The monitoring batch is carried out in November. CEPT would like to submit the Fourth External Monitoring report. In this report, we would like to present the outstanding issues in the third monitoring batch, new arising problems and findings in this monitoring batch. The Report also presents achievements in solving complaints and grievances of affected households in the affected s of Phuc Yen town, Binh Xuyen, Tam Duong, Lap Thach and Song Lo districts of Vinh Phuc province. Reviewing the compliance with REMDP in resettlement plan implementation of Vinh Phuc province will be clearly presented as well as recommendations of the EMA proposed to improve co-operation and compliance to ensure better implementation of the REMDP. 5 SUMMARY - The 4th monitoring report in Vinh Phuc province is made basing on the outcomes of the monitoring for compensation and land acquisition in 1 town and 4 districts including Phuc Yen town, Binh Xuyen district, Tam Duong district, Lap Thach district and Song Lo district. - The 4th monitoring aims at reviewing the settlement of shortcomings mentioned in the 3rd monitoring report, reviewing the results of REMDP implementation after the 3rd monitoring, reviewing shortcomings, difficulties and the settlement of complaints of the relevant parities. - Results of the 4th monitoring: o Some shortcomings found in the 3rd monitoring in districts/ s have been being solved: Vinh Phuc People s Committee, Song Lo district has issued an official letter to answer about 3 poles 8 meters in the field of Dong Thinh (the land dispute among 72 households in Duc Bac and Dong Thinh ). The compensation for land of 5 households in Suoi hamlet, Cao Phong, Song Lo district has been completed. The construction unit has compensated for areas affected during the construction for 4 households in Ngoc Bat hamlet, Cao Phong including Khong Tien Nga, Kiem Manh Mien, Kieu Quang Viet and Khong Van Doan. Vicentech brick factory received the compensation for land on 16th November while the compensation for surface leveling has not been solved yet. However, Vicentech brick factory has allowed the contractor to start their construction. 2 out of 4 resettled households in Son Loi which did not receive the compensation (shortcomings mentioned in the 3rd monitoring) have received the compensation to move into the resettlement area (households of Nguyen Van The and Nguyen Van Thanh). 04 households in Huong Vi hamlet, Huong Son, Binh Xuyen district have decided to get the land in the resettlement area. o Information dissemination and community consultattion have been conducted but insufficiently. o Project information has been disseminated and explained to the DPs who have queries by the local authorities; however, project information booklets (PIB) have 4

6 not been reissued. Vinh Phuc PPC is applying prices as per the Decision No. 3209/NC1 dated August 22 by the PPC on applying compensation prices for structures at the time of allocation of resettlement land to relocating households. o The infrastructure of the resettlement areas are constructed slowly: among 20 resettlement areas, 15 resettlement areas have handed over land to households who are building their households but the infrastructure has not been completed (electricity, water and drainage system are not available); 3 resettlement areas are having surface leveled; 2 resettlement areas have not completed their land acquisition. Resettlements areas are commented to have low quality construction. o Many households expect the increase of slot area in the resettlement area to make it suitable to the daily living and agricultural production of rural households. o Some households are submitting their requests for the resettlement as their remaining areas are not enough to build a house or deformed or have no entrance to their houses. o Livelihood recovery activities have not been implemented although districts have established their income recovery program management unit (whose Director is the Vice Chairman of the district PC, Deputy Director is the Head of the Agricultural Department and members are staffs of functional departments). o Activities related to complaint settlement are conducted in a slow manner. o Delay in solving the impacts arising during the construction 5

7 I. INTRODUCTION 1.1. Project introduction The expressway going through Vinh Phuc province is km long and goes through 23 s of 5 districts/ town including Phuc Yen town, districts of Binh Xuyen, Tam Duong, Song Lo and Lap Thach. The area affected by the project is ha including a wide range of land type: building land, garden land, agricultural land, forestry land, aquaculture land and public land. The affected households total 7, resettlement areas are build for 417 households of resettlement Mandate of EMA Supervise the RP implementation check to see whether the actual compensation and resettlement are conducted in the line of the project s policies stipulated in REMDP. Identify the inconsistence between the policies and actual implementation of the resettlement. Supervise the settlement of questions and complaints of affected households shortcomings mentioned in the 3 rd monitoring. Make recommendations to enhance the resettlement for the next items of the projects Monitoring methodology Review documents in the office Review all of the decisions to approve the project, unit price, compensation plan, establishment of the CARB and other relevant legal documents. Review to see whether the unit price applied for affected assets are possible to approach the market/ alterative price or not. Check in random 30% of the compensation profiles to ensure that the compensation for the affected households is in the line of the project s resettlement policies. Meet with and interview the relevant parties responsible for the compensation and land acquisition Noi Bai Lao Cai expressway PMU: update the progress of construction, land acquisition, return of public works to the affected localities. Getinsa, the consultant of Noi Bai Lao Cai expressway project: update the plan for the implementation of livelihood recovery program for project affected households. The CARB of Phuc Yen town, districts of Binh Xuyen, Tam Duong, Lap Thach and Song Lo: check the compensation profiles kept in the district; check the progress of 6

8 compensation, complaints and the settlement of complaints submitted by affected households. People s Committees of project affected s in these above mentioned districts: check the progress of compensation, difficulties and the settlement of difficulties in the compensation and land acquisition in the s. Assessment on fields Meet with affected households to see whether they have received enough information about the project, compensation policy and their rights in Information dissemination programs. Meet with seriously affected households and households moving for resettlement to assess whether the compensation is conducted in the line of the project s compensation policies. Meet with households sending complaints about the compensation to review the process of complaining and complain settlement of parties related to the project. Visit resettlement areas to assess the progress of building the infrastructure, households houses and the possibility of the resettlement areas in meeting households demands in accordance with the project s policies. Visit affected public works, fields and land of dispute to study the households difficulties and complaints. II. SUMMARY OF THE SHORTCOMINGS FOUND IN THE 3RD MONITORING 2.1. Information dissemination PIBs have not been distributed. Several households do not remember all project information or do not fully grasp the policies Detailed measurement survey Some households complain that the area measured in reality for compensation is fewer than that in the land use right certificate. Some households complain about the missing DMS and wrong identification of their land type. Some impacts arising during the construction are being solved. 9 2.4. Resettlement issues In Vinh Phuc area, there are 20 resettlement areas in which15 resettlement areas witnessed some households receiving the land to build their houses but the electricity, water and drainage system are not available; 5 resettlement areas are having surface leveled. Many households complain that the front of the resettlement slot is narrow, unsuitable to the agricultural production of the households; Many households do not accept to receive compensation for affected structures, saying that the compensation prices are low, so they have not moved to the resettlement sites. Supports regulated by REMDP and the province PC to support the affected households are paid slowly. Many households have petition for resettlement Compensation payment activities In Lap Thach and Song Lo district, 9 households have not received the compensation for the agricultural land due to the price difference and missing DMS. 18 households in Binh Xuyen district and 10 households in Phuc Yen town and some households in Tam Duong district have not received the compensation for the agricultural and building land. 21 resettled households in Tu Yen, Song Lo district disagree to receive the compensation and have not drawn for slots and disagree with the planning of infrastructure of the resettlement area they suggest building houses whose fronts are opposite to each other to help them have a larger area behind their households, suitable to the rural life. 25 resettled households in Duc Bac, Song Lo district have not received the compensation for the assets on their land as they do not agree with the compensation price due to the old compensation pricing while price escalation is happening and have not received land as the area of resettlement slots is small. The construction unit has not returned the public affected works for some s; The construction has affected some agricultural areas in some s (flooding) so the people cannot do 2 3 crop cultivation like before and ask for the compensation or support but have not been solved; 01 household asks for the withrawal of the remaining agricultural area (around 200m 2 ) which is flooded while there is no water drainage so cannot be used for production Replacement price Many affected households in some s complain about the low compensation price which cannot approach the market price or alterative price, particularly, for the garden land close to the building land. 8

