6 Guidelines for the accession of Affiliates to CEN National Member status Guidelines for the accession of Affiliates to CEN National Member status As approved by the CEN Administrative Bord at its March 2002 meeting taking into account Resolution CA 12/ Background CEN recognizes the political evolution taking place in Central and Eastern European countries, most of which are candidates for accession to the European Union. In that respect, the CEN General Assembly in its Resolution AG 6/1991 formulated a first response to the request of the national standards bodies of those countries and more generally of other European Countries, to become more involved in European standardization. Their recognition as Affiliates has given them considerable opportunities to contribute actively to CEN s work, and to benefit from the resulting European standards. To this date, Affiliate Standards Bodies have made very diverse use of the privileges thus granted. According to the CEN Statutes (Article 7.1), national standards bodies of countries likely to become EU or EFTA members have the right to make an application to become CEN national members. At its December 1994 meeting, the CEN Administrative Board felt the need to define guidelines in order to facilitate the decision making process for the CEN national members, who decide at AG level on any application, on the basis of a unanimous vote (abstentions excluded). The CEN Secretary General was requested to draft those guidelines, which provide elements for CEN members when considering an application and a route plan for the candidates, mainly Affiliates, as they prepare for accession to full membership. The contents of these guidelines are in line with those developed with CENELEC. These guidelines have been elaborated keeping in mind some key ideas: Affiliation already provides conditions for wide voluntary participation in CEN work. Full membership provides further rights (vote), but also stringent obligations, which are meaningful only for economies which are well advanced in the process of integration in the European Internal Market. Some of these obligations concern directly the candidate National Standardization Body itself, but others are indirectly related to its national environment, notably the legislative framework for technical legislation. New CEN national members must be able to cope with the pace of the work of the CEN system, in order to benefit fully from it, and not to slow down the progress of CEN, which is governed by market needs. All in all, the process of accession to CEN membership must be seen, by CEN as well as by the candidate organization, as one of the important steps towards the full participation of the concerned countries in the European Internal Market. This step should therefore be made at the right time, in the context of progression towards the EU Internal Market. 4

7 Smjernice za prijam pridruženika u članstvo CEN-a Smjernice za prijam pridruženika u članstvo CEN-a Odobrila Uprava CEN-a na sastanku u ožujku godine uzimajući u obzir Rezoluciju CA 12/ Pozadina CEN je priznao političko kretanje u državama Srednje i Istočne Europe, većina kojih su kandidatkinje za prijam u Europsku uniju. S obzirom na to, Opća skupština CEN-a je svojom Rezolucijom AG 6/1991 dala prvi odgovor na zahtjev nacionalnih normirnih tijela tih država i općenitije drugih europskih država za veće uključivanje u europsku normizaciju. Njihovo priznavanje pridruženicima pružilo im je znatne mogućnosti djelatnog pridonošenja radu CEN-a i izvlačenja koristi iz proizišlih europskih norma. Dosad su normirna tijela pridruženika vrlo različito iskoristila dane pogodnosti. Prema Statutu CEN-a (članak 7.1), "nacionalna normirna tijela država koje će vjerojatno postati članicama EU-a ili EFTA-e" imaju pravo podnijeti prijavu da postanu nacionalni članovi CEN-a. Na svojoj sjednici održanoj u prosincu godine, uprava CEN-a je smatrala potrebnim definirati smjernice koje trebaju olakšati proces odlučivanja nacionalnim članovima CEN-a koji o svakoj prijavi odlučuju na razini Opće skupštine, i to jednoglasnošću svih