WHEREAS, judicial resources assigned to the Juvenile Division should be allocated efficiently between delinquency and dependency cases Consolidation of delinquency and dependency cases in each of the four juvenile divisions will further the purposes announced in decisions of the Supreme Court of Florida mandating the implementation of a unified family court.] NOW, THEREFORE, by the authority vested in me as Chief Judge and pursuant to the Florida Rules of Judicial Administration, it is, ORDERED: l. The Juvenile Division of the Fourth Judicial Circuit, in and for Duval County, Florida, shall consist of four divisions, identified as Divisions A, B, C and D. Each division shall preside over both delinquency and dependency cases. A 2. Responsibility for delinquency detention and dependency shelter hearings shall be allocated among the four divisions so that each division shall conduct a week of detention hearings and a week of shelter hearings in a four week period. The weeks of assignment shall begin with the hearings on Saturday morning in Courtroom J -1 and run through to the following Friday. l In Re: Report of the Commission on Family Courts, 588 So. 2d 586 (Fla. 1991); Report of the Commission on Family Courts, 633 So. 2d 14 (Fla. 1994); and In Re: Report of the Family Court Steering Committee, 794 So. 2d 518 (Fla. 2001).
2 OR BK PAGE New delinquency cases shall be assigned to the division assigned to handle detention hearings on the date the case is opened. 4. New dependency cases shall be assigned to the division assigned to handle shelter hearings on the date the case is filed. 5. The following special assignment rules shall prevail over the weekly, rotational assignments: (a) New delinquency cases shall be assigned to the same division to which any dependency case (active or closed) has been assigned regarding the child or any other children of the subject child s mother (unless the dependency court previously terminated its jurisdiction over the case). (b) If two or more children named in delinquency cases, which arise out of the same set of operative facts, are subject to a reassignment of their case under subparagraph 5(a), each delinquency case shall be transferred to the division of the earliest filed dependency action. (c) All active delinquency cases on a child shall be assigned to the same juvenile division, which shall be the division in which the earliest filed case is pending. (d) New delinquency cases on more than one child, which arise out of the same set of operative facts, shall be assigned to the same juvenile division. (e) ln the event that any child charged in a new delinquency case has other active delinquency cases, the following reassignments will be utilized: (i) lf any child charged in a new case has a pending case with a court
3 OR BK PAGE 877 date, that pending case takes precedence and the new case will be assigned to the same juvenile division in which the earliest filed such case is pending. (ii) If (i) does not apply but any child in a new delinquency case is active in community control or a commitment program, the new case will be assigned to the juvenile division in which that child s community control or commitment case is pending. If there are more than one such divisions, the new case shall be transferred to the division in which the earliest filed case is pending. (iii) lf neither (i) nor (ii) applies but any child in a new delinquency j case is active in a diversion program, the new case will be assigned to the same juvenile division in which that child s diversionary case is pending. If there are more than one such divisions, the new case shall be transferred to the division in which the earliest filed such case is pending. (iv) lf neither (i), (ii), nor (iii) applies but any child in a new delinquency case has a pending open at large case, the new case will be assigned to the same juvenile division in which the open at- large case is pending. lf there are more than one such divisions, the new case shall be assigned to the division in which the earliest filed such case is pending. (v) For all delinquency cases filed prior to December 3, 2007, and for 3
4 OR BK PAGE 878 i which no court dates were assigned as of that date, the special assignment rules in this paragraph 5 shall be subject to the following procedure: p Division JV A.cases with numbers ending in odd numbers shall be considered as remaining JV A cases while JV A cases ending with odd numbers shall be considered as if assigned to JV-B. Division JV-C cases with numbers ending in odd numbers shall be considered as remaining JV-C cases while JV-C cases with i numbers ending in even numbers shall be considered as if assigned to JV-D. 6. The special assignment rules in paragraph five of this order may be overridden by court order based on a finding that the special assignment called for by the rules would be inconsistent with the principles of a Unified Family Court. The judges assigned to the impacted divisions shall consult on such findings when appropriate. 7. Judges assigned to the four juvenile divisions shall meet or confer regularly to coordinate scheduling of hearings, meetings, use of court rooms and other matters necessary to the administration of the juvenile division. 8. This Administrative Order shall take effect January l, 2008, and shall remain in effect until further order of the Court. All terms and conditions set forth in this administrative order shall supersede Administrative Order No l and apply in place of any conflicting or contrary provisions in prior administrative orders. 9. This Administrative Order shall be recorded in the official records of Duval
