1 C0UNCITOAD* U N 'O 'V COUNCIL CF N3N-EUR0PEAN TRADE UNIONS. CONSTITUTION. 1. NAME: The n-jib of the org nisation shall be the COUNCIL 0? NON-EUROPEAN TRADE UNIONS. 2. MEMBERSHIP: The membership shall consist of all bone;-fide non-european Trade and Labour Unions in South Africa that subscribe to the Constitution of the Council. 3. IBJECTS: a) To co-ordinate the aims and activities and to promote the interests of all organised non-european workers and to organise the unorganised workers throughout South A frica. b) To issue appeals and collect money on behalf of affiliated unions whose members are locked-out or on strike or who for any other reason satisfactory to the Council need such assistance. c) To settle disputes between Unions whose activities may overlap or any other disputes, in which case the Council shall act as arbitrator or with the consent of the Unions concerned shall appoint persons other than members of the Council andtrade Unions to act as arbitrators. d) To promote efficiency in the work and book keepin# of the a ffilia te d Unions. e) To further any other activities as may be decided upon by the Conference from time to time. 4. POWERS AND FUNCTIONS: a) The Council shall act as the official voice of its a ffilia te d bodies. b) The Council shall constitute a channel for communication between the non-european Trade Union Movement and the 3.A. Trade Union Movement as well as the Union Government on matters affecting non- European workers. c)the Council shall not usurp any of the functions or authority of any of its affiliated bodies but shall confine it s e lf to work of a consultative and coordinating nature and shall enjoy only such powers in respect of an affiliated body as may be specially delegated to and conferred upon it by such body.
2 «f, *. a) A conference of delegates from a ffilia t e d bodies shall be held annually at such tine and place as may be decided at previous conference. Special conferences nay be called by the Exe&utive Connittee in case of emergency. b)the representation at Conference of each affiliated body which is not raore than three months in arrear With its affiliation fees shall be a maximum of three delegates from ea&h a ffilia te d body* c)the Conference shall determine the policy of the Council for the ensuing year, d)an agenda shall be framed by the Executive Committee and circulated to ail affiliated bodies before the date fixed for holding the conference; all resolutions by affiliated bodies to be forwarded to the General Secretary five weeks prior to Conference, e)affiliated Unions must nominate their members to the General Council one month before the Annual Conference and the new Executive Committee elected as aforesaid shall take office immediately after the Annual Conference. f)at Conference the names of delegates shall be called and responded to. A credential Committee of three persons shall be appointed by the Executive Committee who shall examine the credentials of delegates in order to ascertain if they are in order and shall report its findings to the Chairman. g)business shall be proceeded with in accordance with the agenda, except by consent of the meeting. h)no question other than that appearing on the agenda shall be debated, provided, however, this shall not apply to reports received from the Executive Council In the event of any urgent questions arising the Conference may, upon a majority vote taken without debate, agree to discuss a matter not included on the agenda. i)voting at the Conference shall be by show of hands but any delegat e may demand a division 0 j)upon a motion being carried, it shall be in order to move that the subject matter of the motion be referred to a plebiscite of the membership of the affiliated bodies. In the event of a motion being carried, the Executive Committee shall issue ballot capers being returnable to the Executive Committee six weeks from the date of issue. Voting papers shall be issued to affiliated bodies in accordance with their strength k)except with leave of Conference no speaker shall speak more than once on any motion, nor, unless he be the mover of a resolution longer than 10 minutes provided that the mover of a resolution shall have the right of reply to the debate thereont
3 1} No resolution shall be debated for longer period than one and a half hours, provided that any member shall have the right to subrait resolution for any extension of time; such resolution shall be put without debate and not have effect unless carried by twothirds of those present. m) Each delegate on rising to address the meeting shall first state whether he is for or against the resolution that is being discussed. Not more than two delegates shall speak in succession either for or against the resolution that is being discussed, and if at the conclusion of the second speaker's remarks no delegate i*ises to speak on the other side, the notion and/or amendments shall be at once put, provided that the mover of the original resolution shall have the rirfit to reply. n) Except where otherwise stated, all questions shall be decided by a majority of votes. The Chairman shall have a deliberative vote only and in the event of the equality of votes, the question shall lapse. o) All votes shall be counted by the Chairman but in the case of a ballot, scrutineer^ shall be appointed. p) No question which has been debated and determined on shall be reopened in the same Conference, except on a motion carried by two-thirds of those present. Such motion shall be put without amendments or debate, q) No absent person shall be nominated for any office unltoss his consent in writing has previously been obtained. r)_a11 questions shall be determined by open vote, except in the case of officers who shall be elected by ballot, and an absolute majority of votes cast must be obtained to secure the return of a candidate, provided that where there are more than two nominated in respect of a single vacancy, any such election m; y be conducted according to the system of a single transferable vote, s) A delegate, with the consent of the Conference, shall be allowed to withdraw any motion or amendment submitted by him or the affilia te d body represented by him. t) Any delegate refusing to obey the Chairman s ruling, or being guilty of misconduct, shall upon a vote being taken withdraw from the meeting and the Conference shall have the right to suspend any delegate for any such period as it may t h in k 'fit. u) A motion to review the Chairman's ruling may be moved ana seconaed, but no debate shall be allowed on the same. ^A majority of Conference delegates shall be sufficient to carry such a motion. v) The Annual Conference shall elect the President, Vice- President, Treasurer, Secretary. Assistant Secretary and two Trustees, who shall be non-europeans and must be members of Unions that have been affiliated for at least three months prior to Conference,
