1 1 OPHTHALMIC DISPENSERS O-5 REG 1 The Ophthalmic Dispensers Regulations Repealed by The Ophthalmic Dispensers Regulatory Bylaws (2005), published in Part I of The Saskatchewan Gazette, December 2, Formerly Chapter O-5 Reg 1 (effective December 24, 1981) as amended by Saskatchewan Regulations 15/83. 3 3 OPHTHALMIC DISPENSERS O-5 REG 1 CHAPTER O-5 REG 1 The Ophthalmic Dispensers Act TITLE AND INTERPRETATION Title 1 These regulations may be cited as The Ophthalmic Dispensers Regulations. Interpretation 2 In these regulations: (a) Act means The Ophthalmic Dispensers Act; (b) extended wear lens means a contact lens which is intended by a prescriber to be worn continuously for a period of time in excess of that normally accepted for the wearing of contact lenses, but does not include a therapeutic lens; (c) penalty fee means the amount charged as a penalty for late payment of a fee as set out in clause 11(2)(g); (d) prescriber means a person who issues and signs a prescription; (e) prescription means an order in writing; (f) therapeutic lens means a contact lens prescribed by a duly qualified medical practitioner as treatment of a disease of or injury to the eye; (g) year means the period commencing on April 1 in one year and ending on March 31 in the following year, and annual has a corresponding meaning. 24 Dec 81 co-5 Reg 1 s2. REGISTRATION AND LICENSING Qualifications of ophthalmic dispenser 3(1) A person may be registered as an ophthalmic dispenser where he: (a) produces evidence of good character; (b) pays the fee prescribed in these regulations; (c) maintains his principal residence in Saskatchewan or produces evidence satisfactory to the council that he will become such a resident if his application for registration is accepted; (d) has passed an examination prescribed by the council and conducted by the board of examiners in: (i) anatomy of the eye;

4 4 O-5 REG 1 OPHTHALMIC DISPENSERS (ii) visual disorders; (iii) terminology and definitions in ophthalmic dispensing; (iv) the use of lenses to correct visual disorders; and (v) practical aspects of ophthalmic dispensing; and (e) submits proof of current registration with an association in Canada whose standards for registration are determined by the council to be equivalent to those prescribed by these regulations, or he has successfully completed a course in ophthalmic dispensing that is approved by the council. (2) Clause (1)(c) does not apply to a person who indicates by a written declaration that his practice in Saskatchewan will be restricted to the fitting of artificial eyes. 24 Dec 81 co-5 Reg 1 s3. Application for registration 4 An application for registration is to be completed in full in the form prescribed by the council and forwarded with the fee prescribed in these regulations to the registrar. 24 Dec 81 co-5 Reg 1 s4. Licence 5(1) An application for a licence is to be: (a) made on or before April 1 in each year; (b) in the form prescribed by the council; and (c) forwarded, with the fee prescribed in clause 11(2)(b), to the registrar. (2) Where an applicant for registration was not a resident of Saskatchewan on the date of his application and he is accepted for registration, his licence is effective on and from the date that he establishes his principal residence in Saskatchewan. 24 Dec 81 co-5 Reg 1 s5. Notice to renew licence 6 During the period commencing at least 60 days prior to April 1 in each year, the registrar shall give each member notice in writing, addressed to the member at his most recent address stated in the register, that his licence will expire unless he renews it in accordance with these regulations. 24 Dec 81 co-5 Reg 1 s6. Notice of expiration of licence 7 Where an ophthalmic dispenser fails to pay the fee prescribed in clause 11(2)(b) in accordance with these regulations, the registrar shall notify that ophthalmic dispenser, by registered mail addressed to him at his most recent address stated in the register, that his licence and membership with the association have expired. 24 Dec 81 co-5 Reg 1 s7.

5 5 OPHTHALMIC DISPENSERS O-5 REG 1 Contact lens technican licence 8 A person applying to the registrar for a contact lens technician licence shall: (a) (b) produce evidence of good character; and make application in the form prescribed by the council. 24 Dec 81 co-5 Reg 1 s8. FEES Payment of fees for licence 9(1) Fees for a licence are due by April 1 in each year. (2) Where a member is in arrears of payment pursuant to subsection (1) for a period of not more than three months, he may become a member in good standing upon payment of the fee for the licence and of the penalty fee. (3) Where a member fails to make payment within the period set out in subsection (2), the registrar shall strike that member s name from the register, and the registrar shall only reinstate that member: (a) (b) (c) upon the member s making application to the council; subject to any terms and conditions that the council may prescribe; and upon payment of the penalty fee. 24 Dec 81 co-5 Reg 1 s9. Fees re contact lens technician 10(1) The fee for a licence as a contact lens technician is due on or before December 31 in each year. (2) Subsections 9(2) and (3) apply, mutatis mutandis, to a contact lens technician. 24 Dec 81 co-5 Reg 1 s10. Fees generally 11(1) All fees required by the Act or these regulations to be paid are to be forwarded to the registrar. (2) The fee for: (a) registration as an ophthalmic dispenser is $100; (b) a licence as an ophthalmic dispenser is $250 annually; (c) a licence as a contact lens technician is $150 annually; (d) an inactive ophthalmic dispenser is $25 annually; (e) registration as a student is $10; (f) membership as a student is $20 annually; (g) late payment of any fee mentioned in clauses (a) to (f) is $50.

