2 MANDATORY VIDEOS Introduction Darrell Mahood, Director, Juror Services Hello! My name is Darrell Mahood and I am the Director of Juror Services for the Los Angeles Superior Court. I would like to welcome you to the On-Line Juror Orientation, designed especially for jurors who prefer to receive their orientation in the comfort of their home, or office, AND who are interested in saving a few hours of time on their first day of jury service. Generally, jurors are required to report to the Court s assembly rooms as early as 7:30 a.m. If you take the orientation on the Court s Website, you will have the advantage of reporting at a later time, up to 2 hours later at some locations. You will generally be asked to report at a time prior to the selection of the first jury panel needed in a courtroom that day. Juror orientation is required by law. We hope you find the On-Line Orientation you are about to take informative and helpful in preparing you for jury service. As you watch and listen, you will be given information about various aspects of jury service including the term of service, payment for your service, what to expect when you report, and, on a topic that has become very significant, the use of social media while serving as a juror. Please give this important information your undivided attention. At the conclusion of the approximately 30 minute orientation, you will have the opportunity to provide us with feedback on your experience. 3 Jury Service Qualification Have you ever wondered why you have been selected and summoned for jury service? You have been summoned because you are 18 years of age or older, you are a citizen of the United States, a resident of Los Angeles County and are a registered voter or California driver s license or ID card holder. 4 One Trial Term of Service Judge Jacqueline Connor (retired) Hello! I m Judge Jacqueline Connor. I have the privilege of talking to you today about one trial term of service. You are probably asking yourself, what does this term of service mean? This means that when you report, you will be expected to serve for the length of a single trial. Under this term of service, you are placed on call for no more than five days and can be asked to report for jury service on any one of those days. The five days usually begins on a Monday and as such, you may be asked to report as late as a Thursday or a Friday. Because we do not have you to come into court until we actually have a trial ready for you. If you are asked to report and are not assigned to a courtroom for a jury selection by the end of your first day, you will be done with your jury service. On the other hand, if you are assigned to a courtroom for jury selection on that first day, you will be required to serve until you are excused by the court or you are selected as a juror and the case you are assigned to is completed. In other words, if you are selected as a sworn juror on a trial on your first day, you must remain for the length of the case. Now, the average length of the case in Los Angeles County is five to seven days, so when you report, please make sure this block of time is available. And, remember that we expect you to be ready to serve on your first appearance date. I do hope you enjoy your jury service and I am confident that you will find it a rewarding experience. In my 30 years on the bench, there is not a day that I don t come to court where I m amazed by the power and genius of our system and I hope that you get to participate in it. 5 Labor Code If you are employed, your service as a juror is protected. If you give your employer reasonable notice that you are required to appear in court for jury service, your employer should allow you to perform jury service without jeopardizing your job. Labor Code, Section 230, states that no employer shall discharge or in any manner discriminate against any employee, for taking time off to serve as required by law. 6 Hardship Judge David Sotelo I am Superior Court Judge, David Sotelo. I am going to talk briefly about juror hardship excuses. First and foremost, please understand that any suggested hardship claim that is temporary or marginal will not qualify to excuse you from jury service. So for example, the fact that you transport a child to and from school may not qualify as an undue hardship and you can simply postpone service to a time when your child is on break or on vacation. If that is your situation, jury support staff will assist you in postponing your service to a later date--simply let them know. On the other hand, California Rules of Court identify a number of reasons that will excuse you from jury service based on what is called an Undue Hardship. If you request an Undue Hardship based on financial reasons, you will have to show or prove that you will likely experience an Extreme Financial Burden. Proof of your household income will be considered in the context of the expected length of jury service in order to determine whether serving could compromise your ability to support you and your dependents, or that service will so disrupt your economic ability as to be against the Interests of Justice. That s the definition and standard of Undue Hardship. If you request Undue Hardship because you are obligated to personally care for another person, such as a child or ill family member, you may be required to verify that you personally provide the care continuously Monday through Friday during court hours and that no comparable substitute is available or is practical, without imposing the Undue Financial Hardship. Significant issues regarding transportation to court or the need to travel an excessive