1 ILO-DFID Partnership Programme on Fair Recruitment and Decent Work for Women Migrant Workers in South Asia and the Middle East International Labour Organization (ILO), Dhaka, Bangladesh Terms of Reference Conduct and provide sensitization/ awareness raising program to the recruiting agencies (which are allowed to recruit female migrant workers) about legislation and policies related to the Migration and Trafficking. 1. Introduction ILO is implementing a five-year, inter-regional technical cooperation programme with partnership of DFID that take a targeted approach to prevent the trafficking of women and girls in South Asia and the Middle East. The overall development objective is to address key drivers and vulnerabilities of trafficking, such as poverty and gender inequality, through an integrated prevention strategy of fair migration and decent work. The programme will work with key stakeholders to empower and better protect women migrant workers and girls. Interventions will also include partnerships with governments on laws and policies that better protect migrant workers. Key stakeholders of this project include governments, social partners, and the private sector, NGOs and importantly, the voice and participation of women migrant workers themselves. Fair recruitment practices and its regulation are needed to enable safer migration through regular channels. The task is focused at enabling recruitment of women migrant workers in compliance with fair recruitment practices based on international standards. In order to improve recruitment practices, the project plans to roll out knowledge building initiatives for recruiting agencies responsible for the recruitment of women migrant workers. ILO has developed a toolkit and reference manual on fair recruitment practices for private recruitment/ employment agencies and provided two day long training to 93 staffs including 13 proprietors of a total of 51 recruitment agencies (RA) who are responsible for sending women abroad. The focus of the training included national legislation such as the Overseas Employment and Migrants Act 2013 and Prevention and Suppression of Human Trafficking Act 2012, as well as international best practices. The training session was conducted by the different expert officials of the Ministry of Expatriate Welfare and Oversea Employment as resource person. As per suggestions and requirements of the ministry and ILO, the initiatives for second round exclusive training to the proprietors of RA is very imperative be taken by the project.

Objective of the Assignment To develop sensitization or orientation materials/ module with relevant information of legal and policy matter related to the Migration and Trafficking specially the Overseas Employment & Migrants Act 2013, Policies related to the female migrants, Code of Conduct/ ethical practice etc. and Human Trafficking Prevention and Suppression Act 2012, including ILO Convention 181 and UN Guiding Principal on Human Rights and Business, Ciett Code of Conduct and good Practice on ethical recruitment etc. To provide sensitization to the recruiting agencies (who are allowed to recruit female migrant workers) regarding the aforementioned regulations, policies and issues. 3. Scope of Work: Revise/ fine-tune of the ILO-Toolkit and Develop a manual for one day sensitization/ orientation workshop/ program for the proprietors of Recruiting Agencies who are assigned to send female migrants abroad; Develop Power Point Presentations on the basis of the developed manual regarding Legal instruments/ policies related to recruitment/ migration, ethical practice (good Practice on ethical recruitment) etc. especially the Overseas Employment & Migrants Act 2013 and Policy 2016 (related to the female migrants), and Human Trafficking Prevention and Suppression Act 2012, Code of Conduct/ ethical practice etc. including ILO Convention 181 and UN Guiding Principal on Human Rights and Business, Ciett Code of Conduct; Conduct and Provide 3 batches of a day long training to minimum of 60 proprietors of the recruitment agencies which are responsible to recruit female migrant workers abroad. The contacting organization/firms/entities should conduct orientation or training program to owners of recruiting agencies; Planning of the training including full itinerary of the events; Arrangement for well-equipped and good quality of venue, food and other necessary arrangements for the participants in Dhaka; Producing a training report as described below with photos of the programme and final training documents (manual and power point slides, group work exercise etc.) and developing format for follow-up reporting. Note: The payment shall be made at-actual basis based on usages of the services from contractor (e.g. venue).

