1 CONSTITUTION AND BY-LAWS OF THE NUEVA VIZCAYA STATE UNIVERSITY UNIVERSITY SUPREME STUDENT COUNCIL PREAMBLE We, the students of the Nueva Vizcaya State University, imploring the aid of the Divine Providence, in order to develop dynamic and responsible students, uphold our ideals, principles, and knowledge, conform with the principles of a democratic society and to the ideals for which Nueva Vizcaya State University is founded, do hereby promulgate this University Supreme Student Council Constitution and By-Laws. ARTICLE I NAME AND ADDRESS Sec. 1. This organization shall be called the University Student Supreme Council (USSC). Sec. 2. The official address of this organization shall be: Nueva Vizcaya State University, Bayombong Campus, Bayombong, Nueva Vizcaya; and Bambang Campus, Bambang, Nueva Vizcaya. ARTICLE II PURPOSES Sec. 1. The University Supreme Student Council (USSC) is organized with the following purposes: a. To serve as the main forum for the articulation of ideals and sentiments of the students; b. To assist the University administration in installing discipline among the students; foster unity and harmony with the spirit of true camaraderie among the studentry; c. To act as a partner of the University administration in the realization of a progressive Filipino society by promoting the virtues of honesty, loyalty, obedience, dedication for work and study, cooperation, equality and fairness among the students of NVSU. d. To represent the students in University, Local, Regional, National and International forum on matters related to students welfare, youth activities, and development programs; e. To have a close tie-up/linkage with government agencies and non-government organizations for the dissemination, adoption/utilization, and/or implementation of technologies or programs, and other humanitarian extension services like distribution of relief goods to the target clientele in times of calamity. ARTICLE III DECLARATION OF PRINCIPLES Sec. 1. We believe in one Supreme Being; Sec. 2. We recognize the potentials and capabilities of every student, and treat him as partner in the transformation of ideal traits and freely exercise his special gifts to think, reason, communicate, and love; Sec. 3. We believe in the Strength of a unified organization; Sec. 4. We believe in the ingenuity of the Filipino people living in a democratic society who is God fearing, environment friendly, loyal to his country, and peace loving; Page 1 of 13

2 Sec. 5. We recognize the vital role of the youth in nation building; Sec. 6. We believe in the principles, objectives, and policies of the Nueva Vizcaya State University, and therefore always abide willfully and courageously without mental reservation or plan of evasion. ARTICLE IV MEMBERSHIP Sec.1. All officially enrolled students of the Nueva Vizcaya State University shall be members of the University Student Supreme Council; Sec.2. There shall be a membership fee for every semester, which shall be collected by the CSC Treasurers in each campus during the enrolment period; Sec.3. Ten percent from the total collected membership fee of each campus shall allotted as Federated Fund to be under the custody of the Treasurers and the consent of other officers. Mode of disbursement shall be through a resolution of the USSC with the approval of the Advisers; Sec.4. The membership fee of Bambang Campus shall be deposited in the Rural Bank of Bambang Inc. (Money Shop) in the name of the Southern Campus Supreme Student Council (SCSSC), while the membership fee of Bayombong Campus shall be deposited in Cordillera Savings and Loan Bank in the name of Northern Campus Supreme Student Council (NCSSC); Sec.5. Withdrawals shall be made through a resolution and budget appropriation duly approved in a meeting called for by the USSC and purely for purposes that will benefit the studentry. Sec.6. The official signatories of withdrawals for the Bayombong Campus shall be the Campus Chairperson, Campus Treasurer and Advisers; while the official signatories of withdrawals for the Bambang Campus shall be the Campus Chairperson, Campus Treasurer and the Advisers. Sec.7. No succeeding withdrawal can be made without the liquidation of the prior withdrawal duly accounted and audited. ARTICLE V RIGHTS OF THE MEMBERS Sec. 1. The right to have access to all records and documents of the organization; Sec. 2. The right to hear and to be heard of grievances, views, and opinions in accordance with duly established University procedures and policies for the good of the studentry should not be denied; Sec. 3. The right to organize and to join legitimate organizations, clubs, and associations, whose purposes are relative to the goals and objectives of the USSC and the University; provided, it would not in any way affect his academic standing and duties; Sec. 4. The right to an equal treatment, protection and opportunity irrespective of gender, course, racial or ethnic group, economic and social status, religion, education, physical, and mental capability; Sec. 5. The right of any officially enrolled student of the NVSU to be elected to an office in any recognized organization, and in the USSC provided for in Article VII of this Constitution; Sec. 6. The right to vote in any matter concerning the welfare of the organization. Page 2 of 13