distance may also be brought to the judge s attention. All judges are sensitive to the competing demands placed on you, especially during these challenging economic times. We do not take your presence here lightly. These Undue Hardship standards were established to ensure fairness and uniformity of practice throughout California. So, so long as you are sincere and candid about your situation, your judge will help you shift the information to make an appropriate determination. Thank you. 7 Reassignments Did you notice on your jury summons that your reporting location is not necessarily the closest to your home? Are you wondering whether you can transfer your jury service to a more convenient court? Transfers are possible but they are only granted when there is a legal reason to do so. The Court tries to keep all jurors as close as possible to their home. You should know, however, that state law allows the Court to assign a juror to any court location within the Los Angeles Superior Court s jurisdiction. In case of an immediate need for jurors at a court location that didn t summon you, the Court may re-assign you. 8 ADA Issues Judge Patricia Schnegg Hello! My name is Judge Patricia Schnegg. I am going to cover important information regarding ADA accommodations. If you have a mobility-impaired disability and need parking accommodations, you may contact the jury assembly room staff at the phone number on your summons. You may also obtain the assembly room phone number for the court hat has summoned you by going to the Los Angeles Superior Court s website at If you have a hearing impaired disability, you may want to call the TTY phone number listed on your summons or visit your local jury assembly room. Staff will be glad to help you arrange the services that you need. Depending on your request, the court is able to arrange for a sign language interpreter, a real-time reporter or an assistive listening device. If you have already made arrangements for the accommodations that you need and have confirmed your jury service appearance, don t worry, we ll have those accommodations in place when you report on your first day. If you are a juror with special needs, you may request accommodations by submitting the request in writing or by visiting your local assembly room. 9 Juror Fees and Mileage If this is your first time completing jury service, you may be asking yourself Am I reimbursed in any way? Jurors are compensated $15.00 per day and.34 per mile, one way, but are paid for the second and subsequent days of service. Jurors are not compensated for the first day of jury service pursuant to Code of Civil Procedure. Your payment will be computed at the completion of your jury service and payment will be mailed to your address. You should receive payment within a few days. Travel distance and therefore, the amount of mileage are determined by a computer program. Mileage is calculated by measuring the straight line distance from your home to the court location that is summoning you for jury service. You should know that if you are a government employee who is paid regular salary and benefits while on jury service you are not entitled to juror fees. Persons who are considered government or public employees are those employed by a federal, state, or local government entity such as County of Los Angeles, City of Los Angeles, any school district, a public authority (such as the Metro Transportation Authority or The Metropolitan Water District), and any other political subdivision in the State per Code of Civil Procedure. If you are in one of these categories of employment, you will still be paid mileage for one way, after the second day of service. On-line Orientation Scripts 9 of 33 Rev. December, 2013

10 Donation Program Are you interested in donating your juror fees to a worthy court program? We have three programs you can donate your juror fees to. You may donate to the Court's Juror Assembly Room Improvement Fund, Jury Service Enrichment Fund, or CASA (formerly the Friends of Child Advocates). We ask that you check with your employer to see if you are able to donate your juror fees. There are some employers that require you to return your fees, if you are provided benefits while serving. Please check to prevent any confusion between you and your employer. If you donate your fees to the court's Juror Assembly Room Improvement Fund, the fees will be applied to costs that are incurred in refurbishing the court s jury assembly rooms. Fees donated to the Jury Service Enrichment Fund will be used to improve the overall experience of jury service in Los Angeles County through a wide range of efforts including but not limited to facility, emergency, education and jury appreciation programs. Fees donated to CASA go to a private, not-for-profit corporation. CASA s goals are to provide maximum protection and representation of dependent children of the court. CASA volunteers work one on one with abused, neglected or exploited children, ensuring that the child s voice is heard. If you are interested in donating your fees to any of these programs, please see the jury staff when you arrive. They will give you the appropriate form to complete to process your donation. 11 Parking The Los Angeles Superior Court provides free parking for jurors at the lot shown on your jury summons. If you don t know where the juror parking is located, please refer to your summons. Your parking location is shown in the center portion. You will find this information to the right of the map. The parking lots reserved for jurors are situated close to the courts. 