Tablazon TITLE 28 SOCIAL SERVICES Chapter I Benefits and Privileges of Senior Citizens 1 Section 1. Definition of Terms. For purposes of this Ordinance, the following terms are defined as follows: (a) (b) (c) (d) (e) (f) (g) (h) Senior citizen or elderly refers to any Filipino citizen, resident of General Santos City, and at least sixty (60) years old; Geriatrics refers to the branch of medical science devoted to the study of the biological and physical changes and the diseases of old age; Lodging establishment refers to a building, edifice, structure, apartment or house including tourist inn, apartelle, motorist hotel, and pension house engaged in catering, leasing or providing facilities to transients, tourists or travelers; Medical Services refer to hospital services, professional services of physicians and other health care professionals and diagnostics and laboratory tests that the necessary for the diagnosis or treatment of an illness or injury; Dental services refer to oral examination, cleaning, permanent and temporary filling, extractions and gum treatments, restoration, replacement or repositioning of teeth, or alteration of the alveolar or periodontium process of the maxilla and the mandible that are necessary for the diagnosis or treatment of an illness or injury; Nearest surviving relative refers to the legal spouse who survives the deceased senior citizen: Provided, That where no spouse survives the decedent, this shall be limited to relatives in the following order of degree of kinship: children, parents, siblings, grandparents, grandchildren, uncles and aunts; Home health care service refers to health or supportive care provided to the senior citizen patient at home by licensed health care professionals to include, but not limited to, physicians, nurses, midwives, physical therapist and caregivers; and Indigent senior citizen refers to any elderly who is frail, sickly or with disability, and without pension or permanent source of income, compensation or financial assistance from his/her relatives to support his/her basic needs. Section 2. Contribution to the Community. Any qualified senior citizen as determined by the Office for Senior Citizens Affairs (OSCA) may render his/her services to the community which shall consist of, but not limited to, any of the following: 1 Ordinance No. 18, Series of 1990.

2 a) Tutorial and/or consultancy services; b) Actual teaching and demonstration of hobbies and income generating skills; c) Lectures on specialized fields like agriculture, health, environment protection and the like; d) The transfer of new skills acquired by virtue of their training mentioned in Section 3, paragraph (d); and e) Undertaking other appropriate services as determined by the Office for Senior Citizens Affairs (OSCA) such as school traffic guide, tourist aide, pre-school assistant, etc. In consideration of the services rendered by the qualified elderly, the Office for Senior Citizens Affairs (OSCA) may award or grant benefits or privileges to the elderly, in addition to the other privileges provided for under RA 9994 and this Ordinance. Section 3. Privileges for the Senior Citizens. The senior citizens shall be entitled to the following: (a) (b) (c) the grant of twenty percent (20%) discount and exemption from the Value-Added Tax (VAT), if applicable, on the sale of the following goods and services from all establishments, for the exclusive use and enjoyment or availment of the senior citizen: 1) on the purchase of medicines, including the purchase of influenza and pnuemococcal vaccines, and such other essential medical supplies, accessories and equipment to be determined by the Department of Health (DOH); 2) on the professional fees of attending physician/s in all private hospitals, medical facilities, outpatient clinics and home health care services; 3) on the professional fees of licensed professional health providing home health care services as endorsed by private hospitals or employed through home health care employment agencies; 4) on medical and dental services, diagnostic and laboratory fees in all private hospitals, medical facilities, outpatient clinics, and home health care services, in accordance with the rules and regulations to be issued by the DOH, in coordination with the Philippine Health Insurance Corporation (PhilHealth); 5) in actual fare for land transportation travel in public utility buses (PUBs), public utility jeepneys (PUJs), taxis, Asian utility vehicles (AUVs), and shuttle services in the City; 6) in actual transportation fare for domestic air transport services and sea shipping vessels and the like, based on the actual fare and advanced booking; 7) on the utilization of services in hotels and similar lodging establishments, restaurants and recreation centers; 8) on admission fees charged by theaters, cinema houses and concert halls, circuses, leisure and amusement; and 9) on funeral and burial services for the death of senior citizens. exemption from the payment of individual income taxes of senior citizens who are considered to be minimum wage earners in accordance with Republic Act No. 9504; the grant of a minimum of five percent (5%) discount relative to the monthly utilization of water and electricity supplied by the public utilities: Provided, That the individual meters for the foregoing utilities are registered in the name of the senior citizen residing in the City: Provided, further, That the monthly consumption does not exceed one hundred kilowatt hours (100 kwh) of electricity and thirty cubic meters (30 m3) of water: Provided,

