2 NOTICE OF SALE BY BID The Brownsville Navigation District (Port of Brownsville) offers for sale by bid the various items which have been declared as surplus or salvage to the District. Items include a large quantity of office furniture, some heavy equipment, one snack vending machine, one safe and one boat/motor/trailer. Inspection of these items will be held on Friday, September 14, 2018, from 3:00 pm to 6:00 pm. and Saturday, September 15, 2018, from 10:00 am to 2:00 pm. at the District s Facilities Maintenance Office located at 5100 R. L. Ostos Road at the Port of Brownsville. Governmental ID will be required for entrance to the Port. Further questions may be directed to the Director of Administrative Services, Deborah Lee Duke, at (956) These items are sold with no warranty or other representations as to fitness for purpose. Bids must be received at the Brownsville Navigation District Administration Building at 1000 Foust Road, Brownsville, TX no later than 3:00 pm on Tuesday, September 18, Bids must be submitted on the official bid form, available from the Director of Administrative Services, Deborah Lee Duke. Awards are anticipated to be made on Thursday, September 20, Terms must be completely fulfilled, and all purchased items must be claimed by 2:00 pm Saturday, September 22, 2018, and sales are final. A full bid packet is available on the Port of Brownsville web site under the Business with the Port/Procurement page. The Brownsville Navigation District reserves the right to reject any and all bids if it is in the best interest of the District to do so. 3 SECTION I GENERAL INFORMATION AND INSTRUCTIONS NOTICE Information provided in this packet is to be used for purposes of participating in the sale by sealed bid of surplus or salvage items from the Brownsville Navigation District. It is further expected that each bidder will read these specifications with care since the successful bidders in the sale will be subject to the provisions contained in this material. The Brownsville Navigation District (hereafter referred to as the District) reserves the right to reject any and all bids. The District may cancel this sale at any time prior to the acceptance of a bid by the District. STATEMENT OF PURPOSE 1. The information contained in these specifications is to be used only in connection with the sale of surplus or salvage items. 2. The sale will be individual items or lots of items; the District will not accept a single bid on the entire offering. 3. For the purpose of convenience in the sale, there may be items that have been combined into a lot for which a single bid will be accepted. These lots are considered to be one individual item for the purposes of this sale and are sold as one unit and lots may not be broken. 4. The District reserves the right to accept or reject any or all bids, waive minor technicalities, and award the bid to best serve the interests of the District. The District also reserves the right to waive or dispense with any of the formalities contained herein. 5. The information contained herein is believed to be accurate and up-to date but is not intended to be an express or implied warranty. 6. Items in this catalog are subject to withdrawal from the sale at any time. TIMETABLE 1. This packet will be released for action on or about Monday, September 10, Pre-bid inspection of the items will be held on Friday, September 14, 2018 between 3:00 PM and 6:00 PM and Saturday, September 15, 2018 between 10:00 AM and 2:00 PM at Brownsville Navigation District Facilities Maintenance Office at 5100 R. 4 NO WARRANTY PROVIDED These items have been declared as surplus or salvage to the Brownsville Navigation District, and as such are sold with no warranty or other representations as to fitness for purpose. INTERPRETATION OF MATERIALS If any person contemplating participating in the sale by sealed bid is in doubt as to the true meaning of any part of these materials, they may submit to Deborah Lee Duke, Director of Administrative Services, a written request for interpretation thereof. COMPLIANCE WITH LAWS All bidders involved shall observe and comply with all regulations, laws, ordinances, etc., of local, state and federal governments as they apply to this bidding process. UNIT PRICING Bids must be identified as to the bid for each individual item as presented on the bid sheet. Single bids for multiple items will not be accepted. One bid sheet may include bids for more than one individual item. The bid for each item will be considered and awarded individually. DISQUALIFICATION AND REJECTION OF BIDS Failure to comply with the requirements or the procedures set forth herein, or to satisfy the criteria as set forth in this packet may result in disqualification. It is not intended that exceptions to the specifications will, in and of themselves, result in disqualification. TRANSFER OF BILL OF SALE The bidder whose bid is accepted by the Salvage Auction Team must submit their bid amount no later than 2:00 PM. on Saturday, September 22, Award of the bid authorizes the issuance of the Bill of Sale for the items. 32 INDEMNITY AND HOLD HARMLESS AGREEMENT The undersigned has agreed to purchase and/or remove abandoned, unclaimed, salvaged or scrap material, equipment, or debris from the premises of the Brownsville Navigation District (District). In consideration of the District s allowing the undersigned to enter District premises to purchase and/or remove such property, the undersigned acknowledges the following: 1. The District makes no warranty, express or implied, about the quality or condition of any property or materials purchased or removed. The undersigned takes such materials AS IS WHERE IS with any and all latent and patent defects. The District is not a merchant of such material. This type of material is notoriously unreliable. The District expressly disclaims, and the undersigned expressly waives, all warranties, express and implied, with regard to such material, including implied warranties of fitness for a particular purpose or other warranty created by the Texas Uniform Commercial Code. 2. The handling of salvaged or scrap material can be dangerous. The undersigned, for himself and all persons in privity with him, expressly waives any claims for personal injury or property damage arising out of such materials, its removal, or use, even if such claims are based in whole or in part on the negligence of the District. The undersigned further agrees to indemnify and hold harmless the District against any such claims, even if caused in whole or in part on the negligence of the District. 3. The undersigned has decided to purchase or remove the above-described material solely on the basis of his own examination of the material. In no way has he relied on any representation, statement, or assertion made to him by the District regarding such material or its condition. 4.
