Attend all four sessions and satisfy your first or second year MCLE requirements for newly admitted attorneys. Or, mix and match the sessions that meet your needs and fit your schedule. The program also serves as a great refresher course or way to enhance your skills or an introduction to new areas of the law. All cancelled classes have now been rescheduled to new dates and are available for registration. Join us on Wednesday evening, January 9 th for a very special event featuring Jeffrey Toobin, senior CNN legal analyst, staff writer for The New Yorker and author, as he discusses his new book The Oath: The Obama White House and the Roberts Supreme Court. The book has been described as a gripping insider s account of the momentous ideological war between the John Roberts Supreme Court and the Obama administration. With four new justices joining the Court in just five years, including Obama s appointees Sonia Sotomayor and Elena Kagan, this is a very different Supreme Court. No one is better equipped to cover the Court than Jeffrey Toobin, whose prize-winning bestseller The Nine discussed the inner workings of the Court. Indeed, after the recent Presidential election, the direction of the court may continue to evolve for many years to come. All paid attendees at the program will receive a copy of the publication. NYCLA s Cyberspace and Taxation Committee, along with program chairs Allan R. Pearlman, Chair, NYCLA s Cyberspace Committee and Megan L. Brackney, Kostelanetz & Fink, LLP, Chair, NYCLA s Taxation Committee, have assembled a panel of experts to discuss the NYS Tax Obligations for Businesses Conducting Commerce on the Internet on Tuesday, January 15.. Gain an overview of the New York State sales tax obligations for New York based businesses engaged in commerce on the Internet. Learn from James Connolly, Department of Taxation and Finance s Office of Counsel; Timothy P. Noonan, Hodgson Russ LLP; and Lance Rothenberg, Hodgson Russ LLP as they explore many of the interesting issues and wrinkles that arise during the course of the transactions. NOTE: This program will also offer CPE credit for accountants. 2 FORMER GOVERNOR DAVID PATTERSON TO MODERATE A PANEL ON CONSTRUCTION ETHICS Join NYCLA s Construction Law Committee on Thursday, January 10 for Construction Ethics: Compliance With Fraud Prevention Guidelines (and More), a discussion of the hot button current ethical issues facing the construction industry, as well as a historical perspective. A panel of experts will also provide practical advice for preventing claims and charges, as well as tips for dealing with investigations and whistleblowers. Some of the construction fraud issues to be addressed include: bid rigging, product substitution, trust fund diversions, false claims, violations of prevailing wage rates, bribery, kickbacks and embezzlement. The program will be co-moderated by David Paterson, 55th Governor of New York, Chairman of Icon Compliance Services LLC and Joel Sciascia, General Counsel at Pavarini McGovern, LLC and Co-chair NYCLA s Construction Law Committee, Panelists include: Brian Aryai, Chairman and CEO, Icon Group USA; Clifford Brock, Special Investigative Counsel at MTA Office of Inspector General; and Thomas Toby Thatcher, President and CEO of Thacher Associates. PRACTICAL AND SKILL BUILDING PROGRAMS The CLE Institute is continuing with its tradition of offering practical and skill building programs for attorneys at all stages of their careers. On Tuesday, January 22 join us for Practical Advice for Career Management and Ethical Lawyering, co-sponsored by NYCLA s Ethics Institute. The evening will be divided into two sessions: Career Management from the Ground Up: A Program for Junior Associates: Gain step by step guidance through career management basics that will allow you to get your career off on the best possible foot and allow you to develop into the best lawyer you can be. Topics to be covered include how to communicate effectively and efficiently; how to handle conflict in the workplace; how to ask for and get the kind of work you want; how to develop mentoring relationships; how to build a flawless reputation and manage your career for the long haul. This session will be conducted by Elizabeth Cronise McLaughlin, ECM Executive Consulting. Training the Brain -- Using Mindfulness as a Tool for Ethical Lawyering: Lawyers are consistently exposed to high-pressure situations, such as impending deadlines, adversarial court appearances, and challenging workloads. This lends itself to burnout, emotional distress, and, at times, mistakes and even malpractice. To sustain an ethical law practice and to avoid malpractice claims, it is imperative that lawyers employ mindful listening, scheduling, and concentration techniques. Mindfulness provides tools for lawyers to respond more effectively in stressful situations such that they communicate clearly with clients, pay attention to upcoming deadlines, refrain from reactivity that may impede a successful court appearance, and maintain an internal ethical compass. Gain an introduction to mindfulness meditation and learn useful and practical techniques to integrate into the practice of law. This session will be conducted by Kerry Docherty, The Mindful Mentors LLC. Join NYCLA s Young Lawyers Section and the Federal Court Committee on Thursday, January 31 for Advice From the Bench: Practice Tips for Young Lawyers. This interactive program, moderated by Adam Roth, Esq., features a panel of current and former judges including Michael Battle, former Family Court Judge, former US Attorney WDNY, Schlam Stone & Dolan; Hon. Richard B. Lowe III, App. Term., 1st Dept.; Frank Mass, Magistrate Judge, SDNY; Hon. Eileen Nadelson (Ret.), NY Sup. Ct.. 3 NYCLA S WOMEN S RIGHTS COMMITTEE TO SPONSOR PROGRAM ON IMPORTANT ISSUES THIS JANUARY Join NYCLA s Women s Rights Committee on Thursday, January 24 for Recent Changes to NY Domestic Violence Laws, Some of the issues to be discussed include the creation of a new domestic violence fatality review team; changes to allow a domestic violence victim to shield his or her address from disclosure; the establishment of the crime of aggravated family offense ; an amendment to require a health insurer to accommodate a reasonable request to receive communications at an alternative location or by alternative means; and an amendment pertaining to who may dispose of a deceased person s remains when the deceased person was a domestic violence victim.
