2 Child sex offender disclosure scheme (CSODS) Part one Policy Policy summary Police forces are allowed to disclose information to the public and have a duty to protect members of the public from the potential risk posed by convicted sex offenders. West Yorkshire police has developed a policy procedure based on the national guidance on the Child Sex Offender Disclosure Scheme (CSODS)(commonly known as Sarah s law) to assist police officers and police staff members when requests for this type of information are received. Aim The aim of this policy procedure is to provide details on: processing child sex offender applications under CSODS; the role and responsibilities of Safeguarding Units (SGUs); and how to make a recommendation and decision on disclosure. Scope This policy procedure applies to all police officers and police staff Compliance Criminal Justice and Immigration Act 2008 inserted section 327A into above the Criminal Justice Act 2003 HOC 007/2010 The Child Sex Offender (CSO) Disclosure Scheme Working together to safeguard children 2013 HM Government s Child sex offender disclosure scheme guidance ACPO Child sex offender disclosure scheme national roll out and cross border guidance Chapter 1 Legislation Introduction Section 327A of the Criminal Justice Act 2003 places a duty on responsible authorities, i.e. police, probation and prison services (or MAPPA authority), in every case it manages regarding a convicted child sexual offender, to consider disclosure to particular members of the public of that offender's convictions for child sexual offences. It creates a presumption that: information about the offender's previous convictions will be disclosed where the responsible MAPPA authority has reason to believe that a child sexual offender poses a risk of causing serious harm to a particular child or children; and Child sex offenders disclosure scheme (CSODS) Page 2 of 18

3 the disclosure of information to a particular member of the public is necessary for the purpose of protecting that child or children from serious harm caused by that offender. Criteria CSODS allows: the Force to disclose conviction information about a potential perpetrator of child sex offences in certain circumstances; and anyone to register, with the Force, their child protection interest in an individual who has contact with a specific named child who they think may be at risk. The applicant must be: No Description 1 a parent, guardian or carer of a named child or children (i.e. the potential victim(s)); or 2 a third party who has some form of contact with a named child or children and who is concerned that they are at risk of harm, e.g. grandparent, neighbour or friend. The third party making the application will not necessarily receive the disclosure as it may be more appropriate for the parent, guardian or carer to receive it in respect of safeguarding the child. Aims The principal aim of this scheme is, where appropriate, to provide parents, guardians and carers with information that will enable them to better safeguard their children's safety and welfare. If our enquiries reveal that person has convictions for child sex offences, and is considered a threat; no such convictions but a threat to any child is evident; then we may pass this information on to the child s parents, guardians or carers via the CSODS process. disclosure should be considered under other child protection procedures and advice may be sought from the district Safeguarding Units (SGUs). NB While the CSODS is separate from a MAPPA authorised disclosure, the fact that a disclosure may be considered assists the police in discharging its MAPPA responsibilities. Force undertaking The scheme is administered by district SGUs. It should be noted that other members of West Yorkshire Police must not undertake disclosure of information under the terms of this scheme. Child sex offenders disclosure scheme (CSODS) Page 3 of 18

4 Any requests must be directed to the Customer Contact Centre who will log and pass them to the appropriate SGU to research, investigate and risk assess any information the Force or its partners hold. If it is recommended that information about a sex offender should be disclosed, the proportionality/necessity to do so will be reviewed by the detective chief inspector (DCI), Safeguarding Central Governance Unit (SCGU) at HQ, who will have the final decision. Common law The police are allowed to disclose information to an applicant under Common Law. We have a duty to protect members of the public from crime and are allowed to balance the subject s right to confidentiality against a potential victim s right not to suffer harm from them. Data Protection and Human Rights Disclosure is also governed by the eight principles of the Data Protection Act 1998 and a full description of the lawful authority to disclose such information is given in the HM Government s Child sex offender disclosure scheme guidance. Disclosure must be proportionate and necessary in line with the Human Rights Act Chapter 2 Cross border applications Overview More than one force involved There is the possibility that more than one force could be involved in any one application: Type Force A - receiving force Force B - coordinating force Force C - responding force Force D - responding force Force E - responding force This is the area in which the applicant makes their enquiry. It may be where they reside, but may be elsewhere (will only ever be one). where the applicant resides, if it s different to the above (and will only ever be one). where the named child or children reside. This could be several areas in those cases where families are estranged. where subject resides. This could be several areas if the subject is itinerant or there are multiple subjects. where there is a place of interest and not a particular person resides, i.e.: church, nursery, college etc. Child sex offenders disclosure scheme (CSODS) Page 4 of 18

