Historical Note The 1975 Montana legislature created the position Commissioner of Campaign Finances and Practices. The commissioner was appointed for a five-year term by a committee composed of the speaker of the House, the president of the Senate, and the minority floor leaders of both houses of the legislature. In 1979 the governor assumed the duty of appointing the commissioner, whose term was lengthened to six years, from a list of candidates prepared by the legislative committee. The incumbent is responsible for the investigation of all alleged violations of the election laws and, in conjunction with county attorneys, responsible for the enforcement of the election laws. The commissioner examines each statement and report filed with the commissioner, notably the reports of every political candidate and political organization listing receipts and expenditures to ensure compliance with election laws. The commissioner also approves issuance of certificates of nomination or election after ensuring candidates' compliance with election laws. In 1981 the name of the position was changed to the Montana Commissioner of Political Practices. 1

2 Content Description This collection consists of general correspondence ( ) of the commissioner's office and reports ( ) submitted to the commissioner by political candidates running for local, state, and federal office and related fund-raising organizations. The correspondence concerns directions for completing forms properly, and clarification of the Commission's requirements, procedures, and policies. It includes minutes of an advisory council formed in 1975 of representatives of political organizations to counsel the commissioner of Campaign Finances and Practices; a few news releases of the commissioner; and a list of expenditures and receipts of candidates for state offices in the general election and political committees supporting or opposing initiatives on the ballot in November The bulk of the reports submitted by candidates for state and local offices relate to the 1976 primary and general elections and are form C-5, "Report of Contributions and Expenditures"; form C-6, "Contributions after Pre-Election", which provided public disclosure of the source of large campaign contributions received immediately before an election; and the attendant schedules to both of these forms detailing the source and amount of each expenditure and receipt of funds. The candidates' reports are arranged alphabetically by the candidates' last names. A publication of the commissioner of Campaign Finances and Practices, "Summary of Contributions and Expenditures of Candidates and Political Committees, June 1976 Primary Elections" provides an alphabetical list of all candidates' names, identifies their party affiliation, and identifies the Senate, House, or court district in which they ran. Filed with the reports of the candidates are the reports of political committees directly involved with the election of a particular candidate, such as the "Severson for Legislature" committee. The reports of the political committees are also arranged alphabetically and consist largely of the county central committees and women's clubs of the Democratic and Republican parties. Also included are committees organized around specific issues, such as the Airport Terminal Information Committee, and committees with broader interests, such as the Montana State AFL-CIO Committee on Political Education. As 1976 was the year that Montana communities voted upon alternative forms of government proposed by local government commissions, the reports of political committees formed to support and oppose these proposals are also included in these files. The bulk of the reports submitted by candidates for federal offices are "Reports of receipts and expenditures for a candidate or committee supporting candidates for nomination or election to federal office". Also included are "Statement(s) of a candidate for nomination or election to federal office," "Statement(s) of organization for a political committee," and a small amount of related correspondence. Use of the Collection Restrictions on Use The Montana Historical Society is the owner of the materials in the Research Library and makes available reproductions for research, publication, and other uses.
