AN ACT to make provision with respect to the payment of remuneration and travelling allowances and expenses to members of statutory Boards and of travelling allowances and expenses to members of local authorities. [6 December 1951 BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:- Short Title and 1. (1) This Act may be cited as the Fees and commencement. Travelling Allowances Act (2) This Act shall come into force on the first day of April, nineteen hundred and fifty-two. Interpretation. 2. In this Act, unless the context otherwise requires,- "Local authority" means a Borough Council, a Catchment Board, a County Council, an Education Board, a Harbour Board, a Hospital Board, a Town Board, or an Urban Fire

2 1951] Fees and Travelling Allowances [No Authority; and includes any body that is declared by any enactment to be a local authority within the meaning of this Act: " Member" includes a director of a corporation: " Minister " means the Minister of Finance: " Statutory Board " means a body referred to in the First Schedule to this Act; and includes any body that is declared by any enactment to be a statutory Board within the meaning of this Act. 3. Where, under any enactment, any member of a Remuneration statutory Board is entitled to receive any remuneration ~~ ::ru~~~ by way of salary, fees, or otherwise for his services as a Boards. member of the Board, the remuneration shall be paid at such rate as the Minister from time to time approves in that behalf. 4. (1) This section applies to any member of a Travelling statutory Board who, under any enactment, is entitled to ~~;=~l~c:~ receive payment of travelling allowances or travelling members of expenses in respect of time spent in travelling in the ~~!~~~? service of the Board. (2) Where any such member, for the purpose of attending a meeting of the statutory Board or, pursuant to a resolution of the Board, of transacting any business of the Board, is required to be absent from his usual place of residence, there shall be paid to him, in accordance with regulations made under this Act, an allowance (in this Act referred to as a subsistence allowance) at such rate as the Minister from time to time approves in that behalf. (3) Where the member, for any such purpose, is required to make any journey and he travels by public conveyance there shall be paid to him, in accordance with regulations made under this Act, all fares and other expenses of locomotion incurred by him in making the journey. (4) Where a private means of conveyance is used for any such journey, there shall be paid to the member, in accordance with regulations made under this Act, an allowance (in this Act referred to as a mileage allowance) at such rate as the Minister from time to time approves in that behalf.

The provisions of this Act, as far as they are applicable and with the necessary modifications, shall apply to any member of a committee or a subcommittee of a statutory Board in any case where that member is entitled, under any enactment, to receive payment of any remuneration in respect of his services to the Board or to receive payment of travelling allowances or travelling expenses in respect of time spent in travelling in the service of the Board. 6. Where, under any enactment, a member of a local authority is entitled to receive payment of travelling allowances or travelling expenses, the provisions of this Act, as far as they are applicable and with the necessary modifications, shall apply to that member as if the local authority were a statutory Board. 7. Any approval given by the Minister under this Act may be general in its application or may relate to individual members or classes of members of statutory Boards or to any particular statutory Board or to any class or classes of statutory Boards. 8. Every payment of remuneration, travelling allowances, or travelling expenses made before the commencement of this Act to any member of any Board, Council, Committee, or other body established under any enactment at a rate approved by the Minister in that behalf shall, if otherwise valid, be deemed to have been lawfully made notwithstanding that a different rate may have been prescribed by any regulations. 9. (1) The Governor-General may from time to time, by Order in Council, make regulations for any purpose for which regulations are contemplated by this Act, and may make all such other regulations as may in his opinion be necessary or expedient for giving effect to the provisions of this Act and for the due administration thereof. (2) Without limiting the general power hereinbefore conferred, it is hereby declared that regulations may be made under this section for all or any of the following purposes:- (a) Prescribing conditions subject to which subsistence allowances or mileage allowances shall be payable:

4 1951] Fees and Travelling A.llowances [No (b) Prescribing conditions in respect of disbursements repayable to members of statutory Boards: (c) Prescribing matters to be taken into account when assessing subsistence allowances or mileage allowances: (d) Prescribing conditions to be observed before payments of remuneration or travelling allowances or travelling expenses are made to members of statutory Boards. (3) All regulations made under this Act shall be laid before Parliament within twenty-eight days after the making thereof if Parliament is then in session, and, if not, shall be laid before Parliament within twenty-eight days after the commencement of the next ensuing session. 10. (1) The Acts specified in the Second Schedule to this Act are hereby amended in the manner indicated in that Schedule. (2) The regulations specified in the Third Schedule to this Act are hereby revoked to the extent indicated in that Schedule. Consequential amendments.