članova (suzdržani se isključuju). Od glavnog je tajnika CEN-a bilo zatraženo da izradi nacrt tih smjernica koje članovima CEN-a pružaju elemente za razmatranje prijave, a kandidatima, uglavnom pridruženicima, prikazuju plan pripreme za prijam u punopravno članstvo. Sadržaj ovih smjernica u skladu je s CENELEC-ovim smjernicama. Ove su smjernice izrađene na temelju nekoliko ključnih zamisli: Već pridruživanje pruža uvjete za opsežno dragovoljno sudjelovanje u radu CEN-a. Punopravno članstvo daje daljnja prava (glasovanje), ali i povećava obveze koje imaju smisla samo za gospodarstva koja su znatno uznapredovala u procesu integracije u unutrašnje europsko tržište. Neke od tih obveza odnose se izravno na kandidata, nacionalno normirno tijelo, dok se druge neizravno odnose na nacionalno okruženje kandidata, posebno na zakonodavni okvir za tehničko zakonodavstvo. Novi se nacionalni članovi CEN-a moraju moći prilagoditi dinamici rada CEN-ova sustava kako bi u potpunosti mogli iz toga izvući punu korist i kako ne bi usporavali napredovanje CEN-a koje je uvjetovano potrebama tržišta. Naposljetku, i CEN i organizacija-kandidatkinja moraju proces prijama u članstvo CEN-a vidjeti kao jedan od važnih koraka prema punom sudjelovanju dotičnih država u unutrašnjem europskom tržištu. Zato taj korak treba učiniti u pravom trenutku u kontekstu napredovanja prema unutrašnjem tržištu Europske unije. 5

8 Guidelines for the accession of Affiliates to CEN National Member status 2 Statutory and Internal Regulations requirements for national membership Articles 6 and 7 of the CEN Statutes approved by CEN/AG on 25 June 1992 stipulate that the national members are the National Standards Bodies of EU or EFTA countries or of countries likely to become an EU or EFTA members. There can only be one national member per country. A national standards body is admitted as a CEN national member provided it commits itself to comply with the rules laid down in the statutes of the Association (which implies the capacity to comply also with the provisions of Internal Regulations, and/or other policy decisions) commits itself to adhere to the Code for CEN submits a written application for membership of the Association obtains the consent of the AG (by unanimity - abstentions excluded). 3 Analysis of requirements for Affiliates 3.1 Likely to become a member of EU or EFTA This criterion is already used for the consideration of an affiliation request with CEN. EC/EFTA have been systematically consulted on this before decision. However, for the granting of full membership, a closer examination is necessary, notably in the light of the successive decisions of the European Council and of the regular position papers issued by the Commission. These documents stress the importance of preparatory steps for the extension of the Internal Market to Candidates Countries for the accession negotiations, and in particular the complex process of approximation of legislation, norms and standards. In order to allow, in line with the EU policy, full membership in CEN to be a meaningful step in the process towards accession to EU membership, the above criterion shall be interpreted as follows for the purpose of accession to CEN membership: Condition 1 Condition 2 There must be a Europe Agreement or equivalent agreement between EU or EFTA and the candidate country, specifying a transitional period for accession to EU or EFTA. 9 Smjernice za prijam pridruženika u članstvo CEN-a 2 Statutarni zahtjevi i zahtjevi Unutrašnjih propisa s obzirom na nacionalno članstvo Članci 6 i 7 Statuta CEN-a, koji je Opća skupština CEN-a odobrila 25. lipnja godine, određuju da su nacionalni članovi nacionalna normirna tijela država EU-a ili EFTA-e, ili država koje će vjerojatno postati članice EU-a ili EFTA-e. Moguć je samo jedan nacionalni član po državi. Nacionalno normirno tijelo prima se kao nacionalni član CEN-a pod uvjetom: da se obveže pridržavati se pravila utvrđenih u Statutu CEN-a (što podrazumijeva i sposobnost pridržavanja odredbi Unutrašnjih propisa i/ili drugih odluka o politici) da se obveže pridržavati se CEN-ova kodeksa da podnese pisanu prijavu za prijam u članstvo da dobije dopuštenje Opće skupštine (jednoglasno - suzdržani se isključuju). 