I/We, the person/s named as the declarant/s in Schedule 1, solemnly and sincerely declare as follows: 1 I/We am/are the trustee/trustees (SMSF Trustee) of the superannuation fund named in Schedule 2 (SMSF Fund). 2 A certified true copy of the deed creating the SMSF Fund (SMSF Trust Deed) was provided to AMP Bank Limited ABN , AFSL/Australian Credit Licence number (AMP Bank). 3 The SMSF Fund has been established in accordance with and is currently fully compliant with the Superannuation Industry (Supervision) Act 1993 (Cth) (SIS Act). 4 Particulars of the beneficiaries of the SMSF Fund are shown in Schedule 3. 5 No changes have been made to the SMSF Trust Deed. 6 The SMSF Trust Deed is valid and effectual. 7 The SMSF Trustee as trustee for the SMSF Fund has not committed any breach of trust. 8 Under the SMSF Trust Deed, the SMSF Trustee as trustee for the SMSF Fund: (1) has power to borrow and is not prohibited from borrowing under limited recourse borrowing arrangements to acquire a residential investment property located at the address shown in Schedule 4 (Trust Property) pursuant to section 67A of the SIS Act; and (2) has power to invest and is not prohibited from investing in the Trust Property pursuant to section 67A of the SIS Act. 9 The company named in Schedule 5 (Security Custodian) acts as bare trustee of the property trust named in Schedule 6 (Security Trust) to hold the legal title to the Trust Property on trust for the SMSF Fund in order for the SMSF Trustee as trustee of the SMSF Fund to borrow funds from AMP Bank for the purchase or refinance of the Trust Property pursuant to section 67A of the SIS Act. 10 The Trust Property is beneficially acquired or refinanced by the SMSF Trustee in its capacity as trustee for the SMSF Fund by using moneys provided by the SMSF Fund and funds borrowed from AMP Bank. 11 The Security Custodian is or is to be the registered proprietor of the Trust Property but has acquired it for the benefit of the SMSF Trustee as trustee for the SMSF Fund. 12 The Trust Property is: (1) acquired on an arm s length basis; and SDIndv

2 (2) not acquired from a related party (as defined in the SIS Act) of the SMSF Fund. 13 The arrangements and transactions contemplated by the trust deed of the Security Trust and associated documentation and the loan with AMP Bank and security documentation will not give rise to a breach by the SMSF Trustee, the Security Custodian or any of the beneficiaries of the SMSF Fund to the arrangements and transactions of any of the following: (1) the SIS Act; (2) the SMSF Trust Deed of the SMSF Fund; (3) the trust deed of the Security Trust or any other agreement in connection with the Security Trust relating to the Trust Property; and (4) the investment strategy of the SMSF Fund. 14 I/We am/are aware that AMP Bank is relying on this declaration in agreeing to lend to the SMSF Fund on security of the Trust Property and I/we warrant the accuracy of the statements and representations made in this declaration.
