II 7 An Act Respecting Thc Bank of Nova Scotia Trust Company, Montreal Trust Company of Canada and Montreal Trust Company (Assented to May 9, 1997) Be it enacted by the Governor and Assembly as follows: Short title 1 This Act may be cited as The Bank of Nova Scotia Trust Company Act. Purpose of Act 2 The purpose of this Act is to provide for the transfer of the personal trusteeship business of both Montreal Trust Company of Canada and Montreal Trust Company to The Bank of Nova Scotia Trust Company so that the rights and obligations of those who have relations with Montreal Trust Company of Canada, Montreal Trust Com pany and The Bank of Nova Scotia Trust Company with respect to that personal trusteeship business may be clearly determined. effective date defined 3 In this Act, effective date means the date on which The Bank of Nova Scotia Trust Company acquires the personal trusteeship and personal agency business of Montreal Trust Company of Canada and Montreal Trust Company. Exceptions from application of Act 4 (1) This Act does not apply to (a) real or personal property owned or held by, vested in or granted to Montreal Trust Company of Canada or Montreal Trust Company and that is held by Montreal Trust Company of

12 1997 CHAPTER2 4GELIZ.II 9 (ii) any document or trust to which Section 5 would otherwise apply pursuant to which Montreal Trust Company of Canada or Montreal Trust Company, as the case may be, acts as trus,tee for unit holders in respect of any oil or gas royalty trust fund, (iii) any document or trust to which Section 5 would otherwise apply pursuant to which Montreal Trust Company of Canada or Montreal Trust Company, as the case may be, acts as manager, advisor, registrar or transfer agent, and (iv) any document or trust to which Section 5 would otherwise apply pursuant to which Montreal Trust Company of Canada or Montreal Trust Company, as the case may be, acts as custodian or trustee for the benefit of one or more persons under a plan or other arrangement established by a corporation, partnership or other entity or person other than a natural person. (2) Notwithstanding clause (1)(b), (a) for all real or personal property situate outside the Province for which Montreal Trust Company of Canada or Montreal Trust Company has been appointed, or is entitled to be appointed, by a court of the Province as personal repres entative of a deceased person, whether as exec utor, administrator or otherwise, The Bank of Nova Scotia Trust Company may, upon applica tion to that court, be appointed personal repres entative in the place of Montreal Trust Company of Canada or Montreal Trust Company, as the case may be, with respect to that property; and (b) for all real or personal property situate outside the Province not coming within clause (a), but held by Montreal Trust Company of Canada or Montreal Trust Company under a document or trust to which Section 5 applies, for which the Supreme Court of Nova Scotia has jurisdiction

(2) Subsection (1) applies to every document and trust described in that subsection even if the real or personal property held by Montreal Trust Company of Canada or Montreal Trust Company under the document or trust is situate outside the Province. (3) Where an instrument specified or described in subsection (1) names Montreal Trust Company of Canada or Montreal Trust Company to any office or position described in that subsection and the instrument takes effect after the effective date, The Bank of Nova Scotia Trust Company is deemed to be named in the instrument in the place of Montreal Trust Company of Canada or Montreal Trust Company, as the case may be. Vesting of property 6 (1) Subject to Section 4, all real and personal property and every interest therein that is granted to, held by or vested in Montreal Trust Company of Canada or Montreal Trust Company, whether by way of security or otherwise, in trust, or in the custody, care or control of Montreal Trust Company of Canada or Montreal Trust Company, for or for the benefit of any other natural person or purpose, pursuant to or in respect of every document and trust to which Section 5 applies, and whether in the form in which it was originally acquired by Montreal Trust Company of Canada or Montreal Trust Company, as the case may be, or otherwise is vested on the effective date in The Bank of Nova Scotia Trust Company according to the tenor of and at the time indicated or intended by the document or trust, upon the same trusts, and with the same powers, rights, immunities and privileges, and subject to the same obligations and duties as are thereby provided, granted or imposed. (2) For greater certainty, subject to Section 4, for the purpose of every Act affecting the title to property, both real and personal, the vesting of title in The Bank of Nova Scotia Trust Company of every property affected by subsection (1) is effective without the registration or filing of this Act, or of any other instrument, document or certificate