3 Analiza zahtjeva za pridruženike 3.1 Vjerojatnost postajanja članicom EU-a ili EFTA-e Ovaj je kriterij već primijenjen pri razmatranju prijava za pridruživanje CEN-u. Prije odluke, o tome se sustavno savjetuju EC i EFTA. Međutim, za prijam u punopravno članstvo potrebno je podrobnije razmatranje, posebno s obzirom na postojeće odluke Europskog vijeća i službene dokumente koje je objavila Komisija. Ti dokumenti naglašavaju važnost pripremnih koraka povezanih s proširenjem unutrašnjeg tržišta na države Srednje i Istočne Europe za pregovore o prijamu te posebno ističu "složeni proces približavanja zakonodavstava, pravila i norma". Kako bi se, u skladu s politikom EU-a, omogućilo da punopravno članstvo u CEN-u bude značajan korak u procesu prema prijamu država Srednje i Istočne Europe u članstvo EU-a, gore navedeni kriterij može se, za svrhe prijama u članstvo CEN-a, tumačiti kako slijedi: 1. uvjet 2. uvjet Između EU-a ili EFTA-e i države-kandidatkinje mora postojati Europski sporazum ili istovrijedan sporazum koji utvrđuje prijelazno razdoblje za prijam u EU ili EFTA-u. Proces približavanja nacionalnog sustava sustavu EU/EFTA-e mora dosegnuti točku: u kojoj će postojati i biti potpuno primijenjen poseban zakonodavni okvir za dragovoljnu normizaciju u kojoj je prethodno postojeće tehničko zakonodavstvo koje bi omogućilo usvajanje (ili zadržavanje) tehničkih pravila proturječnih europskim normama i koje bi time prisililo nacionalno normirno tijelo da europske norme ne implementira u cjelini ili da zahtijeva sustavna A odstupanja u što većoj mjeri povučeno, ili tako preinačeno da je omogućeno da europske norme imaju istu ulogu koju imaju u unutrašnjem tržištu; približavanje glavnoga tehničkog zakonodavstva direktivama koje su na snazi u EU-u i u EEA-i ili istovrijednom zakonodavstvu u Švicarskoj je povlašteni način postizanja tog rezultata u kojoj je potpuno primijenjen barem dio Direktive 98/34/EC i njezine dopune 98/48/EC( 1 ) s obzirom na poslove normizacije. 1) Ova Direktiva zamijenila je Direktivu 83/189/EC. 7

10 Guidelines for the accession of Affiliates to CEN National Member status 3.2 Status of the applicant Condition 3 Evidence shall be provided to the effect that candidate organization is recognized in its country as the official standards body competent for all areas of CEN s own areas of competence (which covers all economic sectors, except those covered by CENELEC and ETSI). The statutory rules applicable for the national standards body must be fully compatible with the mode of organization of voluntary standardization as operated in CEN. 3.3 Obligations as CEN national member The obligations (and rights) of a CEN national member are defined in the CEN statutes and Internal Regulations and can be summarized as follows: Condition 4 Condition 5 Condition 6 Membership fee The CEN national members pay a membership fee set by the AG for each financial year. This fee is proportional to the weighted vote granted to each member. For obvious reasons of independence and fair treatment with respect to the other CEN members, the candidates would have to cover their national membership fees when accepted as CEN national members. The corresponding fee would be payable from the 1st of January following their accession to full membership. National consensus One of the main obligations of a CEN national member is to convey a national point of view on technical matters as well as on formal issues (vote, enquiry,...). Each CEN member has to support over 2000 formal processes/year, which obviously requires means, competence and expertise at national level. In addition, CEN members are expected to contribute expertise to the TCs for which their national economy is active. In that respect, the candidate should give evidence of its ability to deal efficiently with these issues. As an element of evidence, the candidate s record when participating as an Affiliate in technical work should be considered. The participation of the