1 Merced Community College District Board of Trustees meeting held April 1, Public Session Call to Order The Board President (Jinet Troost) called the meeting to order at 5:00 p.m. The meeting was held in Room A-103 at the Los Banos Campus of Merced College. 2. Closed Session Items The Board President referenced the items to be presented during closed session then closed the meeting to the public. The closed session items are listed below. PUBLIC EMPLOYEE DISCIPLINE/DISMISSAL/RELEASE CONFERENCE WITH DISTRICT LABOR NEGOTIATOR, Benjamin T. Duran DISSOLUTION OF PROPERTY: A governing body may meet in closed session with its negotiator to consider price and terms of payment in connection with the purchase, sale, exchange or lease of real property Reorganization of Technology and Institutional Research Reorganization of CalSOAP 3. Resume Public Session The public session reconvened at 6:05 p.m. Trustee Vierra led the Pledge of Allegiance. Members Present:, Jinet Troost, Lew Braxton, Eva delong, Jim Glidden, Eugene J. Duran, John Spevak, Anne Newins, Larry Johnson, Mike Cuchna, Caroline Dawson (MCFA), Karyn Wiens (Management Council), Bill Warner (Prop 39 Citizen s Bond Oversight Committee), Stacey Kellner (Recording Secretary) 4. Hearing of the Public An opportunity was provided for members of the public to address the Board on matters of general district business. Trustee Glidden introduced Bill Warner who is a representative on the Prop 39 Citizen s Bond Oversight Committee. 5. Additions and/or Changes to the Agenda None

2 6. Presentations a. Report from the Dean of the Los Banos Campus Dean Karyn Wiens provided a snapshot of statistics for the Los Banos campus which compared fall 2006 to fall 2007 and spring 2007 to spring There was a growth in FTES of 29% from fall 2006 to fall 2007 and from spring 2007 to spring There has been a growth of FTES since the new campus opened. The Los Banos credit courses generated 44.36% of the District s growth. The one year anniversary of the new campus opening will be on June 4, Dean Wiens shared information and dates of events coming up at the Los Banos campus which include an educational festival, a faculty festival to connect fulltime and adjunt faculty, and their first merit and award scholarship event. 7. Consideration of Consent Agenda MSCU (Braxton/Glidden) to approve the consent agenda as summarized below. a. Minutes for Meetings held March 4, 2008 b. Contracts as Summarized on Schedule c. Warrants, Payroll Registers and Trip Requests as Summarized on Schedule d. Resolutions through , Intrabudget Transfers e. Resolutions through , Use of Unbudgeted Funds f. Personnel Schedule g. Curriculum Revisions as Summarized on Schedule h. Permission to Sell / Donate / Discard District Equipment as Listed on Schedule i. Purchase Orders as Summarized on Schedule To the Board for Discussion and/or Action a. Recommended Granting of Tenure Dr. Johnson informed the Board that the faculty member being presented for tenure was not brought to the last meeting because she is a member of the Los Banos faculty and administration wanted her to be presented in Los Banos. Dr. Newins introduced Deborah Cox and shared some background information on her. MSCU (Haden/Glidden) to approve the granting of tenure to Deborah Cox for the academic year and all subsequent academic years. b. Recommended Approval of Joint Use Agreement with Merced County Office of Education for Construction and Use of an Early Childhood Development Center at the Los Banos Campus