10 III Issues on gender and vulnerable households Gender and vulnerable household are not clearly stated in the compensation profile of the project. There is no specific policy for households of policy, invalids and revolutionary martyr or poor households although households of invalids and revolutionary martyr or poor households are listed as project affected households Complaint settlement Many complaints related to land dispute, missing DMS, unit price have not been settled. Many people complain that they are not really satisifed with the complaint settlement of the local authorities. ISSUES RELATED TO LAND ACQUISITION, RESETTLEMENT AND ETHNIC MINORITY DURING THE FOURTH MONITORING Shortcomings mentioned in the previous monitoring have been being settled with the supplementation for the missing DMS, compensation payment and compensation for impacts arising during the construction; however, they have not been completely settled. Some households have not received the compensation for the reason that the infrastructure in the resettlement areas has not been completed so they cannot move to the resettlement areas. Up to now, some resettlement areas have been basically completed; therefore, PMU2 continues to hand over the land and pay compensation for architectual objects and assets on land. At the time of monitoring, this situation is recorded at districts of Lap Thach and Song Lo by the consultants. According to the s managers, support is planned to be paid basing on the new supporting policy which is the calculation for price difference due to the price escalation (according to the Decision No. 3209/NC1 dated August 22 by Vinh Phuc PPC on applying compensation price for structures at the time of allocating resettlement land for the relocating households) for structures and working days of transportation and removal. 9

13 - Resettled households have not been identified correctly. Many households whose remaining area is enough to build a house but there is no entrance to the house or which have no land to build a house as having split land to give to their children or whose houses are built on the agricultural land area not allowed to resettle. C. Compensation 1. Shortcomings - Many households do not agree to receive the compensation due to complaints about the low price. Complaint should be properly settled to make the local people accept the compensation plan. - PMU2 should soon apply compensation prices as per the Decision No. 3209/NC1 for the affected households. - PMU2 is requested to coordinate with Noi Bai- Lao Cai expressway PMU in Vinh Phuc to urge the construction unit to compensate for impacts arising during the construction. - Update the policies in the REMDP. - Distribute REMDP to the DCARB, PCs. - Should pay more attention to households of policy, invalids and revolutionary martyr. - VEC needs to urge the construction unit. - Consultants for REMDP. - Noi Bai Lao Cai Expressway PMU in Vinh Phuc. - PMU2, DCARB - Right after having the comments of the EMA in the 4 th monitoring report (November ). - Right after having the comments of the EMA in the 4 th monitoring 13

G. Complaints and complaint settlement 1. Shortcomings - Many complaints have not been settled. - Getinsa consulting unit has made the cost estimate and drafted the contract with the program PMUs and submitted to VEC. This is the reason for the slowness in the complaint settlement. - It is essential to provide information to the PCs to make them possible to immediately reply complaints if possible or provide guidelines to help households complaining by mouth to write complaining letters in the line of regulations. - PMU2 needs to reply in writing and these documents should be archived in PCs and DCARB. - It is needed to urge the progress of complaint settlement as well as create a cooperative environment during the meetings with the local people to avoid the imposition. - It is needed to intensify the information publication, information dissemination and legal documents of Vinh Phuc PC in a various forms. - PMU2, DCARB and PCs. - Right after having the comments of the EMA in the 4 th monitoring report (November ) 17

CONCLUSIONS - Project Information Booklet (PIB) is being reviewed and has not been issued yet. - Legal documents of Vinh Phuc People s Committee regarding compensation, resettlement compensation and support towards the land withdrawal of the State have been popularized but the local people have not clearly understood their rights in the project. - The cooperation between PMU2, DCARB and PCs is not really tight. Meetings with the affected households have been organized; however, information dissemination is remained limited and many people have not received the project s information. - Missing DMS still happens in terms of quantity so supplementary DMS has been conducted for many times but in a slow manner. - Many households do not agree to receive the compensation due to the disagreement with the compensated area and land type. - The supplementary DMS and compensation are prolonged due to the annual changes of the applicable unit price in the line of decisions by the Province People s Committee leading to the fact that money paid for households receiving the compensation in the next time is more than that paid for households receiving the compensation in the previous time. Therefore, households receiving compensation in the first time find it unfavorable. - The compensation for architectual objects and assets on land is no longer suitable at the time of handing over the resettlement surface. Therefore, is is disagreed by the people who say that the compensation is not enough for them to build a new house in the resettlement area. However, at the time of monitoring, the consultant recorded the payment for the price escalation for architectual objects and assets on the land being applied in Lap Thanh and Song Lo district according to the Decision 3209/NC1. - Many households who have completed the house splitting (parents splits the house and give land to their children) but still build houses on the building land before the date of DMS of the project do not receive the household s support for the removal or progress reward; therefore, some households have not received the compensation. - At present, 2 resettlement areas are in the process of land acquisition (Bai Nghien, Nam Viem and Dong Phang), 3 resettlement areas are having infrastructure built (Hoang Trung, Dong Nga 3 and expressway 2 healthcare centre), 15 resettlement areas are doing the drawing and handing over land in the resettlement area and some households are building their houses. Electricity, water and drainage system have not been completed. - Electricity network and drainage system of almost all resettment areas have not been completed. Some households have moved into the resettlement area. - Most households have drawn for their slots in the resettlement area; however, many households have not received the compensation due to the low quality of the infrastructure in these resettlement areas. Some households worry that 0.4 kv line to supply electricity for the resettlemnt area is in the area of resettled household which can reduce the land usage. 20

22 - Some households do not agree to receive land in the resettlement area; according to them, the area is small and unsuitable for the agricultural production. - Some households ask for the resettlement as the remaining areas are deformed or have no entrance to their houses. - Some shortcomings arising during the construction found in the 2nd and 3rd monitoring have been settled, specially: o The construction unit has compensated for the rice area flooded during the construction of 24 households in Huong Ngoc cooperative, Huong canh town, Binh Xuyen district. o 8 ha of flooded field in hamlets of Phu Thuong, Phu Thinh, Phu Ha, Yen Kieu, Yen Lap and Yen My of Tu Yen has been compensated. - Some impacts newly arising during the construction have been recorded by the monitoring including impacts, for instance, during the soil leveling, land scooping, soil has fallen into the cultivating fields of some households or blocked the sewers of the fields causing flood. - The livelihood recovery program has not been specifically implemented. - Complaints of the local people concerning their rights in the project are settled slowly. The settlement focus on the organization of meetings with the people for explanation, the number of complaints settled in writing is limited while there is a huge number of complaints. V. RECOMMENDATIONS The PMU2 in Vinh Phuc is requested to cooperate with VEC, DCARB and PC to settle the above- mentioned problems to ensure the rights of affected households, specifically: - Issue PIB.Urge and encourage the local social organizations to propagandize, explain and take part in the project implementation. - For impacts arising during the constructions, relevant paries need to urge the construction unit to quickly compensate for affected households. - For the impacts on public works such as internal field canals, it is needed to quickly pay directly to the PC or cooperatives for community to recover their canals and continue their production. - It is needed to make a mechanism of complaint and complaint settlement which should be popularized to the people. Complaints by mouth should be explained at the level to avoid the overload of the DCARB. - It is essential to implement income recovery activities for seriously affected households to ensure that they can quickly recover their living standard like that before the project. 21