Affiliate in TCs/SCs/WGs in terms of the number of experts, is an important element, which, however, has to be evaluated in relation to the economic size of the countries. Also the quality (passive - active) of this participation is to be considered. On that issue, documentation and evidence of such an involvement will be provided by CEN/MC to the CEN national members. Concerning the formal participation in CEN processes, it is necessary for the candidate organization to be in possession of operational telecommunications (including and internet) and IT infrastructure allowing it to respond efficiently to the high volume of data and document communication within the CEN system and participate in the voting process (electronic voting). 8

11 Smjernice za prijam pridruženika u članstvo CEN-a 3.2 Status podnositelja prijave 3. uvjet Mora se pružiti dokaz da je organizacija-kandidatkinja u svojoj državi priznata kao službeno normirno tijelo nadležno za sva područja koja su u nadležnosti samog CEN-a (koji obuhvaća sve gospodarske sektore osim onih koje obuhvaćaju CENELEC i ETSI). Statutarna pravila primjenjiva za nacionalno normirno tijelo moraju biti potpuno kompatibilna s načinom organizacije dragovoljne normizacije primijenjenim u CEN-u. 3.3 Obveze nacionalnog člana CEN-a Obveze (i prava) nacionalnog člana CEN-a utvrđene su Statutom CEN-a i Unutrašnjim propisima, i mogu se sažeti kako slijedi: 4. uvjet Članarina Nacionalni članovi CEN-a plaćaju članarinu koju za svaku financijsku godinu utvrđuje Opća skupština. Ta članarina ovisi o broju glasova koje ima član. Zbog očiglednih razloga neovisnosti i ravnopravnog postupanja u odnosu na druge članove CEN-a, kandidati bi pri prijamu kao nacionalni članovi CEN-a morali snositi svoje članarine. Odgovarajuća članarina dospijevala bi od 1. siječnja nakon prijama u punopravno članstvo. 5. uvjet 6. uvjet Nacionalni konsenzus Jedna od glavnih obveza nacionalnog člana CEN-a je prenošenje nacionalnog gledišta o tehničkoj problematici kao i o formalnim pitanjima (glasovanje, prikupljanje mišljenja,...). Svaki član CEN-a mora godišnje poduprijeti preko 2000 formalnih postupaka što očito zahtijeva sredstva, stručnost i znanje na nacionalnoj razini. Dodatno se od članova CEN-a očekuje da znanjem pridonesu tehničkim odborima koji obuhvaćaju područja u kojima je djelatno njihovo nacionalno gospodarstvo. S obzirom na to, kandidat mora pružiti dokaz svoje sposobnosti učinkovitog sudjelovanja u ovoj problematici. Kao dokaz tome treba u obzir uzeti zapise kandidatovog sudjelovanja u tehničkim poslovima u svojstvu pridruženika. Sudjelovanje pridruženika u tehničkim odborima, pododborima i radnim skupinama, izraženo brojem stručnjaka, važan je element koji, međutim, valja ocijeniti ovisno o gospodarskoj veličini dotične države, ali u obzir valja uzeti i kvalitetu (pasivno-aktivno) tog sudjelovanja. O tom će pitanju dokumentaciju i dokaze o takvom sudjelovanju nacionalnim članovima CEN-a dostaviti CEN-ov Centar za upravljanje (CEN/MC). S obzirom na formalno sudjelovanje u radu CEN-a, potrebno je da organizacija-kandidatkinja raspolaže telekomunikacijskim sredstvima (uključujući elektroničku poštu i internet) i informacijskom infrastrukturom, što joj omogućuje djelotvorno odgovaranje na veliku količinu podataka, prenošenje dokumenata u CEN-ovu sustavu i sudjelovanje u procesu glasovanja (elektroničko glasovanje). 9

12 Guidelines for the accession of Affiliates to CEN National Member status Condition 7 Implementation of ENs An essential mission of the CEN national members is the implementation of ENs, which is defined in the Internal Rules of CEN/CENELEC IR, Part 2, clause 5.2. This implementation is a two phase operation: giving the ENs the status of national standards, and withdrawing any conflicting documents. One of the elements to consider when deciding on an application is the record of the candidate in implementing the ENs which have already been adopted by CEN (the CEN acquis ). With respect to the withdrawal of national conflicting documents, when not already done, a precise calendar with reasonable time limits for such withdrawal should be drawn up by the candidate. 