6 6 O-5 REG 1 OPHTHALMIC DISPENSERS (3) Where, after October 1 in any year, an ophthalmic dispenser: (a) becomes registered pursuant to the Act; or (b) returns from inactive to active status; one-half of the licence fee for that year is required to be paid. (4) Where a contact lens technician becomes registered pursuant to the Act after June l in any year, only one-half of the licence fee for that year is required to be paid. 24 Dec 81 co-5 Reg 1 s11; 11 Mar 83 SR 15/83 s2. Inactive member 12(1) Where an ophthalmic dispenser does not intend to carry on business as such, he may elect to be an inactive member, and, in that case, he shall file a declaration confirming his intention not to carry on that business and shall pay the fee prescribed in clause 11(2)(d). (2) An inactive member is entitled to all the benefits of registration except the right to carry on business as an ophthalmic dispenser and the right to vote. 24 Dec 81 co-5 Reg 1 s12. Reinstatement as active member 13(1) Subject to subsection (2), an inactive member may become an active member upon application to the registrar and upon payment of the fee prescribed in clause 11(2)(b). (2) Where a person has been an inactive member for more than three years from the date he filed a declaration pursuant to subsection 12(1), he is entitled to be reinstated as an active member upon payment of the fee prescribed in clause 11(2)(b) and by complying with any terms and conditions that the council may impose pursuant to section Dec 81 co-5 Reg 1 s13. PROFESSIONAL CONDUCT, COMPETENCE AND PROFICIENCY Spectacles, eyeglasses 14 Spectacles or eyeglasses are to be dispensed only according to a prescription of an optometrist or a duly qualified medical practitioner. 24 Dec 81 co-5 Reg 1 s14. Prohibition re ophthalmic dispenser 15 Except as may be otherwise provided in these regulations, no ophthalmic dispenser shall measure ocular refractive error, determine its correction or diagnose conditions of the eye. 24 Dec 81 co-5 Reg 1 s15.

7 7 OPHTHALMIC DISPENSERS O-5 REG 1 Copy of prescription 16 Copies of a prescription for a patient are to be made available to that patient upon his written request. 24 Dec 81 co-5 Reg 1 s16. Powers of ophthalmic dispenser 17 Subject to subsection 18(2), an ophthalmic dispenser may supply and dispense duplications of, replacements of, reproductions of, or repetitions of spectacles or eyeglasses without a prescription. 24 Dec 81 co-5 Reg 1 s17. Limitations re dispensing 18(1) No ophthalmic dispenser shall dispense spectacles or eyeglasses where he is unable to interpret a prescription unless he consults with the prescriber. (2) No ophthalmic dispenser shall dispense duplications of, replacements of, reproductions of or repetitions of spectacles or eyeglasses where he is unable to determine the prescription accurately from the lenses of the patient s existing eyeglasses or spectacles unless he consults with the prescriber or counsels the patient to obtain another prescription. 24 Dec 81 co-5 Reg 1 s18. DISCIPLINE Duty of council re complaint 19(1) Where a complaint is received by the council respecting a member, the chairman of the council shall conduct a preliminary investigation of that complaint and submit a written report of his findings to the council. (2) Where the council is of the opinion that further investigation is warranted or where the complaint involves an allegation of professional misconduct or professional incompetence, the council shall inquire into and determine the matter in accordance with the Act. 24 Dec 81 co-5 Reg 1 s19. Notice of inquiry 20(1) The council shall give notice to the member who is the subject of an inquiry under subsection 19(2) at least 10 days prior to the date on which that inquiry is to be held, and the notice is to include particulars of the complaint. (2) A notice pursuant to subsection (1) is to be served on the member by personal service. 24 Dec 81 co-5 Reg 1 s20.