5 Risk assess case by case It is necessary for the receiving / coordinating and responding force(s), as well as any agencies involved, to work in close consultation to consider and address the risks posed on a case by case basis. Receiving force Responsibility If the applicant does not reside in the our Force area then we should: 1 obtain the initial contact details; 2 complete the initial checks; 3 ascertain the risk; and 4 pass to the force area where the applicant resides. This should be done via an incident log to the communications department / call centre of the coordinating force as soon as practicable. Coordinating force Responsibility If the applicant resides in our Force area then we oversee the enquiry and act as coordinator for any other force areas involved. If the applicant also makes their application to us, then we are responsible for carrying out the actions listed above as well as: 1 making contact with and initiating action in any other force area(s) involved, i.e.: where the child(ren) and / or subject live; 2 If there is Then this should be done a potential immediate risk; via an incident log to the communications department / call centre of the responding force(s) as soon as practicable; or no potential immediate risk identified; via auditable means i.e. incident log, e- mail, fax or ViSOR activity log and a response ensured; and 3 liaising with the applicant and making such disclosures to them as are deemed appropriate. Other force / agency involvement While it is accepted that primacy in any process will reside in a single force, there will nevertheless be a need for the other forces and agencies involved to fully engage with the process. 6 They should, if necessary, send representatives or provide teleconferencing presence / other contribution to the decision-making conference, be it under the auspices of MAPPA or safeguarding children procedures. All cases In all cases, the coordinating force is responsible for: oversight of the enquiry; coordinating its own actions as well as those of responding forces; and maintaining the anticipated level of service with the applicant. Responding forces Responsibility The force(s) (C, D and E) in which any party resides, other than the applicant, (i.e.: child(ren), subject, premises), is responsible for the actions in relation to this party once informed about the enquiry by the coordinating force. That is: dealing with actions specific to this process as directed by the coordinating force; and / or actions relating to MAPPA or to existing safeguarding children procedures, as applicable. All those involved should make every effort to reach an agreement on what action should be taken. Agreement not reached In the unlikely event that an agreement cannot be reached, and there is a need for a final decision to be made, responsibility for making the decision is as follows: If the subject of the enquiry is a MAPPA subject; Then the MAPPA area that owns the subject has primacy as they are responsible for: minimising all risks associated with the subject, including the risk of offending against the named children; and hosting the final disclosure decision-making conference. Primacy for social care should always rest with the social care team for the area in which the children principally reside. This will, on occasion, be different to the force that holds primacy, i.e. in MAPPA cases. NB This process will not be used to refer individuals to MAPPA, other than where they are already MAPPA nominals or where the strict criteria is met. 7 it is a non- MAPPA case; the force that 'owns' the child(ren) named in the application has primacy as they are responsible for: the child s(ren's) welfare; and hosting the final disclosure decision-making conference, which will come under the remit of local safeguarding children procedures. Disclosure to third party If, as a result of enquiries, it is decided to disclose information to a third party, e.g. to the parents of children who were referred by a concerned-but-not-related applicant, then the force where the third party resides is responsible for making the disclosure (as a responding force). Variation to process for Scotland Application made in Scotland Where the application is made in a Scotland division and the child(ren) reside in West Yorkshire then: The Scotland division West Yorkshire Police will obtain the initial contact details; complete the initial checks and ascertain the risks; create an incident log on their command and control systems and transfer it immediately to West Yorkshire Police Force Communications; undertake the face to face application and empowerment stages (2 and 3), adhering to the time lines set out in the scheme. take ownership of the application and become the coordinating force (including capturing any information for the monthly data return); create an incident log on the West Yorkshire command and control system; undertake a full risk assessment; make a decision regarding potential disclosure; make any subsequent disclosure; and liaise with the force where the subject lives (if not West Yorkshire). Child(ren) reside in Scotland Where West Yorkshire Police receive an application and the child(ren) live in Scotland, the above roles will be reversed. Initial action If you receive an application, you must first establish whether, in fact, any substantive offence is being alleged: If it is... Then you should... alleged that a crime has been committed, create the appropriate or it is apparent that the named log and progress it as child/children is currently being abused; normal. apparent that no offence has been proceed as below. committed; Customer contact centre (CCC) If the applicant asks: at a public enquiry counter then you should offer the person access to a telephone in the station to call the Customer Contact Centre (CCC); or a police officer or police staff member, then you should give them the number of the CCC so they can ring them direct. Creating and completing a log If you receive a call in the CCC, you should create a log on Storm using the appropriate Opening Code and, using the swiss army knife facility, cut and paste the below question set template to the log and populate with the answers as follows: Stage Details of applicant Preferred method of contact Description name, including any other names used, e.g. maiden name; date / place of birth; home address; ethnic origin; gender; preferred language; and relationship to the child(ren) if not the parent, guardian or carer; time / day; method, e.g. by telephone, face to face; and safety issues, applicant nominating a time and place when it is safe for us to contact them; Child sex offenders disclosure scheme (CSODS) Page 8 of 18

