1 JML 5/15/14 Final ORDINANCE NO AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF HILLSBOROUGH COUNTY, FLORIDA, ADOPTING AN AMENDMENT TO THE FUTURE OF HILLSBOROUGH COMPREHENSIVE PLAN FOR UNINCORPORATED HILLSBOROUGH COUNTY, AS ADOPTED BY ORDINANCE 89-28, AS AMENDED, CHANGING THE TEXT OF THE PLAN; PROVIDING FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE. Upon motion by Commissioner Murman, seconded by Commissioner Crist, the following ordinance was adopted by a vote of ~ to _Q_; Commissioner voting "No." WHEREAS, the Hillsborough County Board of County Commissioners adopted a comprehensive plan for Unincorporated Hillsborough County entitled Future of Hillsborough Comprehensive Plan for Unincorporated Hillsborough County on July 12, 1989 by Ordinance (the "Comprehensive Plan"); and WHEREAS, Section , Florida Statutes, provides for a process for adoption of amendments to comprehensive plans; and WHEREAS, following a public hearing held on December 9, 2013, to consider proposed amendments to the Comprehensive Plan, the Hillsborough County City-County Planning Commission recommended approval of the proposed amendments; and WHEREAS, pursuant to Section , Florida Statutes, the Hillsborough County Board of County Commissioners considered at a public hearing held on February 20, 2014, the proposed amendments to the Comprehensive Plan summarized below: Text/Map Amendment HC CPA and Plan Elements Future Land Use Description and Purpose of Proposed Text Amendment Amendment to Policy 17.2 to direct locations for future residential show business uses
2 WHEREAS, on February 20, 2014, the Hillsborough County Board of County Commissioners transmitted to the applicable reviewing agencies, local governments and local governmental agencies as prescribed by Section , Florida Statutes, the above-described proposed amendment to the Comprehensive Plan along with supporting data and analyses; and WHEREAS, pursuant to Section (3 )(c), Florida Statutes, the Hillsborough County Board of County Commissioners held a public hearing on May 15, 2014, to consider the adoption of the above-described proposed amendment to the Comprehensive Plan. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF HILLSBOROUGH COUNTY, FLORIDA, AT A PUBLIC HEARING HELD THIS 15th DAY OF MAY, 2014, IN TAMPA, FLORIDA: SECTION 1. PURPOSE AND INTENT. This Ordinance is enacted to carry out the purpose and intent of and to exercise the authority set out in the Community Planning Act and Chapter Laws of Florida, as amended. SECTION 2. ADOPTION OF AMENDMENT TO COMPREHENSIVE PLAN. The Plan Amendtnent to the Comprehensive Plan, as described above, is hereby adopted by the Board of County Commissioners. The specific amendment to the Comprehensive Plan described above and adopted by the Board of County Commissioners is attached hereto as Attachment "A" and is incorporated by this reference as an integral part of this Ordinance. SECTION 3. SEVERABILITY. If any section, phrase, sentence or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such section, phrase, sentence or portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions thereof. SECTION 4. EFFECTIVE DATE. The effective date of the Plan Amendment shall be thirty-one days after the state land planning agency notifies Hillsborough County of receipt of a complete plan amendment package or if properly challenged, the effective date shall be the date a final order is entered by the Administration Commission or the state land planning agency determining the adopted atnendments to be in compliance. No development orders, development permits or land uses dependent on a Plan Amendment may be issued or commence before the Plan Amendment has become effective.

4 FUTURE LAND USE ELEMENT Residential Show Business Policy 17.2: Attachment ''A'' In order to accommodate the special needs of the seasonal sho\v business residents, Hillsborough County shall provide for the limited storage and attendant servicing of shovr business equipment in some residential zoning districts. Compatibility \vith surrounding uses shall be ensured through adherence to the follo\ving locational criteria: :!\.) The site constitutes infill or a logical e)dension of an existing shovr business use; alternatively, it is infill or an extension of an e)dsting commercial or industrial use Vrhich displays characteristics similar to ShO\V business USeS, SUCh as OUtdoor storage, and is thus compatible vrith such area. B) The Board of County Commissioners has found that the site meets tl?.e intent of the grouping of sho\v business uses. In order to accommodate the special needs of show business residents including limited storage, attendant servicing of show business equipment, and group quarters, show business uses may only be considered within the Gibsonton community as depicted on the map below within zoning districts that allow residential uses. In order to recognize the suburbanization of Gibsonton, and to provide for the future expansion of show business uses, a future study should be conducted to determine if the boundary can be expanded or additional areas could be added. A. The Land Development Code shall provide locational criteria to ensure compatibility with surrounding uses. B. Show business zoning and overlays outside of this boundary remain in effect and approval of this boundary is not intended to make these zonings and overlays nonconforming. Residential Show Business Use Map- Future RSB uses may be considered with this boundary