12 METRO PASS AND METROLINK PROGRAMS Have you wondered if there is an easier and convenient way to get to jury service, without the hassle of driving in traffic? If you are asked to return to jury service on a second or a subsequent day, you may waive your mileage in exchange for a Metro weekly pass or a Metrolink train pass. The Metro pass is a weekly pass that allows you to ride the Metro buses and light rail trains. The light rail trains include the red, blue, green, purple and gold lines. If you take a Metro bus that changes zones or is an express bus, the operator may ask you for additional fare that the court is not able to reimburse. The agreement between Metro and the Court is for local travel only. The Metrolink trains are blue and white. These trains travel on the same rails as Amtrak and freight trains. 13 DRESS ATTIRE You maybe asking "How should I dress for jury service? Your dress should be casual attire, but respectful of the court. Here are a couple of examples. The lady is wearing a blouse, slacks and dress shoes. The man is wearing a shirt, tie, slacks and dress shoes as well. If you are not comfortable wearing a tie, by all means leave it at home. Business casual is appropriate. Here are examples of what you should not wear to court. This lady is wearing shorts with a tank top and flip-flops. The man is wearing a shirt that displays the word "GUILTY". We would like for you to dress comfortably, but dress to show respect for the court and the role you are about to play. If in doubt, check with the jury staff or court staff. Please understand that if you come inappropriately dressed, you will be asked to postpone your jury service to another time. 14 BADGE PLACEMENT On your first day of service, please remember to bring your summons. You will need to return this document to the court. It also contains your juror badge. Staff will request that you detach the badge and place it in a holder, which you will receive when you report. You will need your juror badge for the entire stay with us. You must wear your badge at shoulder height so that you can be identified as a juror by the bailiffs, courtroom staff, security staff, attorneys, litigants, and judges. 15 IDENTITY THEFT If you receive a phone call and the caller identifies him or herself as being a Los Angeles Superior Court employee, or as someone who is affiliated with the court, and requests personal information such as your social security number, California driver's license number or a credit card number, please do not provide this information to the caller. 16 EMERGENCY PREPAREDNESS An emergency can strike at any time and place. If you are in the assembly room during an emergency, you must follow the instructions of staff. 17 REPORTERS AND NEWS MEDIA While you are a juror, you are not permitted to speak to anyone from the media, such as TV, radio, Internet, magazine or newspaper reporters. If you are selected as a sworn juror and placed on a case, you may not speak to anyone about the case you are assigned to, including the media, until the case has been completed. 18 Social Media Judge Laura Priver Hello, my name is Judge Priver. I would like to speak to you about your use of social media while serving on jury duty. During the trial, you are not allowed to talk to anyone about the case or any subject involved in the case. Most jurors understand that they cannot discuss the case with others, including family and friends, or conduct their own investigation. What jurors may not understand is that this includes doing research on the Internet and posting your thoughts or experiences on social media sites such as Facebook, Flickr, and Twitter to name a few. If you are selected to hear a case, the judge will tell you about the law prohibiting discussing the case outside of deliberations. So you are aware, this includes the use of social media, doing research about the case, or simply updating your social media page regarding your jury duty experience. Please understand that it is now a misdemeanor in the State of California to conduct electronic research or post anything about the case you are on while serving as a juror. If you violate the court s order in this regard, you could be charged with a crime or have to pay a substantial fine. Furthermore, your innocent tweet or blog may require the court to stop the trial causing the court and taxpayers to incur the expense of starting the trial over. We know that jurors are committed to fulfilling this important civic duty in a responsible and conscientious manner. To fulfill this responsibility, jurors must focus on the evidence presented in the courtroom. This includes the testimony of witnesses and any physical exhibits the Judge admits into evidence. Only the evidence presented in court can be considered. When a juror considers information from other sources, including the Internet, the lawyers do not have the opportunity to determine if it is accurate or relevant to the case at hand. It may also result in one or more of the parties not getting a fair trial, something none of us want to see happen. The prohibitions against discussing the case, doing research or utilizing the Internet or social media in any way are precautions put in place to ensure that the trial is conducted in a fair and lawful manner. So, while you are serving as a juror, follow the judge s admonition and do not use any electronic devices, social media or send or receive any information from anyone about your jury duty, your experience as a juror, or any trial you may be selected to hear until your service as a juror has been completed and the judge releases you from this prohibition. 