1 WEBSITE CASE LIST JMP 1. People v. AC : Charges Assault 3 rd As a result of Motion s filed by defense counsel the Judge DISMISSED both Counts of Assault 3rd Degree. 2. People v SO: Charged DWI Result defense counsel argued to Town Court Justice that the arrest of the defendant was illegal. The Town Court Justice refused to grant defense counsel motion for dismissal, defense counsel appealed to County Court and the Appeal was granted DISMISSING all Counts. 3. People v. RH Charges CPS 5 th DISMISSAL, Judge dismissed all Counts depending against Defendant as result of a Speedy Trial Motion filed by defense counsel. 4. People v. JR Criminal Contempt 1 st DISMISSED. Based on defense counsel motion that the evidence presented to the Grand Jury was Insufficient the Court granted a full dismissal of all charges. 5. USA v. CF Theft of Government Property DISMISSED. Defense counsel convinced the United States Attorney s Office to dismiss all charges against the defendant. 6. People v. JR Criminal Contempt 1 st NOT GUILTY after Bench Trial 7. People v. DG Four (4) Separate Indictments Criminal Contempt 1 st NOT GUILTY. After four (4) separate Bench Trials defendant is found Not Guilty of all charges at each of the four (4) trials 1
2 8. People v. EM DWI (.14BAC) REDUCTION TO VIOLATION. After a non jury trial defendant is found Not Guilty of DWI and convicted only of Traffic Violation. 9. People v. CP DWI (.17 BAC) NOT GUILTY of DWI. After a nonjury trial the defendant was found Not Guilty of DWI and only convicted of a Traffic Violation. 10. People v. MT Robbery 1 st DISMISSAL. After the District Attorney s Office presented all evidence to the jury the Judge agreed with defense counsel and dismissing all charges based on the lack of credible evidence due to the significant cross examination by defense counsel. 11. People v. CN DWI NOT GUILTY of DWI. After non Jury trial the defendant was found not guilty of DWI and only 12. convicted of Traffic Violations. 13. People v. ER DWI NOT GUILTY of DWI. After non Jury trial the defendant was found not guilty of DWI and only convicted of Traffic Violations. 14. People v. AC DWI NOT GUILTY. After non jury trial the defendant was found not guilty all charges in connection with the DWI. 15. People v. ML Criminal Possession of REDUCTION TO MISDEMEANOR. Based Marijuana on a search warrant defendant was found to be in possession of 15 lbs. of marijuana along with a significant marijuana growing operation in his home. Based on defense counsels 2
3 investigation and research he convinced the District attorney s Office to allow the defendant to plea to a Misdemeanor with only a 200 hour community service sentence. 16. People v. DS Course of Sexual Conduct MISTRIAL. Defendant was charged against a child in the 1 St with a Class B violent felony. During the trial defense counsel made a Motion for Mistrial that was granted by the Court. Defendant was allowed to pled to a Misdemeanor in full satisfaction of the Felony. 17. People v. CH Assault in the 1 st Degree NOT GUILTY. Defendant shot an unarmed individual during a fight over a traffic incident. After two week jury trial, after significant cross examination by defense counsel of the victim and eye witnesses, the jury returned a Not Guilty verdict on all charges. 18. People v. AC Assault 2 nd DISMISSAL of all charges. Based on evidence presented to the Grand Jury, it refused to charge the defendant in connection with a shooting incident. 19. People v. PS Assault in the 2 nd Degree NOT GUILTY. After Motion practice by defense counsel convinced the Judge to reduce the felony Assault 3 rd charge to a misdemeanor to Felony Assault 2 nd to a Misdemeanor Assault 3 rd charge defense counsel conducted a jury trial winning an NOT GUILTY verdict. 20. People v. TW Dog Fighting NOT GUILTY. After a two (2) day 3
4 Non jury trial the defendant was found NOT GUILTY of all charges in connection with his ownership of three (3) ( Pit Bulls ) 21. People v. SB Assault in the 2 nd Degree NOT GUILTY after a one week jury Trial the defendant, who had hit a police officer with a pool stick, was Found not guilty, based on self defense of another after it was determined on defense counsels cross examination of the police officers that one of the police officers had wrongfully assaulted the mother of the defendant. 22. People v. ML Assault in the 3 rd Degree DISMISSED. Upon motions filed by defense counsel the Judge dismissed all Counts against the defendant. 23. People v. ML Burglary in the 2 nd Degree DISMISSED. Based on defense counsel s investigation and presentation of evidence to the District Attorney s Office all charges against the defendant were dismissed. 24. People v. AB Drug Conspiracy DISMISSED. Based on significant Motions filed by defense counsel Relating to the wiretap and search warrant conducted against the defendant the Judge dismissed all Counts against the defendant. All other defendants in the drug conspiracy had previous plead to 4
