1 OFFICIAL GAZETTE ENGLISH GOVERNMENT PRINTING AGENCY j EDITIONrj Bgfaz+~*+- =+b *E.m&mvim EXTRA No. 47 MONDAY, MAY 8, 1950 MINISTERIAL ORDINANCE Ministry of Agriculture and Forestry Ordinance No. 5O i May 8, 1950 In order to enforce the Fisheries Law (Law No. 267 of 1949), in accordance with the provisions of Chapter VI of the same Law and the Enforcement Order for the Fisheries Law (Cabinet Order No. 30 of 1950), the Ministerial Ordinance concerning the Election and Others for Commissioners of Sea-area Fisheries Adjustment Commissions shall be established as follows: Minister of Agriculture and Forestry MORI Kotaro Ministerial Ordinance concerning the Election and Others for Commissioners of Sea-area Fisheries Adjustment Commissions (Form of Filing Application in Electors' Register) Article 1. The application mentioned in Article 6 paragraph 1 of the Enforcement Order for the Fisheries Law (hereinafter referred to as "the Order") and t\e filing application in the electors' register in re-prepared in accordance with the provisions of Article 21 paragraph 1 of the Enforcement Order for the Law concerning the Election for the Public Offices (Cabinet Order No. 89 of 1950) which applies mutatis mutandis in Article 6 paragraph 4 of the Order shall be in Form No. 1 of the separate paragraph. (Form of Electors' Register and Abstract) Article 2. The. basic electors' register and its abstract shall be prepared as in Form No. 2 of the separate paragraph. (Form of Registration Certificate of Electors' Register) Article 3. The registration certificate of the electors' register as prescribed in Article 14 paragraph 1 of the Enforcement Order for the Law concerning the Election for the Public Offices which applies mutatis mutandis in Article 9 oi; the Order shall be prepared as in Form No. 3 of the separate paragraph. (Form of Ballot) %. Article 4. The ballot shall be prepared in accordance with Form No. 4 of the separate paragraph. 2 The ballot to be delivered upon the request under the provision of Article 51 of the Enforcement Order for the Law concerning the Election for the Public Offices which applies mutatis mutandis in Article 9 of the Order shall be prepared in accordance with Form No. 5 of the separate paragraph. (Form of Envelope for Provisional Vote) Article 5. The envelope for the vote under the provisions of Article 50 paragraph 4 or 5 of the Law concerning the Election for the Pub-, liq Offices (Law No. 100 of 1950) and the provision of Article 41 paragraph 4 of the Enforcement Order for the Law concerning the Election for the Public Offices which applies mutatis mutandis in Article 9 of the Order shall be prepared in accordance with Form No. 6 of the separate paragraph. (Forms of Documents relative to Notification and Consent of Persons who are to be Inspectors) Article 6. The documents relative to the notification and consent of persons who are to be inspectors for counting votes and inspectors of poll shall respectively be prepared in accordance with Form No. 7 and Form No. 8 of the separate paragraph. (Forms of Documents relative to Notification of Candidates, Annexed Papers therewith and Notification of Declination) Article 7. The documents relative to the notification of candidacy and recommendation (the document to be annexed therewith showing the consent of the person concerned and registration certificate of the voters' register), the certificate of proposal for retirement from the - public office, the certificate of the political party to which he belongs and notification of declination from candidacy to be annexed therewith shall respectively be prepared in accordance with Forms No. 9 to No. 15 inclusive of the separate paragraph. (Forms of Voting Minutes, Documents relative to Absentee Vote, Minutes for Counting Votes and Minutes for Election) Article 8. The voting minutes, documents relative to absentee vote, minutes for counting votes and minutes for election shall be res- 2

2 pectively prepared as in Forms No. 16 to No. 19 inclusive of the separate paragraph. (Certificate of Election) Article 9. The certificate of election shall be prepared as in Form No. 20 of the separate paragraph. (Modified Application of Regulations for the Enforcement of the Election Law for the Public Offices) Article 10. The provisions of Article 6 (Ballot Box), Article 7 (Seal of Braille Ballot), Article 9 (Form of Certificate applicable to the Reason for Absentee vote), Article 10 (Forms of Envelope for Absentee Vote, Certificate of Absen* tee Vote and Envelope for Certificate) and Article 13 (Writing of Date of Acceptance for Notification relative to Candidacy) of the Regulations for the Enforcement of the Election Law for the Public Offices (Prime Minister's Office Ordinance No. 13 of 1950) shall apply mutatis mutandis to the election for commissioners of Sea-area Fisheries Adjustment Commissions. Supplementary Provision : This Ministerial Ordinance shall come into force as from the day of its promulgation. Any one of you, who comes under any of the items of the following paragraph 1, is requested to file an application within the prescribed period without fail: 1. The extent of owners of the voting right: (a) Article 86 paragraph 1 of the Fisheries Law. Any person who has his residence or opera- -2-

3 tion place within the sphere of a city, town or village (including such city, town or village designated by the Minister of Agriculture and Forestry) along a sea-area in which the Sea-area Fisheries Adjustment Commission it set up and operates fisheries by means of a fishing boat or engages, in behalf of a fisheries operator, in gathering, taking or culturing of aquatic animals and plants by means of a fishing boat for a period over ninety days a year (including juridical person). (b) Article 86 paragraph 2 of the Fisheries Law. Any fisheries operator or fisheries employee whose qualification as above has been increased by the Governor. (c) Article 86 paragraph 3 of the Fisheries Law. Any commissioner of the Sea-area Fisheries Adjustment Commission or any officer of the Fishermen's Cooperative Association or Federation of Fishermens' Cooperative Associations who lost his right to vote after his assumption of office since he has not come under (a) or (b) as above (in this case, he can exercise his right to vote only in the election to be held during his term of office or in the election to be held just after his retirement of office). 2. In case where any notification has been given in accordance withthe provision of Article 17 of the Enforcement Order for the Law concerning the Election for the Public Services which applies mutatis mutandis to Article 8 of the Order or any indication or correction has been made in the register because of decision or judgement, such matters and the date of the notification, indication or correction effected shall be entered in the column of "Remarks" with the official seal upon them. 3.