8 8 O-5 REG 1 OPHTHALMIC DISPENSERS Powers of council on inquiry 21 For the purposes of an inquiry pursuant to subsection 19(2): (a) the council may require the attendance of the member who is the subject of the inquiry and the attendance of any other person whose evidence the council may require; (b) the chairman of the council has all the powers of commissioners under The Public Inquiries Act; and (c) the council may retain legal counsel and any other professional advisors that it considers necessary. 24 Dec 81 co-5 Reg 1 s21. Rights of member 22 The member who is the subject of an inquiry under subsection 19(2) is entitled: (a) (b) (c) to attend that inquiry; to be represented by legal counsel; and to present evidence in his own defence. 24 Dec 81 co-5 Reg 1 s22. Report re inquiry 23 Upon completion of an inquiry under subsection 19(2), the council shall prepare a written report of its decision, together with reasons, and forward a copy of that report to the member who is the subject of the inquiry and to his legal counsel, if any. 24 Dec 81 co-5 Reg 1 s23. Professional misconduct 24 For the purposes of the Act, professional misconduct means any misconduct relating to the provision of services to the public by a member and includes: (a) the failure of a member to abide by the terms, conditions or limitations of his licence; (b) the alteration of a prescription without the consent of the prescriber; (c) the rebate or remission, directly or indirectly, of any portion of the price of contact lenses or ophthalmicappliances or the granting of any discount or concession or of any benefit of any kind to any optometrist or duly qualified medical practitioner; (d) being mentally or physically incapable of practice as an ophthalmic dispenser; (e) the practising as an ophthalmic dispenser while his ability to perform any services is impaired by alcohol or drugs;

9 9 OPHTHALMIC DISPENSERS O-5 REG 1 (f) being convicted of an offence that, in the opinion of the council, renders it inappropriate for a member to continue to practise as an ophthalmic dispenser; (g) the procurement of a licence or a contact lens technician licence by misrepresentation or fraud; (h) the falsification of a record in respect of a prescription for spectacles, eyeglasses or contact lenses; (i) the submission of a knowingly false or misleading account or of false or misleading charges; (j) the submission of an account or the charging of a fee, for an ophthalmic appliance or a contact lens, that is excessive or unreasonable in relation to the ophthalmic appliance or contact lens supplied; (k) a member s holding himself out as possessing special qualifications that he does not in fact possess; (l) the failure to fulfill the terms of any agreement with a person with respect to the fees to be charged for the provision of ophthalmic appliances or contact lenses to that person; (m) counselling or assisting: (i) any person not licensed; or (ii) any registered student under the Act; to practise as an ophthalmic dispenser; (n) knowingly permitting the premises in which a member practises to be used for unlawful or illegal purposes; (o) the refusal by a member to give entry at reasonable times to a duly appointed representative of the council for the purpose of inspecting the premises where the member practises or the refusal to the council s representative to inspect or examine the premises, facilities or equipment at any reasonable time. 24 Dec 81 co-5 Reg 1 s24. CONDITIONS ON PRACTISE Conditions on resumption of practise 25 The council may require any person who has not practised ophthalmic dispensing or contact lens technique for a period of three years or more: (a) to complete a refresher course and pass any examination that the council may approve; or

10 10 O-5 REG 1 OPHTHALMIC DISPENSERS (b) to work under the supervision of any person that the council may designate for a period of not more than 60 days and obtain a written statement from the designated supervisor endorsing the competence of the person being supervised. 24 Dec 81 co-5 Reg 1 s25. Prohibition 26 Unless otherwise authorized by the council, no contact lens technician shall fit or dispense extended wear lenses. 24 Dec 81 co-5 Reg 1 s26. Restricted licence 27 Where a restriction, limitation or condition is imposed upon a member or a contact lens technician, the licence is to be clearly marked restricted licence, and that member or contact lens technician shall have in his possession a complete description of the restriction, limitation or condition, and its duration. 24 Dec 81 co-5 Reg 1 s27. STUDENT OPHTHALMIC DISPENSERS Conditions of registration 28 A person may be registered as a student ophthalmic dispenser and be granted a student membership in the association upon: (a) completion of the application form prescribed by the council; (b) payment of the fees prescribed in clauses 11(2)(e) and (f); and (c) enrolling in a program of instruction in ophthalmic dispensing approved by the council or upon agreeing to enroll in such a program at the earliest date that one becomes available. 24 Dec 81 co-5 Reg 1 s28. Renewal of registration 29(1) Every student ophthalmic dispenser shall renew his membership on or before August 1 in each year by applicationin the form prescribed by the council and payment of the fee prescribed in clause 11(2)(f). (2) No person shall be registered as a student ophthalmic dispenser for a total period of more than 36 months unless otherwise authorized by the council. (3) Where a student ophthalmic dispenser does not renew his membership by August 1 in each year, the registrar shall notify that person that his membership has expired. 24 Dec 81 co-5 Reg 1 s29.