4 DUTILS OF OFFICERS: n) Presilent: The President shall preside over all Conferences and Executive Meetings at which he is presenti He shall sign all Minutes approved by the Executive ana/council. He shall generally exercise in conjunction with the other Officers supervision over the a ffa irs.o f the Council. He shall acquaint himself with this Constitution and conduct the business of the Council according to i t. b) ^1ce-President: The Vice-President shall exercise the powers and carry out the duties of the President in the absence of the latter. c) Treasurer: The Treasurer shall be responsible in conjunction with the Secretary and Trustee, for all noney and property of the Council. d) 1 rust., i. s : The Trustees, in conjunction with the Treasurer, shall be responsible for all the property of the Council, and shall sign all necessary dociments dealing with the property of the Council in accordance with the instructions of the Council or Executive Committee. e) Secretary: The Secretary who nust be a member or an official of an affiliated Union shall be appointed annually by the Council. He shall keep or cause to be kept such books and accounts as nay be required, conduct all correspondence of the Council and collect a f f i l i a tion fees. He shall send out notices of all meetings. f the Conference and Council and Executive Committee, with agenda attached, of the business to be transacted. He shall attend a ll nestings, take minutes of the proceedings, and undertake the general organising work of the Council. He shall draw up an Annual Report of the activities of the Executive and Council, which shall include a Statement of Income and Expenditure for the year ending December 31st certified by examiners appointed by the Executive Committee. He shall have the right to resign on giving three months notice to. the Executive Committee. He shall be paid such salary as the Executive Committee shall determine. The Executive Committee shall have the right to suspend the Secretary should the position warrant such action, and to take a referendum of all affiliated bodies to endorse its action. f)should the Secretary resign or be unable to carry out his duties, as laid down in the Constitution, through any unforeseen circumstances, the Executive Council shall call for nomination from affiliated inodies to f i l l the vacancy and the ballot be confined to the delegates who attended the last Conference, each to have one vote only
5 a) The affairs of the Council between Conferences shall be ijanaged and controlled by a governing body styled the 'Executive Committee which shall be composed of duly nominated representatives from affiliated bodies, including a President} Vice-President, Treasurer, Secretary, Assistant Secretary and two Trustees. Officials and members of the Executive Council shall either be members or duly appointed officials of a:i a ffilia te d Trade Union* b) The president, Vice-Presidenti Treasurer, Secretary, assistant Secretary and two Trustees and five council members, who shall be resident within 36 miles of the Council s headquarters, and designated as members of the Executive Committee, shall carry on the affairs of the Council between the meetings of the Council. The minutes of the meetings of the Council shall be submitted to the next ensuing meeting of the General Council for confirmation. The President and Secretary shall ipso facto oe officers of a ll Committees established by the Council of Non European Trade Unions. c) The Executive Committee shall meet at least once every fortnight. The quorum shall be one-half of the number of members. d) ohoulu the Union to which any member of the Executive Committee belongs Cb.se to be affiliated the member shall retain his seat on the Council to the end of the year, but lose the right to vote and may not be eligible for re-election i f his Union has not re- a ffiliated before the next Conference. e )Should any member of the Executive Committee be absent from three consecutive meetings without satisfactory reason, or should any member act in a manner detrxmenxsx to the best interests of the Council, the Executive Committee is empowered to take disciplinary action --.gainst such member as it may consider necessary, or mav re nv~ any such member from the Executive Committee. Any member dealt with under this subsection shall have the right to appeal to Conference. The Executive Committee is empowered to request an a ffilia t e d body to f i l l any vacancy which may occur between Conferences, either by taking the^next on their list of candidates who participated in the last ballot, or by nominating a member to f ill the vacancy. The decision shall rest with the Union concerned. f)the Executive Committee is empowered to co-opt a member of any workers organisation on any Committee established by the Executive Council. 8. HEAD OFFICE: The Head Office of the Committee shall be at Johannesburg or at any such place as may be decided by the Annual Conference.
6 a) Each a ffilia te d body shall contribute to the Council such an affilia tio n fee as may be decided upon by the Council from tine to tin e. hl ^11 affiliation fees, donations and trust monies oi funcis received by the Council from any other source, either for itself or on behalf of any other r(jdy r person sh 11 be deposited into a banking account. All payments, except those for petty expenses, shall be ia.de by cheque which shall be signed by the Treasurer and two Trustees: -provided that the Treasurer shall have the riaht to draw a monthly cheque for such an amount as nav oe determined by the Executive Committee for petty o fu c e expenses. *) A ll accounts or expenses exceeding the sura of not be incurred or spent-without the sanction of the Executive Committee, provided that such sanction shall not be required for regular payments of salaries and rent previously agreed upon oy the o-eneral Council. d) E/iontlily financial str tements shall be presented to the General. Council and to the Executive Committee L. f ecretary not lrnter th;~n ont calendar month aiter the expiry of the financial month, fa) Any affiliated body which is more than three months in arrears with its affiliatio n fees, shall, subject to the approval of the Executive Council, cease to be a member of the Council.
