1 r PUBLIC SERVICE COMMISSION OF WEST VIRGINIA CHARLESTON Entered by the Public Service Coinmission of West Virginia, in the City of Charleston on the 20t day of December CASE NO PSD-CN BERKELEY COUNTY PUBLIC SERVICE SEWER DISTRICT Application for a Certificate of Convenience and Necessity to construct the Chesapeake Bay Compliance Project, including: (a) Baker Heights WWTP Upgrade; (b) Inwood WWTP Upgrade; (c) Opequon Hedgesville WWTP Upgrade; (d) North Area WWTP Upgrade; and (e) Gantt Pump Station Upgrade and Flow Diversion. COMMISSION ORDER On December 19, 2013, the Berkeley County Public Service Sewer District filed an application, duly verified, for a Certificate to construct certain additions and improvements to the public sewer system in Berkeley County. Pursuant to , West Virginia Code, IT IS ORDERED that the Berkeley County Public Service Sewer District give notice of the filing of said application, by publishing a copy of the attached Notice of Filing once in a qualified newspaper as provided in W. Va. Code et seq., published and of general circulation in counties where service is provided, making due return to this Coininission of proper certification of publication within thirty (30) days from the date of publication. 1 IT IS FURTHER ORDERED that within thirty (30) days of the date of this Order, the Berkeley County Public Service Sewer District shall have completed the mailing of separate notices to each of its customers by one or a combination of the following methods: (i) inclusion of the Form No. 14 Notice of Filing as a bill insert; (ii) separately mailing the Form No. 14 Notice of Filing; or (iii) only for utilities that bill by postcard instead of in an envelope, and who elect not to separately ;Bail the Form No. 14 Notice of Filing, inclusion of a statement on a postcard billing as follows: This utility is seeking a rate increase. Details available in newspaper publications or at the utility office after December E, 2013, by ca!!iag (304) , and the Utility sha!! have made due return to this Coininission of its affidavit as proper certification that the notice was provided.

NOTICE OF FILING On December 19, 20 13, the Berkeley County Public Service Sewer District (District) filed an application, duly verified, for a Certificate to construct certain additions and improvements to the public sewer system in Berkeley County. In order coinply with Federal EPA and West Virginia DEP discharge requirements for the rehabilitation of the Chesapeake Bay, which requirements shall become effective on or about December 3 1, 2015, the Berkeley County Public Service Sewer District is required to inalte upgrades and certain other modifications to the public sewer system. These upgrades and modifications affect the following facilities: Baker Heights Wastewater Treatment Plant located at 2069 Opequon Lane, Martinsburg, WV; Inwood Wastewater Treatment Plant located at 3454 Sulphur Springs Road, Inwood, WV; Opequon Hedgesville Wastewater Treatment Plant located at Eagle School Road, Martinsburg, WV; North Area Wastewater Treatment Plant located at 737 Scrabble Road, Martinsburg, WV; and Gantt (Mobile Home Park) Pump Station located on Harlan Springs Road (County Route 1) in Martinsburg, WV. The application is on file with and available for public inspection at the Public Service Commission, 20 1 Brooks Street, in Charleston, West Virginia. The District estimates that construction will cost approximately $47,73 8,000. It is proposed that the construction will be financed as follows: (1) Senate Bill 245 Grant in the approximate amount of $10,665,078; and, (2) State Revolving Fund (SW) and Infrastructure and Jobs /T Tr. fl, 1 rmnm Am?. nnn Eeveiopment Council (~JUL) loans in (ne approximate total amount or $5 /,u IL,YLL. 3

4 The District anticipates charging the following increased sewer rates for its customers: SCHEDULE I Applicable to all customers served by the Berkeley County Public Service Sewer District other than customers formerly served by Sylvan Grove Waste Treatment, Inc. Available for general domestic, commercial and industrial service. On all accounts not paid in full when due, ten percent (1 0%) will be added to the net current amount unpaid. This delayed payment penalty is not interest and is to be coliected only once for each biii where it is appropriate. TAP FEE The following charge is to be made whenever the utility installs a new tap to serve an applicant. A tap fee of $ will charged to customers applying for service outside of a certificate proceeding before the Coininission for each new tap to the system. 5 DELAYED PAYMENT PENALTY The above schedule is net. On all accounts not paid in full when due, ten percent (1 0%) will be added to the net current ainount unpaid. This delayed payment penalty is not interest and is to be collected only once for each bill where it is appropriate. The proposed increased rates and charges related to the project will produce approximately $5,408,174 annually in additional revenue, an increase of 40%. The total increase granted will not exceed this estimate unless further notice is provided. The increases shown are based on averages of all custoiners in the indicated class. Individual customers may receive increases that are greater or less than average. Furthermore, the requested rates and charges among the various classes of customers are only a proposal and are subject to change (increases or decreases) by the Public Service Cominission in its review of this filing. Anyone desiring to protest or intervene in this Certificate proceeding should file a written protest or request to intervene within thirty (30) days following the date of this publication unless otherwise modified by Coininission order. Failure to tiinely protest or intervene can affect your right to protest aspects of this certificate case or participate in hture proceedings. All protests or requests to intervene should briefly state the reason for the protest or request to intervene.
