Motion Number Moved By Sue Smyth Seconded By Ann Hopkins BE IT RESOLVED THAT the agenda of this meeting be adopted as presented. Chairperson Clancey declared a conflict of interest with respect consent file B C submitted by Weese. Chairperson Clancey welcomed those in attendance at the meeting. The minutes of January 2,2013 and the minutes of February 13, 2013 were introduced. Motion Number Moved By Ann Hopkins Seconded By Bob Surgent BE IT RESOLVED THAT the minutes of January 2, 2013 and February 13, 2013 be adopted as presented.

3 Consent application B C submitted by David Simpson as deferred was introduced. Secretary Treasurer Hogan provided a brief synopsis of actions respecting this file since this application was previously considered. Motion Number Moved By Sue Smyth Seconded By Bob Surgent BE IT RESOLVED THAT the Committee hereby recommends that consent application B C be amended to provide for the creation of a new lot in the same location and with the same frontage and area as what would have been the end result of the original application, and that notice of the amended application be provided to all persons and bodies who are entitled to notice of this application. Chairperson Robert Clancey stepped down as Chairperson and vacated the meeting during deliberations of consent application B C and Assistant Chairperson Ann Hopkins assumed the role of Chairperson. Consent application B C submitted by Murray and Patricia Weese was introduced. Secretary Treasurer Hogan provided a summary of comments received and arising from the notice of application. Motion Number Moved By Sue Smyth Seconded By Bob Surgent BE IT RESOLVED THAT Pursuant to Section 53 Subsection 17 of the Planning Act, R as amended, notice is hereby provided that the application submitted by Murray and Patricia Weese for the creation of a new lot under file number B C is approved subject to the conditions as provided for herein. Conditions Satis?ed The applicants shall fulfill and provide evidence to the satisfaction of The Corporation Of The Township Of Stone Mills that all conditions of approval as provided for herein have been satisfied. Reference Plan Reguired That the land being severed is described by a Reference Plan which clearly illustrates the dimensions and areas of all parts identified therein, and this plan shall be deposited in the Land Registry Office of the County of Lennox and Addington. The applicant shall provide a paper copy and a digital copy of the Registered Reference Plan in a (pdf) format or such other format acceptable to the Township of Stone Millsand all costs for the development, deposit and copy

4 of the Reference Plan are at the expense of the applicant. Alternatively, if an exemption is obtained from the Land Registry Office of the County of Lennox and Addington waiving the need for a Reference Plan, this condition shall specifically not apply. Outstanding Taxes Paid That the payment of the balance of any outstanding taxes, as of the date of certification of the Transfer/Deed with respect to the property subject to the application is made to the Treasurer of the Township of Stone Mills. 5% Parkland Levy That the Township of Stone Mills receive a payment of cash or certified cheque in the amount of 5% of the value of the severed parcel of land valued as of the date of the provisional consent, as prescribed by By-law Potable Water That a well is drilled by a licensed well contractor on the lot to be severed and pump tested to confirm the quantity of water, and copy of the well record clearly indicating the quantity of the water is provided to the Township. The water from the well is quality tested by a qualified professional and evidence of the analysis as well as confirmation of the testing shall be provided to the Township. The quantity and quality of the water from the well shall meet the minimum requirements of MOE Procedure D-5-5 Technical Guideline For Private Wells. Should a written opinion be received by the Township from a qualified professional subsequent to the drilling of a well, that the quantity of the water from the drilled well cannot be reasonably expected to yield the minimum quantity requirements, a shallow dug or blasted well may be allowed provided the shallow well meets the applicable provisions of Technical Guidelines D-5-5, and the owner enters into an agreement with the Township that provides that water filtration and purification is installed for the future use of the shallow well and this agreement shall be registered on title to the lands upon which the well is constru cted. Prior Consents The applicant shall provide written evidence to the satisfaction of the Township of Stone Mills, prepared by a qualified professional in conducting a title search of lands, that no more than one lot has been previously created through the consent process from the lands which are the subject of this consent application since November 23, Off-Site Sewage The applicant shall provide satisfactory evidence to the Township of Stone Mills which indicates there is sufficient off-site reserve sewage system capacity and treatment for hauled sewage. Health Unit Approval

5 The applicant shall provide satisfactory evidence to the Township that the Kingston Frontenac Lennox and Addington District Health Unit has approved the severed parcel for the development of a waste disposal system in accordance with the requirements of the Ontario Building Code and such other requirements determined by the Kingston Frontenac Lennox and Addington District Health Unit. Transfer Reguired The applicant or his/her solicitor shall prepare and submit to The Corporation Of The Township Of Stone Mills, a transfer or such other legal document to provide for the giving of the consent and endorsement by the official of the Township, and this transfer or other legal document shall be provided to the Township within a period of one year after notice of the decision was given under subsection 53 (17) or 53 (24) of the Planning Act. AND FURTHER THAT in addition to the conditions as provided for herein, the following are intended to make the applicant aware of comments and/or concerns submitted by reporting bodies however these should not be interpreted as a specific condition of the approval of this application: In accordance with Ontario Regulation 319/09, a portion of the subject lands lie within the regulated area of Camden Lake Provincially Significant Wetland (PSW), and a watercourse which drains into the PSW. The owners will need to apply to the Conservation Authority for a permit prior to development which includes construction, filling excavation and site grading within 30 meters of the watercourse. Through the permit application process, the Authority will identify any potential concerns associated with any natural hazards on the subject lands, and review the permit application in light of Regulation 319/09 and Authority policies before deciding to issue or deny the permit. The Federal Fisheries Act may apply to the subject lands. Should shoreline alterations or in-water work be proposed, the applicant must contact the Conservation Authority prior to any activity occurring on the site. The Quinte Conservation Authority will review the proposal to determine if there are any potential impacts to fish habitat. Chairperson Clancey resumed the role of Chairperson of this meeting. Further discussion respecting the proposed Development Permit System was deferred to the pending planning meeting with Council. Chairperson Clancey advised that those Members wishing to participate in the Ontario Association of Committees of Adjustment conference should submit their applications as soon as possible.
