1 PENDLETON WHISKY #PWTRAVELS PHOTO CONTEST OFFICIAL RULES NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. INTERNET ACCESS, A FACEBOOK OR INSTAGRAM ACCOUNT, AND VALID ADDRESS REQUIRED. #PWTRAVELS CONTEST SCHEDULE: February 9, 2018 at 5:00 p.m. Pacific Time (PT), and ends on March 23, 2018 at 9:00 p.m. PT ( Promotion Period ). 1. ELIGIBILITY: Promotion is open only to legal residents of the United States and the District of Columbia ( Territory ), who are 21 years of age or older at time of entry. If you reside outside the United States or anywhere outside the Territory, or where prohibited or restricted by law, or are otherwise ineligible, do NOT attempt to enter the Promotion. Persons in the following categories are not eligible to participate or win a prize: (a) Employees, Officers and Directors of Pendleton Whisky, Hood River Distillers, Inc. ( Sponsor ), its affiliates, subsidiaries, representatives, advertising, promotion and publicity agencies, including French West Vaughan; (b) Corporate Officers and Directors, Members and Managers of limited liability companies, and Partners in general or limited partnerships who hold alcoholic beverage licenses or permits to engage in the production, importation, or wholesale or retail sales of alcoholic beverage products and employees and representatives of such entities; (c) Employees of beverage alcohol regulatory agencies; (d) Members of the immediate family (parents, children, siblings, spouses) wherever they may live or members of the same household (whether related or not) of any person in the preceding categories. By entering the Contest, all entrants agree to the Contest Official Rules. 2. To Enter. You can only enter the Contest through the official Pendleton Whisky Facebook or Instagram pages (Facebook.com/pendletonwhisky or Instagram.com/pendletonwhisky) by using hashtag #PWtravels. To enter, you must submit an original photo you own the rights to that contains an image of a Pendleton Whisky product (Pendleton Whisky, Pendleton Midnight, Pendleton 1910, Directors Reserve) in an outdoor setting (both city and country settings will be considered). The winning photos will best capture the spirit of the Pendleton Whisky family of products. Entry Restrictions. NO LIMITATION ON NUMBER OF PHOTO ENTRIES. In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the Authorized Account Holder of the account from which the entry is submitted as of date of entry. Authorized Account Holder means the natural person

2 who is assigned to an address by an Internet access provider, on-line service provider, or other organization that is responsible for assigning addresses for the domain associated with the submitted address. In addition to the rights you grant to Facebook, by posting on this page and participating in this contest you grant Pendleton Whisky the permission to share your photos and comments on any of its online website and social networking platforms including but not limited to: Facebook, Twitter, Instagram and/or in conjunction with other materials of Pendleton Whisky s sole choosing, without prior notice to you and the photo/comment may not be attributed to you. 3. Winner Selection. The three (3) runners up and one (1) grand prize winner of the #PWtravels photo contest that best represents the spirit of the Pendleton Whisky family of products will be notified via DIRECT Facebook or Instagram message by March 30, 2018 at 9:00 p.m. PT. The winning photos will be displayed on the Pendleton Whisky Facebook and Instagram Channels by or before April 6, All entries will be judged by French West Vaughan, an independent promotion managing organization. By participating, entrants accept and agree to abide by and be bound by these Official Rules and the decisions of judges and Sponsor, which are final and binding in all respects and not subject to appeal. 4. Prize/Odds of Winning/Approximate Retail Value ( ARV ). One (1) Grand Prize Winner: One winner will receive a three-night getaway to Denver, CO, including roundtrip airfare for winner and winner's guest, three (3) nights lodging, and a $250 Visa gift card. Winner and winner's guest must be at least 21 years of age. TOTAL APPOXIMATE RETAIL VALUE OF PRIZE: $2,000 Three (3) Runners Up: Three (3) runners up will receive a GoPro HERO Black 6 camera. TOTAL APPOXIMATE RETAIL VALUE OF PRIZES: $ per camera Cost of shipping will be paid for by French West Vaughan and items will be shipped via FedEx Ground.

