1 "INSECTS ONLY (Option I) Bill No By-law No. PS.- A by-law to regulate the cosmetic use of pesticides (including insecticides, herbicides and fungicides) in the City of London. Definitions In this by-law, "Apply" or "Application" in relation to a pesticide means the spraying, depositing, or administering in any manner on private or municipal lands of a pesticide for the'purposes of the control of pests on or to regulate the growth of turf, outdoor trees, shrubs, and flowers.

2 "Enclosed" means closed in by a roof or ceiling and walls with an appropriate opening or openings for ingress or egress, which openings are equipped with doors which are kept closed except when actually in use for egress or ingress. "Farmer" means a commercial food or fibre producer or horticulturist. "Health hazard" means a hazard which has or is likely to have an adverse effect on the health of any person, and which is declared by the Medical Officer of Health of the Middiesex-London Health-Unit or his or her designate. "Infestation" means the presence of insect pests in numbers or under conditions which involve an immediate or potential risk of substantial damage to property. "Pest" means an animal, a plant or other organism that is injurious, noxious or troublesome, whether directly or indirectly, and an injurious, noxious or troublesome condition or organic function of an animal, a plant or other organism. 4 @ SCHEDULE " A The following pesticides and products are exempt from this by-law: soap; mineral oil (also called dormant or horticultural oil); silicon dioxide (also called diatomaceous earth); Bt (Bacillus thuringiensis); nematodes and other biological control organisms; Borax (also called boric acid or boracic acid); Ferric phosphate; Acetic acid; Pyrethrum or pyrethrins; Fatty acids; Sulphur; Corn gluten meal; Any other substances approved through the Board for Organic Agriculture.

5 SCHEDULE "B" / Every person applying or causing or permitting the application of pesticides under subsections 2(2)(e), 2(2)(f), 2(3), 2(4), 2(5), or 2(6), shall comply with the requirements for application as follows: (i) at the time and place of the discharge of the pesticide, ensure that the wind velocity does not exceed I O km / hour, or lower velocity if set out in the pesticide application instructions; (ii) at the time and place of the discharge of the pesticide, ensure that the ambient temperature does not exceed 25 degrees Celsius, or lower maximum temperature if set out in the pesticide application instructions; (iii) at the time and place of the discharge of the pesticide, ensure that there is no smog advisory in effect as issued by the Ontario Ministry of the Environment; and (iv) at the time and place of the discharge of the raining, unless the pesticide application instructions direct otherwi

11 Chapter 612 PESTICIDES, USE OF Definitions Restrictions Offences. [HISTORY: Adopted by the Council of the City of Toronto by By-law No ' Amendments noted where applicable.] Property standards - See Ch GENERAL REF!ZRENCES Definitions. As used in this chapter, the following terms shall have the meanings indicated ENCLOSED- Closed in by a roof or ceiling and walls with an appropriate opening or openings for ingress or egress, which openings are equipped with doors which are kept closed except when actually in use for egress or ingress. HEALTH HAZARD - A pest which has or is likely to have an adverse effect on the health of any person. INFESTATION - The presence of pests in numbers or under conditions which involve an immediate or potential risk of substantial loss or damage. PEST- An animal, a plant or other organism that is injurious, noxious or troublesome, whether directly or indirectly, and an injurious, noxious or troublesome condition or organic function of an animal, a plant or other organism. PESTICIDE -Includes: A. A product, an organism or a substance that is a registered control product under the federal Pest Control Products Act which is used as a means for directly or indirectly controlling, destroying, attracting or repelling a pest or for mitigating or preventing its injurious, noxious or troublesome effects. The provision set out in Subsection A does not apply when pesticides are used (1) To disinfect swimming pools, whirlpools, spas or wading pools; (2) To purify water intended for the use of humans or animals; (3) Within an enclosed building; (4) To control termites; (5) To control or destroy a health hazard; (6) To control or destroy pests which have caused infestation to property; (7) To exterminate or repel rodents; (8) As a wood preservative; ~ - 16