9 Details of subject of enquiry Children in the household Reason for call Identify elements of risk Consent name, including any other names used; date / place of birth; address; ethnic origin; gender; place of work / employment; and nature of relationship to potential victim; name, including any other names used; date of birth; gender; school; and GP; details of the applicant s concerns and why they are seeking a disclosure under the scheme; does the subject know that the applicant is making the enquiry?; and what is likely to happen if the subject discovers that the applicant has made the enquiry; and to share personal data with other agencies. Providing information to the applicant You should inform the applicant that: No Information 1 the CSODS does not replace existing procedures that are in place for: Criminal Records Bureau (CRB) or Disclosure and Barring Service checks; or Subject Access (Data Protection Act) or Freedom of Information Act requests; 2 a disclosure will only be made to the person who is in the best position to safeguard the child/children from harm, i.e. the parent, guardian or carer if a third party applicant; 3 initial checks will be completed as soon as possible and, in any case, within 24 hours to: assess whether the disclosure application should be progressed; and assess whether there is an immediate or imminent risk of harm to the child(ren) from the subject; 4 they will receive a face to face visit within 24 hours from an SGU officer to: verify their identity and relationship to the child; complete the remainder of the CSOD1 (Face to face interview); gather any other intelligence; and give them an information pack about the disclosure scheme; Child sex offenders disclosure scheme (CSODS) Page 9 of 18

10 5 we will aim to complete the application within 45 days and will keep them informed throughout; 6 if any immediate risks to a child/children are identified at any stage, then immediate safeguarding action will be taken and this will include a robust safety plan delivered by the police and partners. Should a decision be made to disclose information, this will also be accompanied with a robust safety plan tailored to their needs; and 7 the log number and details of the SGU who will manage the application (district where the applicant resides). Pass the log to supervisor You must pass the log to your CCC supervisor via Storm. CCC supervisor responsibility The supervisor will: 1 contact the district SGU supervisor (where the applicant resides) by telephone; 2 notify SGU about the log; and 3 endorse the log with the SGU staff member spoken with and they will action as below; or if there is no SGU supervisor on duty, e.g. out of hours, contact the relevant district cadre detective inspector (see next block). District cadre detective inspector responsibility As the district cadre detective inspector, you must: 1 review the log and cause the following checks to be made on the applicant, child/children and subject: PNC; PND; ViSOR; Corvus and / or Niche; and Interpol enquiry regarding foreign convictions (SGU only); 2 ensure that the result of these enquiries is endorsed on the log; 3 consider if the checks disclose the need for any immediate action to safeguard the child/children from imminent harm. This may mean liaising with any SGU staff on duty; and 4 if, in your opinion, there is an imminent risk of harm: initiate action you feel appropriate to mitigate that risk; and update the log with your considerations and the action taken. 11 The log will remain open and the DCR will contact SGU staff, when they are on duty, who will take responsibility for further follow up action. Safeguarding Unit (SGU) Supervisor As the SGU supervisor, you must: review the log; send an to the Safeguarding Central Governance Unit Mailbox outlining the circumstances of the request for central logging; task a staff member to conduct the initial checks; undertake a risk assessment; start a CSODS 1; and task a staff member to undertake a face to face visit and provide that applicant with information about the disclosure scheme. NB This must be completed within 24 hours of the enquiry being received by the CCC. SGU officer tasked to deal with the enquiry Initial checks If tasked by your SGU supervisor, you must: 1 create / push a Niche non crime occurrence for CSODS; 2 endorse the log that SGU are now dealing and close; 3 check systems (PNC, PND, ViSOR, Corvus and / or Niche and Interpol enquiry regarding foreign convictions (SGU only)) regarding the applicant, child/children and subject, unless already shown on the log. This should be done as soon as possible to identify any immediate risk but in any event within 24 hours; 4 endorse the occurrence with the result of the research; and 5 task the occurrence back to the supervisor for review. Face to face meeting You must: 1 arrange to meet the applicant face to face to: establish that the enquiry is genuine and not malicious; obtain more detail about the application in order to further assess risk and to inform a decision around disclosure; and Child sex offenders disclosure scheme (CSODS) Page 11 of 18