3 (d) (e) (f) (g) (h) (i) (j) (k) furthermore, That the privilege is granted per household regardless of the number of senior citizens residing therein; exemption from training fees for socioeconomic programs; free medical and dental services, diagnostic and laboratory fees such as, but not limited to, x-rays, computerized tomography scans and blood tests, in all government facilities, subject to the guidelines issued by Department of Health in coordination with the Philippine Health Insurance Corporation; free administration of vaccine influenza virus and pneumococcal disease for indigent senior citizen patients; educational assistance to senior citizens to pursue post secondary, tertiary, post tertiary, vocational and technical education, as well as short-term courses for retooling in both public and private schools through provision of scholarships, grants, financial aids, subsidies and other incentives to qualified senior citizens, including support for books, learning materials, and uniform allowances, to the extent feasible: Provided, That senior citizens shall meet minimum admission requirements; retirement benefits of retirees from both the government and the private sector shall be regularly reviewed to ensure their continuing responsiveness and sustainability, and to the extent practicable and feasible, shall be upgraded to be at par with the current scale enjoyed by those in actual service; to the extent possible, special discounts in special programs for senior citizens on purchase of basic commodities, subject to the guidelines to be issued for the purpose by the Department of Trade and Industry (DTI) and the Department of Agriculture (DA); provision of express lanes for senior citizens in all commercial and government establishments; in the absence thereof, priority shall be given to them; and death benefit assistance of a minimum of Two thousand pesos (P2,000.00) shall be given to the nearest surviving relative of a deceased senior citizen which amount shall be subject to adjustments due to inflation in accordance with the guidelines to be issued by the DSWD. In the availment of the privileges mentioned above, the senior citizen, or his/her duly authorized representative, may submit as proof of his/her entitled thereto any of the following: 1) an identification card issued by the Office of the Senior Citizen Affairs (OSCA) of the City: Provided, That such identification card shall be honored nationwide; 2) the passport of the senior citizen concerned; and 3) other documents that establish that the senior citizen is a citizen of the Philippines and is at least sixty (60) years of age. In the purchase of goods and services which are on promotional discount, the senior citizen can avail of the promotional discount or the discount provided herein, whichever is higher. The establishment may claim the discounts granted under subsections (a) and (c) of this section as tax deduction based on the cost of the goods sold or services rendered: Provided, That the cost of the discount shall be allowed as deduction from gross income for the same taxable year that the discount is granted: Provided, further, That the total amount of the claimed tax deduction net of VAT, if applicable, shall be included in their gross sales receipts for tax purposes and shall be subject to proper documentation and to the provisions of the National Internal Revenue Code (NIRC), as amended.

4 Section 4. City Government Assistance. In addition to the assistance to senior citizens granted by RA 9994 and its implementing rules and regulations, the City Government shall provide the following: (a) Employment Senior citizens who have the capacity and desire to work, or be re-employed, shall be provided information and matching services by the PESO to enable them to be productive members of society. Terms of employment shall conform to the provisions of the Labor Code, as amended, and other laws, rules and regulations. (b) Health The City Government shall institute a health program and shall provide an integrated health service for senior citizens. It shall train community-based health workers among senior citizens and health personnel to specialize in the geriatric care and health problems of senior citizens. The health program for senior citizens shall, among others, be harmonized with the National Prevention of Blindness Program of the DOH. There shall be established in General Santos City Hospital a senior citizens ward. This geriatric ward shall be for the exclusive use of senior citizens who are in need of hospital confinement by reason of their health conditions. However, when urgency of public necessity purposes so require, such geriatric ward may be used for emergency purposes, after which, such senior citizens ward shall be reverted to its nature as geriatric ward. (c) Additional City Government Assistance (1) Social Pension Indigent senior citizens shall be entitled to a monthly stipend amounting to Five hundred pesos (P500.00) to augment the daily subsistence and other medical needs of senior citizens, subject to a review every two (2) years by Sangguniang Panlungsod, in consultation with the CSWDO, and subject to the availabiltiy of fund. (2) Mandatory PhilHealth Coverage Indigent senior citizens in the City with no children enrolled with PHIC shall be covered by the national health insurance program of PhilHealth. The City Government shall allocate the necessary funds for indigent senior citizens in the City to ensure the enrollment of indigent senior citizens. (3) Social Safety Nets Social safety assistance intended to cushion the effects of economic shocks, disasters and calamities shall be available for senior citizens. The social safety assistance which shall include, but not limited to food, medicines, and financial assistance for domicile repair, shall be sourced from the disaster/calamity funds of City Government, subject to the guidelines to be issued by DSWD.