On 20 th June, the local people grew banana plants on the abuilding expressway and set up watch towers between the residential area and the expressway to prevent the Contractor from their construction. According to the managers of Nam Viem, all of these 312 expressway affected households request for more compensation for the reason: comparing the compensation between Phuc Yen with the nearby province which is Tan Dan, Soc Son district, Ha Noi. The People s Committee has submitted an official document to explain the situation and Traffic PMU2 Vinh Phuc organized 3 meetings with the local people and the LAB. PMU2 is requested to provide compensation soon, apply the prices according to the new decision of the PPC. PMU2 needs to cooperate with the relevant parties and the authorities to encourage the local people and solve the problem in order to ensure the progress of the work.

II Tam Duong district 4 Hop Hoa town The household of Le Thi Tinh (husband: Tran Van Bong) refused to receive the compensation because the area measured in reality is fewer than that in the land use right certificate. Truong Dinh Chinh Truong Dinh Cac Truong Dinh Chung ISSUES Findings of the 4 th monitoring - 17 households complain that the service land price is lower than that of Nam Vien and Son Loi, Binh Xuyen district. There have not been any resolutions for these 17 households. The authorities continue to encourage the local people as well as to provide specific explanations and guidelines if these complaints are correct. - The irrigation works in Dai Loi and Tan Loi were damages, land filled up the ditch leading to the flooding of 30 ha of production area. The work is being blocked, preventing the pumping and drainage. - Dust originated from the material transportation has impacts on the live and farm products of the people in the. The household refuses to receive the compensation because the area measured in reality for compensation is only 106m 2 while the area in the land use right certificate is192 m 2. It is suggested to compensate for a certain percentage for the missing area; however, the household does not agree. Are two households of resettlement, received the compensation for architectural objects in 2008 but have not received compensation for land and submitted complaints about the missing DMS for plants and proposed supplementary compensation for architectural objects due to price escalation. ISSUES Findings of the 4 th monitoring Households in the resettlement area request to build gutters behind the previous resident extending area. The draw for households positions in the resettlement area has been completed but land has not been handed over to the people due to the gutter used with DT309 road. Nguyen Thi Thuy (Bac 1 hamlet) An area of m 2 of the agricultural land of Mrs. Thuy was acquired for the construction of the resettlement area. However, Mrs. Thuy did not agree to sign the minute of surface hand- over meeting participated by representative of PMU2 Vinh Phuc, representatives of the PC and Mrs. Thuy. Mrs. Thuy agrees to receive the compensation only when the partners that had allow the construction unit to level the surface has been punished. On 14 th February 2009, the decision for the surface leveling of the construction unit was issued; however, Mrs. Thuy has not received the compensation. The compensation is for the agricultural land fund 1 near DT309 road. It is requested to reidentify the land origin and compensate according to the price for nearby land. The household has aquatic land (fish pond) which is planned to be compensated as agricultural land so the household requests for the compensation for DT309 nearby land. The household has no building land anymore and ask for resettlement. Pham Thi Song (Doai hamlet) has not The household of MS Song has two affected ricefields: the first one - CONSULTANT S COMMENTS support policies for these households. - PMU2 needs to quickly reach agreement with the PC about the solution, position of the gutters in the resettlement area in order to complete and hand over the surface. - The decision by PMU2 Vinh Phuc and the PC to allow the construction unit to level the surface when Mrs Thuy has not received the compensation is wrong in accordance to the project s policy. It is requested to clarify the possibilities of relevant parties about this issue and inform Mrs. Thuy. - The DCARB and CARB are recommended to reidentify the land origin. - The DCARB and PMU2 need to review the compensation plan to fix the price for the right land type. - Resettlement should be allowed if the household has no building land anymore. This area is proposed to be compensated as reclaimed land but the household requests the compensation for the agricultural land fund 1 Pham Thi Lung (Bac 2 hamlet): has not received the compensation because 1 nacre tree is missed during the DMS and the remaining area is small so asks for resettlement. Phan Dinh Nam (Doai hamlet, poor household) requests for the receipt of an area as twice as the acquired one. The remaining building land is more than 200 m 2 so the household asks for resettlement. ISSUES Findings of the 4 th monitoring is in May Day field, which is compensated as reclaimed land but the household requests for the compensation for the land fund 1; the second ricefield is in Dong Tam (the agricultural land fund 2) nearby DT 309 but the household requests for the compensation according to the price for the land nearly the building land. In 2006, the household received 98m 2 of garden land in the resident extending area after the land dispute. When the project is implemented, the household requested to change the land into the building land but did not do the financial task (not paying the tax) so the district did not accept. 1 nacre tree is missed. The garden land is near the residential area, the post withdrawal remaining area is 91.2 m 2, asks for the resettlement. The land of Mr. Nam s land was divided in accordance with Decision No. 450 in which each head received 1 pole 3 meters; Mr. Nam s household has 6 heads so received 7 poles 3 meters. However, Mr. Nam does not complete product related tasks so the has acquired some of this area. In 2009, Hoang Dan supplemented Mr. Nam s household for the acquired area but Mr. Nam refused to accept for the reason that the previous area can be used for two crops while the proposed area can be used for one crop only so the had to allocate him an area that is as twice as the previous one. The household s remaining area is more than 200 m 2. Mr. Nam requests the to return the supplementary area CONSULTANT S COMMENTS reidentify the land type and inform the household. - The local authorities need to propagandize and explain for the household. - The DCARB and PMU2 need to review the proposed compensation to ensure the pricing for the right land type. - The DCARB and PMU2 need to review the compensation plan and supplement if needed. - Check the rest of the building land of the household and allow the resettlement if it is eligible. - This is the problem between Mr. Nam s household and Hoang Dan People s Committee so the is in charge of solving this problem soon. 25

The household has an area of 50.9 m 2, land fund 1 in Dong Thap bordering DT309 road in which 9.2 m 2 is affected and requested to be compensated as building land nearby land. However, PMU2 cooperated with the district, and Lien Son Irrigation Company to check and identify this area is in the corridor of 1B canal managed by Lieu Son Irrigation Company so PMU2 decided not to withdraw this area and sent an official letter to inform the household. A document has been sent to the household to inform the household about the fact of not acquiring this area; however, the household requests to have a decision of not acquiring this area to receive the compensation for other areas. - PMU2 is requested to issue an official letter to demolish the decision of land withdrawal and issue a decision of not acquisition for this area. Pham Van Ke (Bac 2 hamlet): has not received the compensation and asks for resettlement. The ricefield No. 59 is affected. The total area of the ricefield is m 2 in which m 2 is acquired and m 2 is remained. The household asks for resettlement; however, the request has not been approved. - Relevant parties need to explain about the policy and resettlement conditions. Phan Dinh Yen (Doai hamlet). These households have not been planned for compensation but has not been resolved inspire of being mentioned in the 2 nd monitoring. Has not had the compensation plan as Mr. Yen did not sign the minute of DMS. His house was built in 1993 and the assets on the land are accounted for 80% by the CARB. In 1978, Mr. Yen bought land of Mr. Tam Tu in Bac hamlet (who is living in the South) on which there used to be a vehicle repairing kiosk. After that, Mr. Yen got his agricultural land in the line of Decision No. 450 which is near the land he had bought. Then, he built a variety of works. The land is identified to be free from dispute. The complaint has been sent but there has been no resolution yet. The household requests for the compensation for the building land and for the resettlement. - It is recommended to identify the land origin and apply 100% of the unit price for the assets on the land. - Arrange resettlement if it is eligible. Phan Trung Phong (Doai hamlet) next to the household of Phan Dinh Yen There has been no compensation plan as Mr. Phong has not signed the minute of DMS. The determines that Mr. Phong builds his house and works on the agricultural land. Mr. Phong requests for the compensation according to the building land price and asks for resettlement. - It is requested to re-identify the land origin. 26