3 Dr. Johnson reminded the Board of Dave Younger s presentation last month on the plans for the Childhood Development Center. MSCU (Braxton/Glidden) to approve the joint use agreement with Merced County Office of Education for construction and use of an early childhood development center at the Los Banos campus. c. Recommended Layoff of CalSOAP Staff Dr. Newins shared with the Board that the state has proposed that CalSOAP individual consortiums cover program costs from July 1, 2008, until the budget is passed. The consortium is unable to help provide the $20,000 per month cost of maintaining all four programs. Currently, there are three classified employees in the CalSOAP program. One has found another position at CSU, Stanislaus, a second will be transferring to a vacant position in the Disabled Student Services program. The third position should be issued a layoff notice. MSCU (Glidden/Braxton) to approve the layoff of the CalSOAP classified staff member. d. Casting of Ballot for CCCT Board Election Dr. Duran deferred to Trustee Braxton to provide the names of candidates he would like to nominate. They were Anita Grier, Paul Fong, Mary Figueroa, Tony Ubalde, Charles Meng, Isabel Barreras, Carolyn Batiste, Eva Kinsman, Bill McMillin, and Brian Conley. Trustee Haden provided the names of the candidates he would like to nominate. They were Kay Albiani, Judi Beck, and Andrew Walzer. A vote was taken on each name nominated. MSCU (Glidden/Braxton) to nominate Mary Figueroa, Kay Albiani, Charles Meng, Bill McMillin, Brian Conley, Judi Beck, Isabel Barreras, Carolyn Batiste, Andrew Walzer, and Eva Kinsman for the CCCT Board. e. Recommended Adoption of Resolution Declaring Classified School Employee Week in the Merced Community College District MSCU (Haden/Glidden) to adopt the resolution declaring the week of May 18-24, 2008, as classified school employee week in the Merced Community College District. f. Recommended Approval of Student Success Initiative Plan and Budget MSCU (Glidden/Braxton) to approve the student success initiative plan and budget.

4 Trustee Haden thanked all staff who worked so hard on the development of the plan and budget. g. Recommended Approval to Place Classified Employee on 39-month Rehire List Dr. Johnson informed the Board that the Farm Lab Coordinator has exhausted all of his available leave of absence and is not medically able to return to work. Under Education Code sections and 88195, the District is mandated to place such a classified employee on a reemployment list for thirty-nine months. MSCU (Glidden/Braxton) to approve placing the Farm Lab Coordinator (employee #2424) on a reemployment list for a period of thirty-nine (39) months to commence on March 13, h. Recommended Approval to Destroy Class 3 Records Disposable Records MSCU (Braxton/Glidden) to approve the destruction of class 3 disposable records. 9. To the Board for Information a. Proposition 39 Oversight Committee Annual Report Dr. Johnson informed the Board that the oversight committee has reviewed and approved the annual report that is provided to the Board for information. b. Status of Office of Instruction Reorganization Implementation Schedule Dr. Duran shared with the Board that seven faculty members have submitted their letters of application for the interim dean positions. The selection committee will meet tomorrow to get their charge and review the letters submitted. The selection committee consists of six faculty members, two administrators, and two classified staff members. It is hoped the selected candidates will be brought to the May meeting for the Board s approval. Interviews for the Vice President of Instruction will occur on April 14. Dr. Duran will interview the finalists on April 15. Site visits are tentatively set for the week of April 22 or April 28. It is hoped the selected candidate will be brought to the May meeting for the Board s approval. All of these positions are planned to begin on July 1, 2008, with administrative training/orientation time scheduled immediately after the start date. 10. Information & Questions a. From Board Members Trustee Haden stated he will not be at the May meeting. He wanted to thank Dr. Spevak for his wisdom and help through the years and for his dedication to the District.

5 Trustee Vierra shared he will not be in attendance at graduation this year. Trustee de Long was honored to be able to hand out awards at the classified staff development day. Trustee Braxton expressed his apologies for not being able to attend the classified staff development day for the first time since he has been on the Board. Trustee Glidden thanked MCFA and Academic Senate for their work on the Office of Instruction reorganization. Trustee Troost reminded the Board the workshop scheduled for April 5 has been postponed to the fall. Also, she brought their attention to the packets given to each member regarding the evaluation of the Superintendent. The forms need to be completed and turned into her or Stacey Kellner by May 23, b. From Academic Senate Caroline Dawson reported the Senate is working on its new membership representation that will be in place once the reorganization takes effect. c. From Faculty Association Caroline Dawson shared that new language in their contract regarding the reorganization is going out to the association tomorrow for a vote. The members have approximately a week and a half to get their vote in. She also stated they are working on their membership representation for when the reorganization takes effect. d. From Classified Senate No one present to report. e. From CSEA No one present to report. f. From Management Team Karyn Wiens reported the Management Team will meet this Thursday and there will be a presentation on the illness and injury prevention program and new forms will be reviewed. g. Superintendent's Report Dr. Duran had nothing to report. h. Correspondence Dr. Duran shared the letter from the University of California, Irvine recognizing Professor Max Hallman for his work with a former Merced College student.