3 ARTICLE VI DUTIES AND OBLIGATIONS OF THE MEMBERS Sec. 1. It shall be the obligation of every member to vote in any required or prescribed meeting or election; Sec. 2. It shall be the duty and obligation of every member to actively participate in every activity and/or undertaking of the USSC, the University and the Community as may be required or prescribed; Sec. 3. It shall be the obligation of any student to pay a fine of P for failure to attend/participate in any meeting called and any activity of the university where student participation is called for which shall form a part of student trust fund of their respective colleges; Sec. 4. It shall be the duty of every member to safeguard and abide by the rules and regulations promulgated by duly constituted authorities and to protect the basic rights of every student; Sec. 5. It shall be the duty of every member to protect and safeguard the properties of the school; Sec. 6. It shall be the obligation of every member to uphold the good name of the USSC and the NVSU for which it stands. Sec. 7. It shall present a seminar report to the student council whenever attending seminars or forums. ARTICLE VII THE UNIVERSITY SUPREME STUDENT COUNCIL Sec. 1. The over-all governing body of the students shall be the Federated University Student Supreme Council, which shall be referred to as the USSC. Sec. 2. The governing body shall be composed of the following officers: a. President b. Vice President c. (2) Vice Chairpersons d. Secretary General e. Deputy Secretary f. (2) Treasurer g. (2) Auditor h. (2) Public Relations Officer Sec. 3. The law making powers of the USSC shall be vested into the Legislative Chamber composed of the following officers: a. (8) Senators b. (10) Area Representatives c. College Representatives Sec. 4. Qualifications of USSC officers: a. President, Executive Vice President, and Campus Vice Chairpersons Page 3 of 13

4 1. Shall be a bonafide student of the University for at least two (2) years. 2. Shall be a third year student and beyond, provided that he or she must not have On the Job Training (OJT), Practice Teaching (PT) and thesis work; 3. Shall be of good moral character; 4. Shall be available at all times when needed to discharge his duties, functions and responsibilities as President, Vice President, and Vice Chairpersons of the USSC; 5. Must possess and exhibit exemplary leadership; 6. Must be knowledgeable of parliamentary procedures; 7. Must be computer literate. b. Secretary, Treasurer, Auditor, PRO, Senators and College Representatives: 1. Shall be a bona fide student of the University. 2. Shall be of good moral character. 3. Shall maintain a good scholastic record. 4. Shall be available at all times to discharge his duties. 5. Must be knowledgeable of parliamentary procedures; 6. Must be computer literate. c. Qualifications of Area Representatives shall be provided by the Constitutions and By-Laws of their respective organizations. Sec. 5. The University Supreme Student Council Officers shall have the following duties and functions: a. To formulate implementing rules and regulations in accordance with the Student Handbook of the University as may be deemed necessary to carry out the objectives of the student organization. b. To formulate and implement plans and programs of student projects that enhances students welfare and development in coordination with University authorities concerned. c. To assist the administration in conducting investigations of students and/or organizations charged of violating existing University rules, regulations and policies and recommend penalties and sanctions appropriate to the offense as provided for in the Student handbook. d. To coordinate and report to proper authorities any untoward incident that affects the security and welfare of every bona fide student of NVSU in and out of the University campus. e. To take part in the selection and recommendation of USSC Advisers in coordination with the Director of Student Affairs, Chiefs of Student services, Head of Student Organizations (SO), to the Vice President of Academic Affairs and the President of the University who make the final designation thereof; and f. To conduct regular meetings and special meetings with the Student Organizations as the need arise. Sec. 6. The USSC Officers shall have the following duties and functions: A. PRESIDENT 1. Shall plan and program yearly/semestral student activities with the USSC Officers. 2. Shall seat as a member of the Board of Regents to represent the students. 3. Shall call and preside over all meetings of the council and shall exercise general supervision over all officers of any recognized student organization/ student body organizations. 4. Shall call for special or emergency meeting or elections as the need arises. Page 4 of 13

