3 GENERAL NATURAL RESOURCES ADMINISTRATION CH 495 (SF 3071) HF 3516 DNR TECHNICAL BILL Includes small technical amendments that help DNR administer programs, clarify existing statutes, eliminate obsolete or redundant language, or correct small errors in prior bills. Allows the commissioner of natural resources to enter into grants or contracts to cosponsor conferences and seminars related to natural resources; updates and streamlines the mineral leasing provisions within chapter 93; clarifies snowmobile, ATV, and motorboat DWI revocation provisions; clarifies DWI forfeiture notification provisions; allows class fees for safety training programs to be set based on the cost of delivering the training and allows those funds to be directly available to the program efforts; encourages school districts to cooperate in providing classroom space for safety training programs, clarifies location of deposit for snowmobile fine splits, provides locator language for the session law establishing the Swan Lake Waterfowl Refuge; allows gifts for specific nongame wildlife projects, or projects in a specific area, to be deposited in a separate account; increases the limit from $50,000 to $100,000 for projects that may use an alternative to a performance or payment bond to secure the work; provides the necessary approval for consumptive use of water on the Minnesota side of the Red River of the North and this work will be completed by January 1, Section 8 provides that another emergency response agency may request DNR forestry firefighting resources for use in search and rescue operations. Sections 50 and 51 expand the use of the emergency fire fighting appropriation to fund these efforts, and require the commissioner and the superintendent of the BCA to develop criteria for these types of search and rescue operations. CH 339 (SF 2857) HF 3134 MOSQUITO BILL An act relating to natural resources; modifying authority of the metropolitan mosquito control commission to enter certain lands; amending Minnesota Statutes 1998, section , subdivision 17. Clarifies the Commissioner of Natural Resources authority to determine under what circumstances the abatement of nuisance mosquitoes may occur on DNR administered state lands within the seven-county metro region and to allow the Commissioner of Natural Resources to fulfill his/her mandated responsibilities to effectively manage state lands for their natural resource values and functions. All other sections are effective August 1, CH 332 AGENCY GRANT APPLICATION INFORMATION ON INTERNET SF 2653 (HF 4076) An act relating to state government; requiring state agencies to provide grant information on the Internet; requiring the commissioner of administration to develop a uniform Internet application for grants; amending Minnesota Statutes 1998, section 16B.467; new provisions added in Minnesota Statutes, chapter 15. EFFECTIVE DATE: August 1, CH 469 RULES REVIEW PROCESS MODIFICATION SF 3234 (HF 3000) The law establishes a schedule for review of state agency rules and requires each agency to submit a report on agency rules. A rules task force is created which is to report back to the Governor and legislature by January 15, Minnesota Statutes are amended to give the House and Senate governmental operations committees the same authority that the Legislative Coordinating Commission (or a joint subcommittee established by the commission) currently has to review and object to agency rules. -2-
5 Specific to the Department of Natural Resources, the law provides for rule review in The DNR must submit a report identifying rules recommended for repeal, the rationale for rules recommended to remain in effect and any proposed changes to the legislature by August 1, Signed by the Governor May 15, EFFECTIVE DATE: Sections 1 to 3, 5, and 6 are effective the day following final enactment. Section 7, paragraphs (a) and (b) are effective July 1, All other Sections are effective August 1, CH 499 SF 3819 (HF4143) REVISOR S BILL Includes clarification regarding appropriation of funding for the enforcement division. EFFECTIVE DATE: Unless provided otherwise, each section of this act takes effect at the time the provision being corrected takes effect. CH490 HF4127 (SF2657) TAX BILL Article 6, Sections provide for an inflationary increase in payments in lieu of tax (PILT) on state owned land. See CH485 for further reference to Con-Con land PILT adjustments. EFFECTIVE DATE: These sections apply to payments made in calendar year 2001 and thereafter. -3-