15 12 46 ELIZ. II CHAPTER showing the change of title, in any public office whatsoever within the jurisdiction of the Province. Effect on proceedings 7 (1) No proceeding being carried on and no power or remedy being exercised by or against Montreal Trust Company of Canada or Montreal Trust Company as executor, administrator, trustee, personal representative or in any other capacity referred to in subsection 5(1) in any court of the Province, or before any tribunal or agency of the Province, pursuant to or in respect of a document or trust to which Section 5 applies, is discontinued or affected on account of this Act but, notwithstanding the Civil Procedure Rules. may be continued in the name of The Bank of Nova Scotia Trust Company, which has the same rights, is subject to the same liabilities and shall pay or receive the same costs and awards as if the proceeding had been commenced or defended in the name of The Bank of Nova Scotia Trust Company. (2) A proceeding or a power, right, remedy or right of distress that might have been brought or exercised by or against Montreal Trust Company of Canada or Montreal Trust Company as executor, administrator, trustee, personal representative or in any other capacity referred to in subsection 5W) pursuant to or in respect of a document or trust to which Section 5 applies, may be brought or exercised by or against The Bank of Nova Scotia Trust Company, which has the same rights and is subject to the same liabilities in respect thereof as those that Montreal Trust Company of Canada or Montreal Trust Company, as the case may be, would have had if this Act had not been enacted. (3) In a proceeding that has been continued or commenced in the name of The Bank of Nova Scotia Trust Company under subsection (1) or (2), Montreal Trust Com pany of Canada or Montreal Trust Company, as the case may be, and its officers and employees is deemed to have been acting on behalf of The Bank of Nova Scotia Trust Company in performing any act, whether before or after this Act comes into force, involving the administration of a document or trust to which Section 5 applies, and for purposes of examination for discovery or production of documents in

II 13 relation to any such proceeding, Montreal Trust Company of Canada or Montreal Trust Company, as the case may be, and its officers or employees are subject to the same obligations as if this Act had not been enacted. Preservation of claims 8 Nothing in this Act affects the rights of any person having a claim against Montreal Trust Company of Canada or Montreal Trust Company in respect of a docu ment or trust to which Section 5 applies, or releases, modifies or affects the liability of Montreal Trust Company of Canada or Montreal Trust Company to any such person, but all such rights as may be enforceable in the Province may be asserted against The Bank of Nova Scotia Trust Company, which is responsible for all debts, liabilities and obligations of Montreal Trust Company of Canada and Montreal Trust Company, as the case may be, in respect of any such document or trust. Method of payment and registration 9 (1) Where a person is under an obligation to make payments in relation to property that is vested in The Bank of Nova Scotia Trust Company by subsection 6(1), the person may make the payments to Montreal Trust Company of Canada or Montreal Trust Company, as the case may be, until the Bank of Nova Scotia Trust Company gives or causes to be given notice, in writing, to the person that payment shall be made to The Bank of Nova Scotia Trust Company, and thereupon the person s obligation is owed to The Bank of Nova Scotia Trust Company. (2) For greater certainty, any instrument deal ing with property that is vested in The Bank of Nova Scotia Trust Company by subsection 6(1), but that remains regis tered in the name of Montreal Trust Company of Canada or Montreal Trust Company or any predecessor trust or loan company of Montreal Trust Company of Canada or Montreal Trust Company, in any public office of the Province or in respect of which Montreal Trust Company of Canada or Montreal Trust Company is shown by a document of title as having legal ownership thereof, may be executed by The Bank of Nova Scotia Trust Company and may contain a recital referring to the vesting under this Act.

II 15 An Act Respecting Certain Financial Measures (Assented to May 9, 1997) Be it enacted by the Governor and Assembly as follows: Short title 1 This Act may be cited as the Financial Measures (199 7)Act. PART! EQUITY TAX CREDIT ACT Equity Tax Credit Act amended 2 Section 2 of Chapter 3 of the Acts of 1993, the Equity Tax Credit Act, as amended by Chapter 2 of the Acts of 1995, is further amended by (a) striking out 1997 in the fifth line of subclause (h)(i) and substituting 2001 ; (b) striking out 1997 in the third line of subclause (h)(ii) and substituting 2001 ; and Cc) striking out 1997 in the fourth line of clause (j) and substituting Clause 6(1)(a) of Chapter 3 is amended by striking out 1997 in the fifth line and substituting 2001.