11 11 OPHTHALMIC DISPENSERS O-5 REG 1 Services of student 30 A person registered as a student ophthalmic dispenser may provide ophthalmic dispensing services only under the supervision of one of the following persons, who is physically present and who supervises, checks and approves the work of the student ophthalmic dispenser, as approved by the council: (a) (b) (c) a licensed ophthalmic dispenser; a duly qualified medical practitioner; or a duly qualified optometrist. 24 Dec 81 co-5 Reg 1 s30. Supervision of student 31 No ophthalmic dispenser shall supervise more than two student ophthalmic dispensers at any one time. 24 Dec 81 co-5 Reg 1 s31. Cancellation of registration 32 The registration and membership of a student ophthalmic dispenser may be cancelled by the council where the council is satisfied that: (a) the student is providing services additional to those authorized by these regulations; (b) the student is not receiving the supervision required by these regulations while providing services; (c) the application for registration contained incorrect statements that, had the council known them to be incorrect at the time the application was received, the council would not have registered the student; or (d) the student has discontinued the course required pursuant to clause 28(c). 24 Dec 81 co-5 Reg 1 s32. Reinstatement of student 33 Where the registrar strikes the name of a student from the register, that student may be reinstated, subject to any terms and conditions that the council may prescribe upon: (a) making application to the council; (b) enrolling in a program of instruction in ophthalmic dispensing approved by the council as soon as such a program becomes available; and (c) paying the prescribed membership and course fees. 24 Dec 81 co-5 Reg 1 s33.

12 12 O-5 REG 1 OPHTHALMIC DISPENSERS STUDENT CONTACT LENS TECHNICIANS Conditions of registration 34 A person who is licensed as an ophthalmic dispenser may be registered as a student contact lens technician and be granted a student contact lens technician membership in the association upon: (a) completion of the application form prescribed by the council; (b) payment of the fees prescribed in clauses 11(2)(e) and (f); and (c) enrolling in a program of instruction in contact lens technique approved by the council or upon enrolling in such a program at the earliest date that one becomes available. 24 Dec 81 co-5 Reg 1 s34. Services of student 35 A person registered as a student contact lens technician may provide contact lens technique services only under the supervision of one of the following persons, who is physically present and who supervises, checks and approves the work of the student contact lens technician, as approved by the council: (a) (b) (c) a holder of a contact lens technician licence; an optometrist; or a duly qualified medical practitioner. 24 Dec 81 co-5 Reg 1 s35. Supervision, etc. 36 Sections 29 and 31 to 33 apply, mutatis mutandis, with respect to student contact lens technicians. 24 Dec 81 co-5 Reg 1 s36. ADVERTISING Standard 37 Advertising by an ophthalmic dispenser or contact lens technician is to be seemly and dignified and may contain items of public information, such as the business or company name, location, services or products offered, hours of business, fees or prices and names and educational qualifications of the ophthalmic dispenser or contact lens technician. 24 Dec 81 co-5 Reg 1 s37. Prohibitions 38(1) No advertising by an ophthalmic dispenser or contact lens technician is to contain the term specialist or specializing in, and no person shall hold himself out to the public as a specialist in ophthalmic dispensing or contact lens technique.

13 13 OPHTHALMIC DISPENSERS O-5 REG 1 (2) No ophthalmic dispenser or contact lens technician shall state or imply that products or services provided by him or in the premises operated by him are superior to other similar products or services. (3) No ophthalmic dispenser shall use the initials O.D. or any other initials, title designation or business name in connection with himself or his place of business in such a way as to imply, or that may lead the public to believe, that he is an optometrist or is qualified to provide services under any statute other than the Act. 24 Dec 81 co-5 Reg 1 s38. EXAMINATIONS Ophthalmic dispensing 39(1) Subject to subsection (2), examinations in ophthalmic dispensing are to be held at any time and in any place that the council may determine. (2) Examinations pursuant to subsection (1) are to be held at least once each year where any person has applied for and is eligible to take the examination. 24 Dec 81 co-5 Reg 1 s39. Contact lens technique 40 Examinations in contact lens technique are to be conducted once each year at any time and in any place that the council may determine. 24 Dec 81 co-5 Reg 1 s40. Subjects for examination 41 Examination subjects are: (a) (b) with respect to ophthalmic dispensing: (i) anatomy of the eye; (ii) visual disorders; (iii) terminology and definitions in ophthalmic dispensing; (iv) the use of lenses to correct visual disorders; and (v) practical aspects of ophthalmic dispensing; with respect to contact lens technique, for the written portion: (i) anatomy and physiology of the eye; (ii) terminology and definitions; (iii) optics of the contact lens system; (iv) soft contact lenses and their use; and (v) hard contact lenses and their use; and