5 5. Shall vote in case of ties. 6. Shall maintain proper order and decorum during meetings. 7. Shall appoint from among the USSC members, chair of each of the different special committees as may be created. 8. Shall represent the studentry in all affairs/matters called for by the administration. 9. Shall be the chair of the Student Grievance Committee, and seat as member of the Student Conciliatory and Arbitration Board (SCAB) and Student Disciplinary Tribunal (SDT). 10. Shall present records of accomplishment including financial statement duly signed by the Treasurer and the Auditor at the end of the term without which no clearance /s shall be granted to him/her in case he/she transfers to another institution or graduates. 11. Shall present a seminar report to the student council whenever attending seminars or forums; or conduct an echo seminar as deemed necessary. 12. Shall be one of the signatories in the withdrawal of USSC Funds. B. VICE PRESIDENT 1. Shall perform the duties of the President in his campus from time to time, and coordinate/report to him all their activities at all times and on time; 2. Shall assist the USSC President in the performance of his/her duties, and shall take over the duties of the USSC President in the case of his absence because of termination or expiration of his term of office upon graduation, suspension, resignation or incapacitated; 3. Shall be one of the signatories in the withdrawal of USSC Fund. 4. Shall plan and program yearly/semestral student activities with the USSC officers. A. VICE CHAIRPERSON a. Shall assist the USSC President/Executive Vice President in the performance of his/her duties in their respective campuses. B. SECRETARY 1. Shall call the roll before the opening of the USSC meetings 2. Shall read the minutes of the previous meeting after the roll call 3. Shall be the custodian of all the records of the USSC and the student assembly and attest the minutes of all meetings the USSC shall have called. 4. Shall reproduce and furnish the USSC members or officers any important memos, information, minutes of the previous meeting, or data as maybe requested. 5. Shall not release any document or information to non-members of the USSC without the permission of the USSC President, Advisers, and higher authorities of the University. C. TREASURER 1. Shall be responsible in collecting and depositing dues and fees of the USSC. In case of membership fees or other fees sanctioned by the Board of Regents of the University, and regularly collected by the collecting officer of the University, he/she shall maintain an account book of the same. 2. Shall be responsible in the safe keeping of all financial records of the USSC. 3. Shall make disbursement of funds through proper procedures. 4. Shall submit to the USSC certified and detailed statement of accounts and expenses duly audited and signed by the USSC Auditor and the USSC President. 5. Together with the President of the USSC, he/she shall render a public accounting of funds and inventory of properties upon termination of his/her term. 6. Shall certify as to the availability of funds whenever necessary. Page 5 of 13

6 7. Shall perform such other related duties that the USSC may deem necessary. 8. Shall be one among the signatories in the withdrawal of USSC Funds. D. AUDITOR 1. Shall conduct bi-monthly audit independently or as may be needed on all financial matters relative to the activities and projects of the USSC. 2. Shall report all audit findings to the council in the regular meetings and provide copies of these to the Advisers, Department Chair of Student Development Programs and Services, and the Deans of Student Affairs and Services (both campuses). E. PUBLIC RELATIONS OFFICER 1. Shall take the initiative of maintaining a good and acceptable image of the council 2. Shall be responsible for the preservation of healthy relationship among members 3. Shall act as coordinator with other organizations, as regards to student related activities of the school and the community 4. Shall be the ex officio newsletter editor. He/She shall be in-charge of the publication of the University as well as in provincial and national papers. Sec.8. The USSC Legislative Chamber Officers shall have the following duties: 1. Shall make ordinances which shall be necessary and proper for the studentry whereas every resolution for an ordinance passed by the chamber shall it becomes a policy be presented to the Executive chamber; if the body approves it, it shall then be passed on the Board of Regents for final action; if the body do otherwise, it shall be returned to the chamber along with the objections. The chamber may then either revise and pass it again or drop it completely. 2. Senators shall be the direct representatives of the students, Area Representatives shall be representing their respective bloc from the student organizations unit (college based, non-college based, fraternities and sororities, religious and political) and the college representatives shall represent their respective colleges. 