3 EMN Conference Irregular Migration and Return: Challenges and Practices, Athens June 2014 Aims of the Conference: To raise awareness about work undertaken by EMN in relation to return and irregular migration and also to consider the future developments of the EU Return Policy How m/s, EU institutions, its agencies and third countries can cooperate effectively to overcome the challenges represented by irregular migration

7 Summary of the Conference I EU Return policy remains high on the Home Affairs agenda and on the agenda of the m/s Effective return policy is an essential part of a well managed migration policy: must remain credible to EU citizens and to potential irregular migrants However there are too many cases of migrants with no clear legal status. This must be addressed by more effective implementation tools Essential role of EU cooperation for effective return by EU Agencies: Frontex & European Asylum Support Agency

8 Summary of the Conference II Cooperation for effective return, the external dimension: Cooperation with third countries (Readmission Agreements: Turkey & Pakistan or cases of cooperation like UK & Pakistan) Incentives for return and reintegration: Offered to illegal migrants to encourage return. Essential tool to that are the findings of the EMN study: Findings from the EMN study "Good practices in the return and reintegration of irregular migrants: Member States' entry bans policy and use of readmission agreements between Member States and third countries". Detention and alternatives to detention: How risks are balanced with the fundamental rights of the irregular migrants. Key findings on this issue, the EMN study: The use of detention and alternatives to detention in the context of immigration policies

9 Conclusions Importance of respecting the fundamental rights of irregular migrants, by effective procedures that are in place in all m/s Implementing effectively alternatives to detention, encouraging voluntary departure and reintegration measures: decreasing the number of irregular migrants with no clear legal status Challenges for the EU, institutions and m/s concerning the effective return and implementation of good practices

10 Next Steps Council Conclusions 5 th and 6 th June 2014 emphasize the role EMN can play (EMN Return Expert Group) in supporting the m/s in the practical cooperation of Return Policy, in cooperation with EU Agencies, international organizations and NGO s After collecting practices of returns to Afghanistan and Pakistan, REG next priority will be the West Africa. REG brings together all the aspects of an effective return policy, focused on fundamental rights, effective implementation of tools and cooperation of all (EU, M/S, Agencies, Organizations and third countries).
