7 I. analysis of achievements 1.1 Introduction The National Dialogue Council is provided for by Article 168 of the Constitution of the Republic of Rwanda of 4th June 2003 as amended to date. It convenes annually, under the chairmanship of the President of the Republic and brings together the President of the Republic and representatives of councils of local administrative entities with legal status as elected by their peers. The National Dialogue is also attended by members of the Cabinet and Parliament, and such others as may be determined by the President of the Republic. The National Dialogue Council discusses issues of national importance and problems relating to local government and national unity. Resolutions made (in relation to economic, good governance, social welfare and, justice) are submitted to concerned institutions for implementation. The National Dialogue Council is one of the major platforms at which His Excellency the President of the Republic meets representatives of Rwandan citizens at grassroot level, to discuss issues of national importance and work out appropriate solutions. This Council is one of the indicators for the Rwandans role in making decisions pertaining to national affairs. The 8 th National Dialogue Council convened in Kigali on the 20 th and the 21 st of December 2010 and brought together about 950 participants under the theme: «our responsibility is delivering quality service». The following presentations were made : 1. Strategies and orientation of the third phase of decentralization ( ); 2. Social Cohesion and Reconciliation barometer; 3. The 2 nd Consultative Meeting on the fight against genocide; 4. 9 Year - Basic Education; 5. Savings, Small and Medium Scale enterprises; 6. Housing, afforestation, irrigation and land consolidation; 7. Community-based health insurance scheme, nutrition, hygiene and sanitation and HIV/AIDS. 7
8 In the 8 th National Dialogue Council, a total of 23 resolutions were taken. This report shows the implementation status of those resolutions, as well as a summary on implementation of resolutions earlier taken at the 7 th National Dialogue Council that were not fully implemented or pending as of December Summary of the Report economic Development: In this pillar, 6 resolutions were taken focusing on sensitizing citizens to join SACCOs established under Umurenge SACCO program, protecting all marshlands across the country, by relocating all the people who had settled in the marshlands, but also on addressing market issues relating to agricultural and livestock products. Good Governance: In this area, 6 resolutions were taken aimed at fine-tuning strategies to prevent the impact of genocide by taking care of survivors of the genocide perpetrated against Tutsi, to preserve evidence of genocide, to improve the policy on determination and organisation of volunteer activities in Rwanda, to keep on implementing the decentralization policy, to prevent corruption as reported in local government and to sensitise Rwandan refugees to repatriate. social Welfare: Under this pillar, 7 resolutions were taken in relation to increasing effort in teaching Kinyarwanda language, Culture and Sports, eradication of grass thatched houses, attraction of private investments in education, active participation of parents in their children s education, increasing and empowering TVET centres, launching the Academy of Language and Culture, preparation for the 12 year basic education programme and enhancement of health programmes. Justice: Four (4) resolutions were taken and include; prosecuting those involved in economic crimes (embezzlement and mismanagement of public funds), reviewing laws governing pension schemes (so that they may be extended to all people including those who do not earn a monthly salary), and collaborating with foreign countries for them to extradite all Rwandan genocide fugitives to face justice in Rwanda or be tried in those countries harbouring them. Key achievements In economic Development, Umurenge SACCO membership increased from 1,155,917 to 1,354,748 members. 90 SACCOs established under Umurenge SACCO 8
9 program were issued with full operating licences by BNR while 340 were issued with provisional operating licences (accepting deposits but with no authorisation to give out loans to their customers). Regarding marshland settlements, out of 4,501 houses built in marshlands, 567 and their occupants have been resettledthis activity is ongoing. Marketing strategies include: publication of food prices in media (TV, radios and internet especially on have been implemented. MINAGRI further recommended to public institutions like schools and prisons to regularly buy food from cooperative societies by at least up to 40% of their demand. In Good Governance, delegates from the Ministry of Disaster Management and Refugees visited Rwandan refugees living in Zambia, Malawi, Zimbabwe, and Congo Brazzaville to sensitise them to return home and so far 98 Rwandan refugees have since returned home from the above mentioned countries. Decentralisation programme, phase III ( ) has started and is now ongoing. A team comprising staff from the Ministry in the Office of the President, MINALOC