6 ENFORCEMENT CH 466 DNR ENFORCEMENT BILL SF 3036 (HF 2962) This law provides a number of enhanced enforcement tools, including administrative forfeiture authority for firearms illegally possessed for hunting by felons, expansion of trespass civil citation authority for recreational vehicle trespass, modifying DWI administrative forfeiture provisions when vehicles can be released to lienholders, and modifying the time restraints for fleeing forfeitures involving recreational vehicles. The bill includes a section where the Department is to review and make recommendations for increased penalties and sanctions for gross overlimits of wild animals. Amends Minnesota Statutes 1998, sections 97B.002, subdivision 1; , by adding a subdivision; and , subdivision 4; Minnesota Statutes 1999 Supplement, section , subdivision 7a; new provisions added in Minnesota Statutes, chapter 97A. Signed by the Governor May 15, EFFECTIVE DATE: Sections 1 to 6 are effective the day following final enactment. All other sections are effective August 1, CH 324 SNOWMOBILE STUD STICKER CIVIL CITATION AUTHORITY SF 3283 (HF 3555) Expands current civil citation enforcement authority to stud stickers for violations of snowmobile studs on paved trails. Statewide criminal fines currently comply with amounts specified in this bill. Any penalties for civil citations written by local police agencies will be retained by that unit of government. Amends Minnesota Statutes 1999 Supplement, sections , subdivisions 2, 3, 4, and 6; and , subdivision 1. Signed by the Governor April 4, EFFECTIVE DATE: The day following final enactment. CH 428 BOWFISHING ARCHERY TRANSPORT CASING SF 2683 (HF 2889) Allows a person to use a bow to harvest rough fish from a boat powered by an electric motor and allows the issuance of a special permit allowing for persons that have a permanent or temporary physical disability to take rough fish with a crossbow and all small game. The law also provides an exception to the bow transportation laws. -4-

CH 478 DWI RECODIFICATION AND SIMPLIFICATION SF 2677 (HF 2995) This law is the product of a multi-jurisdictional task force to simplify and reorganize the DWI laws. However, violations occurring before January 1, 2001, which are listed in Minnesota Statutes, section 169A.03, subdivisions 20 and 21, are considered qualified prior impaired driving incidents for all purposes under this act. -5-

CH 251 EXTENDING FISHING SEASON SF 2763 (HF 2980) An act relating to game and fish; modifying certain angling seasons: Notwithstanding Minnesota Statutes, sections 97C.345, subdivisions 1 and 2, 97C.371, subdivision 4, and 97C.395, subdivision 1, for the fishing season, the open angling season for walleye, sauger, northern pike, muskellunge, largemouth bass, and smallmouth bass, and the spearing season for roughfish, catfish, lake whitefish, and northern pike is the Saturday two weeks prior to the Saturday of Memorial Day weekend 1999 to February 29, Signed by the Governor February 16, EFFECTIVE DATE: Effective the day following final enactment. CH 265 PERMANENTLY DISABLED HUNTERS PERMIT PRIVILEGES SF 2346 (HF 2603) An act relating to natural resources; authorizing the use of motor vehicles in wildlife management areas by disabled hunters; modifying certain permits for hunters with -6-
9 disabilities; providing criminal penalties; amending Minnesota Statutes 1998, sections 97A.137, by adding a subdivision; and 97B.055, subdivision 3. Signed by the Governor March 20, EFFECTIVE DATE: Sections 1 and 2 are effective January 1, Any temporary or permanent permits issued prior to January 1, 2001, under Minnesota Statutes 1998, section 97B.055, subdivision 3, are automatically rescinded effective January 1, All other sections are effective August 1, CH 341 (SF3378) HF 3510 TAKING TWO DEER IN NW COUNTIES / LIFETIME LICENSES An act relating to game and fish; providing for certain lifetime game and fish licenses; making the experimental two-deer license in certain counties permanent; appropriating money; amending Minnesota Statutes 1998, sections 97A.071, subdivision 2; 97A.411, subdivision 1; 97A.421; 97A.475, subdivision 4; and 97B.301, subdivision 4; Minnesota Statutes 1999 Supplement, sections 97A.075, subdivision 1; and 97B.020; new provisions in Minnesota Statutes, chapter 97A. Signed by the Governor April 6, EFFECTIVE DATE: Sections 1 to 11 are effective the day following final enactment. The resident licenses under section 5 shall be made available by March 1, 2001, and apply to taking game and fish for the 2001 license year. The nonresident licenses under section 6 shall be made available by March 1, 2002, and apply to taking game and fish for the 2002 license year. All other sections are effective August 1, CH 308 LIGHTED FISHING LURES SF 3586 (HF 3352) An act relating to game and fish; permitting angling with a lighted fishing lure; amending Minnesota Statutes 1998, section 97C.335. Section 1. Minnesota Statutes 1998, section 97C.335, is amended to read: 97C.335 [USE OF ARTIFICIAL LIGHTS TO TAKE FISH PROHIBITED.] A person may not use artificial lights to lure or attract fish, or to see fish in the water while spearing, except that an angler may use a lighted fishing lure. Any battery that is used in lighted fishing lures cannot contain any intentionally introduced mercury. EFFECTIVE DATE: August 1, (See also CH 463 which modifies this bill.) -7-