12 provide safety information and advice to safeguard the child/children; 2 confirm the previously supplied details of the applicant, child/children and subject (as above); 3 complete the CSODS 1; 4 obtain details of any children in the household; 5 ask the applicant for proof of identity. Photo identification should ideally be provided, e.g.: a. passport; b. driving licence; or c. other trusted form of photo identification. Other forms of identification may be used if none of the above are available, e.g.: d. birth certificate; e. household utility bill (e.g. electricity, gas, council tax, water); or f. bank statement; 6 before progressing enquiries on the application, supply the applicant with a notice warning that: a. if they wilfully or maliciously provide false information to us in order to try and get a disclosure they are not entitled to, they may risk prosecution (e.g. under Section 5(2) of the Criminal Law Act 1967 (wasting police time); b. if they disclose evidence of an offence while registering a concern, it may not be possible to maintain their confidentiality; c. any information disclosed by us must only be used for the purpose for which it has been shared, i.e. in order to safeguard the child/children; and d. the application will be dealt with confidentially, but confidentiality can only be guaranteed pending the outcome of the process, as we must consider whether: representations should be sought from the subject, if a disclosure is considered; and the subject should be informed that a disclosure has been made; 7 discuss and confirm the: reason for the application; and history of relationship between the subject and child/children, and endorse these on the CSODS 1; 8 inform the applicant that the person to whom the disclosure is made will be asked to sign an undertaking that they agree that the information is confidential and they will not disclose this information further. 13 A warning must be given that legal proceedings could result if this confidentiality is breached and that it is a breach under Section 55 of the Data Protection Act 1998 for a person to knowingly or recklessly obtain or disclose personal data without the consent of the data controller (i.e. the agency holding the information that will be disclosed, which in most cases will be us). This should be explained to the applicant and their signature obtained on this undertaking. If the applicant is not willing to sign the undertaking, then we will need to consider if disclosure should still take place; and 9 give the applicant an information pack: explaining the Child Sex Offenders Disclosure Scheme; and local leaflets that provide signposts to local support services. Chapter 2 Conduct full risk assessment (max 10 calendar days) SGU officer As the SGU officer dealing, you must: 1 revisit the initial checks; 2 conduct further searches of police information systems; 3 notify the local partners of receipt of the enquiry and ask them to: review information held by their agency in relation to the parties involved; and notify the SGU within three working days of any relevant information held by them which may indicate a risk of harm to the child/children; and 4 after three working days, endorse the occurrence with any relevant information received from the local partners and task the occurrence to a supervisor for review. Supervisor On receipt of the task, you must: 1 review the circumstances which have prompted the enquiry; 2 review the information relating to the antecedent histories of the applicant, child/children and subject; 3 review any additional partner information and determine whether it indicates a risk of harm to the child/children; Child sex offenders disclosure scheme (CSODS) Page 13 of 18