(4) Subsections 181.5(4) to (7) of the Federal Act apply for the purpose of this Part. (5) In this Section, a corporation is related to another corporation or is a member of a related group within the meaning assigned to those expressions by section 251 of the Federal Act. 34 1997 CHAPTER4 46ELIZ.H 31 An Act Respecting the Delivery and Sale of Natural Gas in the Province (Assented to May 9, 1997) Be it enacted by the Governor and Assembly as follows: Short title 1 This Act may be cited as the Gas Distribution Act. Purpose of Act 2 The purpose of this Act is to (a) provide a framework for the orderly development and operation of a gas delivery system in the Province; and (b) allow for fair competition in the sale of gas for consumption in the Province. Interpretation 3 In this Act, (a) Board means the Nova Scotia Utility and Review Board; (b) franchise means a franchise granted pursuant to this Act to construct and operate a gas delivery system; (c) gas means (i) natural gas after it has been subjected to any processing, (ii) coal gas as defined in the Petroleum Resources Act,

II CHAPTER (iii) any substance removed from natural gas, crude oil, oil sands or coal for delivery in gaseous state, (iv) to be gas; (d) any substance declared by the Board gas delivery system means (i) any pipes, equipment, apparatus, mechanism, machinery, instrument or storage facility incidental to the delivery of gas for ulti mate consumption, (ii) any building or structure that houses or protects anything referred to in subclause (i), but does not include a tank car, tank wagon, cylinder or vessel for the delivery of liquefied petroleum gas, including propane and butane, unless such are operated in conjunction with or ancillary to a gas deliv ery system; (e) person includes a partnership; (fl prescribed means, except where the con text otherwise requires, prescribed by the Board by regulation. GRANTING OF FRANCHISE Requirement for franchise 4 Notwithstanding any enactment, no person shall construct or operate a gas delivery system except pursuant to a franchise. Application for franchise 5 (1) A person may apply to the Board, in the time and in the manner prescribed, for a franchise. (2) Notwithstanding subsection (1), the Board may invite applications for a franchise in the time and in the manner prescribed.

36 1997 CHAPTER 4 46 ELIZ. II 33 Required information 6 When submitting an application pursuant to Section 5, the applicant shall provide to the Board the pre scribed information. Public comment and hearing 7 (1) Upon receipt of an application pursuant to subsection 5(1), the Board shall give notice to the public of the receipt of the application. (2) Upon receipt of an application pursuant to Section 5, the Board shall invite public comment on the application and, where in the opinion of the Board it is advis able to do so, hold a public hearing. Grant of franchise 8 (1) The Board may grant a franchise. (2) Before granting a franchise, the Board shall be satisfied that the granting of the franchise is in the public interest and shall take into consideration the following factors: (a) potential; (b) plies; the existence of markets, actual or the availability of adequate gas sup (c) the economic feasibility of the pro posed gas delivery system; anb (d) the financial capability of the applic (e) related experience of the applicant in the delivery of gas; (1) the plans of the applicant to provide service in the franchise area; and (g) such other factors as are prescribed by the Governor in Council.

37 34 46 ELIZ. II CHAPTER (3) The granting of a franchise by the Board is subject to the approval of the Governor in Council. (4) Notwithstanding anything contained in this Act, a public utility as defined in the Public Utilities Act shall not be granted a franchise pursuant to this Act. (5) For greater certainty, nothing in subsection (4) precludes an affiliate or subsidiary of a public utility as defined in the Public Utilities Act from applying for and being granted a franchise pursuant to this Act. Terms and conditions of franchise 9 (1) A franchise (a) shall be for such term as is determined by the Board and may be renewed in accordance with the regulations; and (b) is subject to such terms and conditions as may be specified by the Board or prescribed by the Governor in Council. (2) Notwithstanding Section 43, Section 78 of the Public Utilities Act applies mutatis mutandis to the holder of a franchise within or partly within a regional municipality, town or a municipality of a county or district. Amendment and consolidation of franchise 10 (1) The holder of a franchise may apply to the Board, in the time and in the manner prescribed, to (a) franchise; amend the terms or conditions of the (b) expand the geographical boundaries of the franchise; (c) consolidate non-contiguous franchises granted to the applicant. CONSTRUCTION AND OPERATION OF GAS DELIVERY SYSTEM Prohibited acts 19 A person to whom a franchise is granted shall not (a) construct a gas delivery system or any part thereof, except pursuant to a permit; or (b) operate a gas delivery system, except pursu ant to a licence, issued by the Board pursuant to the Pipeline Act. Application of Pipeline Act 20 The Pipeline Act applies to a gas delivery system and, for greater certainty, a reference in that Act to the Energy Board shall be read and construed as a reference to the Board. RATES 21 (1) The holder of a franchise shall not impose, observe or follow rates, tolls or charges except those that are specified in a tariff that has been filed with the Board and approved by an order of the Board. (2) Where the holder of a franchise is the only customer of that franchise, the Board may exempt the holder of the franchise from the requirements of subsection (1). Approval and fixing of rates, tolls and charges 22 (1) The Board may, on its own initiative or on the application of a person having an interest, by order in writing, approve or fix just and reasonable rates, tolls or

