1 CITY OF ROCKWALL, TEXAS ORDIACE O SUP O. 122 A ORDIACE OF THE CITY COUCIL OF THE CITY OF ROCKWALL, TEXAS, AMEDIG THE UIFIED DEVELOPMET CODE OF THE CITY OF ROCKWALL, TEXAS, AS PREVIOUSLY AMEDED, SO AS TO GRAT A SPECIFIC USE PERMIT WITHI THE SIGLE - FAMILY RESIDETIAL ( SF -10) DISTRICT ALLOWIG FOR A ACCESSORY BUILDIG EXCEEDIG THE SIZE REQUIREMETS, O THE PROPERTY LOCATED AT 921 ALAMO ROAD, BEIG A0.74-ACRE PARCEL OF LAD IDETIFED AS A PORTIO OF BLOCK 4, GARER ADDITIO, AD MORE SPECIFICALLY DESCRIBED I EXHIBIT `A'; CITY OF ROCKWALL, ROCKWALL COUTY, TEXAS; PROVIDIG FOR SPECIAL CODITIOS; PROVIDIG FOR A PEALTY OR FIE OT TO EXCEED THE SUM OF TWO THOUSAD DOLLARS ($ 2, ) FOR EACH OFFESE; PROVIDIG FOR A SEVERABILITY CLAUSE; PROVIDIG FOR A REPEALER CLAUSE; PROVIDIG FOR A EFFECTIVE DATE. Alsup foa Specific Use Peit allowing fo an accessoy building exceeding the size equieents within the Single - Faily Residential ( SF -10) Distict, on the popety located at 921 Alao Road, being a ace pacel of land identified as a potion of Block 4, Gane Addition, City of Rockwall, Rockwall County, Texas, and oe specifically descibed in Exhibit ' A' of this odinance, which heeinafte shall be efeed to as the Subject Popety and incopoated by efeence heein; and WHEREAS, the Planning and Zoning Coission of the City of Rockwall and the govening body of the City of Rockwall, in copliance with the laws of the State of Texas and the odinances of the City of Rockwall, have given the equisite notices by publication and othewise, and have held public heaings and affoded a full and fai heaing to all popety ownes geneally, and to all pesons inteested in and situated in the affected aea and in the vicinity theeof, the govening body in the execise of its legislative discetion has concluded that the Unified Developent Code of the City of Rockwall should be aended as follows: OW, THEREFORE, BE IT ORDAIED BY THE CITY COUCIL OF THE CITY OF ROCKWALL, TEXAS: Section 1. That the Unified Developent Code of the City of Rockwall, as heetofoe aended, be and the sae is heeby aended so as to gant a Specific Use Peit allowing fo an accessoy building exceeding the size equieents within the Single - Faily Residential (SF -10) Distict fo the Subject Popety; and Section 2. That the Specific Use Peit shall be subject to the conditions set foth in Aticle IV, Section , Residential and Lodging Use Conditions, of the City of Rockwall Unified Developent Code (Od. o ) as heetofoe aended and as ay be aended in the futue, and shall be subject to the additional following additions: Od _ S Z Alao Rd ( SUP - Accessoy Building) Page 1 1

2 1) The accessoy building ust confo to all Engineeing and Fie Depatent standads; and 2) Subittal and appoval of a building peit is equied pio to the constuction of the accessoy building; and 3) The accessoy building ust confo to the appoved site plan ( suvey) and building elevations ( photo) depicted in Exhibits' A' & ' B' of this odinance; and 4) The accessoy building shall not exceed 240 squae feet in aea; and 5) The accessoy building shall not exceed a axiu height of 15 feet; and 6) The accessoy building is subject to adinistative eview in the event that the subject popety is sold o conveyed in any anne to anothe paty, subdivided, o e- platted; and 7) The City Council eseves the ight to eview the Specific Use Peit ganted heein upon the expiation of one ( 1) yea fo the date heeof; and 8) Any constuction o building allowed by this equest ust confo to the equieents set foth by the Unified Developent Code, the 2009 Intenational Building Code, the Rockwall Municipal Code of Odinances, city adopted engineeing and fie codes and with all othe applicable egulatoy equieents adinisteed and /o enfoced by the state and fedeal govenent. Section 3. That the official zoning ap of the City be coected to eflect the changes in zoning descibed heein. Section 4. That all odinances of the City of Rockwall in conflict with the povisions of this odinance be, and the sae ae heeby epealed to the extent of that conflict. Section 5. Any peson, fi, o copoation violating any of the povisions of this odinance shall be deeed guilty of a isdeeano and upon conviction shall be punished by a penalty of fine not to exceed the su of TWO THOUSAD DOLLARS ($2,000.00) fo each offence and each and evey day such offense shall continue shall be deeed to constitute a sepaate offense. Section 6. If any section o povision of this odinance o the application of that section o povision to any peson, fi, copoation, situation o cicustance is fo any eason judged invalid, the adjudication shall not affect any othe section o povision of this odinance o the application of any othe section o povision to any othe peson, fi, copoation, situation o cicustance, and the City Council declaes that it would have adopted the valid potions and applications of the odinance without the invalid pats and to this end the povisions of this odinance shall eain in full foce and effect. Section 7. That this odinance shall take effect iediately fo and afte its passage and the publication of the caption of said odinance as the law in such cases povides.
