GROSSMAN, U.S. BANKRUPTCY JUDGE In opposition to the objection of Suffolk Ready Mix, LLC, by its attorneys, The Law Offices of Michael G. McAuliffe, claimant, Manufacturers and Traders Trust Company ( M&T ), by its attorneys, Getman & Biryla, LLP, respectfully represent as follows: 1. Claimant M&T filed a proof of claim in the chapter 11 bankruptcy case of Suffolk Ready Mix, LLC on or about September 30, 2009, said claim having been assigned the Court s claim number In connection with the proof of claim filed in this case, claimant M&T provided certain documentation to support the claim which included print outs from M&T s internal computer system showing the principal balance due and owing of $44,408.85, accrued interest of $ and late fees of $ The sum of the foregoing amounts is $44,923.52, which represents the claim of M&T in this matter. 4. The difference between M&T s calculation and the debtor s books, likely revolves around the manner in which interest and late fees have accrued on this account and M&T submits to this Court that the documentation submitted with the proof of claim is a true and accurate representation of the actual balance due and owing M&T as a claimant in this case. WHEREFORE, M&T respectfully requests that the debtor s objection be overruled and the claim be allowed as filed by M&T in this matter.