14 EXTRACT of the Minutes of a regular meeting of the Council of the Town of Hudson held at St. Mary's Parish Hall on May 6th, 1991 at which the following was adopted: BY-LAW NO 270 CONCERNING PESTICIDES WHEREAS Notice of Motion was duly given at the February4th, 1991 Council meeting; THEREFORE it is moved by Councillor Chris Wilkin and seconded by Councillor George White and thereafter it is moved by Councillor Pierre Frappier and seconded by Councillor Chris Wiikin that the following By-Law bearing No. 270 be and is hereby adopted and decreed as follows: Bv-Law No 327 -Amendment to bv-law no 270 concernina Desticides: (adopiedon June P, 1995) WHEREAS an objective of the Town of Hudson is the reduction and eventual elimination of the use of pesticides; WHEREAS the Town of Hudson adopted on May 6th, 1991 By-Law No 270 concerning Pesticides; WHEREAS article 5 of this By-Law was valid for a period not exceeding 5 years, that is until May 6th, 1996; WHEREAS the Whitiock Golf 8, Country Club presented to Council, at the April 13th, 1995 meeting a report of their activities concerning the use of pesticides from 1989 to 1994; WHEREAS this report indicates that the use of pesticides decreased over this period; WHEREAS an amendment to this By-Law is required since article 5 is valid only until May 6th, 1996; WHEREAS Notice of Motion was duly given at the May Ist, 1995 Council meeting; THEREFORE it is moved by Councillor Huddy Walsh, seconded by Councillor Marie Madeleine Doty that the following By-Law bearing No 327 being an amendment to By-Law No 270 be and is hereby adopted and decreed as foliows: By-Law No 341 -Amendment to bv-law no 270 concerning Desticides: (adoptedonaprii.@, 1996) WHEREAS the Town experienced a serious infestation of chinch bugs in 1995; WHEREAS the present regulation concerning the use of pesticides does not permit the use of any products in the case of such infestations; WHEREAS many complaints were received from citizens in general and also homeowners who experienced the problem concerning the lack of remedy; WHEREAS the Environment Committee has examined the situation and has recommended an amendment to Council; WHEREAS Notice of Motion was duly given at the regular meeting held on March 4th, 1996; THEREFORE, it is moved by Councillor Gordon H. Drewett, seconded by Councillor Albert Pilon and unanimously resolved that By-Law No 341, be and is hereby adopted and decreed as follows: 1. The following words and expressions, whenever the same occur in this By-Law, shall have the following meaning: a) "PESTICIDES: means any substance, matter or micro-organism intended to control, destroy,

15 reduce, attract or repel, directly or indirectly, an organism which is noxious, harmful or annoying for a human being, fauna, vegetation, crops or other goods or intended to regulate the growth of vegetation, excluding medicine or vaccine; b) "FARMER": means a farm producer within the meaning of the Farm Producers Act (R.S.Q., chap., P-28); c) "INSPECTOR means any member of the Police Department of the Town as well as any other person designated for this purpose by the municipal council. 2. The spreading and use of a pesticide is prohibited throughout the territory of the Town. 3. Notwithstanding article 2, it is permitted to use a pesticide in the following cases: a) In a public or private swimming-pool; b) to purify water intended for the use of human beings or animals; c) inside of a building; 8 d) to control or destroy animals which constitute a danger for human beings: e) to control or destroy plants which constitute a,danger for human beings who are allergic thereto; as a wood preservative. Amendment bv Bv-Law No. 341: 1. Article 3 of By-Law No 270 is amended by adding the following: -.,...,.... \/.L. qualified individual. FARMERS: Nohvithstanding article 2, a farmer using a pesticide on an immoveable which is exploited for purposes of agriculture or horticulture, in a hot house or in the open, is requested to a) register, by written declaration, with the Town, in the month of march of each year, the produds which he stores and which he will be using during that year. Any modifications or additions to the said list must also be registered with the Town as soon as possible. b) also provide, in the written declaration at article 4 a), the schedule of application of said products and the area(s) of his property where the products will be applied. Amendment by Bv-Law No. 327: 1. That article 5 of By-Law No 270 be replaced by the following: 5. GOLF COURSES: Nohvithstanding article 2, it is permitted to use a pesticide on a golf course as long as the following conditions are met: a) The use of the pesticide be done by a licensed applicator only;

