3 CHAPTER D-16 An Act respecting the Department of Government Services Short title 1 This Act may be cited as The Department of Government Services Act. R.S.S. 1978, c.d-16, s.1 Department continued 2(1) The department of the Government of Saskatchewan called the Department of Government Services is continued. (2) The Minister of Government Services shall preside over the department. (3) The minister may, upon such terms and conditions as he may consider advisable, authorize in writing one or more officers of the department to exercise any or all of the powers and perform any or all of the functions or duties conferred or imposed upon the minister or the deputy minister by this Act or by any other Act the administration of which is assigned to the minister. (4) Where this Act conflicts with any other Act that is under the administration of the minister, this Act prevails. 1972, c.32, s.2; 1973, c30, s.2; R.S.S. 1978, c.d- 16, s.2. Staff 3 The staff of the department shall consist of a deputy minister, to be called the Deputy Minister of Government Services, and such other employees as are required for the proper conduct of the business of the department. 1972, c.32, s.3; R.S.S. 1978, c.d-16, s.3. Scope 4 All that part of the administration of the Government of Saskatchewan that relates to public works and to supplies and services that are necessary for the public service and that is not by law assigned to any other department or agency of the Government of Saskatchewan shall be under the control of the department. 1972, c.32, s.34; R.S.S. 1978, c.d-16, s.4. Department may acquire equipment and provide certain services 5 The department may: (a) acquire and use equipment required for the provision of a messenger service between departments, agencies, boards, commissions, bureaus, offices and other branches of the Government of Saskatchewan; (b) provide facilities, equipment, supplies and postage necessary to provide a central establishment for the handling of mail to and from departments, agencies, boards, commissions, bureaus, offices and other branches of the Government of Saskatchewan; (c) acquire and operate telephone and other communications equipment for use by departments, agencies, boards, commissions, bureaus, offices or other branches of the Government of Saskatchewan or for any Crown corporation or institution designated by the minister for the purpose of this clause;

D-16 GOVERNMENT SERVICES (d) establish standards for equipment and supplies acquired or provided under this section and develop procedures with respect to the services provided under clauses (a) and (b) , c.26, s.1; R.S.S. 1978, c.d-16, s.5. Queen s Printer 6 The Lieutenant Governor in Council may appoint, as an officer of the Department of Government Services, a person to be the Queen s Printer who shall, under the supervision of the minister, exercise such printing and publishing functions for the province as are assigned to the Queen s Printer by law or as may be assigned to him by the minister. 1972, c.32, s.5; R.S.S. 1978, c.d-16, s.6. Systems Centre continued, powers, costs and rates 7(1) The Systems Centre is continued as a branch of the department. (2) The Systems Centre may: (a) provide systems and organization development services to public agencies; (b) acquire by purchase, lease or otherwise any supplies and equipment that may be necessary to provide systems and organization development to public agencies; (c) employ persons to manage and provide systems and organization development services; (d) receive from public agencies payment, for services provided to them by the Systems Centre, at the rate established in accordance with subsection (4). (3) The cost of providing a service mentioned in subsection (2) shall include: (a) the cost of all equipment, supplies and labour used to provide the service; and (b) any other amounts paid in respect of the service provided; and shall be paid from moneys advanced in accordance with subsection (1) of section 8. (4) The minister shall establish rates to be charged to public agencies for systems and organization development services provided to them by the Systems Centre and the rates shall include all the costs of providing the service. 1976, c.12, s.2; R.S.S. 1978, c.d-16, s.7. Advance account, limitation, surplus 8(1) The Minister of Finance may, upon the requisition of the minister, advance to the Systems Centre out of the consolidated fund such sums of money as are required by the Systems Centre: (a) to acquire supplies and equipment pursuant to clause (b) of subsection (2) of section 7; (b) to employ persons pursuant to clause (c) of subsection (2) of section 7. (2) The account of the advances under subsection (1) shall be known as the Systems Centre Advance Account.