Arising affected households in 3 hamlets have submitted a collective complaint about the impossibility of production due to the flood occurred during the road construction. Le Van Sam ISSUES Findings of the 4 th monitoring Ben Van Tren field (Hoc hamlet): the flooded area is 1,200 m 2, Roc field (Do hamlet): the flooded area is 1,500 m 2 and Ma Day field: flooded area is 2,500 m 2. Ben field (Ngoi hamlet), the flooded area is 1 ha. The remaining area is 51.7 m 2 along the expressway but the landslide makes it impossible for cultivate so he asks for the withdrawal of the remaining area. 6 Kim Long - The resettlement area Dong Cua Dinh (Go hamlet) has been divided into slots; however, the people have not received as the infrastructure has not been completed yet. Nguyen Thi Hanh (Go hamlet), the female head of the household, has not received the compensation. Nguyen Thi Hang (Go hamlet), Ms Hanh s daughter, has not received the compensation. Nguyen Van Tuan (Go hamlet) has not received the compensation and asks for resettlement. - Has completed the surface leveling, pavement and gutters but electricity and water have not been available households have drawn slots in the resettlement area but have not been handed over land in reality. 12 households have not been drawn slots in the resettlement area. - The resettlement area has started degrading (depression in pavement, gutters, etc.). - Some households worry about 0.4 kv network that provides electricity in the resettlement area but is in the slots allocated for resettled households which will reduce the land usage productivity. - Has not received the compensation as there has not been the resettlement land. - The household requests for compensation according to the price at the payment time. - The household has completed the separation; but she has not built a house and is keeping the land given by her mother. - The household asks for the resettlement. - Has not received the compensation due to missing DMS. - Asks for the compensation according to the price at the time of payment. 31 NO Shortcomings/problems from the 3 rd monitoring - Dien Lam hamlet has not received the compensation due to the complaint that PMU2 has done incorrect DMS for the number of rice fields leading to the incorrect area. 8 Dao Tu Resettlement area Nguyen Duc Ly (Doan Ket 2 hamlet) has submitted complaint about the missing area. Nguyen Minh Thuy (Le hamlet) has received the compensation but had complaint about the missing DMS for affected land area. ISSUES Findings of the 4 th monitoring fund 2 (rice field 416), another one is of fund 2. The compensation is planned for 480m 2 of the land fund 1 and the rest of fund 2. According to this household, PMU2 has done incorrect DMS for the number of rice fields leading to the incorrect area. The household asks for the compensation for the whole area as land fund 1. Both two new areas have surface leveled; The infrastructure has not been completed, has no drainage system. Both two resettlement areas have not had electricity and running water. - Requests the support the displacement of the construction material warehouse and warehouse rental during the time of waiting for the issuance of land use right certificate of the compensated land and money for quick acquisition. The household has received the compensation. - Complain that according to the minute of DMS, the affected area is m 2 while the compensation plan is for 66.2 m 2 only and the area compensated is 62.4 m 2 of the building land and 3.8 m 2 of the garden. She request the compensation pricing for the whole as the building land. - A yard of 4.2 m x 7.5 m is recorded in the minute of DMS but it is not planned for compensation. CONSULTANT S COMMENTS with the PC to propagandize and explain about the policies of the project and province to help the household clearly understand. It is needed to speed up the construction progress of these resettlement areas and hand over land to households. Relevant parties are requested to check the minute of DMS and compensate basing on the actual area. - Relevant parties are recommended to review the information, payment profile of the household and do supplementary compensation for the missing area of the compensation plan in comparison with the minute of DMS. - Check and do supplementary compensation for missing architectural objects if necessary. - After the household has completed the land acquisition, pay the support for displacement and land acquisition reward. 30

The household asks the compensation for the whole area as building land. - Has not received the compensation for displacement and quick acquisition. The household has 720 m 2 affected including 4 rice fields. Previously, the household enlarged the local road near the brick kiln on the household s field. Every year, the household contributes products and fulfills financial tasks for the whole area; however, the DMS is only conducted with the current field without the area used for the local road. It is requested to do DMS and compensate for the area used to make the local road. - Has the rice field number 69B, map number 13 has 47 m 2 affected. Mr. Mot used to have a reclaimed rice field which was changed with Mr. Nguyen Van Phuc s (in the same hamlet) for this rice field. Every year (up to 2004) Mr. Mot paid taxes for land fund 1, type 2. The compensation is being planned for the reclaimed land so the household requests to be compensated for the right land type as paying tax and basing on the price at the time of payment. - Mr. Mot has another rice field number 133B, map number 19 with the area in the land use right certificate of 360 m 2. A part of this rice field was acquired to construct a road that reduces the area in the land use right certificate to 236 m 2 which is measured CONSULTANT S COMMENTS - After the household has completed the land acquisition, pay the support for displacement and land acquisition reward. - Review the architectural objects in the payment profile of the household. - After the household has completed the land acquisition, PMU2 needs to pay the support for displacement and land acquisition reward. - PMU2 is requested to cooperate with Dao Tu PC to review the land use right certificate of these rice fields and make a plan for supplementary compensation for the area used to make the local road if it is correct. - PMU2 needs to cooperate with Dao Tu to check the actual land type of the rice field 69B which is being used by Mr. Mot s household. If it is of agricultural land fund 1, type 2, change the compensation plan. - Regarding the 110 m 2 beyond the land use right certificate of the ric efield 133B, it is 31

According to the household, they had to pay tax for the whole area of 360 m 2 in the period from 1981 to 1999 before a part of this area was reduced in the certificate. The household requests for the compensation for the actual area. Arising impacts - 03 graves which have just been found on the field of 3 households including Ngo Van Thanh, Nguyen Duy Ky and Mrs. Nguyen Thi Nhan (see the photos enclosed in the annex). At present, the field having three graves has not been constructed. 9 An Hoa Vuong Van Trai (Phuong Lau hamlet) has not received the compensation since the 2 nd and 3 rd monitoring but has not been solved yet. Tran Van Son (Phuong Lau hamlet), mentally disordered, has not received compensation. The compensation has not been paid when the dispute with Mr. Vuong Van Loi is under settlement. PMU2 has not paid compensation due to the divorce procedures with his ex-wife. Arising impacts - Some small areas along the roadside which are not acquired but difficult to be used for production. - The ditch of Phuong Lau hamlet is affected because the expressway is 4m high leading to the impossibility of drainage. - The construction has impacts on the entrance to the production area and overbridge - 12 households have fields overflown by land and cannot be used for cultivation. Flooding will occur when it rains. - 2 households (Tuan, Nhat) request for resettlement as the road is constructed next to their houses and auxiliary works. - PMU2 has cooperated with the PC to consider and conclude that these 2 households are not eligible for resettlement. CONSULTANT S COMMENTS requested to consider and compensate basing on the actual area on the basis of Clause 2, Clause 3, Article 10 in the Decision No 15/2008/QĐ PC. PMU2 needs to check and make a plan for compensation of the displacement of these graves. It is requested to pay attention to these 2 cases and pay compensation right after the judgment or decision of the Court takes effect. - VEC is requested to urge the construction unit to compensate for impacts arising during the construction. 32