14 4 conduct a full risk assessment to determine if a disclosure may be necessary and consider: No Consideration a Does the subject have convictions or out of court disposals for child related offending? b Is other information held about the subject which may reasonably lead you to believe that the subject poses a risk of harm to the child/children? c What is the subject s child sex offending history, including where no formal action was required? 5 determine if the available information suggests that the subject poses a serious risk and that, by passing on the information, it will protect the named child/children from serious harm and, if so, initiate immediate action to mitigate the risk; and 6 endorse the OEL accordingly and task the occurrence to the SGU detective inspector for review. Chapter 3 Recommendation and decision about disclosure (max 10 calendar days) SGU detective inspector On receipt of the task, you must: 1 consider the information; 2 identify if there are any child safeguarding concerns; 3 complete a CSODS 2 (Disclosure decision making guide) with your recommendation; 4 endorse the OEL accordingly; and 5 forward the papers to the SCGU for the attention and consideration of the DCI in all cases, i.e. whether you believe there are concerns or not. DCI, SCGU The DCI, SCGU, will consider the application, together with the recommendation from the SGU detective inspector, and make a decision about disclosure before any information is released. If... there is no information, or there are no concerns, to disclose to the parent, guardian, carer or applicant (if different) which Then the DCI, SCGU will... 15 indicates a risk of harm; there is information or concerns and it is decided that information about a sex offender should be disclosed; return the papers to the district SGU for filing; and notify the SGU detective inspector so that an SGU officer can be tasked (as below; record the decision on the CSODS 2; and return the papers to the district SGU for filing; and prepare a CSODS 4 (Disclosure minimum standards) for the applicant. No concerns non disclosure 35 calendar days Timescales You must close the enquiry a maximum of 35 calendar days after you have chosen the No concerns non-disclosure route. SGU officer If the DCI, SCGU, makes a no concerns non disclosure decision, as the SGU officer, you will inform the applicant. You will: 1 complete a CSODS 3 (Non-disclosure letter); 2 visit the applicant in person (as any posted correspondence has the potential to put the child/children at more risk); 3 tell them that there is no information to disclose given the information / details they provided and the result of checks made on these details; 4 inform the applicant that the lack of information to disclose does not mean that there is no risk of harm and the applicant should remain vigilant and report any future concerns. If appropriate, the applicant should be signposted to safeguarding information and relevant support services; 5 tell them that the subject will not be notified as no disclosure has been made to them (applicant); 6 serve the CSODS 3 on them for their information, if it is safe to do so; 7 endorse the occurrence OEL with the action taken and attach a copy of the CSODS 3; 8 ensure the application is retrievable on PND; and 9 task the occurrence to a supervisor for finalisation. Records District SGU must: record and scan all actions taken, decisions made and papers (i.e. completed CSODS 3) used on to Niche; and Child sex offenders disclosure scheme (CSODS) Page 15 of 18

16 scan a copy of the CSODS 3 to the SCGU mailbox so that records held centrally can be updated. Review An SGU supervisor should review the occurrence, before finalisation, to ensure that all safeguarding action in respect of the child/children and offenders have been considered and appropriately actioned. Concerns Disclosure 45 calendar days Timescales You must close the enquiry a maximum of 45 calendar days after you have chosen the Concerns Disclosure route. Disclosure If the DCI, SCGU, makes a concerns disclosure decision, as the SGU officer, you will inform the person receiving the disclosure. You will: 1 make the disclosure in person; 2 explain that the disclosure must only be used for the purpose for which it has been shared, i.e. in order to safeguard the child/children; 3 ask them to sign an undertaking that they: agree that the information is confidential; will not disclose this information further; and understand that legal proceedings could result if this confidentiality is breached; 4 if they are not willing to sign it, explain that we will need to consider if disclosure should still take place. The outcome should be recorded and considered in the risk assessment, decision making process and safety plan recorded on the Niche occurrence; 5 not, at any time, send out or leave written correspondence concerning the specifics of the disclosure consideration with them. There would be a potential risk to intelligence sources, victims and perpetrators should such written information get into the wrong hands; 6 use CSODS 4 (Disclosure Minimum standards of information) to convey a disclosure. What the person is told will be recorded verbatim on this form, signed and retained by us. NB It must not be given to the person in any circumstances; and 7 give them information to allow them to safeguard themselves and the child/children in the future. This should as a minimum be a leaflet to explain the Child Sex Child sex offenders disclosure scheme (CSODS) Page 16 of 18

17 Offender Disclosure Scheme and local leaflets that provide signposts to local support services. Records District SGU must: record and scan all actions taken, decisions made and papers (i.e. completed CSODS 4) used on to Niche; and scan a copy of the CSODS 4 to the SCGU mailbox so that records held centrally can be updated. Review An SGU supervisor should review the occurrence, before finalisation, to ensure that all safeguarding action in respect of the child/children and offenders have been considered and appropriately actioned.