(2) Where an offence referred to in subsection (1) is committed by a person on more than one day or is con tinued for more than one day, it shall be a separate offence for each day on which the offence is committed or continued. (3) A tenant of a mobile home park space who receives a notice of increase of rent on or after the twentieth day of December, 1996, but before the coming into force of this Section, may make an applica tion pursuant to Section 14, within thirty days of the coming into force of this Section, to have the notice of rent increase reviewed. (4) A tenant of a mobile home park space who receives a notice of increase of rent after the coming into force of this Section may, within thirty days of receipt of the notice, make an application pursuant to Section 14 to have the notice of rent increase reviewed. 6 Subsection 12(6) of Chapter 401 is amended by striking out under Section 14 or 18 or a complainty in the fifth and sixth lines. 7 The heading immediately preceding Section 13 and Sections 13 to 17 of Chapter 401 are repealed and the following heading and Sections substituted: PROCEDURES 13 (1) Where a person applies to the Director (a) to determine a question arising under this Act; or

II 55 (3) Where a matter is settled by medi ation, the Director may, if a party fails to comply with the terms on which the matter was settled, make an order pursuant to Section 17A. 17 (1) Where, after investigating the matter, the Director determines that the parties are unlikely to settle the matter by mediation, the Director shall, within fourteen days, make an order in accordance with Section 17A. (2) The Director is not disqualified from making an order respecting a matter by reason of hav ing investigated or endeavoured to mediate the matter. 17A An order made by the Director may (a) require a landlord or tenant to comply with a lease or an obligation pursuant to this Act; (b) require a landlord or tenant not to again breach a lease or an obligation pursuant to this Act; (c) require the landlord or tenant to make any repair or take any action to remedy a breach, and require the landlord or tenant to pay any reasonable expenses associated with the repair or action; (d) order compensation to be paid for any loss that has been suffered or will be suffered as a direct result of the breach; (e) terminate the tenancy on a date specified in the order and order the tenant to vacate the residential premises on that date; (1) determine the disposition of a security deposit; (g) direct that the tenant pay the rent in trust to the Director pending the performance by the landlord of any act the landlord is required by

(2) An appeal may be commenced by filing with the Director, within ten days of the making of the order, a notice of appeal in the form prescribed by regulation accompanied by the fee prescribed by regulation. (3) The appellant shall, in the manner prescribed by regulation, serve a copy of the notice of appeal and the notice of hearing on all parties to the order. (4) The board shall conduct the hearing in respect of a matter for which a notice of appeal is filed. (5) The board shall determine its own practice and procedure but shall give full opportunity for the parties to present evidence and make sub missions. (6) The board may conduct a hearing orally, including by telephone, or in writing or partly in writing and partly orally.

II 61 An Act to Incorporate the Antigonish Heritage Museum Board (Assented to May 9, 1997) Be it enacted by the Governor and Assembly as follows: 1 This Act may be cited as the A ntigonish Heritage Museum Board Act. 2 In this Act, (a) Association means the Heritage Associ ation of Antigonish; (b) Board means the Antigonish Heritage Museum Board; (c) Mayor means the Mayor of the Town; (d) Municipal Council means the Council of the Municipality; Ce) municipal councillor means a member of the Municipal Council; CO Municipality means the Municipality of the County of Antigonish; (g) Museum; (h) (i) Town; Museum means the Antigonish Heritage Town means the Town of Antigonish; Town Council means the Council of the (j) town councillor means a member of the Town Council;

(2) All moneys required for each payment pursuant to subsection (1) shall be held to be money required for the ordinary lawful purposes of the Town and the Municipality and shall be levied, raised and collected in all respects as other monies required for the ordinary lawful purposes of the Municipality and the Town are levied, raised and collected. 11 (1) The Board may not make an expenditure except in accordance with an annual budget approved by the Municipal Council and the Town Council. (2) The budget of the Board shall be submitted to the Town and the Municipality in February of each year. 12 The fiscal year of the Board shall be the period from April 1st in any year to March 31st in the following year. 13 The Board shall, not later than January 31st in each year, submit to the Municipal Council and the Town Council an audited statement for the fiscal year immediately preceding. 14 (1) The land on which the Museum is now located and the building that now houses the Museum are exempt from taxation imposed by the Town or the Muni cipality for general municipal purposes as long as they are used by the Board as a Museum.