19 Completing Jury Service The Court will issue you a jury service certificate to provide to your employer at the completion of your service. Employers require this certificate from their employees when they return to work from jury service. If you are in the jury assembly room at the conclusion of the first day and are not assigned to a jury selection, the jury staff will complete your service and provide you with a jury certificate which looks like this. If you are one of the fortunate jurors who is selected as a trial juror, your jury service certificate will be available at the completion of the trial. If you are assigned to a trial that is longer than one week and your employer needs weekly verification, please let us know so that we can print your certificate weekly. Once you have completed your jury service, you will not need to serve as a juror again, until at least 12 months have passed. 20 What to Expect During Jury Duty Democracy is made real every day by thousands of jurors across our country, in both civil cases and criminal cases. You may be asked to serve on a civil case to decide a dispute between two or more parties. Or, it may be a criminal case to decide whether the accused is guilty or not guilty of the charges made. What does it take? Common sense, fairness and impartiality. You don t need any prior knowledge of the law or special training to be a juror. I was scared. I didn t know what I d be getting myself into. I had to wait around. I brought a book so it wasn t, it wasn t bad at all. There are three stages for jurors. Jury selection, the trial stage, when statements, evidence and arguments are presented, and jury deliberations to make a decision. Remain seated and come to order. Department four is now in session. In the courtroom, the judge presiding over the trial and the court staff will give you any guidance needed. The court clerk is in charge of keeping all the documents, records and physical evidence for the trial, and organizing the jurors. The bailiff, deputy or court attendant assures that the process is orderly, and safe, and will be your liaison for any problems or questions that might come up. The court reporter takes down everything said as an official record. Raise your right hands. You and each of you do solemnly swear Jury selection starts with your promising to be truthful. I do. Good morning, ladies and gentlemen. Before we start the jury selection The judge tells you about the claims or charges being made. This information allows you and the court to determine if you have any bias, or prior opinion in this particular case, or towards the individuals involved, or if there is anything about the facts of the case that might prevent you from being fair and impartial. Ladies and gentlemen, before we start selecting the jury in this matter, we need to know some basic information from you. Your occupation If you have any questions about your privacy, or confidentiality, you can always ask the judge. I don t know anybody in this case. I ve never seen anyone here before. 21 Ma am, I need to ask you about The attorneys want the best jury possible for their case. They may ask you about your personal thoughts and experiences. No, that wouldn t bother me at all. Thank you, ma am. Juror Number Six I am a salesman for a large pharmaceutical company. I m married, I have I think it s fairly difficult for people to come into a jury and not have some bias. But I look at, there s the issue of bias, and there s the issue of trying to keep an open mind. The attorneys may excuse individuals as prospective jurors for their case using rules set by law. Sir, thank you for your honesty. Your Honor, as a preemptory challenge, we would thank and excuse juror number six. It s nothing personal. It s a process of forming a jury panel mutually agreed by all parties in the case. Raise your right hands. You and each of you do solemnly swear that you will well and truly try the cause now pending before the court. For a criminal case, there are twelve jurors. For a civil case, there are usually twelve but sometimes fewer. Let me remind the jurors about their obligations You need no special training to be a juror, but you ll follow some rules. During the trial, until you begin jury deliberations, you can t discuss the case with anyone. If someone connected with the case does try to discuss it with you, either inside or outside the courtroom, you ll need to tell the judge or the bailiff. You ll keep your mind open and not make a decision until hearing all the evidence. You can t investigate the case independently by going to the scene or seeking out information on your own. These are not evidence, but rather, their accounts of what the evidence will show. 23 These points of view may oppose each other. and that s what he did. Only a jury can decide. Members of the jury, you have heard all of the evidence. And now it is my duty to instruct you on the law that applies to this case. The judge will instruct you on how to reach a decision based on the evidence. The judge will explain the law and the degree of proof needed to make a decision. Trying to come to some sort of agreement with 12 complete strangers, was, uh... I thought that was an interesting part. That was probably my favorite part of the whole thing, was the deliberations. You ll deliberate as a jury in private, at last free to discuss the case. Often, a guide booklet is available to help organize yourselves as a group. Okay, who s going to be the foreperson? I think that s the first step to get us going You may organize yourselves as seems best. Now I m supposed to make sure that everyone gets a chance to hear everybody s opinions or questions right at the beginning. Does that sound okay, does it make sense? It will be your duty to give your opinion, and also to listen to others. Everyone counts. And that s very important, to speak your mind when you are in that phase of the trial. It s very important because you are affecting other people s lives, and you need to have your say. Let s all take another vote. We re so close to a verdict now. Don t you agree? If you are deliberating a civil trial, only three-quarters of the jurors must agree to reach a final decision. 