5 GOVERNMENT SERVICES c. D-16 5 (3) The net amount of advances made under subsection (1) shall not at any time exceed $2,000,000. (4) Where, in any fiscal year, there results a surplus from the operation of the advances made under subsection (1), the surplus shall be paid to the Minister of Finance and shall form part of the consolidated fund in the next fiscal year; and where there results a deficit from the operation of the Systems Centre Advance Account, the deficit shall be charged by the Minister of Finance to the appropriation of the department for the next fiscal year. 1976, c.12, s.2; R.S.S. 1978, c.d-16, s.8. Regulations 9 The Lieutenant Governor in Council may make regulations: (a) prescribing the methods to be used by the minister in establishing rates under subsection (4) of section 7; (b) prescribing the expenditures or types of expenditures, including losses due to depreciation of equipment and deterioration of supplies acquired by the Systems Centre pursuant to clause (b) of subsection (2) of section 7, that may be charged against the Systems Centre Advance Account, and prescribing methods for calculating the amounts of expenditures and losses that may be so charged; (c) not inconsistent with this Act, that are necessary to carry out the provisions of this section and sections 7, 8, 10, 11 and 12 according to their true intent. 1976, c.12, s.2; R.S.S. 1978, c.d-16, s.9. Fiscal year 10 The fiscal year of the Systems Centre Advance Account is the period commencing on the first day of April in one calendar year and ending on the last day of March in the next calendar year, both dates inclusive. 1976, c.12, s.2; R.S.S. 1978, c.d-16, s.10. Annual statement 11 The minister shall provide an annual statement to the Minister of Finance for inclusion in the public accounts of the province and the statement shall show the standing at the close of the fiscal year of the Systems Centre Advance Account resulting from the year s operations of the account. 1976, c12, s.2; R.S.S. 1978, c.d-16, s.11. Officers 12 The minister may authorize one or more officers of the department to direct the activities of the Systems Centre Advance Account. 1976, c.12, s.2; R.S.S. 1978, c.d-16, s.12. Interpretation 13 In sections 14 to 30: office supplies (a) office supplies means all office suplies and equipment required by two or more public agencies for the transaction of their business and affairs, and without limiting the generality of the foregoing, includes stationery, typewriters, calculators, recorders, projectors and photographic equipment;

D-16 GOVERNMENT SERVICES public agency (b) public agency means a department, agency, board, commission, bureau, office or other branch of the public service of Saskatchewan and includes any crown corporation or institution that the minister designates as a public agency for the purposes of this Act; supply agency (c) supply agency means the supply agency mentioned in section , c.30, s.3; , c.27, s.2; R.S.S. 1978, c.d-16, s.13. Supply agency continued 14(1) The supply agency within the department is continued. (2) The supply agency may: (a) provide office supplies to public agencies; (b) acquire by purchase, lease or otherwise office supplies for sale, lease or other disposition to public agencies; (c) engage persons to manage and maintain office supplies; (d) acquire by purchase, lease or otherwise equipment, services or goods necessary to manage and maintain the office supplies; (e) recover from public agencies for office supplies sold or otherwise provided to them such amounts in respect of the supplies as the minister has established pursuant to section , c.30, s.3; R.S.S. 1978, c.d-16, s.14. Cost of office supplies 15 The costs of office supplies include all costs incurred by the supply agency in connection with the supplies between the times when the supplies are first ordered until they are sold or otherwise provided to public agencies. 1973, c.30, s.3; R.S.S. 1978, c.d-16, s.15. Cost of office supplies to be paid from advance 16 The costs of all office supplies shall be paid from moneys advanced under section , c.30, s.3; R.S.S. 1978, c.d-16, s.16. Minister to establish amounts for office supplies 17 The minister shall prescribe amounts to be charged to public agencies for office supplies sold or otherwise provided to them and such amounts shall include all costs of selling or providing the office supplies. 1973, c.30, s.3; R.S.S. 1978, c.d-16, s.17. Supply agency Advance Account 18(1) The Minister of Finance may, upon the requisition of the minister, advance to the supply agency out of the consolidated fund such sums of money as are required by the supply agency to: (a) acquire by purchase, lease or otherwise office supplies under clause (b) of subsection (2) of section 14;

D-16 7 (b) engage persons to manage and maintain a stock of office supplies; (c) manage a stock of office supplies and to pay the costs of such management; (d) procure such equipment, services or goods as may be required to manage and maintain and sell, lease or otherwise dispose of office supplies. (2) The account of the advances under subsection (1) shall be known as the Supply Agency Advance Account. (3) The net amount of such advances shall not at any time exceed $7,000,000. (4) Where, in any fiscal year, there results a surplus from the operation of the advances made under subsection (1), the surplus shall be paid to the Minister of Finance and shall form part of the consolidated fund in the next fiscal year; and where there results a deficit from the operation of the account, the deficit shall be charged by the Minister of Finance to the appropriation of the department for the next fiscal year. 1973, c.30, s.3; , c.10, s.1; 1976, c.12, s.4; R.S.S. 1978, c.d-16, s.18. Disposal of obsolete, etc., supplies 19 Where the minister finds that any office supplies, through obsolescence or otherwise, are no longer usable for the purposes for which they were intended, the minister may charge the value of the supplies as an operating cost of the supply agency and authorize their disposition in such manner as he considers advisable. 1973, c.30, s.3; R.S.S. 1978, c.d-16, s.19. Regulations 20 The Lieutenant Governor in Council may make regulations: (a) prescribing the methods to be used by the minister in prescribing amounts pursuant to section 17; (b) prescribing the expenditures or types of expenditures, including losses due to depreciation of supplies acquired by the supply agency under clause (b) of subsection (2) of section 14, that may be charged against the Supply Agency Advance Account and prescribing the methods for calculating the amounts of expenditures and losses that may be so charged; (c) not inconsistent with this Act, as are necessary to carry out the provisions of this Act according to their true intent. 1973, c.30, s.3; 1973, c.106, s.3; R.S.S. 1978, c.d-16, s.20. Fiscal year 21 The fiscal year of the supply agency is the period commencing on the first day of April in one calendar year and ending on the last day of March in the next calendar year, both dates inclusive. 1973, c.30, s.3; R.S.S. 1978, c.d-16, s.21.