3. Shall have its own set of rules of proceedings not in contrary to this constitution and by-laws and other existing res and regulations of the university. 4. Shall conduct monthly consultations with the students. 5. Shall be the main organ in maintaining a healthy connection between the council and the students. 6. Assume business transactions of the council. ARTICLE VIII FUNCTIONS AND QUALIFICATIONS OF THE ADVISERS Sec. 1. There shall be three to four (3-4) advisers for both campuses who will serve as USSC Advisers as well. Sec. 2. They shall give advice, assistance, guidance and counseling to the USSC officers and committee chairs in all their activities for the attainment of the goals and objectives of the organization and the University. Sec. 3. Shall be one of the signatories in the withdrawal of USSC fund. Sec. 4. The advisers of both campuses be automatically the advisers of the Federated USSC screened jointly by the USSC officers and approved by the Administration. Sec. 5. The qualities of USSC Advisers are: a. Must be a member of the faculty or staff of the University. Page 6 of 13

7 b. Must be of good moral character and with good scholastic performance or leadership records during his/her college days. c. Possess and exhibit exemplary leadership. d. Must be knowledgeable of parliamentary procedures. e. Must be willing to accept the USSC Advisorship without mental reservations nor seek extra compensation for his/her work as an adviser. f. Must have the trust and confidence among and between the USSC Officers, USSC and Administration and USSC with the faculty and staff. ARTICLE IX ELECTION OF OFFICERS AND TERM OF OFFICE Sec. 1. Campus elections shall be managed by the Committee on Elections and perform functions as stated in the Implementing Guidelines of the Office of Student Affairs while the federated elections shall be managed by the Committee on Selections. Sec. 2. Each campus shall elect their Chairperson, (1) Vice Chairperson, (1) Secretary, (1) Treasurer, (1) Auditors, (1) PRO, (4) Senators, College Representative. Sec. 3. Each college shall elect their Representative who is different from that of their Student Mother Organization President. Sec. 4. Each recognized organization shall be classified by area as stated in Article VII, Section 8, 2 an elect their area representative. Sec. 5. The officers elected at-large of each campus shall compose the electorate body who will elect the USSC President and Secretary General. Sec. 6. The elected Chairperson of each campus shall be the candidates for the USSC President, while the elected Secretary of each campus shall be the candidate for Secretary General. Sec. 7. The Chairperson of each campus who obtained the lesser number of votes shall be the Vice President. Sec.8. No president may run for re-election except for those who just succeeded their position. Sec. 9. Election of officers shall be by secret balloting. Sec. 10. Election of campus council officers shall be synchronized with the election of mother organization officers to be held on the second (2 nd ) week of March, while the election of the USSC shall be held on the second (2 nd ) week of April of every academic year. Sec. 11. Any candidate for an office shall file his/her candidacy with the chair of the Committee on Election (COMELEC) at least one (1) week before the election. The Director of the Student Affairs shall appoint a Coordinator in the screening of candidates. Sec. 12. Election result shall be published the day after the election and shall proclaim winners by the following Monday after the election by the Committee on Election attested by the Student Head Organizations, Chief of Student Welfare and Services and by the Director of Student Affairs. Sec. 13. The term of office of all elected or appointed officers shall be for one (1) school year, starting from July 1 to June 30. Page 7 of 13

8 Sec. 14. Regency shall be in the mode of alternation. ARTICLE X FINANCES Sec. 1. All fees collected through the Cashier s Office will be requested for the withdrawal from the University Administration after the enrollment period and must be deposited immediately to the organization s depository bank in the name of University Student Supreme Council. Sec. 2. All college Governors of each mother organization are tasked to make announcements to their respective college fees and USSC fees should be prioritized. Sec. 3. The SCSSC and NCSSC through its Officers shall have the authority to manage the funds collected from its members as stipulated in the CHED Memorandum Order no. 20 s. 2011, Article I Section 3 on Regular Trust Funds. Sec.4. A fee of Php shall be collected by the Mother Organizations to regulate the conducts of students who do not attend University Activities. Sec. 5. Disbursements of fund of the USSC shall rest on its officers with proper guidance with its advisers and the Office of the Student Affairs and the University Accountant. Sec. 6. Procurement, disbursement and other financial transactions