8 REGULATION OF USE OF COUNTY PROPERTY CHAPTER I COUNTY PARKS AND RECREATION AREAS 1.1 Purpose: These regulations are enacted for the purpose of regulating the use of county owned or controlled areas used as public parks, playgrounds, camping sites, and recreation areas within Boone County, Missouri in order to preserve, protect and promote the public health, safety and welfare. 1.2 Authority: These regulations are enacted under authority vested in the County Commission of Boone County, Missouri by section RSMo. 1.3 General Public Use: All Boone County parks and recreational trails shall be open for general public use subject to the following rules concerning usage: Hours - Parks and recreational trails shall only be used during daylight hours Camping and Fires Prohibited - Overnight camping and campfires of any type are prohibited Commercial Activities - Commercial activities of all types are prohibited including but not limited to soliciting, panhandling, and begging. Concession stands may be operated under special use permit under such terms and conditions as are authorized by the Boone County Commission Climbing and Trespassing - Climbing on or about bluffs, rock out-croppings, and bridges is prohibited and no person using Boone County parks and recreational trails shall enter upon adjoining private land without authorization from the owners thereof, nor shall any person trespass upon any area within any park or recreational trail which is designated for authorized personnel, official use, restricted access, or otherwise closed to the public as indicated by official signage Emergency Telephones - IVo person shall use any emergency telephone for any purpose other than to report an actual emergency or to obtain assistance fi-om a public safety agency. No person shall interfere with another person's legitimate use of emergency telephone, nor in any way tamper with or damage any such telephone or cable connected thereto Wildlife - No person shall pursue, molest, kill, trap, hunt, chase, capture, shoot, throw anything at, or intentionally attempt to frighten any mammal, bird, reptile or amphibian within any Boone County park or recreational trail Wildflowers and Edible Plants - No person shall

9 pick wildflowers or seeds on any tree or plant, nor cut, carve or injure the bark, or break off any limbs on any trees, or pick or harvest wild fruit, vegetables or other edible plants Littering - No persons shall litter or otherwise place or cause to be placed any paper, plastic, trash or other form of waste product on any county park or recreational trail except in designated containers or facilities for disposal thereof. Animals: Domestic pets such as dogs, cats or other animals shall not be permitted in county parks or recreational trails unless under the immediate control of the owner or possessor thereof by means of prompt obedience to voice command, leash, or is otherwise contained within a vehicle or confined by the owner or possessor thereof. No dog shall be permitted to bark or chase other persons using the public areas of a park or recreational trail, nor shall any dog be permitted to defecate in an area designated for vehicular or pedestrian use. All owners and possessors of animals are required to promptly clean, remove and dispose of any animal waste produced by any animal owned or possessed by them or within their control. No horses, horseback riding, or other livestock shall be permitted in county parks or recreational trails. Vehicles: Motor vehicles shall not be permitted within parks or recreational trails other than in designated access and parking areas except governmental vehicles used for maintenance, law enforcement or provision of emergency services, and motorized wheel chairs or carts used by the handicapped or physically disabled Bicycles - Bicycles and other forms of non-motorized wheel transport may be used in areas designated for bicycle use subject to the following rules: On recreational trails bicycles shall proceed in single file and stay at all times on the right side of the trail except when passing a pedestrian or another bicycle Bicyclists shall audibly signal pedestrians and other bicycles when approaching from the rear to pass Bicyclists shall at all times exercise the highest degree of care in order to avoid injury to pedestrians and other bicyclists. Posted Rules and Notices: All persons using county parks and recreational trails shall inform themselves of and obey all posted guidelines, rules and other signage placed in individual public parks and recreational areas. Special Use Permits: County parks and recreational trails may be used in variance of these rules only upon special use permit issued by the Boone County Commission granted upon application under such terms and conditions as deemed appropriate by the Commission in order to preserve and protect the public health and safety. Persons obtaining special use permits may be charged such user fees as deemed reasonable and necessary by the Commission to assure the county is compensated for

10 actual costs incurred. The Boone County Commission may require security deposits for special use permits and may impose contractual charges in connection with concessions or other commercial use of county property. 1.8 Interpretation and Severability: The regulations enacted under this chapter are intended to be in addition to and supplementary of any other provision or remedy authorized or prescribed by law dealing with the same subject matter. In the event of irreconcilable conflict between any regulation contained herein and any other state law or state regulation enacted thereunder, the provision of state law or regulation shall control and be determinative. These regulations are enacted to preserve and promote the public health and safety and for this purpose shall be liberally construed to the fullest extent permitted by law to effectuate the purposes for which they are intended. 1.9 Jurisdiction: The regulations contained in this chapter shall be applicable to all public parks and recreational areas owned or controlled by Boone County, Missouri Penalties and Remedies: Any person who violates any requirement or provision of these regulations shall be deemed guilty of a misdemeanor and shall be punished as provided by law; each incident a violation of any such regulation shall constitute a separate and distinct offense. The penalty provided in this section shall not be construed to be exclusive but is intended to be supplementary and in addition to any other remedy provided or authorized by law or in equity. ffective: These regulations shall become effective on or after the 17 day of