Nguyen Van On The land dispute between two households of Ms. Mai and Mr. Chinh are being submitted to the - The town s pumping station cannot pump water to the North of the field due to the block of the canal caused by the construction. - The interfield to Dong Ro has not been made for local people to harvest their crops. - Sewers of Dong Ro and Goc Ruoi have not been returned. - The town PC has requested for many times but the construction unit has not had any resolution. - Households in Dong Ro want the construction unit to build sewers or the construction unit needs to withdraw the whole area. Like the shortcomings mentioned in the 3 rd monitoring. Households have not been invited to join a meeting or received any reply in writing for this complaint. Request for resettlement and complain that the remaining area cannot be used for living. Households are building houses by themselves as their acquired areas are resident extended ones. - Ms. Mai and Mr. Chinh have not settled their dispute and submitted petition to Binh Xuyen district s Court after the district had reviewed their documents and asked for document CONSULTANT S COMMENTS Noi Bai Lao Cai expressway PMU in Vinh Phuc is requested to work with the construction unit to return affected public works and build the sewer system to ensure the production of affected households/ PMU2 is requested to cooperate with the DCARB and PC to explain these households about the province s price. PMU2 is recommended to consider if these households are of resettlement and timely have resolution to help these households stabilize their lives. The PC needs to have solution to settle the dispute between two households. 33

The household has submitted request to the ISSUES Findings of the 4 th monitoring The land compensation was completed on 16 th November in accordance with the payment decision dated 14 th November 2001 of the province PC. The compensation for surface leveling has not been paid. VICENTECH brick factory has allowed the contractor to implement their construction. The compensation for surface leveling will be paid by PMU2 after completing the calculation. Impacts arising during the construction: - Irrigation and drainage system: rice of fifth- month crop of following households was flooded: + Nguyen Van Hai (Nguyen Van That: 392m 2 + Duong Van Mai: 487m 2 + Nguyen Van Thoi: 192m 2 + Nguyen Van Kiem: 354m 2 - The ditch in Dam Mot was filled up during the construction and cannot be used for the irrigation and drainage of 2.7 ha of agricultural land. - The minute was made at 15h on 21 st July 1022 with the participation of PC s representative, work technician of E&C Posco Company and Phuoc An bridge road construction company. 2 households have submitted letter to the PC and the has submitted to the DCARB and PMU2 but has not been solved. Ngo Thi Sinh (Tay Dinh hamlet) Phan Van Thang (Noi market) Like the shortcomings mentioned in the 3 rd monitoring. The PC has reviewed but not found any basis for the identification of land type. CONSULTANT S COMMENTS PMU2 needs to definitively solve for the brick company. VEC needs to urge the contractor to review and quickly support for these households output. PMU2 needs to review to have a plan of supplementary compensation for two households. PMU2 needs to cooperate with DCARB and PC to reconfirm the land type. 35

ISSUES Findings of the 4 th monitoring CONSULTANT S COMMENTS Phan Tien Sy (Nhu) Cho Noi hamlet has not been compensated for 34m2 of agricultural land. Nguyen Van Hanh (Doi Chua hamlet) requests the project to withdraw the remaining area (200 m 2 ) of the agricultural land as this area cannot be used for cultivation due to being flooded. Household of Mr. Nam (Bay). The construction has leveled the area beyond the land acquisition landmark; he has sent the complaint but has not been solved yet. Household of Dam Thanh Toan, Doi Chua asks for the seasonal compensation and return of the original area affected during the construction. Nguyen Thi Lieu, Tay Dinh hamlet complains that the area measured in reality is fewer than that in the land use right certificate. 14 Huong Son 08 households include: Bui Van Truong, Nguyen Van Nga, Hoang Van Bien, Nguyen Thi Hue, The construction has impacts on the agricultural land beyond the area planned for compensation. Has received the compensation for the acquired area, the remaining area is flooded the gutter was filled up during the construction. The current land is a pond and the water if being drained will flow into the work (overbridge pier) and damage the work. The household has sent the complaint to the PC twice in which the second complaint is sent on 1 st May but has not been replied yet. PMU2 needs to review to have a plan for supplementary compensation for the household. PMU2 needs to consider the withdrawal of the remaining area which cannot be used for cultivation as being impossible for drainage. Like shortcomings mentioned in the 3 rd monitoring. VEC needs to urge the construction unit to return the surface to Mr. Nam s household. The total area of land is around 250m2, of which more than 100m2 has been acquired and compensated. In 2010, the construction unit put the soil into the whole field of the household that makes the household have no land for cultivation. The household directly sent a letter to Phuoc An company and VEC PMU in May to ask for the seasonal compensation and return of the original area. The total area of actual measurement is 212m 2, in which 99m 2 has been acquired. Actually, in 1993 the household was handed over 300m 2 by the locality in the line of Decree No. 64 (was measured by A shaped ruler at that time); however, this area was measured 212m 2 by the project, missing 88m2 without any reasons households: Bui Van Truong, Hoang Van Bien, Nguyen Thi Hue, Nguyen Thi Hue, Huong Vi hamlet have decided for resettlement. VEC needs to urge the construction unit to return the original area and pay the seasonal compensation for the household. Unit needs to cooperate with the DCARB and PC to check the area in the certificate and reality to have complete solution for this household. PMU2 needs to review these cases to approve the resettlement if necessary. 36

Request for the resettlement as the remaining area is deformed so cannot be used for living. Nguyen Thi Man, Nguyen Chi Hoe, Chau Son hamlet requests for business support. ISSUES Findings of the 4 th monitoring - 01 household: Nguyen Van Nga, Huong Vi hamlet has not been decided whether the resettlement is allowed or not. - Bui Thi Dung, Le Thi Lam and Nguyen Thi Nga, Chua Tieng hamlet have not submitted any letters but only complained by mouth. - 3 households in Chua Tieng hamlet and 1 household in Huong Vi hamlet still request for resettlement as the remaining areas are deformed and cannot be used for living. These households have submitted request to the PC but have not been accepted by PMU2. Has not been solved as the documents are insufficient. CONSULTANT S COMMENTS The local authorities should verify the legality of these households. Nguyen Chi Quyen, Chau Son hamlet requests the supplementary compensation for the acquired area. Two land areas, 90m2 for each, handed over by the PC are not listed in the land registration book. These areas have been acquired and are being requested for supplementary compensation. PMU2 needs to verify the affected area of this household and implement supplementary DMS if it is needed. Cemetery. 01 cemetery with sunken surface that has been requested for adding more soil but has not been approved by PMU2. Canals used for the irrigation and drainage for fields in Hoang Oanh and Luong Ngoc hamlet have been filled up during the construction. Like the shortcomings mentioned in the 3 rd monitoring. More than 7km of canal in Hoang Long and Luong Ngoc hamlet have not been repaired as the construction unit and the project have not reached agreement about resolution. The PC and households having fields in 2 fields have requested the construction unit for many times but have not been resolved. PMU2 needs to consider adding more soil to the cemetery s surface to ensure that local people can move graves into the cemetery. VEC needs to urge the construction unit to return canals to hamlets. 37

