1 CODE OF STATUTES Approved by the municipal council: 14 Dec Revised by the municipal council: 01 Jan Sept Jan Sept Aug LOCAL PUBLIC ORDER REGULATIONS FOR LYSEKIL MUNICIPALITY Lysekil Municipality promulgates the following regulations in compliance with the provisions of 1 of the Ordinance (1993:1632). Authorising municipalities and county councils to issue local regulations under the the provisions of the Swedish Public Order Act (SFS 1993:1617). Content and scope of the regulation 1 The regulatory basics for public order and safety is provided in Chap 3 of the Swedish Public Order Act (SFS 1993:1617). These local regulations contain further provisions for maintaining public order in Lysekil Municipality. The regulations in 18 are intended to prevent personal injury and property damage caused by the use of pyrotechnical articles. 2 These regulations shall apply to all locations within the municipality defined as public location as provided in Chap 1 2 first paragraph 1-4 of the Public Order Act, unless otherwise specified. The municipal regulations in regard to locations the municipality has licensed for outdoor markets shall also apply. 3 When applying Chap 3 of the Public Order Act and regulations issued thereunder, in compliance with Chap1 2 second paragraph of the of the Public Order Act, the following areas shall be considered public locations: installations or facilities for play, sports, recreation, swimming and bathing areas, railway facilities, cemeteries, and garden installations. Loading goods and similar 4 When loading, moving, unloading, and other handling of goods or similar, the party responsible for such action shall use necessary means to ensure the public is not subjected to temporary nuisance due to dust, spillage, or unpleasant odours. Unloading and deposit of goods may not take place as to obstruct fire hydrants, fire extinguishing equipment, or fire escape ways, or to obstruct activities of rescue services. The regulation in the first paragraph shall not apply within the operational area of the harbour. Excavation, or other civil engineering work 5 The party responsible for removal of gravel, earth, or sand, dumping backfill material, excavation, digging, or other similar work shall use means to ensure this is done so that the general public is subjected to the least possible nuisance.
2 Noise pollution 6 Work that causes noise pollution for persons in public locations, as with crushing rock, driving piles, and riveting may be done only under permit issued by the police authority. The regulation in this paragraph shall not apply within the operational area of the port administration. Containers and other devices 7 The owner or lessee of a container or other device that shall be placed in a public location is liable to clearly label such with the owner's or the lessee s name, address, and telephone number, and with reflectors as per Appendix 1. Placement of a container or other device shall respect fire safety considerations. In addition, accessibility for bicycle and pedestrian traffic shall be considered. Awnings, flags and signs 8 Awnings, flags, banners, signs, and similar devices may not be erected so they extend across the sidewalk at a height lower than 2.3 metres or across a roadway at a height lower than 4.5 metres. Bill posting 9 Bills, adverts or similar materials may not be posted on building walls, fences, posts, trees, or similar facing a public location without the permission of police authority. Such permission is not necessary for posting on billboards, columns or similar devices which are provided for this purpose. Such permission is also not necessary for business operators for adverts or other announcements that related to the operator's business on the building where they operate. Loudspeaker broadcast 10 Information, advertisements, propaganda or other messages intended for individuals in public places may not by issued using loudspeakers or similar without the permission of the police authority. Collection of money 11 Police authority permits are required for collection of money in collecting tins or similar, if the collection of money is not part of a permitted public gathering or public function. Such permission is not required for collection of money conducted in relation to street music or by school classes for aid organisations. Consumption of alcohol 12 Consumption of alcoholic drinks that have a stronger alcohol content than 3.5 % by volume, is not permitted in public locations within the Lysekil urban areas (see Appendix 2) unless otherwise permitted as provided in necessary legal permit for specific events. Itinerant sales 13 Itinerant sales may not be conducted within the areas designated on Appendix 3. Itinerant sales shall include street selling for which public location is occupied temporarily and in insignificant scope, and which therefore does not require a permit as per Chap 3 1 of the Public Order Act.
3 Camping 14 Camping may not be conducted at the following locations: cemeteries and publicly used assigned parking areas, outdoor facilities for sports and athletics, swimming and bathing areas, festival venues, marinas, and parks and public gardens maintained by the municipality. Dogs 15 Dog owners, dog carers or others persons who have temporary care of a dog are liable to comply with the regulations in 16 and 17. These paragraphs shall not apply in regard to guide dogs accompanying visually impaired persons, police or customs dogs in service, rescue dogs, and service and hearing dogs. 16 Dogs shall be kept leashed with in the urban areas of Lysekil, Brastad, Brodalen, Fiskebäckskil and Grundsund as designated in appendix 4. Female dogs in oestrus must be leashed at all times within the municipality unless within an enclosure. Dog that are not leashed shall wear a collar with the owner's name address, and telephone number. Dogs may not be taken onto public cemeteries, play areas, or for play on assigned lawns, or at swimming and bathing areas for the period between 1 May to 30 September. Dogs may not be taken into Stadsparken, Engelska parken and Havsbadsparken (public parks), except where this occurs during a direct walk on pedestrian walkways in these parks which are specifically designated for this purpose. 17 All waste left by dogs in all public locations and areas specified in 3 as public locations shall be picked up. Cleaning in this regard is not necessary on land that is not specifically gardened or cultivated as a park (natural park land) or where space is assigned for dog walking. Fireworks and other pyrotechnical articles 18 Police authority permits are required for the use of pyrotechnical articles in the following locations: Kungstorget, Rosvikstorg, Stadsparken. Fees for use of public locations 19 The municipality has the right to charge fees for the use of public locations and areas considered public locations by the municipality in accordance with the specifications approved by the municipal council. Violation of this local public order regulations 20 Whoever violates any of the regulations enumerated under 5-18 intentionally or negligently may be fined under Chap 3 22 second paragraphs of the Public Order Act. The Public Order Act also contains provisions for injunctions and forfeiture.