25 OPTIONAL VIDEOS How did you get my name? Your name was picked at random by the Court s computer system from the combined voter list and California driver s license and identification card holders list. Because there are two sources from which we can randomly select your name, it is possible that you may receive two notices in one year. Usually, this is because your name comes to us as John Paul Jones from the voter s list and John P. Jones from the California driver s license and identification card holders list. When this happens, the computer system is programmed to consider you as two separate persons. Under this condition, you may receive a second notice within 12 months from your original summons date. If you receive more than one notice within 12 months, please read the summons carefully and make sure that it is not a Federal Jury Summons. If it is a Federal Jury Summons you must follow the directions on the summons. 26 Ready to Serve? If you need to postpone your service, please make your request before you arrive on your first day of service. Remember, you need to be ready to start your service when asked to report. If you find that you need a postponement on the day that you appear for service, you must ask for one before the first jury panel is called. Once the first panel of jurors is called to report to a courtroom, you will be deemed to have waived the opportunity to request a postponement. Unfortunately, you may not make such a request when you are selected on a panel and you arrive in the courtroom to which you are assigned for a trial. The judge is aware that you have had multiple opportunities to postpone your service and generally, will not consider a postponement in the courtroom. On-line Orientation Scripts 26 of 33 Rev. If you are unsure as to where your reporting location is, please refer to your jury summons. Your reporting location is on the top right hand corner. 28 Juror Privacy One of the concerns that you may have as a juror, is whether your name, address and phone number will be released to the public. There is no reason for you to be concerned. Such information is sealed and only released upon a judge's order. If the court orders your information to be released, Juror Services staff will notify you of the court's order before your personal information is released to anyone. 29 Cell Phone Usage Remember that cell phone conversations can be annoying. We don t prevent you from using your cell phone while you are on jury service. If you are a juror in the assembly room and you need to use your phone, please step outside of the room. Be mindful that there are other jurors in the assembly room who would prefer a quiet environment to read or work on their computer. Once you are assigned to a courtroom, you must place your cell phone or pager on vibrate mode or turn it off. 30 Local Amenities We know that information about local amenities is important to you, such as locations of restaurants, snack bars and ATMs. The jury assembly room staff at your reporting location will provide you with handouts or pertinent information on local amenities. You may also find this information for the court location that has summoned you, on the information sheet that will be provided to you upon completion of juror orientation. 31 Wireless Access Each jury assembly room offers free wireless internet access. If you wish to work or simply browse the Web, you are welcome to bring your computer device and take advantage of the Internet access. However, using your smart phone or other device to take pictures inside the jury assembly room, or anywhere else inside the courthouse, is strictly prohibited. 32 In the Courtroom As a juror, you need to know what to expect once you arrive in the courtroom. The courtroom staff will take roll to assure all jurors have arrived. You will be asked to take an oath as a prospective trial juror. The clerk will then call each prospective juror from a computerized random listing to sit in the jury box. Remember to always listen to the judge's and court staff's instructions. If you are in the jury selection process and have been ordered to return to the courtroom to continue that process on a future day, please return as instructed. If you have been selected as a sworn juror, please follow the judge s or court staff s instructions and arrive promptly. If your court is not in session on a particular day during the trial, you may ask what are you to do? Well, if your court is not in session and you have been selected as a sworn juror and you are employed, you must return to work. If you are retired or not employed, you may follow your normal schedule and report back to the courtroom per the judge's instruction. If you are not selected as a juror and are excused from the courtroom during the jury selection process, you must return to the jury assembly room for further processing. If staff has not received a release for the jurors, you will be placed back in the jury pool for other jury selections in that courthouse. If you are selected and become a sworn juror, please let your employer know.
