expenses, whichever is less. By making the claim or enrolling in the Sweepstakes, you consent to the exclusive jurisdiction and venue of the San Manuel Tribal Court for any such claims asserted by you and waive any defenses to such jurisdiction or venue. The San Manuel Tribal Court 5

6 shall be the exclusive forum for hearing all of such claims unless Sponsor and the claimant expressly and voluntarily agree otherwise in writing. Your enrollment in the Sweepstakes or the filing of such a claim will constitute your agreement to waive any other remedies or forums with respect to your claim. If, notwithstanding the foregoing, a court other than the San Manuel Tribal Court, or an arbitrator who is not acting as part of the San Manuel Tribal Court system purports to assert jurisdiction over such claim, you agree to waive any further proceedings in such forum or the right to object to any motion to remove such action to the San Manuel Tribal Court as the exclusive forum to hear such claim, and to consent to removal of the action to the San Manuel Tribal Court. Any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action. Each Entrant agrees to service of process by mail or other method acceptable under the laws of the State of California. SUBJECT TO THE MAXIMUM AMOUNTS DESCRIBED ABOVE, ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. Nothing herein shall be interpreted as a waiver of sovereign immunity by the San Manuel Band of Mission Indians or the San Manuel Indian Bingo & Casino.