are to be carried out prudently by the Committee on Finance. Sec. 7. All of the expenses of the NVSU-USSC shall be paid for by the SCSSC (50%) and NCSSC (50%) Trust Fund as stipulated in Article XIII Section 5. Sec. 8. The NCSSC and/or SCSSC officers, specifically the President, Vice President, Secretary, Treasurer, Auditor and P.R.O. shall be allotted a monthly communication allowance amounting to P700 for President, 500 for Vice-President and 300 for the Secretary, Treasurer, Auditor and P.R.O. Sec. 9. All the NCSSC and/or SCSSC officers not included in Section 8 of this article except the College Governors of NCSSC and/or SCSSC shall have P50.00 allowance for every University major activities which involves the SCSSC/NCSSC/USSC. Sec. 10. All bank withdrawals shall be purely for purposes that will benefit the studentry. Sec. 11. All the bank withdrawals shall be paralleled with the approved budget appropriation and supported by a resolution. a. The President or the Treasurer and one Adviser (Whichever among the four) shall official signatories for all the withdrawals of the fund. Sec. 12. The official signatories of bank withdrawals for the SCSSC and/or NCSSC shall be the SCSSC and/or President, the Treasurer and the Advisers. Sec. 13. No succeeding withdrawal can be made without the liquidation of the prior withdrawal duly accounted and audited. Page 8 of 13

9 ARTICLE X I STANDING COMMITTEES Sec. 1. There following Committees shall be formed by the USSC and Chairmanship on said committees shall be based on the qualifications stipulated in section 3-b of Article 7. a. Committee on Plans, Programs, and Implementation. b. Committee on Election. c. Committee on Grievances and Student Problems. d. Committee on Internal Affairs e. Committee on Judicial Review f. Special Audit Team Sec. 2. The Committee on Plans, Programs, and Implementation shall: a. Make plans and programs on student activities. b. Implement and evaluate all approved plans and programs of student activities in collaboration with the different organizations; and c. Submit an evaluation report and recommendation of finished program projects or activities of the USSC and Student Organizations for deliberation and improvement. Sec. 3. The Committee on Election shall: a. Administer and safeguard the election proceedings of the USSC with extreme fairness and honesty. b. Receive certificates of candidacies filed by any qualified and interested students. c. Disqualify any candidate guilty of dishonesty, fraud, and violence of any sort that will destroy the sanctity of the conduct of the election through due process of law. d. Declare failure of election and nullify any election results found to be anomalous or influenced by dishonesty, fraud, violence of any sort that destroys the sanctity of the ballots and the conduct of the election. e. Announce election results one (1) day after the date of election. f. Receive and decide protests and counter-protests presented by any aggrieved party. Sec. 4. The Committee on Grievance and Student Problems shall: a. Act as the liaison between the students and the Administration. b. Act as the Judiciary Council that will hear cases with extreme neutrality and reliability. c. Hear, gather, and record all student problems presented; accept worthwhile opinions as well as offer solutions and suggestions to the problems; and d. Strive with extreme care to solve and settle student problems within its bounds and elevate problems to the Administration beyond their control. Sec. 5. Duties/function and composition of the Committee on Grievance and Student Problems: a. The Committee of Grievance and Student Problems shall be composed of the USSC President as Chair, USSC Vice President as Vice Chair, the USSC Secretary as the secretary, and the other USSC Officers as well as Presidents of the different recognized organizations as members; and b. The Chair of student Grievance and Cases unit, USSC Advisers, Department chair of Student Welfare Programs and Services Chief, Department chair of Guidance and Services, and the Deans of the Student Affairs and Services (both campuses) shall be their Advisers. 10 Sec. 6. The duties/ functions and compositions of the Committee on Internal Affairs shall be: a. The committee shall be formed whenever there are cases of recalls, removals and suspension of officers form the council. b. The committee shall have three members and one permanent member of whom is one of the advisers of the USSC. c. The committee shall be chaired by any non-partisan officer elected by the Legislative Chamber. d. The committee shall act impartial and only serve as an arbiter during all proceedings. e. Committee guidelines shall be based on Article XI of this constitution and bylaws. Sec. 7. The duties/ functions and composition of the committee on Judicial Review shall: a. The committee shall be an independent body whose members are appointed by the USSC President, two of whom are permanent members: the OSA Director and Associate Director, and one ex-officio member