3 OBJECTIVE OF THE PRESENTATION To provide an overview of the role of the Public Service Commission of Canada (PSC) in safeguarding non-partisanship and the integrity of staffing in the federal public service of Canada. 3

5 THE PUBLIC SERVICE COMMISSION Created in 1908 to counter widespread political patronage PSC administers the Public Service Employment Act (PSEA) PSC safeguards the non-partisanship nature of the public service and merit-based staffing in the core federal public service Mandate: Appoint, or provide for the appointment of, persons to or from within the public service Conduct investigations and audits Administer provisions relating to political activities of employees and deputy heads 5

7 MERIT AND NON-PARTISANSHIP Canada will continue to benefit from a public service that is based on merit and non-partisanship and in which these values are independently safeguarded. Preamble of the Public Service Employment Act Merit Person meets essential qualifications for the work to be performed Nonpartisanship Political influence in staffing Appointments free from political influence The PSC has the authority to investigate appointments Political activities Employees have the right to engage in political activities so long as it does not impair / is not perceived as impairing impartial performance of duties Regime administered by PSC, authority cannot be delegated Independent Oversight Instruments: Reporting to Parliament Policy setting Monitoring Audits Investigations The PSC may: Revoke an appointment or not make an appointment Take corrective action, including revocation of delegated authorities 7

10 DELEGATION TO DEPUTY HEADS Under the PSEA, the PSC has exclusive authority to make appointments PSC delegates authority to deputy heads through written delegation agreements Deputy heads must respect PSC policy requirements and delegation agreements in exercising their delegated authority Delegation provides flexibility to deputy heads to meet operational needs Deputy heads may delegate to the level they deem appropriate PSC Parliament Deputy heads PSC 10

11 OVERSIGHT FRAMEWORK FOR STAFFING The renewed approach to monitoring and oversight of staffing is a key component of the New Direction in Staffing (NDS). Organizational Monitoring Ongoing monitoring Cyclical assessment (every five years at a minimum) Limited reporting to the PSC Deputy head led investigations PSC Oversight System-wide staffing audit Survey of staffing Risk-based audits (as deemed necessary by the PSC) PSC investigations PSC Enabling Support Staffing support to organizations Support for ongoing improvement 11