11 CH 331 AQUATIC FARM REGULATION MODIFICATION SF3260 (HF 3868) The law modifies regulations affecting private aquaculturists (those who raise and sell fish). The law eliminates inspection requirements if artificial tanks or jars are added to a licensed aquiculture facility, allows the removal of carp and bullheads from licensed ponds, modifies units of measure for reporting purposes, and allows the commissioner to issue permits to catch fish by angling and keep them for brood stock purposes. Amending certain requirements for licensed aquatic farms; amending Minnesota Statutes 1998, sections , subdivisions 2, 6, and 7; , subdivision 3; and 97C.521. EFFECTIVE DATE: August 1, CH 374 INLAND WATERS PERCH LIMITS SF 2514 (HF 2807) The purpose of the law is to establish daily and possession limits for yellow perch between December 1, 2000, and December 1, The current limit is ten daily and one hundred in possession. The law states: Until December 1, 2001, on inland waters, the daily limit for taking yellow perch is 20 and the total possession limit for yellow perch is 50. EFFECTIVE DATE: December 1, CH 406 SF 173 (HF 304) NW ANGLE HUNTING JURISDICTION FOR RED LAKE BAND An act relating to natural resources; allowing the possession of wild animals taken under the Red Lake Band's conservation code on Red Lake Reservation lands north of the 49th parallel; amending Minnesota Statutes 1998, section 97A.505, by adding a subdivision: BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. Minnesota Statutes 1998, section 97A.505, is amended by adding a subdivision to read: Subd. 3b. [WILD ANIMALS TAKEN ON RED LAKE RESERVATION LANDS WITHIN THE NORTHWEST ANGLE.] Wild animals taken and tagged in accordance with the Red Lake Band's conservation code on the Red Lake Reservation lands in Minnesota north of the 49th parallel shall be considered lawfully taken and possessed under state law. 12 FORESTRY CH 337 SUNKEN LOGS RECOVERY SF 2546 (HF 2259) An act relating to natural resources; providing for the recovery of sunken logs in inland waters and outlines the regulatory leasing framework for this form of logging on public lake and stream beds; adds new provisions to Minnesota Statutes, chapter 103G; repeals Minnesota Statutes 1998, section EFFECTIVE DATE: Sections 1 to 3 are effective June 1, CH 375 HERITAGE FOREST AREAS ESTABLISHMENT SF 2949 (HF 2613) Gives the Commissioner the authority to establish Big Woods Heritage Forest areas in 13 southeast counties pursuant to county board resolutions; amends Minnesota Statutes 1998, section , subdivision 2; adds new provisions to Minnesota Statutes, chapter 89. EFFECTIVE DATE: August 1, CH 485 (SF 2878) HF 3213 CONSOLIDATED CONSERVATION LANDS/ FORESTRY BILL This law is the combined legislation for two Department initiatives: the Department forestry bill, and the bill designating the consolidated conservation lands into wildlife and forestry management units. The forestry portion contains revisions to timber sales revisions. It streamlines and clarifies the procedures for the state s timber auctions and sales which also improves customer service and increases administrative efficiency; amends language regarding the use of ATV in limited state forests to clarify what roads may be used for this motorized travel; assures that a public notification and involvement process related to DNR administered timber sales is implemented by the department and reported to the legislature on a regular basis. The consolidated conservation lands (con-con lands) portion of the law immediately designates 260,000 of these acres into either state forest or wildlife management areas. The remaining 100,000 acres will be reviewed over the summer with input from the counties and user groups, with final recommendations to the legislature next session. The purpose of section 29 is to direct the department to make recommendations to the legislature concerning smoke chasers eligibility for unemployment insurance. EFFECTIVE DATE: August 1, CH 393 SF2877 (HF3328) IRON RANGE OHV REC AREA APPROPRIATION EXTENSION An act relating to natural resources; adding to the Iron Range off-highway vehicle state recreation area; extending the availability of a previous appropriation; providing exemptions from hunting restrictions in certain areas.
