Fidelity National Insurance Company, d/b/a Fidelity National Title Insurance Company of New York Date of Decision: August 15, 2013 Judge: Attorneys: Honorable Carmen D. Minora Plaintiffs: Carl J. Guagliardo, Esquire Defendants: Lawrence A. Durkin, Jr., Esquire Summary of Opinion: In this insurance bad faith and breach of contract action, stemming from a title dispute regarding land which the plaintiffs had planned to develop, the Court determined that an unreasonably delay of nearly five years, along with multiple and repeated violations of Pennsylvania law by defendant, constituted bad faith, reckless indifference and outrageous conduct toward the insureds. In reaching this finding, the Court determined that there was no reasonable basis for the delay, and that such an extreme delay constitutes bad faith under 42 Pa.C.S The Court awarded punitive damages in the amount of $1.6 million, four times the compensatory damages, for a total award of about $2.1 million, including about $97,000 in interest from the date the plaintiffs filed their claim.