3 4. Expected Outputs and deliverables: A manual for a day long training based on fine-tuned toolkit in Bangla. Two pages concept note in English consisting content and session plan of the manual and finalize with suggestions/ inputs of ILO, Ministry of Expatriates Welfare & Overseas Employment (MoEWOE); Power point presentations on the sessions of the training in English and Bangla; The training/ orientation plan for carrying out the training, venue selection, agency selection including target, timelines and logistics. Organization will send the invitation letter as per Ministry (MoEWOE) issued letter and consultation with the ILO; Conduct 3 batches (each batch will have participants) of training with minimum of 60 proprietors of recruiting agencies (which are responsible to recruit female migrant worker abroad) including Nominations and profiling; Report of each training and at the end compilation report of all trainings, list of trainees with complete contact address; Pre and post evaluation of the training; A format to assess enhancement of knowledge of trained proprietor of recruitment agency to understand notable changes in their fair/ ethical recruitment practice (Follow-up report on ethical practices) 5. Assignment Period The duration of the assignment will be 3-4 months, expected to start 15 th June 2016 Sl Assignment Expected date/ time 1 Development of training/ orientation materials 20 days includes two pages concept notes, training manual, power-point presentations etc. 2 Conduct and provide training to the recruiting 35 days agencies 3. Reporting: individual training report and a compiled report with photos and list of trainees with complete 10 days contact address, Pre and post evaluation of the training etc. 4 Development of a follow-up reporting format 5 days

Eligibility Criteria Minimum 5 years of experience in providing/ conducting training and developing training guideline; Experience in dealing with the issue of labor migration/ human trafficking/ forced labor/ labor rights and related laws; At least 3 master trainers should be enlisted in the pool of trainers; In relation to the above, evidence should be given by the bidder. 7. Selection criteria Proven 5-10 year experience on related work and capacity to develop practical training guideline, session plan and conduct training program; Extensive experience in related work; Must have pool of master trainers with delivery experience; Some working experience with the government and the recruiting agencies is a strong advantage; Experience in documentation, reporting and evaluation of the training program 8. Responsibilities of the ILO as well as the project As described in the service contract document. ILO shall monitor and supervise the work and review progress of the work, provide regular technical support and feedback and provide support for engaging stakeholders and constituents as when required. Besides, the Work in Freedom (WIF) project will provide necessary technical assistance for planning and implementation of the said training program. The project will also establish linkages with the government as well as the BAIRA to help provide assistance as required. Therefore, the selected training service provider will be required to keep close and constant touch with the WIF project for organizing meeting, consultation and coordination support in regards to this task. The selected service provider should maintain the quality of the training and required services as per procedure and protocol of the government and ILO. 9. Reporting and Documentation The training service provider will maintain proper documentation process of the training and assess evaluation and quality of the training through standard template. In addition, the contracted Training Service Provider will regularly update training related data proving input to ILO training/event data monitoring system on completion and achievement of training deliverables. The service provider should report as per the TOR and its deliverables.

Payment Modality The payment on the awarded contract will be made in Bangladesh Taka (BDT) against achieved output and on submission of report as per ILO financial rules and payment conditions that will be stipulated in the Purchase Order (Service for Contract). 11. Proposal Submission and Selection Process of Competent Organization/ Firm/ Entity The ILO invites technical and financial proposal from qualified organization/firms/entities having relevant experience in delivering similar services as mentioned in this Terms of Reference (TOR). Only a single technically responsive and financially viable organization/firm/entity will be selected following ILO procurement rules/procedure on evaluation by an ILO team of professionals, and awarded with the contract for the expected deliverables and outputs as per the TOR. Cumulative Evaluation Method will used for this procurement exercise and Contract will be awarded to highest scorer in Cumulative analysis considering Technical and Financial Evaluation. The technical proposal will contain 70% and financial proposal will contain 30% weight whereas Technical Evaluation passing score is 70%. Any firm scores less than 70% in technical evaluation, the financial proposal of the firm shall not be considered for financial evaluation. The proposals in hard copy with a cover letter to be submitted to: The Country Director, ILO Country Office for Bangladesh, Dhaka Attention: National Project Coordinator, Work in Freedom Project, House: A-9, Road: 127, Gulshan-1, Dhaka Proposal submission Procedure and Submission Deadline: Proposals shall be reached to the above office on or before 5 June, 2016 by 4.30 pm. The proposer must submit the Technical and Financial Proposals in separate sealed envelopes mentioning Technical Proposal and Financial Proposal on the top of respective envelopes as though the financial information could not be revealed before financial proposal Opening. Then a big envelope shall be used cover the both proposals mentioning writing Proposal for Training Services to RA Work in Freedom Project, ILO, Dhaka on the top of the big sealed envelope. Unsealed Financial Proposal and proposal received after the deadline would be ground for rejection.