who is the legal counsel of the university; b. The committee shall review actions of the USSC and all recognized student organizations and strikes down those deemed unconstitutional; c. The committee shall be the sole interpreter of this constitution and by-laws; d. The committee shall have the following qualifications: 1. Must be a bona fide student of the university; 2. Must be knowledgeable with the principles of political science; 3. Must not be an incumbent USSC officer; 4. Must secure a recommendation from their respective college deans. Sec.8. The Powers, Functions and Composition of the Special Audit Team: a. The Special Audit Team shall be composed by the University s Internal Audit, The Deans of Student Affairs and Services (both campuses), the University Accountant, USSC Advisers and the SO Unit Head. b. The SAT has the authority to audit the USSC and both campus Student Councils every end of the semester. Any findings of lapses or insufficiency of supporting documents, the SAT may ask for an explanation through the issuance of memorandum addressed to the council. c. Patterns and formats of Financial Statements shall be prescribed by the Special Audit Team. ARTICLE XII RECALL, REMOVAL, AND SUSPENSION FROM OFFICE OF USSC OFFICERS Sec. 1. Any USSC officer shall be recalled any time for loss of confidence. Sec. 2. Any officer may be removed or suspended from office during his/her term on any of the following grounds: a. Three (3) consecutive absences in regular meetings or in any activity of the council without valid reason; b. Neglect of duty or abandonment; c. Abuse of position; commission of an offense involving moral turpitude; d. Receiving or soliciting money using the name of the Organization for personal use, bribery; e. And any violation of the University rules and regulations as embodied in the student handbook. Page 10 of 13

11 Sec. 3. Any officer who violates any of the grounds herein enumerated shall be given a chance to explain in writing for his/her side subject to the procedures and decisions of the Committee on Internal Affairs. Sec. 4. Abandonment of office exists if the officer fails or refuses to perform his/her duties. Sec. 5. Two-thirds (2/3) vote of the USSC Officers be required in the suspension or termination of an officer. Sec. 6. In case of death, transfer, absence, incapacity, graduation of any elected officer, the next in rank shall take-over and serve the remaining term. ARTICLE XIII MEETINGS Sec. 1. The regular meetings of the USSC shall be every second Saturday of the month at exactly 8:00 A.M. Sec. 2. Special meetings shall be called by the President as the need arises. Sec. 3. All meetings shall be in accordance with parliamentary procedure. Sec. 4. Simple majority of the members shall constitute a quorum (1/2 + 1). Sec. 5. Any member of the USSC shall be allowed to request for a meeting. Sec. 6. Any member of the USSC who absents himself/herself in three federated meetings without valid reason shall be grounds for termination. Sec. 7. The venue of the next regular meeting shall be decided by the body. ARTICLE XIV GENERAL PROVISIONS Sec. 1. The name of the organization shall not be used for unjust and unlawful reasons. Sec. 2. The USSC shall function in accordance with existing national policies of the Philippine Government with the guidance of the Advisers herein defined and shall be under the Deans of Student Affairs and Services. Sec. 3. All Officers shall take their oath of office to support and defend the USSC s constitution as well as the goals and objectives of NVSU. Sec. 4. No contribution either in cash or in kind shall be solicited by any member except for a lawful, just and responsible purpose, to be determined by the officers of the organization and duly approved by the administration. Sec. 5. The name of Bayombong Campus Student Council will term as the Northern Campus Supreme Student Council (NCSSC) and the Bambang Campus Student Council will term as the Southern Campus Supreme Student Council (SCSSC). Sec. 6. There shall be a separate constitution and by-laws for the two student councils of the two camps and the USSC shall only pertain to the federated. Sec. 7. This constitution shall be promulgated in English and/or Filipino language. Page 11 of 13

12 ARTICLE XV AMENDMENTS Sec. 1. This USSC Constitution and By-Laws shall be subject for amendments as the need arises. Sec. 2. Any amendment to or revision of this constitution shall be by majority vote of the officers of the USSC. Sec. 3. Any amendment to or revision of this Constitution shall be presented to the whole studentry for ratification. Sec. 4. Existing student organization s constitution and by-laws, policies, provisions or regulations that are inconsistent with the provisions of this Constitution and By-laws are hereby amended, modified or repealed accordingly. Sec. 2. This constitution and by-laws shall take effect upon ratification of the students, confirmation of the Board of Regents and the publication to college bulletin boards. Page 12 of 13