5 (4) Death Benefit Assistance Death benefit assistance of a minimum of Two thousand pesos (P2,000.00) shall be given to the nearest surviving relative who took care of the deceased senior citizen until his/her death, or in his/her absence, the benefactor or the licensed foster family of the deceased indigent senior citizen, which amount shall be subject to adjustments every two years due to inflation, in accordance with the guidelines issued by the CSWDO and DILG. In keeping with the intention of the law and similar government assistance being granted, this benefit shall apply in relation to deceased indigent senior citizens only. However, it will not preclude Barangays in the City from giving such benefit to non-indigent senior citizens. (d) Recognition and Maintenance of Senior Citizen Center The City Government shall recognize the allocation of lot for the establishment of the present Senior Citizen Center provided under Resolution No. 107, series of 1991, as amended by Resolution No. 280, series of As such, the City Government shall endeavor to continue to provide assistance for its improvement and maintenance. Barangays shall endeavor to establish their own Senior Citizen Center and provide funds for its maintenance. Section 5. The Office for Senior Citizens Affairs (OSCA). There shall be established an Office for Senior Citizens Affairs (OSCA) to be headed by a senior citizen who shall be appointed by the mayor for a term of three (3) years without reappointment but without prejudice to an extension if exigency so requires. The appointee shall be chosen from a list of five (5) nominees as recommended by general assembly of senior citizens organizations in the City. The Sangguniang Panlungsod shall choose three (3) nominees from the five (5) recommendees by the association. The head of the OSCA shall be appointed to serve the interest of senior citizens and shall not be removed or replaced except for reasons of death, permanent disability or ineffective performance of his/her duties to the detriment of fellow senior citizens. He/she shall be entitled to receive an honorarium of an amount at least equivalent to Salary Grade 10 to be approved by the City Government. He/she shall be assisted by the City Social Welfare and Development Officer in coordination with the Social Welfare and Development Office. The Office of the Mayor shall exercise supervision over the OSCA relative to their plans, activities and programs for senior citizens. The OSCA shall work together and establish linkages with accredited NGOs POs and the barangays in their respective areas. The OSCA shall have the following functions: (a) (b) To plan, implement and monitor yearly work programs in pursuance of the objectives of RA 9994 and this Ordinance; To draw up a list of available and required services which can be provided by the senior citizens;

6 (c) (d) (e) (f) (g) To maintain and regularly update on a quarterly basis the list of senior citizens and to issue national individual identification cards, free of charge, which shall be valid anywhere in the country; To serve as a general information and liason center for senior citizens; To monitor compliance of the provisions of RA 9994 and this Ordinance, particularly the grant of special discounts and privileges to senior citizens; To report to the City Mayor, any individual, establishments, business entity, institutions or agency found violating any provision of RA 9994 and this Ordinance; and To assist the senior citizens in filing complaints or charges against any individual, establishments, business entity, institution, or agency refusing to comply with the privileges under RA 9994 and this Ordinance before the Department of Justice (DOJ), the City Prosecutor s Office, the regional trial court, or the municipal trial court in cities. Section 6. Information Campaign. All establishments in the City covered by RA 9994 and this Ordinance shall prominently display posters, stickers, and other notices that will generate public awareness of the right and privileges of senior citizens under the provisions of R.A and this Ordinance. Section 7. Partnership with National Government. The City Government shall forge partnership with the national government and shall explore livelihood opportunities and other undertaking to enhance the well-being of senior citizens in the City. Section 8. Support for Non-Governmental Organizations (NGOs). Non-governmental organizations or private volunteer organizations dedicated to the promotions, enhancement and support of the welfare of senior citizens are hereby encouraged to become partners of City Government in the implementation of program and projects for the elderly. Accordingly, the City Government shall recognize the vital role of NGOs in complementing the government in the delivery of services to senior citizens. It shall likewise encourage NGOs for the senior citizens to develop innovative service models and pilot projects and to assist in the duplication of successful examples of these models. Section 9. Penalties. Any person or entity who refuses to honor the senior citizen card issued by government or violates any provision of R.A shall suffer the penalties provided under said law and its implementing rules and regulations. Violation of any of the provision not falling under said national law and its implementing rules and regulations shall suffer the following PENALTIES: First Offense: Fine of two thousand pesos (P2,000.00); Second Offense: Fine of three thousand pesos (P3,000.00); Third Offense: Fine of five thousand pesos (P5,000.00) and imprisonment of not less than six (6) months but not more one (1) year. In addition, proper authorities may also cause the cancellation or revocation of the business permit and other similar privileges granted to any person, establishment or business entity.