39 NO Shortcomings/problems from the 3 rd monitoring 15 Gia Khanh town Quang Ha resettlement area VI Lap Thach district ISSUES Findings of the 4 th monitoring Household of Mr. Moc and Mr. Tam have not handed over the surface for the resettlement area and ask for more compensation. - After the withdrawal, Mr. Moc s household (has died) has remained 384 m 2 of agricultural land fund 1; however, the household has 4 couples living on their father s land. The household asks for resettlement, the authorities have planned to allocate another slot and separate house for the household but the household - After the withdrawal, Mr. Tam s household has remained 240m 2 and asks for resettlement. The authorities have allocated the household a building slot while the household has another building slot. The household has sold a slot and now asks the project for another slot. The does not agree as this request is unreasonable. - In the resettlement area, people have built their houses; however, the infrastructure such as gutters has not been completed while electricity and running water are not available. The has held meeting and via the district to recommend PMU2 to quickly complete the resettlement. CONSULTANT S COMMENTS - PMU2, DCARB and need to cooperate to propagandize and encourage these 2 households to receive the compensation in the line of existing regulations. - Should have an official letter and explain to help households understand rights and policies of the project and the province. 16 Tien Lu - Resettled households ask for the continuance of house rental support because the resettlement land has not been handed over for more than 6 months. All of the households (59 households of focused resettlement) have received compensation for affected assets on their land but have not received compensation for land as resettlement land has not been handed over. - Bai Hoi hill resettlement area has 29 households has surface, infrastructure such as electricity, water, gutter completed and handed over land to the people. - Dong Phang resettlement area has not completed the land acquisition as 9 households have not received the compensation for agricultural land and ask for 1 slot in the resettlement area: 7 - PMU2 needs to consider these cases to support these households with house rental. - PMU2 needs to cooperate with the DCARB and PC to explain to households. 38

ISSUES Findings of the 4 th monitoring households in Dinh hamlet (Tran Thi Thinh, Tran Van Hien, Tran Xuan Hanh, Tran Dang Nhan, Do Van Hung, Tran Kim Hoan, Do Van Trung); 2 household in Nuong Ai hamlet (Do Cao Duong); 1 household in Minh Tru hamlet (Dang Van Vien) have submitted request for 1 slot in the resettlement area but the PC does not accept. PMU2 transferred money to the Treasury which requests to have construction bill to pay the money. The culture house is built by the local people so has no bill; therefore, the hamlet has not received the compensation from the Treasury. CONSULTANT S COMMENTS PMU2 needs to confirm or guarantee to make the Treasury to pay money for Muong Cau hamlet. Irrigation canals of Chua hamlet, Muong Cau are requested to be returned to help the local people have irrigation water for the cultivation. Arising impacts Around 100m 2 in the project land withdrawal landmark has not been planned for compensation. The hamlet has requested PMU2 many times; however, it is informed by PMU2 that the construction has not been constructed on this area by the investor. This area will be compensated if it is constructed. At present, the canal has been leveled but not compensated. Do Dinh Trong, Chua hamlet has 167m 2 of field affected and acquired and has received compensation for 131m 2 in the first time, but has not received compensation for 36m 2 due to missing DMS. 167m2 of land include 3 ricefields, 86m 2 and 45m 2 have been compensated and done the 2 nd DMS and the household has signed the minute. For the 3 rd ricefield of 36m 2, the household removed the edge between this rice field and 86m 2 rice field nearby to make them become 1 rice field; therefore, the Unit has identified as one rice field of 86m2. The household has handed over 2 rice-fields of 86m 2 and 45m 2, while 36m 2 has not been handed over due to the missing DMS. PMU2 planned to support VND for 36m 2 but the household refused and said that is the field that must be compensation basing on the field price. VEC needs to urge the construction unit to return these irrigation canals. PMU2 is requested to cooperate with the DCARB and PC to review the area and location of each rice-field of Mr. Trong s household, do supplementary DMS and make a compensation plan for his household. 39

41 NO Shortcomings/problems from the 3 rd monitoring 17 Dong Ich 05 households including: Trieu Van Luan, Nguyen Van Chat, Pham Thi Nham, Nguyen Van Hung and Nguyen Xuan Huong (Hoang Trung hamlet) are affected by resettlement. These HOUSEHOLDs refused to receive compensation which is reduced during the appraisal. ISSUES Findings of the 4 th monitoring Dang Anh Son, Chua hamlet is affected by the project and 55 m 2 of his agricultural land used to grow corn is acquired. The compensation pricing in 2009 is VND/ m 2. However, going to the to receive the compensation, he could receive compensation for 35 m 2 only. At that time, he received full compensation for 35 m 2 and sent a letter to PMU2 to ask for supplementary compensation for 20m 2 in accordance with the signed minute of DMS. PMU 2 has confirmed the supplementary compensation but has not paid the household the compensation for that 20m 2 yet. The household sent a letter to the in The PC and cooperative also confirmed that area is presented in the geography map and his land use right certificate proves that the total area of the household is 55m 2. Like the shortcomings mentioned in the 3 rd monitoring - Household of Trieu Duc Luan has received the compensation for his agricultural land but has not received the compensation for assets and architectural objects on the land. - Has sent a letter to the PC but has not resolved yet. CONSULTANT S COMMENTS PMU2 is requested to confirm and make a plan to compensate the household with remaining 20m 2 basing on the new price at the time of payment for the household to hand over their surface. PMU2 needs to cooperate with the DCARB and PC to specifically and clearly explain the reduction of the total compensation for these households after appraisal. Dao Dinh Hai, Dai Lu hamlet has not received the compensation. The area in the red book is 144 m2, the area of actual measurement is 197.8m2. The Commune PC has held a meeting and agreed to compensate 197.8m2 for Mr. Hai but he asked for the compensation for 216m2 (9 meters) The area in the land use right certificate confirm by the is 144m 2 but the household has to pay tax and service fee for 208.8m 2 every year. After receiving the letter of the household, the DCARB agreed to compensate for 144m 2 in the land use right certificate and 53.8m 2 beyond the land use right certificate, totaling 197.8m2 equivalent to 65,534,867 VND the household received on 29 th August. The household has sent a letter to the for the 2 nd time but has not been solved. The household requests the to check and compare the area in the household s land use right certificate and PMU2 needs to cooperate with DCARB and PC to provide the household with specific and clear explanations. 40

