The Property is Located at the Southeast Quadrant of Fox Avenue and I-35E and is Legally Described as a 0.6-Acre Tract of Land out of the Eli Pickett Survey, Abstract No. 1014, Zoned General Business (GB). 2 MINUTES ZONING BOARD OF ADJUSTMENT JULY 6, 2016 The Lewisville Zoning Board of Adjustment was called to order at 6:31 p.m. Board Members Present: Antonio Gallizzi (Vice-Chair), Mary Ellen Miksa, James Collier, Alternates Winston Edmondson and Douglas Hicks sat. Members Tom Jensen (Chairman) and Audra Smolinski were absent. Staff Members Present: Richard Luedke, June Sin Item 2: Selection of a Chairman and Vice-Chairman was next on the agenda. A motion was made by James Collier to retain Tom Jensen as the Chair, seconded by Mary Ellen Miksa. The motion passed unanimously (5-0). A motion was made by Mary Ellen Miksa to retain Antonio Gallizzi as the Vice-Chair, seconded by James Collier. The motion passed unanimously (5-0). Item 3: Minutes Approval of the April 6, 2016 minutes was the next item on the agenda. A motion was made by James Collier to approve the minutes, seconded by Winston Edmondson. The motion passed unanimously (5-0). Item 4: Public Hearing There was one item on the agenda: A. Consideration of a Variance Request to Allow an Existing Building to Encroach Approximately 1.3 Feet Into the 30-Foot Setback for the Property Located at 812 Charles Street; Further Identified at Lot 2, Block A of the Boenker Addition, Zoned Single-Family Residential (R-7.5); as Requested by Julie Riegel, the Property Owner. (Case No. BA ). Staff gave a brief presentation of the variance request and history of the property. The encroachment was discovered during the platting process. The variance is to allow the existing structure to remain in its current location. The public hearing was then opened and there being no one present to speak on the item, the public hearing was then closed. A motion was made by James Collier to approve the requested variance, seconded by Winston Edmondson. The motion passed unanimously (5-0). There being no other business before the Board, the meeting adjourned at 6:38 p.m.

BACKGROUND: The unplatted property contains an existing self serve carwash that was built in 1975 on property zoned General Business (GB). The properties immediately abutting this site are also zoned GB and occupied by a Shell gas station, Braum s Ice Cream and Burger Restaurant and Revival wood finishing business. All of these businesses are allowable in the GB district and all were constructed after the residential subdivision was established in the early 1960 s. ANALYSIS: Section Height and Area Exceptions and Modifications (a)(3) states All monopole and lattice towers above 25-feet in height shall be placed with a minimum 3:1 distance to height ratio from the nearest single-family or two-family zoned lot or tract. This means that the proposed 110-foot tower is required to be a minimum of 330-feet from the nearest single-family or two-family zoned lot or tract. The proposed tower in this case would only be approximately 188-feet from the Single-Family Subdivision of Lakeland Terrace, significantly less than the required 330-feet. The proposed tower should not be granted a variance since the proposed hardship is self imposed, meaning that there are other parcels of land that would comply with the 3:1 distance to height ratio along the I-35E corridor. The applicant has chosen a property that does not meet this requirement. Prior to 2013, 100-foot monopole towers were allowed only in Light Industrial (LI) zoning by right. In 2013, the ordinance was amended to allow these towers in other zoning districts with the approval of a Special Use Permit. The one requirement that has not changed is the minimum distance to height ratio from single-family property. Tower setbacks and distance to height ratios are very common in most communities and are primarily in place as a safety measure for single family neighborhoods and to protect aesthetic qualities in areas surrounding these neighborhoods.

5 ZBOA Staff Memo 3:1 Distance to Height Variance Request August 3, 2016 The subject property is located within a 0.75-mile segment of the I-35E corridor that contains single family zoning within close proximity to the freeway frontage. The rest of the 9-mile I-35E corridor through Lewisville does not contain single family zoning within close proximity of the freeway frontage; therefore, the opportunity to comply with the required 3:1 distance to height ratio exists on a multitude of properties along 8.25 miles of the I-35E corridor in Lewisville. Since discussions began with the applicant, staff has encouraged the applicant to seek other properties in the area where a proposed tower would meet the required distance to height ratio. No evidence has been provided to demonstrate a due diligence search of other available properties in the area which would allow for compliance with the 3:1 distance to height ratio. The applicant states in the narrative letter that the tower is needed to resolve a significant gap in its voice and data service to its customers. The applicant has not submitted any evidence confirming that this gap exists. The Board may approve a variance request for specific cases where granting a variance from the terms of the Zoning Ordinance will not be contrary to the public interest, where, owing to special conditions, a literal enforcement of the Ordinance will result in unnecessary hardship. The applicant has failed to provide evidence that a hardship exists. RECOMMENDATION: That the Board of Adjustment deny the variance request to allow a reduction in the 3:1 distance to height ratio, a distance of 330-Feet to 188-Feet.