7 If the offender is a corporation, partnership, organization or any similar entity, the officials thereof directly involved such as the president, general manager, managing partner, or such other officer charged with the management of the business affairs shall be liable therefor. Chapter II Prosthesis Workshop Center 2 Section 1. Creation. - There is hereby created a Prosthesis Workshop Center for Persons with Disabilities in Barangay Fatima, this City, to be known hereinafter as Prosthesis Center, which shall be under the technical and administrative supervision of the City Social Welfare and Development Office. Section 2. Declaration of Policy. - It is the policy of the City Government to promote the welfare and well-being of persons with disabilities through the provision of adequate facilities and delivery of services calculated to uplift the dignity of the disabled persons. In the fulfillment thereof, the City Government envisions the establishment of a workshop center not only to facilitate the development of prosthesis to be made readily available to qualified beneficiaries, but also equip persons with disabilities with skills and knowledge to ensure their smooth integration into the mainstream of the society. The city shall endeavor to forge partnership with private organizations or NGOs in the pursuit of this project in the concept of public-private partnership. Section 3. Beneficiaries of the Prosthesis Workshop Center. - The services and facilities of the Prosthesis Center shall be limited only to residents of General Santos City who have orthopedic defects, or who become amputees or have shortened limbs requiring immediate services of the center upon the recommendation of a physician. However, the center may admit non-residents of the city provided that such beneficiaries shall pay the full cost of material and production of prosthesis. Section 4. Fees. - Prosthesis shall be made readily available to all persons with disabilities. However, beneficiaries living below poverty line based on the social case study being made by CSWDO shall be fully subsidized. Non-residents of General Santos City availing the services of the center shall pay the full cost of material and production of prosthesis. Section 5. Trust Fund. - A trust fund in the name of the Prosthesis Workshop Center for Persons with Disabilities is hereby established, to which account all the remittances realized from the operation of said center shall be deposited. Subject to the usual government accounting and auditing rules and regulations, expenses for personnel services, supplies and materials, and other related and necessary expense that may be incurred in the course of operation and administration of the said center shall be chargeable against the fund heretofore established. Section 6. Source of Fund. The City Government shall set aside funds for the operation and maintenance of the Prosthesis Center. 2 Ordinance No. 12, Series of 1999.

8 Section 7. Implementing Guidelines. - Immediately after the approval of this ordinance, the Office of the City Mayor in coordination with the Office of the City Social Welfare and Development Office, shall formulate implementing guidelines to govern the administrative and fiscal operation and management of the Prosthesis Center. Chapter III Anti-Poverty Agenda 3 Section 1. Short Title. - This Ordinance shall be known for short as the 2006 Anti- Poverty Agenda of General Santos City. Section 2. Coverage. - (a) This Ordinance shall cover all persons living in poverty who are bonafide residents of the City. For the purpose of this Ordinance, the term Persons Living in Poverty shall refer to any natural person living on poverty threshold as defined by National Economic and Development Authority (NEDA) and/or the National Statistical Coordination Board (NSCB). (b) Within reasonable time but not to exceed one (1) year after this Ordinance shall have taken effect, the City through its office concerned shall come out with a listing of all persons living in poverty in the twenty-six (26) barangays including their specific whereabouts in these barangays and their socio-demographic profiles. (c) The City Government office concerned shall update such listing at least once in every three (3) years or as often as necessary. Persons named/included in such listing shall be the only ones qualified to avail of the anti-poverty programs of the City. The City Government Office concerned must strictly see to it that no natural person shall form part of such listing by means of fiction, machination, fraud or stealth, or on the mere basis of political accommodation. Section 3. Statement of Policy. - The following guidelines shall be adopted and observed in the design and implementation of all anti-poverty programs in the City: i. That every poverty alleviation program, project or activity shall generally effect to reduce by a significant proportion the number of barangay residents living in poverty and at the same time the number of barangay residents who suffer from hunger; ii. That the program shall meaningfully provide for a transparent, effective, accountable, and sustainable poverty intervention strategy/scheme; iii. That the program shall specifically focus intervention towards promoting health, food and nutrition, water and environmental sanitation, income security, shelter and affordable but decent housing, peace and order, free access to basic education, functional literacy, and family care; iv. That the program shall take into account the principle and interrelationship of population and development in planning and implementation; and v. That, as far as practicable, the program shall also take into account the eight (8) United Nations Millennium Development Goals to which the Philippines is a signatory, specifically: Eradicate extreme poverty and hunger; achieve universal primary education; promote gender equality and 3 Ordinance No. 05, Series of 2006.

