1 09 CRS STATE OF NORTH CAROLINA v. PLEA AGREEMENT CHADWICK C. LEE ALTER OFFICIAL CASE RECORD OBSTRUCTION OF JUSTICE 32 COMMON LAW CONSPIRACY 3 COMMON LAW 1. Defendant will plead guilty to ten counts of felony obstruction of justice, ten counts of altering an official case record, and one count of conspiracy to commit felony obstruction of justice. All counts will be consolidated into eight judgments. Defendant will be sentenced to an active prison sentence of not less than 6 months nor more than 8 months in each of the eight judgments and the sentences will run consecutively; 2. Defendant will surrender his license to practice law to the North Carolina State Bar; 3. Defendant agrees to testify truthfully at any and all proceedings if called as a witness by the State in the cases against Cynthia Jaeger, J. Lee Hatch, Portia M. Snead, S. Vann Sauls or Jack E. McLamb, III, truthfulness to be determined by the trial court; 4. Defendant will reimburse his clients identified in indictments 09CRS the full amount of the fee collected from the clients; 5. Defendant will pay a fine in an amount to be determined by the Court.

Defendant will plead guilty to ten counts of felony obstruction of justice, ten counts of altering an official case record, and one count of conspiracy to commit felony obstruction of justice. All counts will be consolidated into seven judgments. Defendant will be sentenced to an active prison sentence of not less than 6 months nor more than 8 months in each of the seven judgments and the sentences will run consecutively; 2. Defendant will plead guilty to four counts of misdemeanor obstruction of justice in lieu of the charges in 09CRS ; 2. The charges will be consolidated into two judgments and Defendant will receive two consecutive terms of 45 days, which sentences will be suspended and defendant placed on supervised probation for 36 months under the conditions which follow in addition to the regular terms and conditions of supervised probation; 3. Defendant agrees to testify truthfully at any and all proceedings if called as a witness by the State in the cases against Cynthia Jaeger, Chadwick C. Lee, J. Lee Hatch, Portia M. Snead or Jack E. McLamb, III, truthfulness to be determined by the trial court; 5. Defendant will reimburse his clients in Johnston County files 07CR50005, 07CR51510, 07CR551511, and 07CR54378 the full amount of the fee charged and collected from the clients for legal services rendered in the cases identified in this paragraph; 6. Defendant will not represent any clients in any criminal cases (to include infraction, misdemeanor, and felony charges for a period of three years from the date of entry of judgment in these cases, 09CRS , and must receive 10 hours of continuing legal education [CLE] credit in the area of criminal law each year of his probation over and above yearly CLE requirements under current rules of the North Carolina State Bar before resuming the representation of clients in criminal cases; 7. Defendant must obtain an additional 2 hours of CLE credit in the area of ethics each year of his probation over and above yearly CLE requirements under current rules of the North Carolina State Bar;

4 8. Defendant will perform community service in an amount which will be determined by the Court; 9. Defendant will pay a fine in an amount to be determined by the Court.

Defendant will plead guilty to three counts of misdemeanor obstruction of justice; 2. Two of the counts will be consolidated and Defendant will receive two consecutive sentences of 45 days, which sentences will be suspended and defendant placed on supervised probation for 36 months under the conditions which follow in addition to the regular terms and conditions of supervised probation; 3. Defendant will serve three weekends in the Johnston County Jail; 4. Defendant agrees to testify truthfully at any and all proceedings if called as a witness by the State in the cases against Cynthia Jaeger, Chadwick C. Lee, J. Lee Hatch, Portia M. Snead or S. Vann Sauls, truthfulness to be determined by the trial court; 5. Defendant will reimburse his clients in Johnston County files 07CR5059, 07CR5323, and 07CR the full amount of the fee charged and collected from the clients; 6.