42 NO Shortcomings/problems from the 3 rd monitoring Nguyen Viet Doanh, Dai Lu hamlet has changed land with Mr. Thang. The affected assets have been counted for Mr. Thang; therefore, Mr. Doanh cannot receive the compensation. Mr. Doanh has sent complaint to PMU2. 18 Dinh Chu Tran Quoc Khanh, Bac Son hamlet requests the project to compensate for 3 poles of aquaculture pond, 01 fish watch - house (more than 10m2) and 150m of electric wire from the house ISSUES Findings of the 4 th monitoring that in the s records (as the still keeps the land use right certificate whose name is incorrect). The household has not received the compensation but has been invited to the for many times without any clear reasons. The DMS has been done with 108m2 of affected area. His name is listed in the minute of DMS but not in the list of compensation. The household has not handed over the surface and sent a letter to PMU2. The land changed with Mr Thang and being cultivated by Mr. Doanh is not affected. The compensation is planned for the old price of 10 million VND. The land use right certificate of 108m2 which is in Mr. Doanh s name is paid annual tax. He joined the DMS and signed into the minute. At the time of paying the compensation, Mr. Thang s household is cultivating on this area. Pham Thi Nham household head whose husband is an invalid and died 3 years ago, her son Nguyen Van Hung lives in Hoang Trung hamlet. The household has received compensation for 144m 2 of affected agricultural land and has not received compensation for the whole building land, trees, cowshed, etc., to which the DMS was implemented and pricing was fixed in 2008 at 230 million VND due to the unavailability of the resettlement surface. 60m 2 of land the household gave to the son Nguyen Van Hung before the DMS was implemented has not been compensated. The household complains about the missing DMS for some assets such as 1 dug well, 2 cisterns, 1 pond- land banked edge in front of the house. To the time of monitoring, the household s compensation is added 180 million VND for price escalation, totaling 430 million VND. Like the shortcomings mentioned in the 3 rd monitoring report. His household and other households have been compensated; however, the remaining area neither can be used for cultivation nor fishing due to its dryness. The household requests for the support for the aquaculture (water surface support). CONSULTANT S COMMENTS The PC is requested to confirm the owner of the acquired area. PMU2 needs to review and cooperate with the CARB to conduct supplementary DMS and compensate for 2 households in the line of policies of the project and province. PMU2 needs to consider the supplementary compensation for the household of Tran Quoc Khanh. 41

ISSUES Findings of the 4 th monitoring CONSULTANT S COMMENTS Nguyen Kim Thiep, Ngoc Vi hamlet requests for the withdrawal of the rest area of the affected field as the remaining area of the field cannot be used for cultivation due to lack of the entrance. 19 Van Quan Nguyen Thi Binh (Sa Phung hamlet) 191m2 of garden land bordering Dinh Chu was missed during the inventory. Since 2008, the household has separated land for the son but does not keep any documents. At present, its house is affected. The rest of the area has been separated for the son so the household has no land to build another house. Hoang Thi Han (Sa Phung hamlet) died more than 1 year ago. The household complains about the missing of 140m2 of growing cassava. The supplementary DMS has been implemented but the household has not received the compensation. Like the shortcomings mentioned in the 3 rd monitoring report. The household has sent a letter to the PC to ask for the withdrawal of the remaining area. The has put into a report but has not been solved by the District Project Management Unit m 2 of garden land out of 2400m2 is affected. Building land: 300m2, garden: nearly 2000m2. The household asks for resettlement. 64m2 of rice land type 3 of was DMS implemented but PMU2 paid Mr. Vien of the same hamlet by mistake. The has confirmed and is waiting for PMU2 resolution. 240m2 of rice land type 5 is compensation at the price of 46,000 VND/m2 as this area, according to PMU2, is not in the land use right certificate. Households of Ms. Loi and Ms. Nhan have land mixed between land fund 1 and 2 that has not been separated so disagree to receive the compensation. They have submitted a letter to the and district and the district has sent an official letter. Ba Xep resettlement area, Yen My hamlet has 19 slots with the total area of 3750m2. The foundation and entrance have been completed; gutters are available but there is no drainage way; there have been no electricity and water -> cannot hand over to the people. People don t want to live in the 2 nd strip which is inconvenient for their daily lives. Households want to check if there are any graves under the foundation so the current foundation must be removed for checking. The administrative landmark was adjusted without announcing the local people who continue their production in this field; therefore, the compensation is paid for Dong Thinh. 25 resettled households have not received the compensation due to the disagreement with the compensation price and worry about price escalation. Pham Hong Thai, Yen My hamlet has a three compartment house on the agricultural land and is not under resettlement; however, the household has no land to live and asks for 1 slot of resettlement. The household has not received the compensation and submitted a letter of resettlement. The asks the CARB and PMU2 to allocate 1 slot for this household to help them stabilize their lives as this is a poor household in the. The province and district PC have sent an official letter to confirm this area is of Dong Thinh as the first plan. Nguyen Van Nhan, Khoai Thuong hamlet, who has 2.9 m2 of cassava growing hill land out of 150m2 affected, has not received the compensation and requests for the withdrawal of 150m out of 25 households are main one while the rest are split ones. DMS has been conducted with all of these households in accordance with Decision No. 18 in 2009 and Decision No. 43 in by Vinh Phuc People s Committee. 8 households have received the compensation while 17 households have not (including split households) for the reason that the price of land and assets on land is low so request for higher price (inspire of PMU2 should consider the resettlement for this household. 50 6.2. Annex 2 Interview notes 1. Ms Nguyen Thi Luu Director of Phuc Yen Site clearance Board She has been handed over from Mr Tuan, the former Director since July which has not compeleted yet so she has not clearly understood shortcomings of the s in Xuyen A road region. However, she knows that the cooperation between PMU2 and DCARB is still loose and unclear leading to the difficulties in encouraging the local people there remains no common voice. The construction and problems related to the people s resettlement need to be dealed completely. Recently, the people are much worried and fence the abuilding road to stop the construction due to the low compensation price. The local authorities encourage the local people as well as request PMU2 to clearly deal with this problem to avoid spontaneous activities of the people. 2. Mr Dinh Kim Tuyen Chairman of Phu Thang People s Committee Phuc Thang no longer have nay complaints about compensation. The current construction has certain impacts on the production due to the dust but it is inconsiderable as the road is far from the resident area. 3. Mr Nguyen Thanh Xuan Chairman of Nam Vien PC A total of 312 households have their agricultural land affected and 63 households have their agricultural land acquired for the construction of resettlement area. 10 households have not received the compensation due to the low price. On 20 th June, the local people grew banana plants on the abuilding expressway and made a fence to stop the construction for the reason of comparing the compensation between Nam Vien and the nearby province which is Tan Dan, Soc Son district, Ha Noi. PMU2 has issued an official letter and organized 3 seminars to discuss with the local people but they have not agreed. 4. Mr. Nguyen Duc Chinh Tien Chau PC 17 households complained about the low price for the service land in the previous time; the people compared the price between 2 nearby localities whose price is 300,000 VND/m2 apart. Regarding this problem, the has sent an official letter to request for the compensation for the service land equal to that of Nam Viem to avoid complaints preventing the construction; however, DCARB and PMU2 have not had any resolutions to this problem. Some irrigation works in Dai Loi and Tan Loi hamlet have not been returned leading to the flood occurring when it rains and drought occurring when it is sunny, having impacts on the production 49