D-16 GOVERNMENT SERVICES Annual statement 22 The minister shall provide an annual statement to the Minister of Finance for inclusion in the public accounts of the province which statement shall show the standing at the close of the fiscal year of the Supply Agency Advance Account, setting out any surplus or deficiency resulting from the year s operations of the account. 1973, c.30, s.3; R.S.S. 1978, c.d-16, s.22. Administration of agency 23 The minister may authorize one or more officers of the department to direct the activities of the supply agency. 1973, c.30, s.3; R.S.S. 1978, c.d-16, s.23. Central Vehicle Agency continued 24(1) The Central Vehicle Agency is continued as a branch of the department for the purpose of providing land and air transportation service to public agencies. (2) The Central Vehicle Agency shall, for the purpose mentioned in subsection (1): (a) acquire by purchase, lease or otherwise such vehicles and equipment as may be necessary to provide land and air transportation service to public agencies; and (b) procure such labour, supplies, repairs, services and facilities as may be necessary for the operation and maintenance of such transportation service. (3) All vehicles and equipment acquired, and all supplies, repairs and facilities procured, by the Central Vehicle Agency shall be charged to one or more accounts of assets of the Central Vehicle Agency. (4) During the period that vehicles, equipment, supplies, repairs and facilities of the Central Vehicle Agency or any of them are usable for the purposes for which they were intended, such allowances as may be determined by the minister shall be made for depreciation due to wear and tear, obsolescence and for maintenance of the vehicles, equipment, supplies, repairs and facilities. (5) The allowance mentioned in subsection (4) shall, for the purpose of the Central Vehicle Agency Advance Account, be considered as an operating expense and the account shall be reimbursed the amount of such expense on the basis of a rental at such rate as may be determined by the minister to be charged to the public agency for which the vehicles, equipment, supplies, repairs and facilities or any of them are used , c.27, s.3; R.S.S. 1978, c.d-16, s.24. Advance to pay for vehicles, etc. 25(1) The Minister of Finance may, upon the requisition of the minister, advance out of the consolidated fund such sums of money as are required to pay for vehicles, equipment, labour, supplies, repairs, services and facilities or any of them acquired or procured pursuant to section 24. (2) The account of the advances under subsection (1) shall be known as the Central Vehicle Agency Advance Account. (3) The net amount of such advances shall not at any time exceed $25,000, , c.27, s.3; 1976, c.12, s.5; R.S.S. 1978, c.d-16, s.25.

D-16 9 Cost of service to be charged to user 26 The total cost of transportation service provided to a public agency shall be charged by the Central Vehicle Agency to the public agency and the amount so charged shall be credited to the Central Vehicle Agency , c.27, s.3; R.S.S. 1978, c.d-16, s.26. Computation of costs 27(1) In computing the costs of providing land and air transportation service to public agencies, the Central Vehicle Agency shall take into account, in addition to the direct costs of labour, vehicles, equipment, suppplies, repairs and facilities, amounts in respect of remuneration to, and allowances for expenses of, supervisory personnel, administrative and other overhead costs and any costs of handling, storing or distributing supplies used in providing the transportation service. (2) The Minister of Finance may advance out of the consolidated fund the amount of the costs and amounts mentioned in subsection (1) in the same manner as if they were direct costs of the transportation service , c.27, s.3; R.S.S. 1978, c.d-16, s.27. Regulations 28 The Lieutenant Governor in Council may make regulations prescribing: (a) the manner in which rates are to be calculated and charges made for the provision of transportation service to public agencies; (b) the manner in which and conditions under which vehicles, equipment, supplies, repairs or facilities shall be acquired or disposed of by the Central Vehicle Agency; (c) the manner in which the business of the Central Vehicle Agency shall be conducted and the manner in which forms used in connection therewith may be introduced, altered or amended , c.27, s.3; R.S.S. 1978, c.d-16, s.28. Fiscal year 29 The fiscal year of the Central Vehicle Agency is the period commencing on the first day of April in one calendar year and ending on the last day of March in the next calendar year, both dates inclusive , c.27, s.3; R.S.S. 1978, c.d-16, s.29. Annual statement 30 The minister shall provide an annual statement to the Minister of Finance for inclusion in the public accounts of the province, which statement shall show the standing at the close of the fiscal year of the Central Vehicle Agency Advance Account, setting out the surplus or deficiency resulting from the year s operation , c.27, s.3; R.S.S. 1978, c.d-16, s.30. Annual report 31(1) The minister shall, in accordance with The Tabling of Documents Act, submit to the Lieutenant Governor in Council an annual report on all works under the control of the department, with such further information as may be requisite to enable the Legislative Assembly to judge the working of the department.
