1 RECRUITMENT TESTS SAMPLE QUESTIONS The information contained in these sample questions is constructed solely for the sample and do not necessarily reflect the views of TAFE SA or South Australia Police employees. Similarly, scenario problems presented are fictitious and any resemblance to any event is purely coincidental. Page 1 of 8

2 READING COMPREHENSION TEST The following example passages tests your ability to read and understand written English. Choose the most correct answer. Passage 1 The burden of proof can be defined as the job or onus of proving a case. The burden of proof is placed on one of the parties in a legal dispute. In criminal matters the burden of proof is placed on the prosecution. The prosecution must prove that the accused is guilty. In civil matters the burden of proof lies with the plaintiff. In an action for negligence it is the plaintiff who must establish that the defendant owed them a duty of care, breached that duty and suffered damage. The standard of proof refers to how much must be proved in order for a party to succeed. The standard is different in criminal and civil matters. In criminal matters the standard of proof required is beyond a reasonable doubt. The defendant s guilt must be proved beyond any reasonable doubt. In civil matters the standard is less onerous. The plaintiff must prove their case on the balance of probabilities. The court must be satisfied that the plaintiff s version of the facts is more probable than not. 4 Passage 2 Australia has an adversary system of trial. In some countries the system of trial is different; the inquisitorial system of trial is used. This is the case in most European countries, in Africa and South America. The origins of the adversary system of trial can be found in the legal system operating in England in the eighteenth and nineteenth centuries. The inquisitorial system of trial has its origins in France and Germany in the eighteenth and nineteenth centuries. We will now examine what a trial is and the key features of the adversary system of trial. A trial can be defined as the hearing of a dispute by a court in order to decide the truth. The adversary system of trial is marked by two main features. The first is that there are two opposing or adverse sides competing in respect of the same dispute and secondly there is an independent judge and jury to decide the dispute. An important feature of the adversary system of trial is that the parties to the dispute have control over the running of the case both before and during the trial. 8 WRITTEN EXPRESSION AND WRITING TEST This test measures your ability to express yourself clearly in written English. The following example sentences may include a combination of spelling, grammar and punctuation errors. Generate a corrected version of each sentence. 1.