5 Criminal charges and done jail time. As a result of defense counsel s work the defendant walked away from the case with no conviction. 25. People v. RA Criminal Possession of DISMISSED. Based on defense Weapon in the 2 nd Degree counsels cross examination of the police officer during the Probable Cause Hearing the Judge agreed with defense counsel and dismissed all charges against the defendant. 26. People v. RZ DWI DISMISSED. Defense counsel s Motion for Failure to Timely Try the Defendant all charges were dismissed. 27. People v. AC Criminal Possession of DISMISSED. On the eve of trial a Weapon in the 2 nd Degree defense counsel convinced the District Attorney s Office to dismiss all charges against the defendant. 28. People v. SH Criminal Possession of DISMISSED. A Weapon in the 2 nd Degree 29. People v. RF Murder in the 2 nd Degree NOT GUILTY. At a conclusion of a non jury trial the defendant was found not guilty of all charges based on self defense. 30. People v. WG DWI (.29 BAC) NOT GUILTY of DWI. After a nonjury trial. Defense counsel won the Suppression of the Breath Test resulting in a not guilty verdict on the DWI with the defendant only being convicted of traffic violations. 31. People v. AS Dog Fighting REDUCTION TO MISDEMEANOR. Defendant was Charge with 13 Dog fighting felonies and during the course to of a jury trial convinced the District 5
6 Attorney s Office based on the lack of evidence to dismiss all felonies and allowing the defendant to plea to one misdemeanor. 32. People v. MM DWI DISMISSED. 33. People v. JB Sex Abuse NOT GUILTY. After a weeklong jury trial the defendant was found not guilty of all charges. 34. USA v. LA Perjury NOT GUILTY. After a non jury trial The Federal District Court found the Defendant not guilty of lying to Grand Jury. 35. People v. MH Murder in the 2 nd Degree DISMISSAL. Based on defense Counsel s motion suppression of the blood drawn from the victim for lack of chain of custody all charges against the defendant, who was alleged to have injected his wife with a fatal dose of morphine, were dismissed. 36. People v. MN Murder in the 2 nd Degree NOT GUILTY. After two (2) hung jury s defendant was found not guilty of murdering his love interest husband. 37. People v. MR Rape NOT GUILTY. After a jury trial the defendant was cleared of all wrong doing in connection with a sexual encounter. 38. USA v. LS Conspiracy and NOT GUILTY. Bank Larceny 39. USA v. JT RICO NOT GUILT. After significant jury 6
7 Trial the defendant was found not guilty of a Racketeering Conspiracy. 40. People v. LS Criminal Possession of NOT GUILTY. Weapon in the 2 nd Degree 41. People v. PW Conspiracy and Mail NOT GUILTY. After a long jury Truck Robbery trial and defense counsel cross Examination of main prosecution witnesses the jury returned a not guilty verdict all Counts of against the defendant. 42. USA v. DD Witness Tampering DISMISSAL. After the prosecutions Presented all evidence to a jury, defense counsel convinced the federal judge to dismiss all Counts against the defendant as the prosecution s case lacked credible evidence. 43. USA v. SL Money Laundering DISMISSED on defense counsel s Motion the Federal District Court Judge dismissed all Counts charging an attorney with laundering money for clients. 44. USA v. SH Federal Civil Rights NOT GUILTY. As lead counsel Violation in a high profile case against five (5) police officers defense counsel earned not guilty pleas for all defendants. 45. People v. MB DWI NOT GUILTY. After a weeklong Jury trial the defendant was cleared of all charges in connection with his DWI Arrest. 46. USA v. JT Mail Fraud DISMISSED. Based on defense 7

Defendant was charged with murder based on a large gang fight at Lancaster Speedway. Based on the significant cross examination of defense counsel the defendants were cleared of all charges. 48. People v. GL Arson DISMISSED. After hearings and based on defense counsels motion all charges against the defendant were dismissed. 49. People v. MB Sex Abuse in the 1 st Degree NOT GUILTY. Based upon defense Counsel skilled cross examination of the victim the defendant was found not guilty of all charges. 50. People v. MV Sodomy NOT GUILTY. Defendant was Found not guilty of a jury trial 51. People v. ML DWI NOT GUILTY of DWI. After a Jury trial the defendant was found not guilty of DWI and only convicted of traffic violations. 52. People v. FA Rape in the 1 st Degree; NOT GUILTY. After a Sodomy; Sexual Abuse in significant jury trial defense the 1 st Degree counsel s examination of the victim lead to the acquittal of the defendant of all charges. 53. People v. RT DWI DISMISSL. After the prosecution Presented all evidence and based on the cross examination of defense Counsel all charges against the defendant were dismissed. 8