There shall be paid out of moneys appropriated by Parliament for the purpose to the members of the Board and to examiners appointed under section fifty one of this Act remuneration by way of fees, salary, or allowances and travelling allowances and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions of that Act shall apply accordingly as if any such member or examiner were a member of a statutory Board within the meaning of that Act." : (b) By repealing paragraph (d) of subsection (1) of section 192. By adding to section 16 the following subsection :- " (9) There shall be paid to the members of the Council By repeaiing section 9, and substituting the following section :- " 9. There shall be paid out of moneys appropriated by Parliament for the purpose to the members of the Tribunal

There shall be paid to the members of the Registration Board appointed pursuant to paragraph (d) of section two hereof remuneration by way of fees, salary, or allowances and travelling allowances and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions of that Act shall apply accordingly as if the Board were a statutory Board within the meaning of that Act.": (b) By repealing paragraph (h) of section 2 : (c) By adding to section 5 the following subsection:- "(3) There shall be paid out of moneys appropriated by Parliament for the purpose to any assessor appointed under this section remuneration by way of fees, salary, or allowances and travelling allowances and expenses in accordance with the Fees and Travelling Allowances Aot 1951, a.nd the provisions of that Act shall apply accordingly as if any such assessor were a member of a statutory Board within the meaning of that Act." By repealing section 4, and substituting the following section:- "4. There shall be paid to the members of the Council remuneration by way of fees, salary, or allowanoes and travelling allowances and expenses in aocordance with the Fees and Travelling Allowances Act and the provisions of that By repealing section 7, and substituting the following section:- "7. There shall be paid to the members of the Board and to any assessors appointed under section twenty-six of this Act remuneration by way of fees, salary, or allowances and travelling allowances and expenses in accordance with the Fees and Act shall apply accordingly as if any such assessors (as well as the members of the Board) were members of a statutory Board within the meaning of that Aot." (a) By repealing subseotion (6) of seotion 4, and substituting the following subseotion :- "(6) There shall be paid out of moneys appropriated by Parliament for the purpose to the members of the Commission (other than the Minister) remuneration by way of fees, salary, or allowances and travelling allowanoes and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions of that Aot shall apply acoordingly.": (b) By repealing paragraph (k) of subsection (2) of section 26.

A Board may payout of its General Fund to the Chairman and to each member travelling allowances and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions of that Act shall apply accordingly." : (b) By repealing section 93, and substituting the following section :- "93. The Board of any secondary school may pay to its members travelling allowances and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions of that Act shall apply accordingly as if any such Board were a statutory Board within the meaning of that Act." By repealing section 3. By repealing section 14. By repealing section 5, and substituting the following section :- " 5. The Board of Managers of every technical school may pay to its members travelling allowances and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions of that Act shall apply accordingly as if any such Board were a statutory Board within the meaning of that Act." By repealing subsection (4) of section 2, and substituting the following subsection :- "(4) There shall be paid out of moneys appropriated by Parliament for the purpose to the unofficial members of the Commission remuneration by way of fees, salary, or allowances and travelling allowances and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions of that By repealing section 4, and substituting the following section :- "4. There shall be paid to the members of the Board allowanoes and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions,of that Act shall apply aocordingly." By repealing section 8, and substituting the following section :- "8. There shall be paid to the members of the Council