51 of the local people. The PC has requested the construction unit and PMU2 but has not received any reply yet. 5. Nguyen Hong Luong Vice Chairman of Gia Khanh PC Some households have moved to the resettlement areas to build and complete their house but the infrastructure has not been completed, for instance, there are no sewers, electricity and running water. Up to now, 2 households in the have not handed over their surface as they have not received the compensation as ask for more compensation; however, the amount asked by these 2 households is unreasonable and excesses the compensation regulated by the province. 6. Nguyen Van Cuong Vice Chairman of Tam Duong district PC The DCARB is working as a supporter for PMU2; therefore, it is unaware of shortcomings of the project s. It does not manage the fund and is inactive. 1.5% to 2% of fund for the CARB is not transferred. 7. Pham Van Suu Duy Phien My family has 2 poles of field fund 1 but the confirms only 1 pole as fund 1 and another pole as fund 2 so I don t agree. My family asks to clarify this problem and requests for the compensation for both 2 poles as land fund Le Thanh Luong An Hoa PC The construction is done in 3 hamlets and has impacts on the drainage canals of 3 hamlets and interfield roads and production land of households. The requests the project to deal with the interfield road, drainage canal and withdraw the rest of small areas which is promised by the project but has not been solved. 9. Vuong Van Trai An Hoa I bought 3 ricefields from Mr. Loi and have paid tax for 10 years, from 1993 to 2003; however, it is unreasonable to give money to Mr. Loi s child. I have other 3 ricefields that are acquired but paid as land fund 2 so I don t agree and have not received the money. I don t want to make it difficult but asks for the compliance of the policies and then I am willing to receive the compensation upon receiving the decision of withdrawing and compensating land in the line of Decision No 69 of the Government. 10. Tran Van Son Phuong Lau hamlet An Hoa I am living with my parents and my second wife. I divorced with my ex-wife. I don t know the reason why the district court decides to divide my assets into 3 portions including those 50

52 compensated by the project. I have divorced; therefore, my assets should be divided into 2 portions. 11. Nguyen Huu Quan Vice Chairman of Kim Long PC The resettlement area has been constructed but 12 households have not drawn due to their disagreement with the construction price difference at the resettlement area and price paid for affected households. Additionally, some slots face Huu Thu Tam Quan road in which there is electric poles in the area handed over. The area of slots in the resettlement area is adjusted from m2 to 125 m2 for two front slots and 150m2 for slots in other locations. I have 2 acres of agricultural land in Ngo Nga field, Huu Thu 1 hamlet which were flooded during the construction. Some nearby households are taking advantage of this area for breeding young fish. Households having flooded area request for the compensation for the productivity reduction and the loss of cultivation for 4 crops. 12. Mr Sai Van Chinh Head of Huu Thu 1 hamlet Kim Long. The has nearly 50,000 m2 of the agricultural land in Ngo Nga field (behind the VEC management office, bordering the old 2B expressway) is flooded and there is no entrance to the field for cultivation; the sent a request to VEC on 11 th November for the request of drainage canal and the redesign for this affected area. Moreover, the also asks the PC for the change of this flooded area from the agricultural land into a football ground (letter sent on 14 th November ). Along with this flood area of nearly 50,000 m2, there is another area of 7 acres near the roundabout that is flooded during the construction. The invited PMU2 to make a minute of DMS in the meeting on 24 th July with the participation of households having this affected land who have agreed with the withdrawal basing on the current price for agricultural land of the province and each household has also sent a withdrawal request. 13. Le Van Cong Chairman of Dao Tu Commune PC The has 2 resettlement areas which have handed over slots to each household but no household has built their house due to the availability of clean water and sewers. 14. Nguyen Van Than the Head of Le hamlet Dao Tu Some resettled households in the hamlet have received the land; however, they have sold their land and bought another land to build a house in the resident area due to the lack of infastructure. Currently, there are 4 households in my affected during the construction but the supplementary DMS has not been conducted. Households request for the supplementary DMS 51

53 and compensation suitable to the reality and then they will receive the compensation. This is their right rather than causing any difficulties for the project. 15. Tran Van Lien Le hamlet Dao Tu My family has 720m2 of land affected, including 4 ricefields. My family made a local road near our brick kiln many years ago on our field area and pays annual products and fulfil all financial tasks for the full areas. We only want the project to do the DMS the area used to make the local road but the DMS has not been conducted. 16. Phan Dinh Nam Doai hamlet Hoang Dan In 1993, my family was not given the land by the cooperative and our land was withrawn due to our lack of products. Xuyen A expressway project has withrawn all of my current land. I want to have land divided in the line of Decision No. 450/ 1992 like before as the study of documents makes me find that there is no document regulating the land withdrawal due to the lack of products. 17. Nguyen Van Hoi Vice Chairman of Son Loi, Binh Xuyen district Some of the cases among shortcomings of Son Loi have not solved but not considerably. The most serious problem lies in the flooding of fith- month crop due to the damange of the drainage system and households complaints. Regarding 4 households in the resettlement area, only 2 households have received the money and land to move into the resettlement area; however, all of these household ask for the support for the construction of foundation and land edge to avoid erosion. 18. Nguyen Van Tuyen, Luong Cau hamlet, Son Loi, Binh Xuyen district The household moved to the resident extending area of Luong Cau hamlet in the late 1992, in 1993 there were 2 people of the household who were not given the land. The land on which the household is living is the household s cassava growing land retained by changing field in 1992 so the has not issued with land use right certificate. The household completed the DMS in 2008 and received compensation in 2009, in which 80% of the compensation is for the agricultural land. There is no service land. The household received the compensation for assets on land without any support for removal. 19. Mr Man Director of Tay Ngoai Agricutural Cooperative Tam Hop We have requested for many times for the reconstruction of the s pumping station. Previously, the ditch is connected and directly goes from the pumping station to the field; however, the construction filled the land which make the ditch take a roundabout route. The ditch 52

54 is narrow and cannot circulate its flow, affecting the station s water tank. The water cannot ensure the irrigation for some fields of more than 70ha to support the winter spring crop. 20. Tran Van Da vice Director of Gia Cau Irrigation Enterprise under Tam Dao Irrigation Company. I am managing from Son Loi to Tam Hop and Huong Son. This pumping station serves a lot of surrounding area but it is affected by the expressway and it is difficult to find a suitable solution when the construction has not been completed. There is no document to decrise the current situation of the pumping station. This is the State s work. When the surface has been handed over for construction, all parties have to create favourable conditions for each other to complete the construction. However, this is the work supporting the production of the local people and has to work well and cannot be affected for any reasons. 21. Tran Thi Hong, Tam Hop, Binh Xuyen district Our household s land type is 5 which is stated is rank 6 in the compensation profile. The household has sent a letter to the to request for the adjustment from type 6 to type Nguyen Van Hanh, Tam Hop, Binh Xuyen District Requests the project to withrwa the remaining area (200m2) of the agricultural land as this area cannot be used for cultivation due to the flooding. 23. Mr Hoa Land administration officer in Huong Son The commuen has requested PMU2 to return the entrance to Ba Mo s cemetery to make people able to move the graves.xuyen A expressway goes through the cemetery. The design did not mention the construction of the road to enter to cemetery which is in the middld of the field without any entrance. The local people want PMU2 to quickly resolve the problem to help them enter this cemetery. 2 pumping station is Chua Tieng and Thieu Khanh were agreed to be rebuilt by the project; however, they have not been done yet. The compensation paid for the is not enough to build these 2 stations so the asks the interference of the district and province. The PMU agreed to build and withdraw the compensation paid for the. 24. Nguyen Xuan Hien Manager of the Natural Resources and Environment Department in Lap Thach district Noi Bai Lao Cai expressway project is basically good; however, the infrastructure of some resettlement areas in some s has not been completed so the people cannot build their houses and move into these areas.
