4 BUSINESS OF THE COUNCIL OF THE CITY OF HALF MOON BAY For meeting of: December 20, 2016 AGENDA REPORT TO: VIA: FROM: Honorable Mayor and City Council Magda Gonzalez, City Manager Michael Bridges, Management Consultant/Special Advisor to the City Manager TITLE: LETTER OF SOLIDARITY WITH THE COMMUNITY AND INFORMATIONAL UPDATE ON THE IMPACTS OF THE RECENT FEDERAL ELECTION RECOMMENDATION: Approve the draft of a letter of solidarity for City Council signatures. Staff, with City Council input, will be convening a task force to make recommendations and coordinate actions that can be taken. Staff will return in January with additional alternative actions the City Council may take. FISCAL IMPACT: There is no fiscal impact. STRATEGIC ELEMENT: This recommendation supports the Healthy Communities and Public Safety Elements of the Strategic Plan. BACKGROUND: At the December 6, 2016 City Council meeting, the City Council directed staff to convene a community task force that includes councilmembers, members of the religious and non-profit community as well as community members; and to provide a Draft Statement of Solidarity for Council consideration. DISCUSSION: A draft Statement of Solidarity is attached for the City Council review. If approved, it will be finalized for signatures (and titles, following the selection of Mayor and Vice Mayor). Mayor Rick Kowalcyzk and Vice Mayor Debbie Ruddock were selected to be on the task force. Staff, in consultation with the Mayor and Vice Mayor, will be convening the task force to make recommendations and coordinate actions that can be taken by the members of the task force and other organizations. 4

5 December 20, 2016 Letter of Solidarity with the Community and Informational Update on the Impacts of the Recent Federal Election Page 1 of 2 The San Mateo Sheriff has issued a directive on the Sheriff s Office Policy on Immigration Enforcement (attached). The provisions are essentially the same as those found in sanctuary city resolutions. The State of California and numerous cities across the nation are taking various actions concerning impending immigration issues. Staff will be reviewing these various actions and will provide updates to the City Council along with reports from the task force. ATTACHMENTS: 1. Letter of Solidarity with the Community 2. Bolanos Subject: Sheriff s Office Policy on Immigration Enforcement The Sheriff s Office has a long and proud history of building strong relationships of mutual respect and trust with the community members that we serve, regardless of their immigration status. We have a significant interest in ensuring that they trust us and feel confident that they may report acts of suspected criminal activity and/or reach out to us for essential services without fear of being reported to immigration officials. Given recent community concerns regarding a possible increase in immigration enforcement activity, I want to ensure that all Sheriff s Office employees clearly understand our existing policies and practices related to immigration enforcement. Under federal law, federal immigration agencies and officials have primary jurisdiction and responsibility for the enforcement of immigration laws. Similarly, California state law leaves direct enforcement of immigration laws to federal agencies and officials. Consistent with this, and in recognition of the fact that the primary function of the Sheriff s Office is to enforce the laws of the state of California, the Sheriff s Office does not directly investigate or enforce immigration laws. It is not the practice of Sheriff s Office personnel to inquire about, investigate, or report to Immigrations and Custom s Enforcement (ICE), an individual s immigration status. Further, the Sheriff s office does not generally detain inmates past their scheduled release date without lawful authority. See Corrections Policy 4.09, ICE holds and Requests for Notification. The Sheriff s Office will continue to cooperate with federal law enforcement officials to ensure public safety. All persons booked into our detention facilities have their fingerprints uploaded to a Department of Justice Database, which federal immigration officials may access for use in making a determination regarding an inmate s possible immigration status. Following this process, ICE may choose to issue to the Sheriff s Office a Request for Voluntary Notification of Release of Suspected Priority Alien. The Sheriff s Office will continue to respond to these requests with accurate and timely information providing the anticipated release date and time of an inmate. The Sheriff s Office will also continue to grant ICE agents access to our detention facilities to interview inmates and take appropriate enforcement activity, including taking custody of an inmate pursuant to federal law. While the Sheriff s Office will be making relatively minor changes to its immigration related policies and practices to ensure consistency with recently passed state law, we do not anticipate any modifications to the determination that we will not directly enforce or investigate immigration laws, but will maintain cooperation with federal law enforcement officials. 8