80 % of the implementations should have taken place before admission of the candidate as a full member. An acceptable calendar must be proposed for the remaining implementation, and for the withdrawal of remaining conflicting documents. Condition 8 Information and standstill procedure In line with the existing CEN rules, the candidate must be prepared to participate in the notification procedure for their national work, which includes a standstill on all national work in areas of agreed European work. Evidence of corresponding Internal Rules of the candidate organizations shall be provided. Condition 9 Sales, copyright,... with regard to ENs The candidate has to give evidence that the CEN/CENELEC policy on copyright and exploitation rights as given in the Exploitation Agreement can be properly implemented in its country, taking into account the current (or planned) national legislation on the protection of intellectual property rights. The candidate has further to demonstrate that its commercial policy is in line with the clauses and provisions of CEN/CENELEC Guide 10 ( 2 ) (see document CA N 1261) which establishes the agreed policy for the distribution and sales of CEN/CENELEC publications. 4 Consequences on the CEN Internal Regulations of adhesion of new national members For the benefit of both the candidate and CEN members, the CEN capacity to absorb new members is an important issue to consider and the acceptance of new members may not jeopardize the existing CEN system. It is, however, believed that this condition will be fulfilled if the candidate organizations meet the criteria as defined in 3. The additional membership fees will cover the cost of their servicing by the CEN Management Centre. However, it is obvious that if new members are accepted, this will have to be reflected, notably in some clauses of the Internal Regulations. One clause which is worth mentioning is the clause regarding the votes on ENs. 2) Formerly Memorandum

13 Smjernice za prijam pridruženika u članstvo CEN-a 7. uvjet Implementacija europskih norma Bitna je dužnost nacionalnih članova CEN-a implementacija europskih norma u skladu s Unutrašnjim propisima CEN/CENELEC-a, 2. dio, točka 5.2. Ta implementacija ima dvije faze: davanje statusa nacionalnih norma europskim normama i povlačenje svih proturječnih dokumenata. Jedan od elemenata koji valja uzeti u obzir pri odlučivanju o prijamu je evidencija o kandidatovoj implementaciji europskih norma koje je CEN već usvojio (stečevina CEN-a). Što se tiče povlačenja nacionalnih proturječnih dokumenata, u slučaju kad to povlačenje još nije obavljeno, kandidat treba sastaviti poseban kalendar s razumnim rokovima za to povlačenje. 80 % implementiranja dokumenata treba obaviti prije prijama kandidata u punopravno članstvo. Mora se predložiti prihvatljiv kalendar za implementiranje preostalih dokumenata i povlačenje preostalih proturječnih dokumenata. 8. uvjet Postupak obavješćivanja i mirovanja U skladu s postojećim pravilima CEN-a, kandidat mora biti pripravan sudjelovati u postupku notifikacije nacionalne normizacije koji uključuje mirovanje čitave nacionalne normizacije u područjima dogovorene europske normizacije. Mora se pružiti dokaz o primjerenosti unutrašnjih pravila organizacijekandidatkinje. 9. uvjet Prodaja, autorska prava, s obzirom na europske norme Kandidat mora pružiti dokaz da se u njegovoj državi može na odgovarajući način implementirati CEN/CENELEC-ova politika autorskih prava i prava uporabe koja je utvrđena u Ugovoru o iskorištavanju (Exploitation Agreement), uzimajući u obzir postojeće (ili planirano) nacionalno zakonodavstvo o zaštiti prava intelektualnog vlasništva. Kandidat mora nadalje dokazati da je njegova komercijalna politika u skladu s odredbama uputa CEN/CENELEC Guide 10 ( 2 ) (vidi dokument CA N 1261) koje uspostavljaju dogovorenu politiku distribucije i prodaje CEN/CENELEC-ovih publikacija. 4 Posljedice prijama novih nacionalnih članova na Unutrašnje propise CEN-a U interesu je i kandidata i članova CEN-a važno pitanje koje valja uzeti u obzir CEN-ova sposobnost prihvaćanja novih članova jer njihov prijam ne smije ugroziti postojeći CEN-ov sustav. Vjeruje se, međutim, da će taj uvjet biti ispunjen ako organizacije-kandidatkinje zadovoljavaju kriterije iz točke 3. Dodatne članarine pokrivat će troškove koje će CEN-ov Centar za upravljanje (CEN/MC) imati pri opsluživanju novih članova. Očito je, međutim, da će prijam novih članova imati utjecaja, posebno na neke odredbe Unutrašnjih propisa. Jedna od takvih odredbi koju vrijedi spomenuti je ona o glasovanju o europskim normama. 2) Prije Memorandum