and the Office of Ombudsman was set up and tasked to address alleged corruption issues in local government. In Social Affairs, Instruction 411/12.00/2011 of 18/02/2011 was issued to improve learning and teaching practices as well as sports in primary and secondary schools. The budget allocated to sports and cultural activities has increased from Rwf 253,940,295 to Rwf 560,075,563. On the other side, the number of women using family planning practices increased to 45% (2011) from 27% in In Justice, various labour laws, including laws on maternity and retirement pension benefits were reviewed. In a way of bringing justice to genocide perpetrators, a number of suspects have been arrested in Netherlands, Belgium and France. Some of suspects have been sentenced while others are still being detained pending trial. A list of people who committed economic crimes was also drawn and forwarded to all relevant authorities. Overall, out of 23 resolutions, 19 (83%) are almost fully implemented while 4 (17%) are partially done. The following Pie chart shows a summarised implementation status of the 23 resolutions. 9

In Agriculture Development, a crop irrigation master plan was adopted; some 22,681 Ha of marshland and 450 Ha of uphill land are under irrigation. To ensure access to market by farmers, marketing strategies that include, publication of food item prices in media (TV, radios and internet especially on have been implemented; MINAGRI further recommended public institutions like schools and prisons to regularly purchase their food items from cooperative societies to at least 40% of their demand. A committee composed of tea growers, private sector federation and employees of NAEB (National Agriculture and Export Board) has been put in place to regularly monitor the fixing of appropriate prices to be granted to the tea farmers by taking into consideration changes in international market prices. 13

17 Key achievements A steering committee was set up at national level to prosecute people who committed economic crimes of embezzling and misusing public funds. Steering committees were also set up at District level to ensure refund of arrears on loans secured from micro finance institutions. Regarding trying those who embezzled funds from micro finance institutions, 779 sentences were met out of 1,030 identified cases. Verdicts already enforceable are 565 worth Rwf 1,284,656,131 as ordered by Courts of Law. Voluntary refund of embezzled funds now stands at Rwf 9,345,000. Various laws were revised, including a law relating to the organization and allocation of maternity benefits in Rwanda, a draft law determining the organization of the retirement pension scheme benefits and a draft Prime Minister s Order determining the supervising organ for Rwanda Social Security Board (RSSB). Government of Rwanda held a meeting with the Governments Burundi and DRC to enable Rwandans who worked in those countries enjoy their retirement pension benefits. As a result, Rwandans who worked for the Government of Burundi have started receiving their benefits. In partnership with the Government of Rwanda, Netherlands, Belgium and France have arrested some Rwandans living in those countries and being suspected of committing the crime of genocide against the Tutsi in Some were sentenced while others are still being detained pending trial. The United States of America have extradited one Rwandan citizen following his earlier conviction by the Gacaca Courts to Rwanda to serve his sentence. 1.5 Implementation of Resolutions from the 7th National Dialogue Council On average, the 7 th National Dialogue Council had adopted 23 resolutions including one which did not require monitoring (as a vote of thanks). In December 2010, their implementation was as follows: Seven (32%) of these resolutions had been successfully implemented, 14 (64%) resolutions had been partially done while one (4%) was yet to be implemented. 17
18 These resolutions continued to be monitored and as of December 2011, their implementation is as follows: 15 resolutions (68%) are now fully implemented, 7 resolutions (32%) are still partially implemented. 19 1.6 Lessons learnt Analysis of implementation of these resolutions indicates that almost all were successfully implemented (19/23=83%). This was mainly due to the fact that an implementation plan was prepared soon after the resolutions were adopted. This approach facilitated PRIMATURE and Ministries to closely monitor implementation of the resolutions. This good performance shows that Ministries have made significant efforts in implementation. 1.7 conclusion Resolutions taken in the National Dialogue Council have a greater impact because the Council is chaired by H.E. the President of the Republic and brings together representatives of the citizens and other categories of Rwandan citizens, the resolutions taken from this dialogue should be implemented as a whole. This is the reason why for those few resolutions not yet successfully achieved, their implementation will continue. This is an indication of the will, commitment and capacity of Rwandan citizens to ensure their own development without continuously depending on (foreign assistance). 19