16 b) The pesticide be stored in a fireproof storage area with containment, ventilation, steel shelving and fireproof sign. The Golf Clubs must maintain an up to date inventory list which must be available to the Town of Hudson's Environment Committee upon request; c) The applicator must have and comply with material safety data sheets available for each product they might apply and they must provide the sheet to any abutter of the Goif Club property; d) That there be no application of pesticides within two (2) meters of the Golf Clubs' property lines: e) That there be no application of pesticides within five (5) meters of any open watercourses; f) That there be no application of pesticides when wind velocity exceeds fifteen (15) kmhr; g) Each year in the month of January, the Goif Clubs must submit to the Town a written report of all the measures which have been taken to control the application of pesticides and produce a detailed inventory of all chemicals used and applied during the year; h) That this report be examined by the Town of Hudson's Environment Committee to establish that the activities enumerated in the said report meet all the requirements of Integrated Pest Management and demonstrate a continuing effort to minimize the use of pesticides. The committee's decision to be submitted to Council on or before March 31st of each year. 6. Notwithstanding article 2, it is permitted to use a biological pesticide to control or destroy insects which constitute a danger or an inconvenience for human beings.?. 7. Any person and/or entity must conform to the National Fire Code re the storage of pesticides. 8. This By-Law binds the Town, its officers and employees as well as any person carrying out works on its behalf or at its reauest. 9. Any inspector may visit and examine all moveable and immoveable property, as also the interior or exterior of any house, building or edifice whatsoever, to ascertain that this By-Law is executed; the owners or occupants of such property, buildings and edifices must admit such inspector. IO. For the purpose of article 8 or the Agricultural Abuses Act (R.S.Q.. chap. A-2) an inspector designated by the Town may use a pesticide, notwithstanding article 2 of the By-Law, if there is no other efficient way of destroying joxious plants determined as such by the Provincial Governmm nd the presence of which is harmful to a real and continuous agricultural exploitation. Amendment by Bv-Law No. 327: 2. That article 11 of By-Law No 270 be replaced by the following: 11. Anyone contravening a provision of this by-law, or tolerating or permitting such a contravention, commits an infraction and is liable, besides the costs, to the following fine: for a first infraction: a minimum of THREE HUNDRED DOLLARS (300 $) and a maximum of ONE THOUSAND DOLLARS (1 000 $) if the offender is a physical person or a maximum of TWO THOUSAND DOLLARS (2 000 $)if the offender is a morai person; 2. for a repeat infraction: a minimum of SIX HUNDRED DOLLARS (600 $) and a maximum of TWO THOUSAND DOLLARS (2 000 $) if the offender is a physical person or a maximum of FOUR THOUSAND DOLLARS (4 000 $) if the offender is a moral person.

18 THE CORPORATION OF THE CITY OF PETERBOROUGH BY-LAW NUMBER BEING A BY-LAW TO REGULATE THE USE OF PESTICIDES WITHIN THE CITY OF PETERBOROUGH THE CORPORATION OF THE CITY OF PETERBOROUGH BY THE COUNCIL THEREOF HEREBY ENACTS AS FOLLOWS: WHEREAS Section 130 of the Municipal Act, 2001 authorizes the City to enact bylaws which provide for the protection of the "health, safety and well-being" of City residents; AND WHEREAS the Council of the City of Peterborough desires to respond to the concerns expressed by City residents about the health risks associated with the use of pesticides; AND WHEREAS regulating the non-essential use of pesticides will help to promote and protect the health of City residents. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF PETERBOROUGH BY ITS COUNCIL ENACTS AS FOLLOWS: Definitions: 1. In this by-law, the following word has the following meaning: I.P.M. accredited groundskeeper - means a person who: (a) (b) obtains and maintains accreditation in a recognized integrated pest management programme from the Audubon Cooperative Sanctuary System of Canada, or equivalent, as determined by the City: and provides proof of I.P.M. accreditation to the City Clerk on or before January 31" of each year. pesticide - means any substance, other than a substance derived from plants, plant extracts or microbial pest control agents, which is intended to: (a) (b) control, destroy, reduce, or repel, directly or indirectly, an animal, plant or other organism which is harmful or annoying to a human being; or inhibit or prevent the growth of plants. Offence 2. The application or use of a pesticide is prohibited within the boundaries of the City of Peterborough. Exceptions 3. Notwithstanding Article 2, it is permitted to apply or use a pesticide in the following cases: (a) (b) (c) In a public or private swimming pool; To purify water for human or animal use; Inside of a building;

19 (d) (e) (9 On land used for the commercial production of food; To control, destroy, reduce or repel, directly or indirectly, an animal, plant or other organism which is harmful to human health; or On a golf course, provided that after March Is', 2007, any such use or application is permitted only under the direction of an I.P.M. accredited groundskeeper.