By inserting, after section 15, the following section:- " 15A. There shall be paid to the members of the Board and to each assessor appointed under section twelve of this Act Act shall apply accordingly as if the assessors (as well as the members of the Board) were members of a statutory Board within the meaning of that Act." By adding to section 18, as subsection (2), the following subsection :- "(2) There shall be paid out of moneys appropriated by Parliament for the purpose to the members of any Committee or advisory body appointed by the Minister pursuant to this section remuneration by way of fees, salary, or allowances and travelling allowances and expenses in accordance with the Fees and Act shall apply accordingly as if any such Committee or body were a statutory Board within the meaning of that Act." By repealing sections 7 and 11 (5) (c). By repealing section 11. (a) By repealing section 14, and substituting the following section :- " 14. The Council shall pay to its members, and to the members of any advisory or executive committee set up by it, remuneration by way of fees, salary, or allowances and travelling allowances and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions of that : (b) By repealing section 36, and substituting the following section :- "36. Any Urban Fire Authority may pay to its members travelling allowances and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions of that : (c) By omitting from subsection (3) of section 40 the words "regulations under this Act", and substituting the words " the Minister of Finance".

By repealing subsection (4) of section 32 (as enacted by section 5 of the Government Life Insurance Amendment Act 1951), and substituting the following section :- " (4) There shall be paid to the members of the Board (other than the Minister) remuneration by way of fees, salary, or allowances and travelling allowances and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions of that (a) By repealing subsection (8) of section 68, and substituting the following subsection:- " (8) There shall be paid ont of moneys appropriated by Parliament for the purpose to any person or persons appointed to hold any inquiry under this section remune ration by way of fees, salary, or allowances and travelling Travelling Allowances Act 1951, and the provisions of that Act shall apply accordingly as if any such person were a member of a statutory Board within the meaning of that Act.": (b) By repealing subsection (8) of section 91, and substituting the following subseotion:- "(8) There shall be paid out of moneys appropriated by Parliament for the purpose to the members of the Appeal Board remuneration by way of fees, salary, or allowances and travelling allowances and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions of that :

24 1951] Fees and Travelling Allowances [No AMENDMENTS TO ACTs--continued TItle of Act. 1938, No. 7- The Social Security Act , No. 12- The Soil Conservation and Rivers Control Act , No. 40- The Soil Conservation and Rivers Control Amendment Act , No. 13- The Standards Act , No. 5- The Stock Remedies Act , No. 4- The Surveyors Act 1938 By adding to section 83 the following subsection :- "(5) There shall be paid out of moneys appropriated by Parliament for the purpose to the members of any Committee or advisory body appointed under this section and to the members of any special tribunal appointed for the purposes of section eighty-four of this Act remuneration by way of fees, salary, or allowances and travelling allowances and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions of that Act shall apply accordingly as if any such Committee, body, or tribunal were a statutory Board within the meaning of that Act." (a) By repealing section 8, and substituting the following section :- "8. There shall be paid out of moneys appropriated by Parliament for the purpose to the members of the Council or of any Advisory or Technical Committee appointed under section eleven of this Act remuneration by way of fees, salary, or allowances and travelling allowances and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions of that : (b) By repealing subsection (1) of section 114, and substituting the following subsection :- "(1) Any Board may pay to its members travelling allowances and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions of that By repealing subsection (2) of section 5. (a) By inserting, after section 6, the following section:- "6.&.. By repealing section 89, and substituting the following section :- "89. There shall be paid to all Licensing Authorities and all members of Licensing Authorities remuneration by way of fees, salary, or allowances and travelling allowances and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions of that Act shall apply accordingly as if any such Authority were a statutory Board within the meaning of that Act." By repealing subsection (1) of section 7, and substituting the followin.e: subsection :- "(1) The Board shall pay to its members and to any assessors appointed under section thirty-four of this Act Act shall apply accordingly as if any such assessors (as well as the members of the Board) were members of a statutory Board within the meaning of that Act."