14 Guidelines for the accession of Affiliates to CEN National Member status 5 Assistance to become national member The Affiliates who want to become CEN members need to prepare for membership and to strengthen their capacity to assure the responsibilities of a national member. While CEN undertakes to assist the Affiliates in their tasks, the European Union pre-accession programmes related to standardization, metrology, certification and quality assurance have an important role to play in that respect for the countries concerned, and so do the bilateral cooperation programmes on the same subject. The overall coherence of these actions is of paramount importance to ensure the successful enlargement of CEN. 6 Processing of applications 6.1 According to Article 7 of the statutes an official letter of application is to be addressed to CEN. This letter must provide evidence and a supporting file regarding the items developed in this document is to be annexed (notably demonstrating compliance with criteria 1 to 9 above). 6.2 On receipt of the file and letter, the CEN Secretary General, in consultation with the President and Vice- Presidents, will commission two independent experts to review the documentation and to prepare a report related to the conditions for acceptance. 6.3 A consultation with EC and EFTA Secretariat will be arranged. 6.4 A consultation with CENELEC/ETSI will be arranged (notably on the weighted voting). 6.5 On the basis of the elements 6.2, 6.3 and 6.4, negotiations will start between CEN and the candidate on the terms of accession to membership and, in particular, with respect to the calendar and the weighted vote to be granted. 6.6 Transmission of the complete file to CEN/CA for recommendation to the AG. 6.7 Voting by AG according to Article 7.1, item 3 (unanimity - abstentions excluded). 12

15 Smjernice za prijam pridruženika u članstvo CEN-a 5 Pomoć u postajanju nacionalnim članom Pridruženici koji žele postati članom CEN-a moraju se pripremiti za članstvo i povećati svoju sposobnost preuzimanja odgovornosti nacionalnog člana. Dok se CEN obvezuje pridruženicima pomoći u njihovim zadaćama, pretpristupni programi Europske unije, koji se odnose na normizaciju, mjeriteljstvo, potvrđivanje/certifikaciju i osiguravanje kvalitete, imaju u tom pogledu za dotične države važnu ulogu, a isto vrijedi za dvostrane programe suradnje o istom predmetu. Ukupna koherentnost tih akcija je od iznimne važnosti za osiguravanje uspješnog proširenja CEN-a. 6 Postupak s prijavama 6.1 Prema članku 7 Statuta, službena prijava (pismo) za prijam mora se uputiti CEN-u. To pismo se mora obrazložiti i mora mu se priložiti podupiruća dokumentacija povezana s točkama ovog dokumenta (osobito dokumentacija koja pokazuje pridržavanje gore navedenih uvjeta od 1 do 9). 6.2 Nakon prijama prijave, glavni tajnik CEN-a će, u dogovoru s predsjednikom i potpredsjednikom, dvama neovisnim stručnjacima povjeriti preispitivanje dokumentacije i sastavljanje izvještaja o uvjetima prijama. 6.3 Savjetovat će se s Europskom komisijom i tajništvom EFTA-e. 6.4 Savjetovat će se s CENELEC/ETSI-jem (osobito o ponderiranom broju glasova). 6.5 Na osnovi elemenata iz točaka 6.2, 6.3 i 6.4, započet će pregovori između CEN-a i kandidata o uvjetima prijama u članstvo, posebno s obzirom na kalendar i ponderirani broj glasova. 6.6 Potrebna dokumentacija prosljeđuje se Središnjoj upravi CEN-a radi davanja preporuke Općoj skupštini. 6.7 U Općoj skupštini glasuje se u skladu s člankom 7.1, stavak 3 (jednoglasnost suzdržani se isključuju). 13