3 Prize must be claimed within two (2) business days. If winner does not claim their prize within two business days, prize will be forfeited and an alternate winner will be selected from the remaining entries. The grand prize winner must submit a signed and notarized affidavit within five (5) business days of notification of prize winning. The grand prize winner s trip must fall within the months of May 2018 and June 2018, but can take place on any consecutive three-day period during those months. Limit one (1) prize per entrant submitted through Facebook or Instagram profile. No prize substitution, except by Sponsor in its sole discretion due to unavailability of prize (or any prize element) for any reason and only then for prize/prize element of equal or greater value. No prize transfer. All expenses related to acceptance or use of prize which are not specified in these Official Rules as well as applicable taxes on prize are winner s sole responsibility. Odds of winning depend on the total number of eligible entries received. 5. Conditions of Participation. Entries must be the property of the participant and participant must have the right and authority to submit the entry. Entries that violate or infringe upon another person's right, including but not limited to copyright, are not eligible. In the event of non-compliance with the eligibility requirements or if prize is not claimed within three days, such prize will be forfeited without compensation of any form. The preceding in no way precludes Sponsor from taking other actions against such individuals so as to protect its rights. By participating, entrant indemnifies, releases and agrees to hold harmless Pendleton Whisky, a division of Hood River Distillers, Inc., their respective parent companies, affiliates and subsidiaries, promotion marketing/advertising agencies (including French West Vaughan) and the directors, officers, agents, representatives, shareholders, employees, successors and assigns of any of the above organizations ( Released Entities ) from any and all liability arising from participating in the Contest, any Contest-related activity and/or acceptance, receipt, possession or use/misuse of any prize. 6. Limitations of Liability. Sponsor s computer is the official clock for purposes of the Contest. Sponsor and its agencies assume no responsibility for (a) any incomplete, incorrect or inaccurate information, whether caused by website users, tampering, hacking or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error; (b) any error, omission, interruption,

4 deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of any website and/or entries; and (c) any problems or technical malfunctions of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, programming or failure of on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof, or for injury or damage to entrant s or to any person s computer (or any information/materials stored therein) related to or resulting from downloading materials from any website or participating in Contest. Force Majeure. If, for any reason, the Contest (or any part thereof) is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm or other natural cataclysm, riot, strike, civil commotion, governmental regulation or any other causes beyond the control of Sponsor which, in its sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest (or any part thereof), Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and conduct the Contest and select the prize winners in a manner which is fair, equitable and in accordance with these Official Rules, as determined by Sponsor in its sole discretion. Notice of such action by Sponsor will be posted on 7. DISPUTE RESOLUTION/GOVERNING LAW/WAIVER OF JURY TRIAL. To the fullest extent permitted by law, by participating in the Contest, you agree that: (a) any action at law or in equity arising out of or relating to these Official Rules or the rights and obligations of any entrant and/or Sponsor shall be filed in state court in Oregon, and you hereby consent and submit to the personal and exclusive jurisdiction of such courts for the purposes of litigating any such action (and waive any right to change of venue, forum non conveniens, or any like right) AND ANY RIGHT TO A TRIAL BY JURY AND A TRIAL BY JURY IS ALSO HEREBY WAIVED, (b) any and all disputes, claims, and causes of action arising out of or connected with these Official Rules, and/or the rights and obligations of any entrant and/or Sponsor, shall be resolved individually, without resort to any form of class action, and (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (if any), including costs associated with participating in this Contest but in no event attorneys' fees; and (d) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, exemplary, special, incidental, indirect and consequential damages and any other damages (whether due to negligence or otherwise), other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these

5 Official Rules, or the rights and obligations of any entrant and/or Sponsor, shall be governed by and construed in accordance with the laws of the State of Oregon without giving effect or regard to any principles or doctrines of conflicts of law/choice of law of State of Oregon or of any other jurisdiction.