9 empower women; reduce child mortality; improve maternal health; combat HIV/AIDS, malaria and other diseases; ensure environmental sustainability; and develop a global partnership for development. Section 4. Implementing Agency. - The Office of the City Social Welfare and Development (CSWDO) is hereby designated to be the City s implementing arm in all matters relative to poverty alleviation. As such the CSWDO shall: i. Within three (3) months after this Ordinance shall have taken effect, prepare the general rules and guidelines implementing the provisions of this Ordinance; ii. Design and prepare anti-poverty programs, projects, and related activities for the City to carry out pursuant to the provisions of this Ordinance, put these into effective action, and/or assist/oversee the effective implementation of these programs; iii. Coordinate/work with different government organizations (GOs), nongovernment organizations (NGOs) and People s Organizations (POs) in the pursuit of anti-poverty programs; iv. Exercise such other functions expressly granted, those necessarily implied therefrom, as well as functions necessary, appropriate, or incidental to the efficient and effective implementation of the provisions of this Ordinance. Section 5. Funds. - (a) Within six (6) months after this Ordinance shall have taken effect, the Local Chief Executive shall propose the necessary appropriation of funds to be used in the implementation of City s poverty alleviation programs depending on the actual costs of these programs, such to be taken from the general fund, subject to the approval of the Sanggunian. (b) For the purpose of this Ordinance the City Government may also accept funds coming from other GOs and NGOs to be used in the implementation of anti-poverty programs, projects and related activities, subject to the proper government accounting and auditing procedures. Chapter IV Emergency Assistance Program 4 Section 1. Program Objective. The Emergency Assistance Program of the City Government of General Santos is established to: 1.1 lessen the bio-psychosocial impact of natural and man-induced disasters by providing timely, appropriate and adequate relief and rehabilitation services to victims as well as to other distressed/displaced persons in crisis; 1.2. develop individual, family and community capabilities for quick, orderly and structured response through preparedness and mitigation activities in major and destructive hazards, hence, preventing loss of lives and properties, minimize suffering and facilitate rehabilitation towards sustainable development. 4 Ordinance No. 03, Series of 2010.

Program Description. - It is a program that provides relief, mitigation and rehabilitation services to victims of natural/man-made calamities and social disorganization, as well as prepare the people and community to cope with disaster and prevent loss of lives and properties. 13 System Tertiary P 6, Barangay Certification on residency Section 4. General Policies. The following shall be the general programs/policies: A. The stockpiling of food and non-food items and other requirements for emergency/crisis operations/situations shall be maintained for a quick and systematic response. This will be subjected to Commission on Audit rules and regulations; B. The maintenance of cash advances for mortuary and limited financial assistance as defined in the types of services vis-à-vis per capita cost to be extended to beneficiaries shall be institutionalized, subject to Commission on Audit rules and regulations; C. The Social Worker s professional judgment/decision and recommendation through the conduct of thorough assessment and home visitation shall prevail in determining the eligibility of customers/beneficiaries. He/she shall likewise determine the actual cost of assistance based on needs with the above given limitation and available resources; D. Any financial assistance to be extended to beneficiaries beyond the maximum amount stipulated herein shall be at the discretion of the Local Chief Executive. E. Beneficiaries of 4Ps or similar programs from government or NGOs shall be excluded from this program (educational program). F. Parents or guardians of student beneficiaries are required to attend or participate orientation/seminar, meetings or activities called by the CSWDO as deemed necessary. Section 5. Monitoring and Evaluation. - The technical staff of the City Social Welfare and Development Office shall undertake a periodic monitoring and evaluation on the adequacy, appropriateness and timeliness of the Emergency Assistance Program Delivery.