FISCAL IMPACT: None associated with this action. STRATEGIC ELEMENT: This recommendation supports the Inclusive Governance Element. BACKGROUND: A General Municipal Election was held in Half Moon Bay on November 8, 2016 for the purpose of electing two councilmembers to four year terms. The County of San Mateo Elections Department has canvassed the votes and certified the elections results. 10 RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HALF MOON BAY RECITING THE FACT OF THE MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2016 DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a Municipal Election was held and conducted in the City of Half Moon Bay on Tuesday, November 8, 2016, as required by law; and WHEREAS, notice of the election was given in time, form, and manner as provided by law; voting precincts were properly established; election officers were appointed; and in all respects the election was held and conducted and the votes were cast, received, and canvassed and the returns made and declared in time, form, and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in General Law Cities; and WHEREAS, the County Elections Department canvassed the returns of the Election and has certified the results, the results are received, and made a part hereof as Exhibit A. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HALF MOON BAY, CALIFORNIA DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the whole number of ballots cast in the precincts except absentee ballots and early voter ballots was 1,967 and that the whole number of absentee ballots was 4,050 and the total number of early voter ballots was 94 making a total of 6,111 ballots cast in the city. Section 2. That the names of persons voted for at the election for Members of the City Council are as follows: Harvey Rarback Adam Eisen Michael Thompson Carol Joyce Section 3. That the number of votes given at each precinct and the number of votes given in the city to each of the persons above named for the respective offices for which the persons were candidates were as listed in Exhibit A. Section 4. That the City Council does declare and determine that: Harvey Rarback was elected as Member of the City Council for the full term of four years; and that Adam Eisen was elected as Member of the City Council for the full term of four years. Section 5. That the City Clerk shall enter on the records of the City Council of the City a statement of the result of the election showing: (1) The whole number of votes (ballots) cast in the city; (2) The names of the persons voted for; (3) For what office each person was voted for; and (4) The total number of votes given to each person. Section 6. That the City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk 10

11 shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. Section 7. STRATEGIC ELEMENT: This recommendation supports the Inclusive Governance Element. BACKGROUND: The following parameters are to be considered when determining meeting dates: Hold at least one meeting every month (i.e. do not cancel two meetings in a row) Continue to hold two meetings in June due to the budget adoption process Continue to hold two meetings in December due to the customarily high volume of agenda items in December, including City Council reorganization Staff recommends holding meetings on the first and third Tuesdays of each month with the following exceptions, as is consistent with previously adopted Council meeting calendars: Meeting Date January 3, 2017 February 21, 2017 July 4, 2017 August 1, 2017 January 2, 2018 Consideration (This meeting was already cancelled as part of last year s schedule review) Schools closed from 2/20 2/24; and holiday schedule the week prior will impact agenda material preparation. The first meeting of July has been cancelled each of the past five years due to the 4 th of July holiday. The 4 th of July is on a Council date in Traditional time many city and civic groups go dark and a frequent time for family travel; however, this schedule allows one meeting to be held in August. City Hall is closed in December during the time that meeting agenda and materials are typically prepared. 12

Consistent with this, and in recognition of the fact that the primary function of the Sheriff s Office is to enforce the laws of the state of California, the Sheriff s Office does not directly investigate or enforce immigration laws. It is not the practice of Sheriff s Office personnel to inquire about, investigate, or report to Immigrations and Custom s Enforcement (ICE), an individual s immigration status. Further, the Sheriff s office does not generally detain inmates past their scheduled release date without lawful authority. See Corrections Policy 4.09, ICE holds and Requests for Notification. The Sheriff s Office will continue to cooperate with federal law enforcement officials to ensure public safety. All persons booked into our detention facilities have their fingerprints uploaded to a Department of Justice Database, which federal immigration officials may access for use in making a determination regarding an inmate s possible immigration status. Following this process, ICE may choose to issue to the Sheriff s Office a Request for Voluntary Notification of Release of Suspected Priority Alien. The Sheriff s Office will continue to respond to these requests with accurate and timely information providing the anticipated release date and time of an inmate. The Sheriff s Office will also continue to grant ICE agents access to our detention facilities to interview inmates and take appropriate enforcement activity, including taking custody of an inmate pursuant to federal law. While the Sheriff s Office will be making relatively minor changes to its immigration related policies and practices to ensure consistency with recently passed state law, we do not anticipate any modifications to the determination that we will not directly enforce or investigate immigration laws, but will maintain cooperation with federal law enforcement officials. 19
