Fidelity National Insurance Company, d/b/a Fidelity National Title Insurance Company of New York Date of Decision: August 15, 2013 Judge: Attorneys: Honorable Carmen D. Minora Plaintiffs: Carl J. Guagliardo, Esquire Defendants: Lawrence A. Durkin, Jr., Esquire Summary of Opinion: In this insurance bad faith and breach of contract action, stemming from a title dispute regarding land which the plaintiffs had planned to develop, the Court determined that an unreasonably delay of nearly five years, along with multiple and repeated violations of Pennsylvania law by defendant, constituted bad faith, reckless indifference and outrageous conduct toward the insureds. In reaching this finding, the Court determined that there was no reasonable basis for the delay, and that such an extreme delay constitutes bad faith under 42 Pa.C.S The Court awarded punitive damages in the amount of $1.6 million, four times the compensatory damages, for a total award of about $2.1 million, including about $97,000 in interest from the date the plaintiffs filed their claim. Brier, Esquire Summary of Opinion: In this case arising out of a dispute relative to farm deeds, timber harvested from the farm, equipment purchased and used on the farm, and banking activity allegedly done by Defendants, The Court found that the equipment pieces were not part of Decedent s estate; the farm deeds were valid conveyances; Decedent s nephew as tenant in common to the farm is entitled to 50% of the unauthorized timbering proceeds; Decedent s nephew is entitled to title to the grave plot meant for Decedent and $ for the plot actually used for Decedent; the three $10,000 withdrawals need no judicial relief; any of the $500 withdrawn from the MAC account if it exists, belongs to Decedent pursuant to 20 Pa.C.S.A. Section 6304(a); any amount remaining of the approximately $450,000 of Decedent s bonds illegally liquidated by Defendant belongs to Decedent s estate; and Defendant must return to the estate of Decedent the $89,691 tax loss incurred by Decedent when Defendant illegally liquidated Decedent s bonds. 8
