1 Guidance for Annual Notification of barristers registered under rs15 of the Scope of Practice Rules in the BSB Handbook (previously known as Rule 206 of the Code of Conduct 8 th Edn.) About the form This form must be completed to notify us of your intention to hold yourself out as a barrister in connection with the supply of legal services under rs15 of the Scope of Practice Rules in the BSB Handbook (previously known as Rule 206 of the Code of Conduct 8 th Edn.) for 2014/15. How notifications are dealt with Notifications are received by the Records Department who will process your notification and confirm that you are permitted to hold yourself out as a barrister under rs15 of the Scope of Practice Rules in the BSB Handbook, or contact you if further clarification is required. Notifications will be processed within seven working days. The deadline for annual notification is Monday 31 March Barristers who have not confirmed notification by the 1 April 2014 will no longer be entitled to hold themselves out as a barrister in connection with the supply of legal services under rs15. 3 Ethical Enquiries Service If you are unsure whether you are able to hold yourself out as a barrister in connection with the supply of legal services under rs15 of the Scope of Practice Rules in the BSB Handbook, please contact the Ethical Enquiries Service on: Ethics@BarCouncil.org.uk The Ethics Enquiries Service provides guidance on the Code of Conduct in the BSB Handbook. Frequent Asked Questions I don t understand the changes in relation to rs15 of the Scope of Practice Rules in the BSB Handbook, where can I find out further information? Please refer to our frequently asked questions which explains the changes and the new processes which have been introduced. What should I do if I no longer wish to hold myself out as a barrister in connection with the supply of legal services under rs15 of the Scope of Practice Rules in the BSB Handbook? Please notify the Records Department by completing the unregistered barristers form. If you do not return this notification form, from the 1 April 2014 your record will be automatically amended to show that you are not entitled to hold yourself out as a barrister in connection with the supply of legal services. If I fail to renew my notification by the 1 April 2014, what happens? You will no longer be able to be hold yourself out as a barrister in connection with the supply of legal services under rs15 of the Scope of Practice Rules in the BSB Handbook now or at any point in the future and your record will be amended accordingly. What should I do if I am unsure whether it is appropriate for me to notify of an intention to hold myself out as a barrister in connection with the supply of legal services under rs15? 5 What do I do if I have changed my name? To change your name on our records, you must firstly notify your Inn of Court by sending a certified copy of a deed poll or certified photocopy of your marriage certificate. Once your Inn of Court has amended their records, please inform the Records Department. Section 1: Your personal details Membership number Every barrister has a unique individual member number; please enter these details if you know your membership number. Section 2: Professional details Please provide full contact details of the place from which you will be supplying legal services. Are you an employee, manager of, or do you have an ownership interest in, an authorised body? An authorised body is a body that has been authorised by an approved regulator. Please provide details of the approved regulator, if appropriate. Section 3: Declaration The declaration must be completed in all cases and for all notifications. Knowingly or recklessly giving the Bar Council information which is false or misleading, or failure to inform the Bar Council of materially significant information of which you are aware, may lead to disciplinary action being taken against you. 5