14 14 O-5 REG 1 OPHTHALMIC DISPENSERS (c) with respect to contact lens technique, for the practical portion: (i) keratometry and its application; (ii) inspection and modification; (iii) use and application of the slit lamp; and (iv) corneal staining and the use of fluorescein. 24 Dec 81 co-5 Reg 1 s41. Marks 42 To pass the examination in ophthalmic dispensing a person shall receive a mark of at least 50% in the examination for each of the subjects described in clause 4l(a) and shall obtain an average mark of at least 60% in those subjects. 24 Dec 81 co-5 Reg 1 s42. Eligibility re ophthalmic dispensing 43 No person shall write an examination in ophthalmic dispensing unless he has completed a course in ophthalmic dispensing approved by the council or has received a waiver of that requirement from the council. 24 Dec 81 co-5 Reg 1 s43. Right to be examined more than once 44 A person who fails to obtain the marks prescribed in section 42 may apply to write examinations set at a future date for subsequent applicants. 24 Dec 81 co-5 Reg 1 s44. Eligibility re contact lens technique 45 No person is qualified to take any contact lens technique examination unless he has completed a course of study in contact lens technique that is approved by the council and has passed the examination in ophthalmic dispensing. 24 Dec 81 co-5 Reg 1 s45. Examination fees 46(1) The examination fee for: (a) ophthalmic dispensing is $100; (b) contact lens technique is $100; and is to be paid at the time of registration for the examination. (2) The fees prescribed in subsection (1) cover both the written and practical portions of the examination. 24 Dec 81 co-5 Reg 1 s46.

15 15 OPHTHALMIC DISPENSERS O-5 REG 1 Payment of fees 47 Examination fees are to: (a) be paid to the registrar; (b) accompany the application form for the examination; and (c) be submitted not less than five days prior to the date of the first examination. 24 Dec 81 co-5 Reg 1 s47. Equipment at examinations 48(1) Persons being examined pursuant to these regulations may bring only pocket calculators to the examination. (2) The council shall provide any reference material, equipment, lenses, frames or tables necessary for examinations. 24 Dec 81 co-5 Reg 1 s48. Examination date, etc. 49 The council has the right to assign an examination date, time and location to each person to be examined. 24 Dec 81 co-5 Reg 1 s49. SERVICES BY CONTACT LENS TECHNICIANS Power to dispense contact lenses 50(1) A contact lens may be dispensed by a contact lens technician only pursuant to a prescription for contact lenses signed by a duly qualified medical practitioner or optometrist. (2) A prescription for spectacles or eyeglasses does not constitute a prescription for a contact lens. (3) The dispensing of a contact lens does not include: (a) making a final assessment of the adequacy of the fit or the physiological adaptation of the eye to the lens; (b) arranging for the continued supervision and evaluation of a contact lens patient; or (c) making a decision with respect to whether a patient may continue to wear contact lenses. 24 Dec 81 co-5 Reg 1 s50. Patient to return to prescriber 51 Having dispensed a contact lens, a contact lens technician shall forward to the prescriber the physical specifications of the contact lens dispensed and shall direct his patient to return to the prescriber for a final assessment. 24 Dec 81 co-5 Reg 1 s51.

16 16 O-5 REG 1 OPHTHALMIC DISPENSERS Powers 52(1) A contact lens technician may measure the corneal radius. (2) Subject to the other provisions of these regulations, no contact lens technician shall measure ocular refractive error or determine its correction. (3) No contact lens technician shall diagnose conditions relating to the health of the eye. 24 Dec 81 co-5 Reg 1 s52. Change of lens power 53(1) No contact lens technician shall change the lens power as prescribed in a prescription without the written or verbal authorization of the prescriber. (2) Where a verbal authorization to change the lens power has been given by the prescriber, a contact lens technician shall request written confirmation from the prescriber. 24 Dec 81 co-5 Reg 1 s53. Replacement of contact lens 54(1) Where a request has been made to a contact lens technician for the replacement or duplication of a contact lens and the prescription is more than six months old, the contact lens technician shall take reasonable efforts to ensure that the prescription is the most recently issued prescription for the intended wearer. (2) Where the most recent contact lens prescription is more than two years old, a contact lens technician shall direct the intended wearer to be examined again for the purposes of determining the necessity for another prescription. 24 Dec 81 co-5 Reg 1 s54.
