I am pleased to introduce Quinn Brisbon, Kimberly Lightner, Tyler Strause, Matthew Ross, Cara Williams, and Nicholas DeLissio, who is Representative DeLissio's nephew. They are here with their commanding officer, Lt. Col. Ken Weiland, and in the rear of the House are Lt. Col. Robert Kennedy; Sgt. Maj. Carolann Wright; and family members of the cadets, including Col. Edward DeLissio, the father of Nicholas and brother of Representative DeLissio. Will all our guests please rise, back in the center and over here to the left. Welcome to the hall of the House. STATEMENT BY MS. DeLISSIO The SPEAKER. The Speaker recognizes the lady from Philadelphia County, Ms. DeLissio, under unanimous consent. Ms. DeLISSIO. Thank you, Mr. Speaker. Mr. Speaker, it is my privilege today to honor these newly sworn cadets. In the 3 years that I have been in office, I have been impressed to participate in a number of events honoring military personnel, and most unfortunately, sometimes those honors are posthumously, and today we have had the opportunity to witness some of us were there in the rotunda this morning to witness these young men and women taking this oath of office, this commitment to country that allows us to do what we do every day as legislators. It provides our constituents and the citizens of Pennsylvania that freedom and that liberty to live our lives the way our country was intended and founded over 237 years ago today. So this morning, Mr. Speaker, with your indulgence, I would like to share with you reflections of a newly sworn cadet: "Today I've sworn an oath to serve my country, to protect its citizens, and to be a part of something bigger than myself. There is no greater feeling than being a part of the greatest team in the world, and I'm proud to say I had the opportunity to announce that commitment today in the Pennsylvania State Capitol.

4 102 LEGISLATIVE JOURNAL HOUSE JANUARY 29 "I am proud to follow in the family tradition. My dad, Ed, is a colonel in the U.S. Army, and my mom, Karen, is a West Point graduate. "I look forward to serving my country proudly and becoming a future leader in the United States Army. Thank you." And thank you, Mr. Speaker. The SPEAKER. The Speaker thanks the lady. STATEMENT BY MR. GILLEN The SPEAKER. The Speaker recognizes the gentleman from Berks County, Mr. Gillen, under unanimous consent. Mr. GILLEN. Thank you, Mr. Speaker, and I want to thank the gentlelady from Philadelphia as well for her very pointed, very patriotic remarks. We have a great tradition in this hall of honoring those fallen warriors who have gone on before us and indeed wounded warriors. We have introduced many that were midstream in military careers, but in my brief tenure in the House, I do not recall acknowledging those that are at the very genesis of their careers and having their oath of office administered in this very building, in the rotunda. If I could just familiarize us a brief moment with the Nittany Battalion, they have competed for many years in ROTC, a rigorous ROTC competition, and for 4 years running at Fort Dix, New Jersey, they were the winners of that competition. Last April the Nittany Battalion, Penn State's ROTC, participated in an international competition. Physically Penn State is the best, it is the brightest, and they won a national ROTC competition at West Point. They, additionally, competed internationally against the likes of the Aussies and the Canadians, and when they were acknowledged for their performance, it was said of them that they were professional and they were focused. Indeed, the accolades referred to them as being highly skillful and excellent. Translated from Mandarin into English was another team that did not do nearly as well as the United States team represented by Penn State, and it was the Chinese team. Mr. Speaker, these men and women could have been professional athletes in some cases. They will never be in the stadium on a Saturday with 100,000 cheering fans. They will never experience tens of thousands in an arena. They have chosen the admirable place of quiet and humble duty because of their love for duty, honor, and country. What America needs in the 21st century is exactly what the Nittany Battalion is offering a love of country, a love of family, and a love of duty and we are privileged to have the Nittany Lion Battalion here with us in the hall of the House of Representatives this morning. CALENDAR BILLS ON SECOND CONSIDERATION The House proceeded to second consideration of HB 1951, PN 2926, entitled: An Act amending the act of June 13, 1967 (P.L.31, No.21), known as the Public Welfare Code, in public assistance, prohibiting eligibility for Megan's Law violators. * * * The House proceeded to second consideration of HB 976, PN 1117, entitled: An Act establishing guidelines and procedures governing certain investigations of correctional officers by the Department of Corrections; authorizing certain civil suits by correctional officers; and providing for impact of collective bargaining agreements and for summary suspensions. Will the House agree to the bill on second consideration? Mr. SCAVELLO offered the following amendment No. A05391: Amend Bill, page 1, lines 1 and 2, by striking out "a bill of rights for correctional officers during certain investigations" and guidelines and procedures governing certain investigations of correctional officers Amend Bill, page 1, line 10, by striking out "Bill of Rights" and Investigation Procedure Amend Bill, page 1, lines 12 and 13, by striking out "provide standards to protect the rights" and establish guidelines and procedures governing the investigation Amend Bill, page 5, line 28, by striking out "Summary suspensions" and Suspensions Amend Bill, page 5, lines 29 and 30; page 6, lines 1 through 7, by striking out all of said lines on said pages and (a) General rule. Suspension of a correctional officer shall be in accordance with provisions of the act of August 5, 1941 (P.L.752, No.286), known as the Civil Service Act, except as follows: (1) No suspension based on a pending internal investigation shall last more than 60 days from the effective date of suspension. (2) Written notice of suspension shall be provided to the corrections officer no later than five working days after the effective date of suspension. Thank you, Mr. Speaker. My amendment simply amends the title of the legislation from the Correctional Officers Bill of Rights to the Correctional Officers Investigation Procedure Act. The amendment also makes changes to section 7 of the bill, which relates to suspensions. This change would align the terms of the suspension with those prescribed in the Civil Service Act. It is taking adverse possession from 21 years down to 10 years as under current law. Mr. VITALI. Right. And what is the policy reason behind doing that? Mr. MASSER. I would say that we are seeing a number of blighted properties in a number of areas that ownership is sometimes hard to determine. The occupants are in the house and it is further adding to the blight problem we have throughout the Commonwealth, whereas the owners cannot apply for financing to fix the house, in many cases. Mr. VITALI. Could you thresh that out a little more? My concern here, I will tell you, is I just want to make sure that someone who is the rightful owner of a property maybe their neighbor is encroaching on it and they do not do anything for 10 years and all of a sudden it is their neighbor's property. I am just a little concerned here. When I went to law school, it was 21 years and no one seemed to suggest that was the wrong amount of time. So maybe if you could just thresh out examples of how this might come into play. I am just a little concerned, a little concerned about a change in the law to this extent. Mr. MASSER. Nothing is changed except the timeframe. All the protections that were in there for that 21-year period, since the beginning of the Commonwealth, are still in there protecting it. It has changed if they are an occupant from 21 years to 10 years. Mr. VITALI. Right. Mr. MASSER. And it is only in certain circumstances. Mr. VITALI. And what circumstances are they? Mr. MASSER. A property that is no more than one-half acre in area, it is improved by a single-family dwelling, it is identified as a separate lot in a recorded conveyance, occupied by the claimant, and not part of a common interest ownership community. Mr. VITALI. Okay. Have any groups weighed in on this? Have there been any groups come out in support of it or in opposition to it? Mr. MASSER. The Pennsylvania Bar Association has and is in favor of the bill; strongly supportive. There was a similar bill that was done by Representative Wheatley in sessions past. Mr. VITALI. Right. Okay.
