2 We, the people decree and expressly reject the dismissal of Constitutional Court case no: CTT 19/14 on numerous grounds, including those stated in all previous communications as per common law case no: 2013/06/S11 but not limited to the following: Furthermore, sufficient cause is evident that the Justices acting as representatives of the Constitutional Court representing the land have made an error in judgment regarding the subject matter jurisdiction of this case. When the Justices representing the Honourable Court make a judgment and when they use their discretion they may exercise it. However, when they act outside of the Bill of Rights, the spirit, purport and objects thereof, it is not allowed. Thus, when such a decision is made it is made outside the Constitutional Court and if the Registrar accepts the judgment, it becomes an error in procedure. The Justices are invited to develop the common law in accordance with the spirit, purport or objects of the interpretation of the Bill of Rights rule 39. The Justices are failing in their duty and to not do so is procedurally unfair and in consequence thereof now renders any order or judgment null and void. Furthermore, aforementioned Justices have failed in all instances and cases to respond when according to the Bill of Rights: 33(2) Everyone whose rights have been adversely affected by administrative action has the right to be given written reasons. As the Justices are the defendants in this case there can be no rule making. The Presidency is constitutionally obligated to institute Judges to oversee this case in consultation with the people. In consequence of the herein-mentioned and due to numerous complaints having been filed by the people with this court of record regarding various activities by various agents of the REPUBLIC OF SOUTH AFRICA (Pty) Ltd, a Commission of Inquiry has been launched, hereinafter Tribunal Commission, and will formally convene by public notice and gazette: Date: Location: 29th of April to 1 st of May Constitutional Hill; Event Space Arena, below Constitutional Court; 1 Hospital Street; Constitution Hill; Braamfontein; JHB; ZA 2
3 We, the people have formally and by express wish invited the man, also known as Pope Francis to send a delegation from the Vatican Curia to observe and participate in this people s Tribunal Commission as per the Motu Propria issued on the 11 th of July 2013 so as to hold all equal before the law as per the Golden Rule. The Presidency and other key Officials will be invited to participate. Sources of South African Law South Africa's law is sourced from (1) statutory law made by the legislative body (the most important of which is of course the Constitution), (2) common law (this includes the Roman-Dutch 'old authorities' and judicial precedent gleaned from case law), (3) African customary law, and (4) foreign and international law. Note that Custom, and Legal scholarship are not in themselves sources of law, although they inform the interpretation and application of law. Sources of law that are binding or authoritative must be followed by judges in making decisions, while persuasive sources are not binding on their decisions. The authoritative effect of a source for a particular decision depends on the type of source, the position of the judge in the hierarchy of courts, and the other sources that are relevant to the question at hand. Roman-Dutch authorities It follows that if one's task is to research the provisions of a particular law applicable in South Africa, one should consult the codified legislation, case law and failing this, one can follow the originating sources, i.e. English Law or Roman-Dutch Law (also known as "the Old Authorities") as the case may be. Any application of such a source must be lawful within the context of the Constitution and the spirit in which it was written. It is noticed by this court of record that agents of REPUBLIC OF SOUTH AFRICA (Pty) Ltd are now unknowingly or knowingly engaging in, or are party to unlawful activities which are in violation of the Bill of Rights and which are by definition of Black s Law Dictionary 4 th Edition: fraudulent or dishonest acts: One which involves bad faith, a breach of honesty, a want of integrity, or moral turpitude. Hartford Acc. & Indem. Co. v. Singer, 185 Va. 620, 39 S.E. 2d 505, 507, 508. All our communications, thus far, now stand as truth in commerce and as truth in fact. Know that there is more to follow. 3
4 Order: Justices are hereby ordered to cease and desist all further rulings and to hold them in abeyance of fraud and dishonesty until the Tribunal Commission has convened, heard and ruled on all complaints of and by the people and in consultation with UZA. In addition, people may be summoned by this court of record in their private capacity, under the pains of penalty of perjury, to appear before the Tribunal Commission. Anyone summoned and failing to appear may be found to be in contempt of this court of record and may be imprisoned or placed under people s house arrest if found guilty of such a plaint. Furthermore, the Tribunal Commission will decree and require full cooperation by people acting as agents of the REPUBLIC OF SOUTH AFRICA (Pty) Ltd when and if information is required as to the promotion of access to information (refer to rule 32 of the Bill of Rights) and as to the promotion of just administrative action (refer to rule 33 of the Bill of Rights). Conclusion It is of national importance and in the public interest to be given a proper forum by common law public hearing by declaration and with the involvement of all interested parties to hear, establish and settle any and all just debts, claims, costs and judgments as well as all issues incidental to and challenging the same rule of law in order to promote just administrative action and efficient administration. To not do so is a travesty of justice and we the people will take further lawful action as to the peace and freedom of all people on the land to ensure that all are equal before the law and that no-one acts as if above the law. In the celebrated words of Justice Brandeis in Olmstead vs United States: If the Government becomes a lawbreaker, it breeds contempt for the law, it invites every man to become a law unto himself; it invites anarchy. Falsa orthographia, sive falsa grammatica, non vitiate concessionem. Neither faulty spelling nor faulty grammar will vitiate a grant or a wish. Neither false Latin nor false English will make a deed void when the intent of the parties plainly appears as per the Plain Language Movement and the Golden Rule. all right reserved. 4
